IN RE: SHERIFF'S OFFICE — 2021 MARINE SLOW NO WAKE ZONE ENFORCEMENT GRANT -
GRANT ACCEPTANCE
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS the Sheriff's Office has been awarded Marine Slow No Wake Zone Enforcement Grant
reimbursement funding from the Michigan Department of Natural Resources (MDNR) in the amount of
$100,000 with no County match required; and
WHEREAS the grant funding period is January 1, 2021, through December 31, 2021; and
WHEREAS the Marine Safety Slow -No Wake Zone Enforcement Program is a new legislatively initiated
program administered by the MDNR intended to provide county sheriff departments with grant funds to
enforce slow -no -wake zones to mitigate high water impacts on local infrastructure; and
WHEREAS the Sheriff's Office has received several complaints from citizens regarding damage to their
boats, docks, seawalls, and property from slow -no -wake violations; and
WHEREAS the funding will be used for the reimbursement of salaries and fringe benefits to patrol and
enforce slow -no -wake zones; and
WHEREAS the grant award has completed the Grant Review Process in accordance with the Grants Policy
approved by the Board at their January 21, 2021 meeting.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accepts the 2021
Marine Slow -No -Wake Zone Enforcement Grant reimbursement funding from the Michigan Department of
Natural Resources, for the period January 1, 2021, through December 31, 2021, in the amount of $100,000.
BE IT FURTHER RESOLVED that the Chairperson of the Board of Commissioners is authorized to execute
the grant award and to approve any grant extensions or changes, within fifteen percent (15%) of the original
award, which are consistent with the original award as approved.
BE IT FURTHER RESOLVED that acceptance of this grant does not obligate the County to any future
commitment and continuation of this program is contingent upon continued future levels of grant funding.
BE IT FURTHER RESOLVED the budget is amended as follows:

This grant program is not administered in the Departments MiGrants online system,
therefore, attached to this email is your marine safety slow -no wake grant
agreement. Please print this agreement, sign, date, and return it to the Department
via email at dnr-slownowakearants(&michiaan.aov. The Department will sign
the agreement and return a fully executed version to you via email for your records.
Also attached to this email is the marine slow -no wake zone enforcement program
policy and procedure document which outlines the eligible expenditures, activity
reporting requirements, reimbursement request due dates, and Departments contact
information related to this program.
All other forms and documents related to this program are available on the Marine
Slow -No Wake website, but for your convenience we have attached the monthly
activity report and state aid voucher to this email as well.
Please remember, this program is separate from the Annual Marine Safety
Operating Grant Program and expenses incurred under that program are not eligible
for reimbursement in this grant program. This program was legislatively funded
specific to the enforcement of slow -no wake zone patrols to help mitigate high
waters. These funds are not available for routine marine enforcement patrols,
search and rescues, day to day program administration, etc.

oxallt+ MARINE SAFETY SLOW -NO WAKE GRANT PROGRAM
GRANT AGREEMENT
Required by authority of 1994 PA 451, as amended, and 1972 PA 227.
This Agreement is between the Michigan Department of Natural Resources for and on behalf of the State of
Michigan ("DEPARTMENT") and OAKLAND COUNTY ("GRANTEE").
1. The GRANTEE has been approved by the DEPARTMENT to receive Marine Safety Slow -No Wake
program funding for a sum of money equal to One Hundred Percent (100%) of the total cost of marine
slow -no wake eligible expenses, which shall not in any event exceed One Hundred Thousand Dollars
and Zero Cents ($100,000.00). There is no local match requirement for this reimbursement.
Salaries, Wages and Benefits for:
Marine Safety Slow -No Wake Law Enforcement and Related Activities;
o Salary and Wages are reimbursable to the GRANTEE at the employees' hourly rate.
Overtime is only eligible if the employee worked in excess of 80 hours for full time
employees and 40 hours for part time employees in a pay period on Marine Safety related
duties. This includes the employees marine related activities in their annual operating grant
and their slow -no wake enforcement activities.
Operating Expenses for:
• Purchase of fuel, oil, parts and maintenance for patrol vehicles, watercraft, and trailers directly related
to slow -no wake enforcement activities.
The Agreement period for state funding is January 1, 2021 through December 31, 2021.
5. This Agreement shall be administered on behalf of the DEPARTMENT through Grants Management. All
reports, documents, or actions required of the GRANTEE shall be submitted directly to the DEPARTMENT
unless otherwise instructed by the DEPARTMENT.
6. Reimbursement will be made only upon DEPARTMENT review and approval of a complete reimbursement
request submitted by the GRANTEE.
7. The GRANTEE may not assign or transfer any interest in this Agreement to any other agency, group or
individual.
8. The GRANTEE shall display valid and proper state of Michigan registration on all vessels and comply with
the state of Michigan life jacket regulations.
9. This Agreement may be canceled by the DEPARTMENT, upon 30 days written notice, due to Executive
Order, budgetary reduction, other lack of funding, upon request by the GRANTEE, or upon mutual
Agreement by the DEPARTMENT and GRANTEE. The DEPARTMENT may honor requests for just and
equitable compensation to the GRANTEE for all satisfactory and eligible work completed under this
Agreement up until 30 days after written notice, upon which time all outstanding reports and documents are
due to the DEPARTMENT and the DEPARTMENT will no longer be liable to pay the GRANTEE for any
further charges to the grant.
10. The GRANTEE agrees not to discriminate against an employee or applicant for employment with respect to
hire, tenure, terms, conditions, or privileges of employment, or a matter directly or indirectly related to
employment, because of because of religion, race, color, national origin, age, sex, sexual orientation,
height, weight, marital status, partisan considerations, or a disability or genetic information that is unrelated
to the person's ability to perform the duties of a particular job or position. The GRANTEE further agrees
that any subcontract shall contain non-discrimination provisions which are not less stringent than this
provision and binding upon any and all subcontractors. A breach of this covenant shall be regarded as a
material breach of this Agreement.
11. The GRANTEE agrees to follow the DEPARTMENT procedure policy:
a. The GRANTEE will openly advertise and seek written bids for contracts for purchase or services
with a value equal to or greater than $50,000.00 and accept the lowest qualified bid.

b. The GRANTEE will solicit three (3) written quotes for contracts with purchases or services
between $5,000.00 and $50,000.00.
12. The Agreement may be executed separately by the parties. This Agreement is not effective until:
a. The GRANTEE has signed it and returned it, and
b. The DEPARTMENT has signed it.

Proqram Oblective
The Marine Safety Slow -No Wake Zone Enforcement Program is a new legislatively initiated program, funded
at $1.75 million General Fund and administered by the Department of Natural Resources (Department). The
program is intended to provide county sheriff departments with grant funds to enforce slow -no wake zones to
mitigate high water impacts on local infrastructure.
Criteria
Grant funding is made available to county sheriff departments within the State of Michigan. Awards are
dependent on such factors as the area of public waters to be patrolled for slow -no wake zone enforcement to
address high water problems and the number of law enforcement personnel available for those types of marine
patrols. Activities include the patrolling and enforcement of current slow -no wake zones and the creation and
enforcement of new slow -no wake zones established under MCL 324.80110 — 324.80112a and 324.80146 to
mitigate high water problems.
Dollar Amount Available
Funding is based on the criteria listed above and varies from county to county. There is no minimum grant
request amount, and the maximum grant request amount is $100,000.00. Reimbursement is up to 100 percent
of actual expenditures, not to exceed the grant allocation.
Eliaibility and Expenses
All county sheriff departments in the State of Michigan are eligible to apply. Expenses applied to patrol time
and law enforcement work related to slow -no wake zone patrols are eligible for reimbursement.
Eliaible Expenses
• Patrol boat fuel and oil expenses for slow -no wake zone patrol efforts.
• Patrol boat maintenance due to slow -no wake zone patrol efforts.
• Vehicle mileage at the approved state rate limited for the purposes of this grant.
• Salary and wages for enforcement of slow -no wake regulations to mitigate high water issues.
Overtime is eligible in this program only if a FT Officer works 80 hours or more and a PT Officer
works 40 hours or more in a single pay period on marine safety related enforcement activities,
this includes the annual operating marine grant related activities.
• Court appearances or other administrative time for slow -no wake zone efforts.
Ineliaible Expenses
• CSS&M related expenses that can be claimed through the Annual Operating Marine Safety
Grant program.
• Personal floatation devices, uniform purchases, and other expenses.
• Firearms, duty belts and accessories, pepper spray, etc.
• New equipment purchases (boat, motor, and trailer).
General marine patrol efforts shall not be charged to this grant program. Only salaries and wages, vehicle
mileage, and fuel that are used for the enforcement of slow -no wake zones to mitigate high water problems
shall be charged to this grant. Activities spent on a single patrol conducting general marine safety efforts and
slow -no wake enforcement shall be charged correctly to the appropriate grant(s) or funding source(s).
Timeline and Deadlines
Grant applications are made available on the Department's Marine Safety website in February 2021.
County sheriff department grant application proposals are due by March 22, 2021 to the Department via Email
to Christie Bayus, program manager at bavusc(d)..michiaan.aov.
Each applicant will be notified as to the success of their application.
The Department will evaluate each application submitted. Applications not meeting the criteria will not be
approved for grant assistant. Those that meet the criteria will be notified of their approved Marine Safety Slow -
No Wake Zone Enforcement grant award by May 1, 2021. Grants will be issued for an entire calendar year,
January 1, 2021 through December 31, 2021.
Activity Report Procedures
Monthly Activity Reports that reflect the daily activity related to slow -no wake enforcement efforts are due
monthly. The County must submit to the Department a monthly activity report no later than the 10" of the
following month via email to dnr-slownowakearants(c)michiaan.aov For Example: If a county performed slow -no
wake zone patrol related activities in the month of June, then it is required to submit to the Department its
monthly activity report no later than July 10, 2021. If no activity was conducted, the County must submit a
blank activity report to adhere to the reporting requirements.
Activity included on this report should not be included on your annual operating marine safety activity report.
Reimbursement Reauest Procedures
The State Aid Voucher/Financial Report form is used by the counties to request reimbursement from the
Michigan Department of Natural Resources (DNR) for their expenditures in conducting Marine Slow No Wake
Zone Enforcement Grant Program. This form is located on the Marine Slow -No Wake website, along with all
other program related documents.
Reimbursement Requests can be submitted to the Department twice a year. They are submitted via email to
dnr-slownowakearants(a michiaan.aov. The first reimbursement request, which must include all expenditures
incurred through your last pay period in the month of June 2021, is due August 15, 2021 and the second one is
due after the expiration of the grant agreement or no later than February 1, 2022. If you decide to only submit
one reimbursement request for the grant period, then you should use the second due date.
All grantees are required to retain financial and programmatic records and supporting documents for ten years
following closeout of the grant, regardless of if you are randomly selected for a DNR review of expense. If the
DNR is audited, these records may be requested for the audit.
