Woodward, District #19 IN RE: BOARD OF COMMISSIONERS – EXTENDED CONTINUATION OF LOCAL STATE OF EMERGENCY DUE TO CORONAVIRUS PANDEMIC TO JUNE 12, 2020 To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS on March 10, 2020, Governor Gretchen Whitmer issued an executive order (No. 2020-4) declaring a state of emergency due to the novel coronavirus (COVID-19); and WHEREAS on March 13, 2020, County Executive David Coulter declared a local state of emergency in Oakland County, Michigan pursuant to Section 10 of Public Act 390 of 1976, MCL 30.410, due to the occurrence and threat of widespread or severe injury or loss of life from the known transmission of COVID- 19 within Oakland County; and WHEREAS on March 13, 2020, County Executive David Coulter also requested the governor to declare a state of emergency or state of disaster in Oakland County, Michigan pursuant to Section 12 of Public Act 390 of 1976, MCL 30.412; and Commissioners Minutes Continued. May 28, 2020 279 WHEREAS on March 13, 2020, the President of the United States issued a proclamation declaring a National Emergency concerning the (COVID-19) outbreak; and WHEREAS on April 1, 2020, Governor Whitmer signed Executive Order No. 2020-33 declaring a state of emergency expansion and additionally declaring a state of disaster to address the fast-progressing COVID- 19 pandemic; and WHEREAS Governor Whitmer has issued, and renewed, an Executive Order requiring Michigan residents to “Stay Home, Stay Safe”, stating “to suppress the spread of COVID-19, to prevent the state’s health care system from being overwhelmed, to allow time for the production of critical test kits, ventilators, and personal protective equipment, to establish the public health infrastructure necessary to contain the spread of infection, and to avoid needless deaths, it is reasonable and necessary to direct residents to remain at home or in their place of residence to the maximum extent feasible”; and WHEREAS Governor Whitmer issued Executive Order 2020-100 on May 22, 2020 extending the “Stay Home, Stay Safe” restrictions to June 12, 2020; and WHEREAS pursuant to the provisions of Section 10 of Public Act 390 of 1976, MCL 30.410, the Oakland County Board of Commissioners unanimously adopted MR# 20084 on March 18, 2020, authorizing the continuation of the local state of emergency declared on March 13, 2020, effective until April 17, 2020; and WHEREAS the health, economic, and social harms of the COVID-19 pandemic are widespread and severe, touching all communities and people throughout Oakland County. The local state of emergency declared by Oakland County Executive Dave Coulter on March 13th due to the threat of widespread spread of the COVID-19 virus remains an active emergency, requiring appropriate authority for relief, recovery and response; and WHEREAS pursuant to the provisions of Section 10 of Public Act 390 of 1976, MCL 30.410, the Oakland County Board of Commissioners unanimously adopted MR# 20102 on April 13, 2020, authorizing the extended continuation of the local state of emergency declared on March 13, 2020, effective until April 30, 2020; and WHEREAS pursuant to Section 10 of Public Act 390 of 1976, MCL 30.410, the Board of Commissioners adopted MR# 20116 on April 29, 2020, authorizing the extension of the local state of emergency declared by the County Executive on March 13, 2020 until May 15, 2020; and, WHEREAS pursuant to Section 10 of Public Act 390 of 1976, MCL 30.410, the Board of Commissioners adopted MR# 20148 on May 13, 2020, authorizing the extension of the local state of emergency declared by the County Executive on March 13, 2020 until May 28, 2020; and, NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners pursuant to Section 10 of Public Act 390 of 1976, MCL 30.410, approves the extension of the local state of emergency declared by the County Executive on March 13, 2020 to June 12, 2020, and authorizes the Chairperson of the Board to execute any documents associated therewith. BE IT FURTHER RESOLVED that a weekly report on the County’s financial response to the Coronavirus Disease 2019 (COVID-19) outbreak shall be sent to all members of the Board of Commissioners via e-mail, including a detailed description of amounts expended until further notice. BE IT FURTHER RESOLVED no budget amendment is required at this time. Chairperson, I move the adoption of the foregoing resolution. Gingell, District #1; Shelley Taub, District #12; Michael Spisz, District #3; Thomas Kuhn, District #11; Robert Hoffman, District #2; Adam Kochenderfer, District #15; Thomas Middleton, District #4; Philip Weipert, District #8; Christine Long, District #7; and Eileen Kowall, District #6 IN RE: BOARD OF COMMISSIONERS - REQUIRING URGENCY FROM GOVERNOR WHITMER TO OPEN UP OAKLAND COUNTY’S ECONOMY To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS in March of this year, the Coronavirus unexpectedly attacked Oakland County and the State of Michigan, causing residents, businesses, governments and the medical profession to implement very reactive measures to address the virus; and WHEREAS Oakland County and the State of Michigan has been a hot bed for COVID-19 and has suffered some of the largest volumes of COVID-19 cases and deaths; and WHEREAS Governor Gretchen Whitmer has implemented restrictions on residents and businesses to help control and contain the COVID-19 spread and assist in reducing the outbreak; and WHEREAS the restrictions implemented on residents by Governor Gretchen Whitmer’s Executive Orders, including Stay Home, Stay Safe and social distancing have been extended to June 12, 2020; and WHEREAS the restrictions implemented on businesses by Governor Gretchen Whitmer’s Executive Orders are having a monumental impact on our local businesses, their employees and individual business owners; and WHEREAS COVID-19 cases and deaths peaked in April and are continuing to decline in Oakland County and in the State of Michigan; and WHEREAS local businesses are the backbone of Oakland County’s economy and if they are not permitted to open soon, hundreds or more will have their doors closed permanently; and WHEREAS it is not sustainable to continue to prop up local businesses by providing grants and other subsidies from the State of Michigan and Oakland County. NOW THEREFORE IT BE RESOLVED that the Oakland County Board of Commissioners urges Governor Gretchen Whitmer to lift restrictions and more aggressively open Oakland County’s economy so that Oakland County businesses can re-establish their operations and workers can restore their livelihoods. BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners urges Governor Gretchen Whitmer to recognize that her unwillingness to re-open Oakland County’s economy in a more aggressive fashion will have a detrimental impact over a prolonged period of time on the people of Michigan and the residents of Oakland County. BE IT FURTHER RESOLVED that the Oakland County Clerk/Register of Deeds provide a copy of this resolution to Governor Gretchen Whitmer, Senate Majority Leader Mike Shirkey, Speaker of the House Lee Chatfield and all Oakland County Senators and State Representatives. MISCELLANEOUS RESOLUTION #20172 BY: Commissioner Marcia Gershenson, District #13 IN RE: BOARD OF COMMISSIONERS – ENCOURAGE OAKLAND COUNTY VOTERS TO VOTE BY MAIL IN 2020 AUGUST PRIMARY AND NOVEMBER GENERAL ELECTIONS AND DECLARE SUPPORT FOR MICHIGAN SECRETARY OF STATE JOCELYN BENSON’S ACTION TO MAIL OUT ABSENTEE BALLOT APPLICATIONS TO ALL MICHIGAN REGISTERED VOTERS To the Oakland County Board of Commissioners Ladies and Gentlemen: WHEREAS the nation and Oakland County is in the midst of a pandemic caused by a novel coronavirus known as COVID-19; and WHEREAS the United States is the country with the most recorded cases of COVID-19; and WHEREAS Oakland County has the highest number of cases of any county in Michigan; and WHEREAS the Centers for Disease Control and Prevention (CDC), in response to the COVID-19 pandemic, proposed a number of recommendations in preparation for future elections including: encourage mail-in methods of voting if allowed in the jurisdiction and early voting; and WHEREAS the COVID-19 pandemic requires all communities to take precautionary measures to protect voters, election poll workers and volunteers, while preserving democracy and making voting as easy and safe in upcoming elections; and WHEREAS early voting, absentee voting and mail-in voting ballots have all increased in the last 20 years; and WHEREAS as of now, five states use vote-by-mail as their primary way of voting: Oregon, Washington, Colorado, Utah and Hawaii; and WHEREAS furthermore, those serving in the military rely on mail-in absentee voting for those deployed overseas; and WHEREAS in 2018, one in four Americans who cast a ballot did so through the mail; and WHEREAS Americans should not have to choose between their health and casting a ballot; and WHEREAS in the May 2020 elections in Michigan, all voters were sent an absentee ballot application; and WHEREAS the May 2020 election, saw record turnout which was nearly twice as big as any prior May election - 99% of all voters casted absentee ballots; and WHEREAS on May 19, 2020, Michigan Secretary of State Jocelyn Benson, a Democrat, announced that the state will send an absentee application to each Michigan registered voter for the August Primary and November Elections in 2020; and WHEREAS Benson explained that her decision was based on safety during the COVID-19 pandemic, for voters, clerks and volunteers; and WHEREAS Republican Secretaries of State in Kentucky, West Virginia and Georgia have all turned to mail voting systems to keep residents safe; and WHEREAS in Michigan, mailing absentee ballot applications ensures that no Michigander must choose between their health and their right to vote; and WHEREAS because voters in Michigan approved Proposition 3 in 2018, with Oakland County voters approving it with 65%, every Michigander has the right to cast an absentee ballot; and Commissioners Minutes Continued. May 28, 2020 285 WHEREAS voting by mail is easy, convenient, safe, and secure; and NOW THEREFORE BE IT REOLVED for public health and safety considerations in response to COVID-19 in upcoming elections in 2020, the Oakland County Board of Commissioners encourages voters to vote by mail. BE IT FURTHER RESOLVED the Oakland County Board of Commissioners supports Michigan Secretary of State Joselyn Benson’s action to mail applications for absentee ballots to all registered voters. BE IT FURTHER RESOLVED the Oakland County Clerk is directed to forward a copy of this resolution to Governor Gretchen Whitmer, Secretary of State Jocelyn Benson, all local clerks in Oakland County, the State Senate Majority and Minority leaders, the State House Speaker and Minority leader, members of the Oakland County State Legislature delegation. Chairperson, I move the adoption of the foregoing resolution. MARCIA GERSHENSON The Chairperson referred the resolution to the Pandemic Response and Economic Recovery Committee. There were no objections. Commissioner Zack addressed the Board to inform the Commissioners that MOGO Bike Share Program will be available in five Oakland County Communities: Royal Oak, Ferndale, Oak Park, Berkley, and Huntington Woods, beginning June 4th, 2020. MISCELLANEOUS RESOLUTION #20173 BY: Commissioner Adam Kochenderfer, District #15 IN RE: BOARD OF COMMISSIONERS – REQUEST THE STATE OF MICHIGAN TO IMPROVE PROCESS FOR UNEMPLOYMENT CLAIMS To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS in March of this year a new strain of the coronavirus, otherwise known as COVID-19, attacked Oakland County and the State of Michigan causing residents, businesses, governments and the medical profession to implement reactive measures to address the virus; and WHEREAS COVID-19 and responsive measures have had a devastating impact on Oakland County families, businesses and individuals stricken by this virus; and WHEREAS it has been widely reported that the State of Michigan’s Unemployment Agency has been ill- prepared for this crisis and thousands of Michiganders have struggled to file unemployment claims; and WHEREAS despite the fact that 95% of unemployment claims are filed through the State of Michigan‘s website, this website has crashed multiple times, delaying the filing of claims for Oakland County residents who have lost their jobs and need financial assistance; and WHEREAS the Detroit Free Press has reported that some Oakland County residents had to wait nearly a month to file their unemployment claims; and WHEREAS the website’s online chat function is often closed and unresponsive; and WHEREAS many residents who have called the Michigan’s Unemployment Agency have received a busy signal or have spent hours on hold and unable to obtain prompt assistance; and WHEREAS problems at Michigan’s Unemployment Agency have persisted despite statements that they would be resolved; and WHEREAS Michigan’s Unemployment Agency has implemented recent upgrades that have created other issues and concerns causing the stoppage of payments without warning; and WHEREAS all Oakland County residents deserve the right to file unemployment claims without undue delay and to obtain timely assistance from the State of Michigan. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners urges the State of Michigan to improve the process for filing unemployment claims and receiving timely payment, including increasing capacity, reducing wait times, eliminating errors and drastically improving the functionality of the State of Michigan’s website. BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners requests the State of Michigan take further measures to ensure that all Michigan residents can obtain prompt assistance with any questions regarding unemployment claims.
