ROLL CALL PRESENT: Mayor Scripture, Mayor ProTem Samson, Councilmember Moffitt, Councilmember Georges, Councilmember Shepard STAFF PRESENT: Interim City Manager/Police Chief Scott Sarvello, City Attorney Renis Nushaj, Clerk August Gitschlag, Parks & Rec Director Gina Boyd, DDA Director/ED Director Joan Horton, Finance Director Kelly Rau PUBLIC COMMENT - Items appearing on the agenda AGENDA APPROVAL Motion by Scripture, Samson seconds to amend the agenda to remove Consent Agenda Item C. Renshaw rental rates approved for the fourteen (14) single bedroom units at $470.00 per month and the single efficiency unit at $440.00 per month to New Business Item k. Ayes: Georges, Samson, Scripture, Shepard, Moffitt Motions passes Council again expressed a need for a comprehensive policy as to who and how one qualifies to live in the Renshaw apartments. CONSENT AGENDA A. Minutes of the Special City Council meeting held on Friday, August 13, 2021, as presented. B. Minutes of the Regular City Council meeting held on August 17, 2021, as presented. C. Renshaw rental rates approved for the fourteen (14) single bedroom units at $470.00 per month and the single efficiency unit at $440.00 per month. D. Department Reports for the month of August 2021. E. List of Bills as presented in the amount of $842,223.62. Motion by Shepard, Georges seconds to approve the Consent Agenda Ayes: Georges, Samson, Scripture, Shepard, Moffitt Nays: Motions passes PRESENTATIONS / PROCLAMATIONS A. Presentation by Gina Boyd, Director of Recreation and Senior Services. PUBLIC HEARINGS none NEW BUSINESS A. Consideration of approving the PUD developing agreement between the City of Clawson and Trowbridge Land Holdings LLC. Motion CM-198-21 by Samson, Scripture seconds to approve the PUD developing agreement between the City of Clawson and Trowbridge Land Holdings LLC. Ayes: Samson, Scripture Nays: Moffitt Abstain: Georges, Shepard Motions passes Because Georges and Shepard served on the Planning Commission during the initial phases of the PUD plan, they are not eligible to vote on the matter while sitting on City Council. B. Consideration of the introduction and 1st reading of an Ordinance to amend the City of Clawson Code of Ordinances Chapter 34, Article X, Division 1, Section 34-481, Division 14, Section 34-893, And Division 21, Section 34-1104 to regulate on-premises smoking establishments. Motion CM-199-21 by Scripture, Samson seconds to move the consideration of amending the City of Clawson Code of Ordinances Chapter 34, Article X, Division 1, Section 34-481, Division 14, Section 34- 893, And Division 21, Section 34-1104 to regulate on-premises smoking establishments, with an amended age of 21 to a public hearing 7pm on September 21 st, 2021. AMENDED to make the legal age limit raised from 18 to 21. (agreed upon friendly amendment, after discussion with Police Chief and City Attorney) Ayes: Georges, Samson, Scripture, Shepard, Moffitt Motions passes C. Consideration of the introduction and 1st reading of an Ordinance to amend the City of Clawson Code of Ordinances Chapter 34, Article X, Division 19, Section 34-1058 to regulate building materials outside the CC and CMD districts. Motion CM-200-21 by Scripture, Shepard seconds to move the consideration of amending amend the City of Clawson Code of Ordinances Chapter 34, Article X, Division 19, Section 34-1058 to regulate building materials outside the CC and CMD districts. Ayes: Georges, Samson, Scripture, Shepard, Moffitt Motions passes Planning Team explained the use of different materials on facades, and how some specific to the ordinance are not the ideal street level surface for buildings. D. Consideration of the request for a joint meeting of City Council and Planning Commission on September 27th, 2021 to discuss the Capital Improvement Plan Motion CM-201-21 by Scripture, Shepard seconds to call for a Special Joint Meeting of the Clawson City Council and Planning Commission at 6:30 pm September 27th Ayes: Georges, Samson, Scripture, Shepard, Moffitt Motions passes E. Consideration of approving the application of a Redevelopment Liquor License for Chuck Tacoma LLC for 236 S. Main St. Motion CM-202-21 by Shepard, Georges seconds to call for a Special Joint Meeting of the Clawson City Council and Planning Commission at 6:30 pm September 27 th Ayes: Georges, Scripture, Shepard, Moffitt Abstain: Samson Motions passes Redevelopment liquor licenses are non-transferrable licenses that upon local approval can be issued to a local business in a redevelopment area (in this case our DDA) when an investment of $75,000 or more is made in a property. Council asked questions about the future menu. F. Consideration of approving the drainage and surface restorations for the alley located on E. 14 Mile Rd. Motion CM-203-21 by Samson, Shepard seconds to approve the drainage and surface restoration Ayes: Georges, Scripture, Shepard Nays: Moffitt Motions passes G. Consideration of approving the resolution to contract the Oakland County Elections Division to conduct all absentee ballot counting for the City. The City Clerk explained that absentee ballots will now be tabulated under the supervision of the Oakland County Elections Division on their high speed scanners, joining many other Oakland County Communities. Ballots delivered on Election Day will be tabulated at the precincts. Motion CM-204-21 by Samson, Shepard seconds to approve the drainage and surface restoration Ayes: Georges, Samson, Scripture, Shepard, Moffitt Motions passes H. Consideration of renewing the lease with Spanish for Toddlers, LLC and the City of Clawson to allow the tenant to use four rooms more fully described as Room 1, Room 2, Room 3, Room 8, the small courtyard, and a small office located at the Hunter Community Center for a term to expire on August 31, 2022 at a rate of $2,500 per month. Motion CM-205-21 by Scripture, Samson seconds to approve renewing the lease with Spanish for Toddlers, LLC and the City of Clawson and allow the tenant to use four rooms, the small courtyard, and a small office located at the Hunter Community Center for a term to expire on August 31, 2022 at a rate of $2,500 per month. Motion CM-206-21 by Scripture, Shepard seconds to forgo the RFP process and select a firm from the three that submitted proposals to City Council in 2019. Search selection After an initial motion to secure the MML for the search, the conversation moved to GovHR, and a discussion of the pros and cons of each firm was discussed. The initial motion by Samson was amended to GovHR. Motion CM-207-21 by Samson, Shepard seconds to select Gov HR for City Manager Search Services Ayes: Georges, Scripture, Shepard Nays: Moffitt Motions passes K. Motion CM-208-21 by Scripture, Samson seconds to create a policy for management of the Renshaw Apartment Complex including standards for application. CLOSED SESSION Motion CM-213-21 to enter into closed session for: A. Pursuant to Section 8 (h) of the OMA to consider materials exempt from disclosure under section 13(1) (g) of the Freedom of Information Act. B. Consideration for going into closed session pursuant to Section 8 of the OMA paragraph (f) To review and consider the contents of an application for employment or appointment to a public office if the candidate requests that the application remain confidential. Motion CM-213-21 by Scripture, Moffitt Seconds to enter into closed session for items A. & B. at 9:45pm Ayes: Georges, Samson, Scripture, Shepard, Moffitt Motions passes Motion CM-214-21 to exit closed session in regards to items A. & B. at 10:36pm Ayes: Georges, Samson, Scripture, Shepard, Moffitt Motions passes COUNCIL SESSION CALLED BACK TO ORDER AT 10:42pm ROLL CALL: Mayor Scripture, Mayor ProTem Samson, Councilmember Moffitt, Councilmember Georges, Councilmember Shepard The following motions were made after closed session discussion, and the Sarvello employment agreement was debated in open session as well. Motion CM-215-21 by Scripture, Moffitt seconds to direct the City Attorney negotiate an agreement with former City Manager Michael Smith which reflects the spirit of the discussions which took place in closed session. Ayes: Georges, Samson, Scripture, Shepard, Moffitt Motions passes Motion CM-216-21 by Scripture, Samson seconds to approve an updated addendum to Scott Sarvello’s contract to include an additional $750 a week in compensation for additional duties.
