Chairperson David Woodward addressed the Board to introduce Commissioner Gershenson. Commissioner Gershenson addressed the Board to give a special presentation entitled: Oakland County Centennial Celebration of the 19th Amendment and Women’s Suffrage. The following people addressed the Board during Public Comment: Elaine Tsapatoris and Michael Zubas, Jr. via e-mails read into the record by Andrea Powers, Budget Analyst, Oakland County Board of Commissioners. The resolutions on this Consent Agenda follow (annotated by an asterisk {*}): *MISCELLANEOUS RESOLUTION #20328 BY: Commissioner Helaine Zack, Chairperson, Finance and Infrastructure Committee IN RE: CENTRAL SERVICES/AVIATION DIVISION – AIRPORT LAND LEASE: BECKER HANGAR, LLC To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the County of Oakland (“the County”) owns the Oakland County International Airport in Waterford Township; and WHEREAS parcels of land are leased to various aviation businesses for the purpose of constructing hangars, aviation ramps, and related appurtenances for conducting aviation business at the Airport; and WHEREAS the Aviation Division has negotiated the attached Land Lease with Becker Hangar, LLC; and WHEREAS the Land Lease will have a term of thirty (30) years from April 1, 2020, to March 31, 2050, with annual rent fixed for the first year at $13,228.30; and WHEREAS under the Land Lease the County has the right to change the rental payments each and every two years, as set forth in the Land Lease; and WHEREAS the Lessee at its sole cost is responsible for any improvements to the property and maintenance to the grounds including mowing, snow removal, and landscaping; and WHEREAS the Airport Committee and the County’s Office of Corporation Counsel have reviewed and agreed to the terms of the Land Lease. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby approves and accepts the terms and conditions of the attached Land Lease with Becker Hangar, LLC for the lease term of thirty (30) years from April 1, 2020, to March 31, 2050, with annual rent fixed for the first year at $13,228.30. BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners directs its Chairperson or his designee to execute the attached Land Lease and all other related documents between the County and Becker Hangar, LLC. BE IT FURTHER RESOLVED that no budget amendment is required at this time as this is a lease renewal, and the revenue is already reflected in the FY 2020 – FY 2022 adopted budget and FY 2021 – FY 2022 County Executive Recommended Budget. August 20, 2020 567 *MISCELLANEOUS RESOLUTION #20329 BY: Commissioner Helaine Zack, Chairperson, Finance and Infrastructure Committee IN RE: INFORMATION TECHNOLOGY – THIRD QUARTER 2020 DEVELOPMENT APPROPRIATION TRANSFER To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS all development cost is incorporated as a single appropriation within the non-departmental budget, and then an amount equal to the actual expense is transferred to the user department with a summary report to the Finance and Infrastructure Committee; and WHEREAS the Department of Information Technology has determined the Third Quarter 2020 development charges to be $1,184,449.45 for the General Fund/General Purpose County departments; and WHEREAS direct charges to Special Revenue and Proprietary fund departments are $1,274,522.75 and non-county agencies are $11,471.28 for the Third Quarter 2020; and WHEREAS an appropriation transfer to General Fund/General Purpose County departments is needed to fund these development charges. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners has reviewed the Third Quarter 2020 Development Report and approves the Third Quarter appropriation transfer as specified on the attached schedule. BE IT FURTHER RESOLVED that the respective departmental Fiscal Year 2020 budgets are to be amended as specified in the attached detail schedule. (The vote for this motion appears on page 572). *MISCELLANEOUS RESOLUTION #20330 BY: Commissioner Helaine Zack, Chairperson, Finance and Infrastructure Committee IN RE: INFORMATION TECHNOLOGY – REQUEST FOR APPROVAL OF CONSTRUCTION LICENSE AND LEASE AGREEMENT AMENDMENTS AND LEASE AGREEMENT AMENDMENTS WITH CERTAIN GOVERNMENTAL ENTITIES To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS for over a decade the County has operated and maintained an interoperable public safety radio communications system for the benefit of its residents on behalf of and for local law enforcement, fire services, emergency medical services, hospitals, homeland security and other public safety services; and WHEREAS the County constructed, operates, and maintains this public safety radio communications system with funds from the County 9-1-1 charge (fee) on devices, as permitted by and defined in the Emergency 9-1-1 Service Enabling Act, Michigan Public Act 32 of 1986, MCL §484.1101 et seq., as amended (the “Act”); and WHEREAS the operation and maintenance of the existing public safety radio system required the County to locate equipment on various towers and property throughout the County, including towers and property owned by numerous governmental entities; and WHEREAS the Oakland County Board of Commissioners approved the execution of Construction License and Lease Agreements and Lease Agreements with numerous governmental entities, including the following: 1. City of South Lyon (MR#04174); and WHEREAS because the current public safety radio system is nearing its end of useable life, a replacement system was competitively bid, evaluated by a team of public safety users and County administrators, and awarded to Motorola, for a standards-based P-25 trunked radio system, which will be integrated with the Michigan Public Safety Communications System (MPSCS); and WHEREAS the replacement system will be utilized by public safety and other users in and around Oakland County; and WHEREAS the replacement system design requires continued use of the following tower and property sites owned by: 1. Bloomfield Township 2. Commerce Township 3. City of Farmington Hills 4. Groveland Township 5. Lyon Township 6. Village of Milford 7. Oakland Community College 8. Oakland Township 9. Orion Township 10. City of South Lyon; and WHEREAS the Departments of Information Technology and Corporation Counsel have drafted, reviewed, and approved the attached amendment to be executed with the above-listed governmental entities; and WHEREAS the Department of Information Technology recommends entering into amendments to facilitate continued use of the towers/property for the replacement system. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the attached amendment and authorizes and directs the Chairperson of the Board to execute the amendment with the above-listed governmental entities. BE IT FURTHER RESOLVED that the Chairperson is authorized to execute all documents associated with and to effectuate the attached amendment with the above-listed governmental entities. BE IT FURTHER RESOLVED that all agreement and amendments thereof associated with the Radio System shall be kept by Radio Communication in the Department of Information Technology. (The vote for this motion appears on page 572). *MISCELLANEOUS RESOLUTION #20331 BY: Commissioner Penny Luebs, Chairperson, Health, Safety and Human Services Committee IN RE: HEALTH AND HUMAN SERVICES/HEALTH DIVISION – MICHIGAN DEPARTMENT OF HEALTH AND HUMAN SERVICES LOCAL COMMUNITY STABILIZATION AUTHORITY FUNDING To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the Oakland County Health Division has received funds from the Michigan Department of Health and Human Services (MDHHS) in the amount of $1,128,353 for Essential Local Public Health Services (ELPHS) programs under MCL. 123.1357(4)(a)(viii); and WHEREAS Local Community Stabilization Authority (LCSA) funds will be used to supplement existing Fiscal Year FY 2020 ELPHS funds to maintain levels of service in face of increased and increasing demands on local health services; and Commissioners Minutes Continued. August 20, 2020 569 WHEREAS Oakland County was originally awarded Fiscal Year (FY) 2020 ELPHS funding totaling $5,004,672 through the Comprehensive Planning, Budgeting and Contracting (CPBC) Agreement (Miscellaneous Resolution #19285); and WHEREAS LCSA approved distribution of additional funds for reimbursement of allowable costs of required health services described in MCL 333.2475 not otherwise reimbursed; and WHEREAS it is requested to create one (1) General Fund/General Purpose (GF/GP) full-time eligible (FTE) Administrator Public Health and two (2) GF/GP FTE Epidemiologists in the Health Administration unit (#1060201); and WHEREAS the costs for the Public Health Administrator position, prorated for the remainder of FY 2020 totals $15,471 and $131,862 for FY 2021 - FY 2023; and WHEREAS the costs for the two (2) Epidemiologist positions prorated for the remainder of FY 2020 totals $24,380 and $206,925 for FY 2021 – FY 2023; and WHEREAS it is requested to add additional hours to ten (10) GF/GP part-time, non-eligible (PTNE) Public Health Technician positions to equal 1,000 hours per year each within the Hearing and Vision unit (#1060237-12314, 12315, 12316, 12317, 12318, 12319, 12320, 12321, 12322, & 12323); and WHEREAS the costs for the additional Public Health Technician hours for the remainder of FY 2020 totals $5,307 and $49,418 for FY 2021 – FY 2023; and WHEREAS the remaining balance of $1,083,195 for FY 2020 will be used for the following: $1,007,567 for professional services, $57,780 for Environmental Health Migration Project, and one-time equipment purchases totaling $17,848. Also, the remaining balance for FY 2021 – FY 2023 in the amount of $740,148 will be used for Professional Services $729,381 and ongoing equipment costs of $10,767; and WHEREAS LCSA funding will be distributed annually pursuant to MCL.123.1357(4)(a)(viii). NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby approves acceptance of FY 2020 MDHHS LCSA funding in the amount of $1,128,353. BE IT FURTHER RESOLVED to create one (1) General Fund/General Purpose (GF/GP) Full-Time Eligible (FTE) Administrator Public Health and two (2) GF/GP FTE Epidemiologist in the Health Administration unit (#1060201). (The vote for this motion appears on page 572). *MISCELLANEOUS RESOLUTION #20332 BY: Commissioner Penny Luebs, Chairperson, Health, Safety and Human Services Committee IN RE: WATER RESOURCES COMMISSIONER – INFOSEND CONTRACT EXTENSION To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the office of the Water Resources Commissioner’s Billing Services Unit utilizes Infosend, Inc., a vendor that provides bill printing, special notice printing and mailing services for water and sewer customers on behalf of certain Oakland County communities; and WHEREAS the contract for Infosend, Inc. print and mailing services is between Oakland County and Infosend, Inc.; and WHEREAS the contract with Infosend, Inc. was first established on October 1, 2015, and is set to expire on September 30, 2020; and WHEREAS the Water Resources Commissioner’s Office uses NorthStar, a utility billing system from Harris Computing, Inc. to produce a monthly data file that provides customer billing information which is sent to Infosend, Inc. so that bills and notices can be printed and mailed; and WHEREAS the Water Resources Commissioner’s Office is implementing a new utility billing system to replace NorthStar as part of an approved 2019-2020 Master Plan project; and WHEREAS the Water Resources Commissioner’s Office needs to postpone the bid process for a new bill print and mailing services provider until after the new utility billing system is implemented and tested in order to avoid the need to integrate a new bill printing solution with NorthStar, then again with the new NorthStar system replacement; and WHEREAS Infosend, Inc. agrees to extend the contract for an additional three years without an increase in fees; and WHEREAS the anticipated cost for continuing the contract for postage, materials and services brings the contract “not to exceed” amount to $630,000; and WHEREAS the Purchasing Terms and Conditions state in Section 2400.6 Duration of Contracts and under Procedure states “The Board of Commissioners shall approve contracts beyond five years.” NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby approves that the contract for Infosend, Inc. bill printing and mailing services is extended for an additional three years to September 30, 2023, with a “not to exceed” amount of $630,000. August 20, 2020 571 *MISCELLANEOUS RESOLUTION #20333 BY: Commissioner Penny Luebs, Chairperson, Health, Safety and Human Services Committee IN RE: CIRCUIT COURT - FAMILY DIVISION - OAKLAND COUNTY CHILD CARE FUND BUDGET 2020-2021 To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS The Child Care Fund (CCF) reimbursement program is a collaborative effort between Michigan’s circuit courts, county governments, tribes, and state and county Department of Health and Human Services, to share costs that support programming for neglected, abused, and delinquent youth in Michigan; and WHEREAS pursuant to provisions of Chapter 400 of the Michigan Compiled Laws (MCL), entitled “The Social Welfare Act”, Oakland County is required to develop and submit an Annual Plan and Budget (AP&B) for the provision of funding of juvenile justice and foster care services to the Bureau of Juvenile Justice, Department of Human Services, annually to receive reimbursement; and WHEREAS the state supports the county’s CCF with a fifty percent (50%) cost share on eligible direct expenditures and ten percent (10%) for an indirect cost allotment to fund administrative expenditures; and WHEREAS the State Pays First (SPF) legislation (Senate Bill 101 amended PA 280 of 1939), effective October 1, 2019, now requires the State to pay 100% of expenditures for CCF abuse/neglect children with 50% reimbursement to the State; and WHEREAS the Oakland County Circuit Court - Family Division and the Oakland County Department of Health and Human Services have developed the attached juvenile justice and foster care services budget for the State's fiscal year, October 1, 2020 through September 30, 2021; and WHEREAS the figures provided are estimates for State Child Care Fund budgeting purposes only, based on current available data and may not reflect the eventual adopted budget and/or expenditures for this program; and WHEREAS the application reflects $31,646,755 in direct gross expenditures and $3,800,000 in offsetting revenues, leaving a direct net expenditure amount of $27,846,755 for the period of October 1, 2020 through September 30, 2021. The Child Care Fund reimburses 50% for all eligible direct net expenditures of $27,846,755, rendering a State reimbursement of $13,923,377 should the State approve the budget and the County expends all funds listed in the application; and WHEREAS the application reflects $2,460,998 in Neglect/Abuse Out of Home Care expenditures which represents the County’s fifty percent (50%) reimbursement to the State; and WHEREAS the Health, Safety and Human Services Committee has reviewed this budget and recommends its submission to the State Office. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners authorizes submission of the 2020-2021 Oakland County Child Care Fund Budget for FY 2021 – FY 2023 to the Bureau of Juvenile Justice’s Child Care Fund Unit, Department of Health and Human Services. MISCELLANEOUS RESOLUTION #20334 BY: Commissioner Helaine Zack, Chairperson, Finance and Infrastructure Committee IN RE: HUMAN RESOURCES DEPARTMENT – COVID-19 TEMPORARY CHILD CARE FLEXIBILITY LEAVE POLICY To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS in an effort to provide flexibility for departments to address employees who may be experiencing childcare issues due to COVID-19, the Human Resources Department is proposing a Temporary Child Care Flexibility Leave Policy (“Policy”); and WHEREAS to qualify under the new Policy the absence must be related to childcare needs as a result of COVID-19, or an involuntary or voluntary furlough due to COVID-19; and WHEREAS an extension of benefits will count for any leave related to COVID-19 as of March 23, 2020; and WHEREAS qualifying leaves referenced in the Policy must be approved by the employee’s department as well as the Human Resources Department; and WHEREAS the Policy allows departments and employees flexibility regarding work schedules/work hours that meet the Policy criteria and will require employees to sign an agreement that overtime will be calculated based on over 40 hours per week; and WHEREAS no additional funding or budget amendment is required at this time, but the impact of the Families First Coronavirus Response Act Family Medical Leave Act leave option referenced in the Policy will need to be monitored during the Policy period; and WHEREAS this Policy will be in effect through December 31, 2020. NOW THEREFORE BE IT RESOLVED the Oakland County Board of Commissioners approves the COVID- 19 Temporary Child Care Flexibility Leave Policy effective August 21, 2020. BE IT FURTHER RESOLVED that this Policy will remain in effect through December 31, 2020. BE IT FURTHER RESOLVED that no budget amendment is required at this time. The wage gap between men and women still impacts women’s economic power, and gender-based discrimination still plagues workplaces and business transactions; and WHEREAS women consistently earn less than men – women of all races earned, on average, just 82 cents for every $1 earned by men of all races, according to the most recent Census Bureau data from 2018; and Commissioners Minutes Continued. August 20, 2020 581 WHEREAS without adequate investments in the child care industry, families across the country and in Michigan will be unable to return to work; and WHEREAS as the COVID-19 pandemic continues to spread, child care providers are figuring out how to support families while keeping children and staff safe; and WHEREAS on average, providers are serving 67 percent fewer children now than they were prior to the pandemic, significantly reducing their revenue; and WHEREAS at the same time, providers are required to implement enhanced health and safety protocols that carry significant costs; and WHEREAS many states require that providers regularly do deep cleanings and disinfecting, which can add several hours of work each week. Even more costly are new limitations on classroom sizes; and WHEREAS without adequate support from the federal government Michigan could lose 121,264 licensed child care slots, approximately 41% of the child care supply; and WHEREAS prior to the spread of the coronavirus, Michigan could not provide care for every child that needed it; and WHEREAS with 2.33 children per child care slot available, working families lacked access to safe, quality child care; and WHEREAS the spread of COVID-19 has brought this problem to the brink of catastrophe; and WHEREAS since the pandemic, it is now estimated that there are 3.95 children per child care slot available; and WHEREAS without robust federal investments, the child care industry cannot provide the care needed to help Americans return to work; and WHEREAS the $1.4 billion Michigan would receive from the Child Care is Essential Act would help child care providers stay open, keep employees on payroll, and safely operate under new guidelines. MISCELLANEOUS RESOLUTION #20345 BY: Commissioners Gwen Markham, District #9; Marcia Gershenson, District #13; Helaine Zack, District #18; Penny Luebs, District #16; David Woodward, District #19; William Miller, District #14; Angela Powell, District #10; Nancy Quarles, District #17 IN RE: BO ARD OF COMMISSIONERS – SUPPORT FOR THE EQUAL RIGHTS AMENDMENT RATIFICATION To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS neither “women” nor “sex” are words that appear in the Constitution, revealing the limits of the Founding Fathers’ narrow understanding of women as equal citizens; and WHEREAS the Constitution was written by and for white men with means, which reserved its principle of equal justice under law for the sole benefit of the authors and their privileged peers; and WHEREAS this meant that women and people of color were openly regarded as less than full citizens and thus excluded from many legal protections because of their sex, race, and/or ethnicity; and WHEREAS one hundred years after women gained suffrage, the time for a constitutional amendment explicitly guaranteeing equal rights regardless of sex is long overdue; and WHEREAS authored by legendary activists Alice Paul, Crystal Eastman, and others in 1923 and later revised, the proposed Equal Rights Amendment (ERA) mandates that: “Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex.”; and WHEREAS when the ERA was written, women’s status in American society was still often considered secondary to men’s; and WHEREAS legal restrictions, such as prohibitions against voting and property ownership, combined with long- standing stereotypes about women’s roles meant that women were relegated to certain defined spaces and not treated as full citizens; and WHEREAS in particular, many women of color were further constrained by the compounding effects of entrenched racial, ethnic, and gender biases, reinforcing a societal hierarchy where they had diminished status when compared with white women; and WHEREAS ratifying the ERA in the U.S. Constitution would affirm that sex discrimination is inconsistent with the nation’s core value of equal protection under the law, and it would send a clear message about a national commitment to the inherent equality of all people; and WHEREAS on May 22, 1972, Michigan was among first states to ratify the ERA; and Commissioners Minutes Continued. August 20, 2020 587 WHEREAS the amendment also bolsters the argument that judicial review of cases alleging sex discrimination should utilize the highest level of legal scrutiny, requiring a compelling state interest to deem a particular sex- based action or practice unconstitutional; and WHEREAS the amendment should be understood as just one fundamental element of the fight for gender equality, one that provides an extra layer of protection that could make a difference in undoing long-standing discriminatory practices; and WHEREAS the absence of an explicit prohibition against sex discrimination in the U.S. Constitution remains one key impediment undermining the fight for gender equality and women’s progress overall and the ERA is an important tool to accomplish this progress; and WHEREAS boosted by activism of women’s rights and civil rights advocates, the U.S. Congress passed the ERA in 1973 and initially gave states until 1979 to ratify it by a three-fourths majority; and WHEREAS the deadline was extended to 1982, but the ERA fell three states short of the 38-state threshold; and WHEREAS recently, a groundswell of support for women’s rights led Nevada to ratify the ERA in 2017, followed by Illinois in 2018. In January 2020, Virginia became the historic and crucial 38th state to ratify the ERA (pending legal challenges, however, meaning the amendment’s future remains uncertain); and WHEREAS in a bipartisan vote, the U.S. House of Representatives voted on February 13, 2020 to eliminate the deadline for the ratification of the Equal Rights Amendment; and WHEREAS further action on this measure has been blocked by U.S. Senator Majority Leader Mitch McConnell (R-Kentucky) in support of the Trump Administration’s opposition to the ratification of Equal Rights Amendment; and WHEREAS there is precedent ratification constitutional amendments beyond the original seven year deadline provided in the U.S. Constitution, the 27th Amendment was originally proposed in 1789 and was not ratified until 1992; and WHEREAS former U.S. Supreme Court Chief Justice Charles Evans Hughes stated: “Congress, in controlling the promulgation of the adoption of a constitutional amendment, has the final determination of the question whether, by lapse of time, its proposal of the amendment had lost its vitality before being adopted by the requisite number of legislatures.”; and WHEREAS the adoption of federal legislation to eliminate the deadline for the ratification of the Equal Rights Amendment is necessary to place the principles of gender equality and equal rights into the U.S. Constitution and the framework of our government. August 20, 2020 588 WHEREAS it is an issue that impacts women at all levels, in all types of jobs, across race, ethnicity, and other factors; and WHEREAS according to the 2020 Center for American Progress’ one-year analysis, women working full-time in the United States collectively earned an estimated $546.3 billion less than their male counterparts in the one year since the House passed the comprehensive equal pay legislation; and WHEREAS the same analysis found that, on an individual level and in that same one-year period, a full-tim e working woman earned about $9,585 less than a man on average; and WHEREAS furthermore, when broken down by race and ethnicity, the earnings gap was larger for most women of color when compared with white men; and WHEREAS in the same one-year analysis of full-time workers, on average, black women earned about $17,344.36 less than white men, and Latinas earned about $20,483.36 less; and WHEREAS these numbers are a reminder that while the gender wage gap is often talked about in terms of cents on the dollar, the cumulative impact over time is much larger than a few cents; and WHEREAS while these earnings gaps may not be visible on the surface, they both represent and add to economic burdens facing women and their families; and WHEREAS without action, these earnings gaps are not projected to close anytime soon. At the current pace of change, women overall are not estimated to reach pay parity with men overall until 2059; and WHEREAS moreover, black women and Latinas are not estimated to reach pay parity with white men until 2130 and 2224, respectively; and WHEREAS despite the progress made by the landmark Equal Pay Act of 1963 and other civil rights legislation, the gender wage gap between women and men persists; and WHEREAS some opponents point to these existing equal pay laws—effectively ignoring the wage gap and other ongoing economic challenges that confront many working women on a daily basis—and claim that nothing else is needed; and WHEREAS the Paycheck Fairness Act is legislation that could begin to chip away at the persistent gender wage gap—particularly the factors that are caused or affected by discrimination; and WHEREAS in the absence of meaningful action, with each passing day, women are being shortchanged and harmed by the lack of access to equal pay. August 20, 2020 589 WHEREAS the U.S. Congress recognized that fact when it included a federal eviction moratorium in the Coronavirus Aid, Relief, and Economic Security Act (CARES Act); and WHEREAS however, that moratorium only covered approximately 30% of renters, and it expired on July 24, 2020; and WHEREAS on June 29, 2020, S. 4097 - the Protecting Renters from Eviction and Fees Act (Act) was introduced; and WHEREAS the Act would extend and expand the eviction moratorium for renters that ended on July 24, 2020; and WHEREAS it would also ensure renters will not lose their housing if they experience economic hardship during this crisis and need additional time to make their housing payments; and WHEREAS furthermore, it would extend the federal eviction moratorium to March 27, 2021, one year after the date of enactment of the CARES Act, and expands the moratorium to cover substantially all renters; and WHEREAS the Act also would prohibit fees, fines, and extra charges due to nonpayment of rent; and WHEREAS on August 8, 2020, the President signed the executive order which offers some mitigation measures, but it falls short of extending the moratorium included in the CARES Act; and WHEREAS it only instructs the Department of Health and Human Services (HHS) and the Centers for Disease Control (CDC) to "consider" whether temporarily banning residential evictions is "reasonably necessary" to further prevent the spread of COVID-19; and WHEREAS eviction is destabilizing for individuals and families and can have a negative impact on health, economic security, and the ability to access housing in the future; and WHEREAS eviction also puts families at risk of homelessness, which increases their vulnerability to contracting COVID-19; and WHEREAS experts are warning that ending the moratorium now could lead to “an avalanche of evictions” as Americans continue to face high unemployment rates; and WHEREAS the latest U.S. Census Bureau Household Pulse Survey finds that 30% of renters have no or little confidence they can make their next housing payment; and WHEREAS the COVID-19 crisis is far from over. The implications for housing instability, an impending tsunami of evictions, and the devastation of homelessness are only growing. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby supports S. 4097 - the Protecting Renters from Eviction and Fees Act. Local governments with populations over 500,000 are eligible for direct payments; and WHEREAS the County of Oakland was allocated $219,438,710 under the Coronavirus Relief Fund (CRF) to respond directly to the emergency as well as expenditures incurred to respond to second-order effects of the emergency; and WHEREAS the United States Treasury Department (“Treasury”) released the Coronavirus Relief Fund Guidance for State, Territorial, Local, and Tribal Governments (“Guidance”) on April 22, 2020 which provides local governments a general guidance for those recipients of the CRF funds and the eligibility of the payments from the Fund to cover the costs associated with the COVID-19 emergency; and WHEREAS according to Treasury guidance, which is still evolving, any Title V CARES Act funds which are not expended and still remain on 12/30/2020, and/or expenses deemed by Treasury to not be in compliance with the Act, must be returned to Treasury; and WHEREAS these funds may only be used to cover costs that are necessary expenditures incurred due to the public health emergency; were not accounted for in a budget approved as of March 27, 2020; are not government revenue replacements; and are incurred by December 30, 2020; and WHEREAS it is critical for the county to respond quickly and efficiently in numerous areas to provide adequate support throughout the county in response to the pandemic; and WHEREAS according to the Guidance, in order to facilitate compliance with COVID-19-related public health measures the County is eligible to expend costs for the “facilitation of distance learning, including technological improvements, in connection with school closings to enable compliance with COVID-19 precautions”; and WHEREAS the Oakland County Board of Commissioners champions an overarching plan by the County to provide the technological improvements to supply broadband internet access to Oakland County so the gap in educating our most important citizens, our children, does not widen any further. NOW THEREFORE BE IT RESOLVED that the Chairman of the Oakland County Board of Commissioners appoint a Study Group to ensure broadband internet access is available to the school children of Oakland County.
