HomeMy WebLinkAboutResolutions - 2021.03.11 - 34232MISCELLANEOUS RESOLUTION #21076 March 11, 2021 BY: Commissioner Penny Luebs, Chairperson, Public Health and Safety Committee IN RE: HEALTH AND HUMAN SERVICES/NEIGHBORHOOD AND HOUSING DEVELOPMENT DIVISION - AMENDMENT OVER 15% TO PY 2019 ANNUAL ACTION PLAN AND PY 2016-2020 CONSOLIDATED PLAN AND SPECIAL GRANT ALLOCATION APPLICATION FOR CORONAVIRUS AID, RELIEF, AND ECONOMIC SECURITY (CARES) ACT (P.L. 116-136) COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG-CV ROUND 3) To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the Department of Health and Human Services/Neighborhood and Housing Development Division (N&HD) plans to submit a Substantial Amendment to the PY 2019 Annual Action Plan and PY 2016-2020 Consolidated Plan and a Consolidated Grant Application for Coronavirus Aid, Relief, and Economic Security (CARES) Act (P.L. 116-136) Community Development Block Grant (CDBG-CV) funds to the United States Department of Housing and Urban Development (HUD); and WHEREAS the PY 2016-2020 Consolidated Plan is amended to identify Oakland County's programs designed to serve the needs of eligible beneficiaries in response to local, state and national declared emergencies; and WHEREAS the PY 2019 Annual Action Plan Substantial Amendment contains a consolidated federal grant application for activities designed to accomplish the emergency response goals and objectives for the CDBG-CV Program; and WHEREAS on July 2, 2020, via Miscellaneous Resolution #20235, the County accepted HUD's CARES Act funds through the CDBG-CV Program to provide aid, relief and economic security to low-income persons during the pandemic in the amount of $3,166,997; and WHEREAS on September 11, 2020, HUD announced to the N&HD a PY 2019 additional special allocation of $3,999,312 for CDBG-CV Round 3 for the period of July 1, 2020, through September 30, 2022; and WHEREAS if HUD's special allocation is approved, the total revenue for the CDBG-CV Program would be $7,166,309; and WHEREAS the CDBG-CV grant is 100 percent federally funded, and no County funds are required; and WHEREAS the grant funds will continue to partially fund the following nine (9) Full -Time Eligible Special Revenue (SR) positions: one (1) N&HD Assistant position (#05413), four (4) N&HD Coordinator positions (#01279, #03231, #03430, and #06098), one (1) Supervisor N&HD Administrative Services position (#01371), two (2) N&HD Technician positions (#03230 and #01768), and one (1) Housing Counseling Supervisor (#3354) in the Department of Health and Human Services/Neighborhood and Housing Development Division (1060701); and WHEREAS the grant will continue to partially fund two (2) Full -Time Eligible Special Revenue (SR) Senior Specialist positions (#00730 and #10806) in the Department of Health and Human Services/Neighborhood and Housing Development Division (1060702); and WHEREAS the grant application has completed the Grant Review Process in accordance with the Grants Policy approved by the Oakland County Board of Commissioners at their January 21, 2021 meeting. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves submission of the PY 2019 Annual Action Plan Substantial Amendment totaling $3,999,312 (Round 3) to the United States Department of Housing and Urban Development designed to accomplish the goals and objectives for the Community Development Block Grant (CDBG-CV) Program for the period July 1, 2020, through September 30, 2022. BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners approves the attached PY 2016-2020 Consolidated Plan Substantial Amendment. BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners authorizes both the Board of Commissioners Chairperson and the County Executive to execute this special allocation application and to approve amendments and extensions within fifteen percent (15%) of the original award, consistent with the original agreement as approved. This allocation was authorized by the Coronavirus Aid, Relief, and Economic Security Act (CARES Act), Public Law 116-136, which was signed by President Trump on March 27, 2020, to respond to the growing effects of this historic public health crisis. The CARES Act made available $5 billion in Community Development Block Grant Coronavirus (CDBG-CV) funds. Of this amount, the Department immediately allocated $2 billion on March 27, 2020, the same day President Trump signed the Act, based on the fiscal year 2020 CDBG formula; this constituted the first round of CDBG-CV fiends. Next, $1 billion was required by the Act to be allocated to States and insular areas within 45 days of enactment of the Act; HUD accomplished this on May 11, 2020, and this constituted the second round of CDBG-CV funds, Finally, the remaining $2 billion in CDBG-CV funds was required by the Act to be allocated to states and local governments at the discretion of the Secretary on a rolling basis; HUD accomplished this on September 11, 2020, and this constituted the third round of CDBG-CV funds Additionally, up to $10 million will be set aside for technical assistance. Accordingly, this letter informs you that your jurisdiction's allocation for the third round is $3,999,312. Your cumulative amount for all allocation rounds is $7,166,309. The CARES Act adds additional flexibility for both the CDBG-CV grant and, in some cases, for the annual FY2019 and FY2020 CDBG grants in these unprecedented times. The public comment period is reduced to not less than 5 days, grantees may use virtual public hearings when necessary for public health reasons, the public services cap is suspended during the emergency, and States and local governments may reimburse costs of eligible activities incurred for pandemic response regardless of the date. In addition, the CARES Act authorizes the HUD Secretary to grant waivers and alternative requirements of statutes and regulations the HUD Secretary administers in connection with the use of CDBG-CV funds and fiscal year 20t9 and 2020 CDBG funds (except for requirements related to fair housing, nondiscrimination, labor standards, and the environment). Waivers and alternative vnvw.hud.gov espanothud.gov requirements can be granted when necessary to expedite and facilitate the use of funds to prevent, prepare for, and respond to coronavirus. The CDBG CARES Act Federal Register Notice (FR-6218-N-01) was released on August 10, 2020. The notice describes the allocations and grant procedures applicable to the CDBG-CV grants. It also describes the program flexibilities, waivers, and alternative requirements that apply to the CDBG-CV grants as well as the fiscal year 2019 and 2020 CDBG grants. As further such flexibilities become available, they will be posted on HUD's website and distributed to grantees. The Department will also support grantees with technical assistance. As you develop your plan for the use of these grant funds, we encourage you to consider approaches that prioritize the unique needs of low- and moderate —income persons and the development of partnerships between all levels of government and the private for -profit and non- profit sectors. You should coordinate with state and local health authorities before undertaking any activity to support state or local pandemic response. CDBG-CV grants will be subject to oversight, reporting, and the requirement that each grantee have adequate procedures to prevent the duplication of benefits (DOB). HUD will provide guidance and technical assistance on DOB, the prevention of fraud, waste, and abuse, and on documenting the impact of this program for beneficiaries. Reminder, all CPD Grantees must ensure they maintain active Dun and Bradstreet Numbering System (DUNS) numbers in the System for Award Management (SAM) system. Entities must have an active and unexpired DUNS before execution of grant agreements to avoid delays in the obligation of funds- which will delay your ability to drawdown funds in the Integrated Disbursement & Information System (IDIS). Grantees are required to maintain an active SAMs registration by re -activating their DUNS number annually in the SAM system for the entire drawdown period of their grants. Oakland County Neighborhood & Housing Development Division is the responsible entity for CARES Act funds. The onset of COVID-19 has created new priority needs. The substantial amendment to the Consolidated Plan will allow the county to expend CARES Act funds to address emergency needs. Department of Housing and Urban Development (HUD) waived this+comment period requirement provided that no less than five (5) days are provided for public comments on each substantial amendment. The CARES Act eliminated the cap on the amount of funds a grantee can spend on public services, removed the requirement to hold in -person public hearings in order to comply with national and local social gather requirements, and allowed grantees to be refrribursed for COVID-19 response activities regardless of the date costs were incurred. The bill alsq.allowed grantees to apply for waivers of specific statutory regulations. The CDBG-CV funds allocated under the CARES Act may be used for a range of eligible activities that prevent and respond to the spread of infectious diseases such as the coronavirus disease (COVID-19). The proposed CDBG-CV activities must meet one of the three CDBG National Objectives as required by regulation. This amendment to the PY 2019 Annual Action Plan describes how the CDBG-CV will be utilized locally to address the COVID-19 pandemic. CDBG programs recommended for funding in the amended PY 2019 Annual Action Plan include public services administered by Oakland County Neighborhood & Housing Development Division to provide emergency rent/mortgage/utility/food assistance. Oakland County Neighborhood & Housing Development will administer the CARES Act funds. Prior to receipt of the funding from the U.S. Department of Housing and Urban Development (HUD) Office of Community Planning and Development, Oakland County prepared a formal substantial amendment to its PY 2016-2020 Consolidated Plan and PY 2019 Annual Action Plan. Oakland County also amended is citizen participation requirements as reflected in its amended Citizen Participation Plan. CDBG-CV Description Public Services - Subsistence Pavment (Emeraencv, R9,nt/Mortaaae/Utility/Poo0 Relief) Public services to assist with no more than six months of emergency payments for past -due rent, including mobile home lot rent, land contract payments, mortgage payments, homeowner association fees, utilities (gas/electric/water), and food assistance to stably house households and prevent homelessness when no other means to pay is available. Payments will include any additional charges due to delinquency such as late charges or court costs. Households who reside in an Oakland County with a gross income less than 80% of area -median income may be eligible. Households must have a COVID-19 hardship. Delinquency must have occurred after April 1, 2020. Beneficiaries will be allowed to receive assistance one time. An application including self -attestation for income will be used. Applications including supporting documentation may be received in person or electronically. Applicants will be strongly encouraged to meet with a housing counselor for further financial education and receive referrals., Applicants that, do not qualify for CDBG-CV assistance will be provided with resource/referral information to other programs that may be of assistance. A marketing planwill.be developed and procedures to prevent duplication of services will be maintained for all CDBG-CV activities.
