HomeMy WebLinkAboutResolutions - 2020.07.02 - 33407MISCELLANEOUS RESOLUTION #20240 July 2, 2020 BY: Commissioner Helaine Zack, Chairperson, Finance and Infrastructure Committee IN RE: HUMAN RESOURCES — MEMORANDUM OF AGREEMENT FOR ELECTION DAY HOLIDAY WITH OAKLAND COUNTY COMMAND OFFICERS ASSOCIATION To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the Oakland County Board of Commissioners passed Miscellaneous Resolution # 19349 to establish Election Day in November as on official holiday for Oakland County employees on even numbered years; and WHEREAS the Command Officers Association (COA) current collective bargaining agreement (October 1, 2018 — September 30, 2021) calls for any non-healthcare benefit modifications implemented during calendar years 2019, 2020 and/or 2021 shall be negotiated; and WHEREAS the COA has expressed a desire to accept the employee benefit modification of the Election Day Holiday, and WHEREAS all parties have agreed to this negotiation; and WHEREAS funding for all 24 hour/7 day operations was referenced in Miscellaneous Resolution #19349 and has been included in the FY 2021 - FY 2023 County Executive Recommended budget. NOW THEREFORE BE IT RESOLVED the Oakland County Board of Commissioners approves the Memorandum of Agreement for Election Day Holiday with the Oakland County Command Officer's Association. BE IT FURTHER RESOLVED that the employees represented by the COA (bargaining unit 15) will recognize Election Day as an official County holiday as described in Merit Rule 26, BE IT FURTHER RESOLVED that the 24 hour/7 day operations has been included in the FY 2021 - FY 2023 County Executive Recommended budget and, therefore, no budget amendment is required with this resolution. LETTER OF AGREEMENT This Letter of Agreement ("Agreement") Is entered Into on this day of June, 2020, between the Oakland County Command Officers' Association ("CoA"), the Oakland County Sherlfrs office and the County of Oakland (collectively referred to as "County") This Agreement is based on the following facts: The Oakland County Board of Commissioners brought forth a Miscellaneous Resolution (H19349) to establish Election Day in November as an official County holiday for Oakland County employees. The command Officers' current collective bargaining agreement (October 1, 2016 —September 30, 2021) calls for any non -healthcare benefit modifications implemented during calendar years 2019, 2020 and/or 2021 shall be negotiated. The Command officers' Association has expressed a desire to accept this employee benefit modification. Therefore, the parties agree as follows: The employees represented by the Command Officers' Association (bargaining unit 15) will recognize Election Day (as described in Merit Rule 26) as an official County holiday. Merit Rule 26 defines Election Day as the Tuesday following the first Monday in November in even years, this Includes national, state and local government representatives at all levels up to the governor and president. This Agreement is appended and Incorporated into the collective bargaining agreement. Upon the execution of a successor collective bargaining agreement, the Election Day holiday language will he Inserted Into Article XIII, General Conditions, Section 7, (2.).
