IN RE: CIRCUIT COURT — FY 2022 MICHIGAN DRUG COURT GRANT PROGRAM (ADULT
TREATMENT COURT) — GRANT APPLICATION
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS the Circuit Court is applying to the State Court Administrative Office (SCAO), Michigan Drug
Court Grant Program in the amount of $305,060, for the grant period of October 1, 2021 through September
30, 2022; and
WHEREAS the total program grant application funding for the Adult Treatment Court (ATC) is $566,030,
consisting of $305,060 in grant funding from SCAO, $150,000 in PA 511 Community Corrections funding,
and $110,970 from General Fund/Child Care Fund; and
WHEREAS the court intends to continue the ATC to deal with problems of increasing recidivism, increasing
use of alcohol and illegal drugs, rising system costs, and the increase in jail days ordered; and
WHEREAS the SCAO is allowing Circuit Court to consolidate its mental health component into this ATC
grant via a mental health "track" of the ATC, in order to avoid certification requirements which are not
feasible for our drug court to meet at this time; and
WHEREAS the grant funds that were previously obtained through the mental health grant have been
requested in this ATC grant application to service the mental health participants of the ATC; and
WHEREAS the application proposes to continue to partially fund the following two (2) positions: one (1)
General Fund/General Purpose (GF/GP) Full Time Eligible (FTE) Youth and Family Casework Supervisor
position (#3010402-09712) and one (1) GF/GP FTE Technical Office Specialist position (#3010402-10677);
and
WHEREAS the grant application proposes to continue to fully fund one (1) Special Revenue (SR) FTE
Technical Office Specialist position (#3010402-12029); and
WHEREAS the ATC grant application provides funding for drug testing supplies and kits, bus passes,
meetings, contractual services for individual and family treatment, incentives, transitional housing, and
defense attorney fees; and
WHEREAS the grant application also provides funding for contractual services from Oakland Community
Health Network (OCHN) in the form of a Court Liaison position, as well as a Peer Recovery Coach, which
serves and assists the ATC Team via assessments, court testimonies, consultations, progress updates,
crisis intervention, community referrals, and coordinates care throughout OCHN's network of Core Provider
Agencies (CPA), bridging the gaps between the Court and Mental Health systems; and
WHEREAS the grant application has completed the Grant Review Process in accordance with the Grants
Policy approved by the Board at their January 21, 2021 meeting.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby approves
the grant application to the State Court Administrative Office (SCAO) for the FY 2022 Michigan Drug Court
Grant Program (Adult Treatment Court) in the amount of $305,060, for the period of October 1, 2021,
through September 30, 2022.
BE IT FURTHER RESOLVED a budget amendment is not required at this time.

There have been a few personnel changes in the Adult Treatment Court that differ from the application submitted for fiscal year 2021. First, our
previous Drug Treatment Court Coordinator; Mrs. Jacqueline Howes -Evanson, retired as of April'30, 2021 and was replaced by Mr. Nathanial
Gilling. Se condly, the Honorable Yasmine Poles has recently taken over for the Honorable Shalina Kumar as of May 4, 2021 to preside over the
women's cases in the Adult Treatment Court.',Fhally, our treatment team has beenable,to secure the assistance of the Oakland County
Prosecutor's Office in an effort that is beingI'ed',by Mr: John Skrzynski, venom is the Chief Prosecuting Attorney. _
There are no changes to note in, terms of program capacity. The Adult Treatment Court does not currently limit the: number of participants in the
program. -
In terms of program changes, the Adult Treatment Court continues to adapt based on the needs presented through our current global health crisis.
We continue to align with local; state, and national guidelines to prioritize the health and safety of our team'members and participants,' Our client
reporting; staffing; case conferences, and court sessions continue to take place virtually at this time. In'saying this, the program is proud to note
that we have been able to continue to hold all sessions as scheduled without delay, creatively administer proper sanctions and Incentives, conduct
graduation ceremonies to recognize the achievements of our participants, as wall as participate in educational conferences, vorkshops;, and
tramings, all in'an effort to provide consistent and appropriate services to our clients in need.

Additional funding is being requested for�fiscal gear 2022 for two main reasons Firat there has been an increase in operational, costs due to the
GOVID-19 pandemic. This includes the program absorbing some unexpected (costs for clients whom are unemployed or rendered unable to work
because of the health crisis including supports for drug' screening, tethering,; and transportation. Oakland County was awarded approximately
$16,000 less in fiscal year 2021 than was granted in fiscal year 2020 resulting In these additional costs having to be supplemented from other
funds. Secondly, Oakland County has increased employee salaries as part of a' newsalary administration plan coming from a recent compensation
study. The purpose of the study and the corresponding action was to ensure'employee salaries align Wtntheir private -sector peers and that

Describe the contractual costs associated with the proposed project.
Drug Testing: These funds are used to pay for alcohol and drug[ testing. For alcohol breathalyzer testing we use House Arrest Services at
$10,00/day x 2 participants x 90 days plus enrollment fees ($30.00 enrollment fee), For drug testing we use both JAMS and RESULTS. JAMS
charges $6.00 for a 6-panel (instant test) which includes marijuana, Methamphetamines, Cocaine, Heroin, Benzadiazepines, and Adulterants. They
will complete a PBT for free if the defendant shows for a regularly scheduled drug screen; however, if they are called to show up for a PBT alone,
then they charge a $2.00 fee. Lab confirmations are $25.00, mouth swabs are $30.00, and additional testing is available for K2 and MDM1A for
$2.00 more on top of the cost of the regular screen. Drug testing confirmations are to be paid only if the confirmation is negative. RESULTS
charges $10 for a 13-panel which includes Amphetamines, Barbiturates, Beirmclazepines, marijuana, Cocaine, Methaqualone, Opiates,
Phencyclidine, Methadone, Propoxypene, Buprenorphine, Oxycodone, and Tricyclic Antidepressants- They also test for adulterants (at no
additional cost). They charge the program a reduced rate for ETG's of $10.00 as they are not currently administering PBT's due to the health
crisis. If the sample is positive and is sent to their outside lab then they charge $20.00 for each substance they run a confirmation on.
Treatment: These funds are used to pay for residential services, detox, relapse "tune-up" weekends, therapy, transitional housing, and MAT. In
terms of residential, detox, and "tune-up" weekends, ATC uses Meridian Health Services with residential charges at $180.00/day, detox charges at
$205.00/day, and relapse "tune-up" weekends at $340.00/weekend (or $113.331day). Individual and group therapy utilize the
assistance of Oakland Family Services where costs are $65.00 for an individual session and $25.00 for a group session. Oakland Family Services
also provides substance abuse testing for an additional $15-00. For 3/4 housing the ATC program utilizes the Davis House which charges $425.00
per month or $14.16 per day. For Medication Assisted Treatment the program uses either Easter Seals or Bio-Med. There Is an intake fee of
$80.00 to $175.00 and office visit fee of $80.00 for these services as well as fees for the medication though this all depends on an individual's
insurance.
Peer Recovery Coach and Mental Health Liaison: A Peer Recovery Coach has been incorporated into the ATC team to provide additional
participant support. This service falls under allowable expenses under consultant/contractor and will be paid approximately $31/hour. The upper
cost of this position/service is $21,100. Also, the ATC treats offenders with co-oceuring disorders (mental health and substance abuse). This
money Is used to purchase contractual services from Oakland Community Health Network (OCHN) in the form of a Mental Health Liasion position
which serves and assists the ATC team by completing assessments, court testimonies, consultations, progress updates, crisis intervention,
community referrals, as well as help to coordinate care throughout OCHN's network of Core Provider Agencies. The cost of this postiioNservice is
$58,000.00 (1,700 hours x $34.00/hour) . An Intergovernmental Agreement for these services has been established between the court and
OCHN for this position.
Defense Attorney Fees: These fees are paid to the ATC Defense Advisor for attending case conferences, court sessions, and relevant trainings.
The services are billed at $100,00/hour x 30 hours — 10 sessions x approximately 3 hours/session.

In -state and out-of-state training, including national conferences (other than the pre -approved
MATCP conference, and training required for planning programs)

Construction or renovation
• Overtime pay rate, excluding law enforcement
. Fringe benefits, including paid time off, for contractual services
• Fees for missed sessions/services/appointments ("no-show" fees)
• Late fees for failure to pay on time
CONDITIONS ON EXPENSES
All MDCGP projects are based on the cost reimbursement concept; i.e., state, local, or private funds
shall be expended before reimbursement is provided. Your court will be reimbursed quarterly after
invoices for grant expenses have been submitted to and approved by SCAO.
Costs must be allowable as stated above, and they must be reasonable and necessary. All grant costs
and billings will be reviewed by the State Court Administrative Office (SCAO) to ensure that they
reflect costs generally recognized as ordinary and necessary for the operation of the problem -solving
court and reflect market prices for comparable goods or services.
Additionally, the grant expenditures must be for goods and services that are or will be utilized for
the grant period or fiscal year (October 1 to September 30). Billing for goods and services (i.e.,
bus tokens, library materials, drug testing supplies on September 24) that could not reasonably be
used up prior to September 30 will be denied for reimbursement. The above list of disallowable
expenses is not exhaustive. Contact SCAO if you are not sure about an expense. If required by the
court funding unit, costs must be sustained by competitive bids.
Individual consultant fees are limited to $650 (excluding travel, lodging and meal costs) per day,
which includes legal, medical, psychological and accountant consultants. If the rate will exceed
$650 for an eight -hour day, written approval is required from SCAO. Compensation for individual
consultant services is to be responsible and consistent with that paid for similar services in the
market place.
GRADUATION REFRESHMENTS AND SUPPLIES
Programs that have annual or biannual graduations for multiple participants may request deviation
from the allowable list through the grant manager. The request must be made through a
WebGrants contract amendment and approved, prior to purchase, and must specify the number of
graduates, the date of the ceremony, and the supplies being purchased.

TRAVEL EXPENSES
Travel expenses may not exceed the state rate, or your program's county rate, whichever is the
lesser expense. State mileage rate includes: premium rate for roundtrip less than 100 miles and
standard rate for roundtrip more than 100 miles.
Grant funds may only be used to reimburse expenses incurred by the program. Grant funds will
not cover expenses for future services, such as annual bus passes.
Regional programs are distinguished from other programs by the number of geographically distinct
jurisdictions participating in a single joint program. Below are examples of regional program
designs:
• Two or more circuit courts participating in a single regional court.
• Two or more district courts from different counties participating in a single regional
court.
• One or more district courts and one or more circuit courts, from different counties,
participating in a single regional court.
NONSUPPLANTING
SCAO requires that funds not be used to supplant state, local or tribal funds. The grantee must
assure that funds will not be used to replace or supplant state, local or tribal funds, but will be used
to increase the amount of such funds that would, in the absence of grant funds, be made available
for criminal justice activities.
This means that if your court plans to:
(a) Hire new positions (including filling existing vacancies that are no longer funded in your
agency's budget): It must hire these additional positions on or after the official grant award
start date, above its current budgeted (funded) level of positions.
(b) Rehire personnel who have already been laid off (at time of the application) as a result of
state, local, or tribal budget cuts: It must rehire the personnel on or after the official grant
award start date and maintain documentation showing the dates(s) that the positions were
laid off and rehired.
(c) Maintain personnel who are (at the time of application) currently scheduled to be laid off on
a f lure date as a result of state, local, or tribal budget cuts: It must continue to fund the
personnel with its own funds from the grant award start date until the date of the scheduled
layoff (e.g., if the layoff is scheduled for October 1, then funds may not be used to fund the
personnel until October 1, the date of the scheduled layoff), and maintain documentation
showing the date(s) and reason(s) for the layoff. [Please note that as long as your agency
can document the date that the layoff would occur if the grant funds were not available, it
may transfer the personnel to the grant funding on or immediately after the date of the
layoff without formally completing the administrative steps associated with a layoff for
personnel.]
Documentation that may be used to prove that the scheduled layoffs are occurring for local
economic reasons that are unrelated to the availability of grant funds may include (but are not
limited to) council or departmental meetings, memoranda, notices, or orders discussing the layoff;
notices provided to the individual personnel regarding the date(s) of the layoff, and/or budget
documents ordering departmental and/or jurisdiction -wide budget cuts. These records must be

maintained with your court's grant in the event of an audit, monitoring, or other evaluation of your
grant compliance.
ASSURANCES
1. Applicants must provide assurance that there has been, and will continue to be, appropriate consultation
with all affected agencies in planning and implementation of the drug treatment court program.
Applicants are required to have a current Memorandum of Understanding that includes the parties as
stated in MCL 600.1062(1) and (2).
2. Applicants must provide assurance that all treatment programs and providers used in the drug treatment
court program are licensed and/or accredited by the appropriate state government or professional
agencies.
3. Applicants must provide assurance of the intention of the jurisdiction to continue the program after
funding from the Michigan Drug Court Grant Program (MDCGP) has been exhausted. .
4. Applicants must provide assurance that all recipients of funding under this grant program are required
to comply with nondiscrimination requirements contained in various federal and state laws. Each
applicant court should have a copy of their Equal Employment Opportunity plan on file and available
for review by SCAO upon request.
5. Applicants must assure that they and any sub -grantees will not use funds from MDCGP for lobbying
and that they will disclose any lobbying activities related to MDCGP.
6. Recipients of funding under this grant agree that all expenditures, including personnel services,
contractual services, and supplies, shall be in accordance with the standard procedures of their court.
The grantee's accounting system must maintain a separate fund or account to support expenditures.
Recipients of funding agree to maintain accounting records, following generally accepted accounting
principles for the expenditure of funds for purposes identified in the budget and any budget
amendments.
7. Only program activities and expenses in the approved grant budget and incurred during the fiscal year
are eligible for reimbursement.
8. State funds may not be used to replace (supplant) funds that have been appropriated for the same
purpose.
9. Recipients of funding will assure that the Michigan Supreme Court, SCAO, the local government audit
division of the Michigan Department of Treasury, the State Auditor General, or any of their duly sworn
authorized representatives shall have access to and the right to examine, audit, excerpt, copy, or
transcribe any pertinent financial transactions, accounting records, or other fiscal records related to this
grant. Such records shall be maintained for a period of five years after completion of the grant project
or until all SCAO audits are complete for the fiscal period, whichever is later. Recipients shall provide
quarterly reports on the funds expended by the drug treatment court in the form required by SCAO.
10. Applicants agree to collect and provide program and participant data in the form and manner required
by SCAO, and to participate in follow-up and evaluation activities.
11. Applicants receiving awards from SCAO agree to utilize the Drug Court Case Management
Information System (DCCMIS) to manage drug treatment court cases and report all data to SCAO
under MCL 600.1078.
12. Applicants who receive funding from MDCGP must plan, design, and operate their programs according
to one of the following models: Drug Treatment Courts: The Ten Key Components, The Ten Guiding
Principles of DWI Courts, Juvenile Drug Court: Strategies in Practice, Family Treatment Court Best
Practice Standards, or Family Dependency Drug Courts: Addressing Child Abuse and Neglect Cases
Using the Drug Court Model. Additionally, applicants agree to follow all applicable state laws, court
rules, and administrative orders pertaining to the operation of drug courts and adjudication of related

cases, and standards and required best practices per SCAO's Adult Drug Court Standards, Best
Practices, and Promising Practices.
13. Applicants agree to participate in SCAO required training including the Bureau of Justice Assistance's
Drug Court Planning Initiatives (DCPI). Courts that apply to DCPI training, but are not selected, must
agree to participate in Problem -Solving Court Fundamental training.
14. All recipients of funding under this grant program will ensure that violent offenders, as defined in MCL
600.1060(g), will be excluded from the drug court programs.
15. Applicants agree that if a federal 501(c)3 exists or is developed for drug treatment court purposes, or if
the MHC court develops a partnership with an existing 501(c)3, that no employee of the court will be
directly involved in the operations of the 501(c)3.
16. SCAO may suspend funding in whole or in part or terminate funding for the following reasons:
a. Failure to meet SCAO certification requirements.
b. Failure to comply with the requirements of the grant program, which includes the submission
of the required reports submitted within the time frames listed in the Reporting Requirements
section of this document.
c. Failure to make satisfactory progress toward the goals or strategies set forth in this application.
d. Failure to adhere to the requirements of the grant contract.
e. Proposing or implementing substantial plan changes to the extent that the application would
not have been selected for funding.
f. Filing a false statement in this application or other report or document
g. Other good cause shown.
17. The project director identified in the grant application is responsible for directing the implementation of
the drug treatment court grant project. The financial officer is the individual who is fiscally responsible
for this project, and is responsible for accountability for the grant funds. The authorizing official is the
individual authorized by the court to enter into this agreement. SCAO prohibits the same individual
from assignment in more than one capacity.

Data Exception Reports in DCCMIS must be corrected quarterly by the following dates (For planning
grants -only required if the program has active participants):

Progress Report is due on the following date:
• October 30 (Not required for planning grants)
DCCMIS User Audit Report is due on the following date (For planning grants -only required if the
program has active participants):
