HomeMy WebLinkAboutResolutions - 2020.11.19 - 33886MISCELLANEOUS RESOLUTION #20567 November 19, 2020 BY: Commissioner Penny Luebs, Chairperson, Health, barely dnd Human Services Committee IN RE: SHERIFF'S OFFICE — FY 2021 JOINT TERRORISM TASK FORCE (JTTF) — GRANT ACCEPTANCE To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the Federal Bureau of Investigation (FBI) may reimburse state and local law enforcement agencies (LEA) for the cost of overtime incurred by officers assigned full-time to FBI -managed task forces for overtime expenses incurred as a result of task force related activities; and WHEREAS the FBI sends a Notice of Limits each fiscal year, which outlines the maximum limits for reimbursement under the Cost Reimbursement Agreement (CRA) between the Oakland County Sheriff's Office (OSCO) Joint Terrorism Task Force (JTTF) and the FBI; and WHEREAS the Sheriff's Office will receive up to $19,180.25 in JTTF reimbursement funding from the FBI for the period of October 1, 2020, through September 30, 2021; and WHEREAS this funding will be used for the reimbursement of overtime for an OCSO Sergeant assigned to the JTTF for the expenses necessary for detection, investigation, and prosecution of crimes against the United States; and WHEREAS no county match is required; and WHEREAS the Board of Commissioners approved the CRA for the JTTF by Miscellaneous Resolution #18218; and WHEREAS the Notice of Limits has completed the Grant Review Process in accordance with Miscellaneous Resolution #19006. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the Notice of Limits for FY 2021 State and Local Overtime Reimbursements in the amount of $19,180.25 from the Federal Bureau of Investigation (FBI) for the period of October 1, 2020, through September 30, 2021 BE IT FURTHER RESOLVED that acceptance of this funding does not obligate the County to any future commitment, and continuation of this program is contingent upon future levels of reimbursement funding. The draft resolution needs to be updated to reflect if a budget amendment is required or not. —Lynn Sonkiss (10/ 16/20) Human Resources: FIR Approved — No HR Implications —Lori Taylor (10/12/20) Risk Management: Approved by Risk Management. —Robert Erlenbeck (10/16/20) Corporation Counsel: Approved —there are no legal issues with the agreement. — Sharon Kessler (10/13/20) NOTICE OF LIMITS FOR FY 2021 STATE AND LOCAL OVERTIME REIMBURSEMENTS Subject to the availability of funding and legislative authorization, the FBI may reimburse state and local law enforcement agencies (LEA) for the cost of overtime incurred by officers assigned full-time to FBI -managed task forces provided the overtime expenses were incurred as a result of task force -related activities. Consistent with regulation and policy, a separate Cost Reimbursement Agreement (CRA) must be executed between the FBI and the LEA, and an underlying Memorandum of Understanding (MOU) must exist in support of the task force relationship. For fiscal year 2021, the maximum limits for reimbursements under these CRAB are $1,598.35 per month and $19,180.25 per year for each officer assigned full-time to the task force. These limits are effective for overtime worked on or after October 1, 2020. These reimbursements are limited to eligible officers' direct overtime salary expenses and shall not include any costs associated with the LEA's indirect expenses or officers' benefits such as retirement, social security, and similar related expenses. FBI field offices and state and local law enforcement agencies may process overtime reimbursement requests under formally executed CRAs in accordance with the authority of this notice. This notice is issued unilaterally by the FBI's Budget Officer and does not require formal acceptance and signature by FBI field offices and state and local law enforcement agencies. This notice does not represent an authorization to obligate or expend funds. The actual amount of overtime expenses that can and should be approved for each task force officer is also dependent upon the availability of funding and operational necessity.
