IN RE: Circuit Court - Contract Adult Treatment Court Interlocai Agreement with Oakland County
Health Network (OCHN)
Chairperson and Members of the Board:
WIIEREAS the Sixth Tudicial Circuit Court's Adult Treatment Court has been increasingly receiving referrals
for individuals having substance abuse problems: and
WHEREAS individuals in this special high -risk population have significant rates of recidivism and are likely to
be incarcerated if left untreated; and
WHEREAS the Adult Treatment Court (ATC) was developed as an alternative to incarceration for individuals
who suffer from mental illness and substance abuse: and
WHEREAS a partnership with Oakland Community Health Network (OCHN) and the SixthJudicial Circuit
Court has been established to collaborate in providing Peer Recovery Support Services 1 PRSS); and
WHEREAS the role of a PRSS provider is to support individuals working on recovery both in the treatment
center and in their natural enviromuent: and
WHEREAS pursuant to the Urban Cooperation Act, MCL 124.501 et seq., the County and the OCHN would

WHEREAS Miscellaneous Resolution (MR) #18437 approved Amendment #1 to provide these services for the
period of October 1, 2018 through September 30.2020:and
WHEREAS M.R. #20358 approved Amendment #2 to provide these services for the period of October 1, 2020
through September 30. 2021; and
WHEREAS the funding for these services was included in the FY 2019 Michigan Drug Court Grant Program
(Adult Treatment Court) agreement (MR #18364), FY 2020 Michigan Drug Court Grant Program (Adult
Treatment Court) agreement (MR #19406), and FY 2021 Michigan Drug Court Grant Program (Adult
Treatment Court) agreement (MR #20644); and
3VHEREAS the agreement for Amendment #3 is effective from October 1. 2020 through September 30, 2022
unless terminated according to provisions in the agreement: and
WHEREAS OCHN will be reimbursed a not -to -exceed amount of $21,100 for FY 2021 and the not -to -exceed
amount of $10,100 for FY 2022: and
WHEREAS FY 2021 funding for the peer recovery support services is included in the FY 2021 Michigan Drug
Court Grant Program (Adult Treatment Court) (MR #20644): and
WHEREAS once awarded, funding for the peer recovery support services will be included FY 2022 Michigan
Drug Court Grant Program (Adult Treatment Court) agreements, administered by the State Court
Administrative Office ISCAO1. Ianoroved via separate resolution): and
WHEREAS the agreement amendment has been presented to the OCHN for their approval; and
WHEREAS the Optional Unified Form of Government Act provision MCL 45.556(p) gives the County Board
of Commissioners the statutory authority to "Enter into agreements with other governmental or quasi -
governmental entities for the performance of services jointly".
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Conmussioners approves the
attached Interlocal Agreement Amendment #3 between Oakland County Circuit Court and Oakland Community
Health Network for the non -to -exceed amount of $21,100 for Fiscal Year 2021 and not to exceed amount of
S10.100 for Fiscal Year 2022 to OCHN to continue to provide peer recovery support setwices for FY 2021 and
FY 2022.
BE IT FURTHER RESOLVED that the Board Chairperson is authorized to execute the Agreement
Amendment #3 oil behalf of the County of Oakland. and hereby accepts and binds the County of Oakland to the
terms and conditions of this Agreement Amendment lt3.
BE IT FURTHER RESOLVED a budget amendment is not required at this time as funding for these services
in FY 2021 was included and utilized with the Circuit Court's FY 2021 Michigan Dnug Court Program (Adult
Treatment Court) (MR #20644). funding for FY 2022 will be included in the FY 2022 Michigan Drug Court
Grant Program (Adult Treatment Court) agreement via a separate resolution.
BE IT FURTHER RESOLED acceptance of this agreement does not obligate the County to any future
commitment and continuation of this program is contingent upon continued future levels of grant funding.

AMENDMENT #3
The Parties, COUNTY OF OAKLAND ("County"), and OAKLAND COUNTY
COMMUNITY HEALTH NETWORK ("OCHN"), agree and acknowledge that the purpose of
this Amendment is to modify as provided herein and otherwise continue the present contractual
relationship between the Parties as described in their current Adult Treatment Court Program
Contract dated April 14, 2018, as amended ("Contract').
This Amendment 3 shall take effect on October 1, 2021, and shall continue through September 30,
2022, unless otherwise terminated by any of the Parties pursuant to section 12 of the Contract.
In consideration of the mutual promises, representations, assurances, agreements and provisions
in the Contract and this Amendment, the adequacy of which is hereby acknowledged by the Parties,
the Parties agree to amend the Contract as follows:
1. Section 3.5 of the Contract shall be amended in part to include the following:
For fiscal years 2021 and 2022, the County agrees to pay a not to exceed amount
of $21,100 to OCHN for providing, through the designated Service Provider, the
services of a Peer Recovery Coach during fiscal year 2021, which runs from
October 1, 2020, through September 30, 2021 (FY2021), and a not to exceed
amount of $10300 for fiscal year 2022, which runs from October 1, 2021, through
September 30, 2022 (FY2022). In the event the Supreme Court of Michigan fully
funds the position at $21,100 at some point during FY2022, the County agrees to
increase the not to exceed amount to $21,100 for the FY2022.
2. Section 3.6 of the Contract shall be amended to the following:
To ensure timely payment, OCHN will invoice the County monthly for the services
provided by the Peer Recovery Coach. OCHN will calculate this amount based on
the employment costs of the Peer Recovery Coach not to exceed $21,100 for

FY2021 and not to exceed $10,100 for FY2022, unless the Supreme Court of

point, OCHN will calculate the monthly amount based on the not to exceed amount
to $21,100 for the FY2022.
3. Sec. 3.12 shall be added to state the following:
If any part of this Agreement is supported or paid for with any State, federal, or
other third -parry funds granted to the County, then OCHN and its contracted
Service Providers shall comply with all applicable grant requirements. The County
will provide OCHN with a copy of any applicable grant requirements.
4. Sec. 12 shall be amended to the following:
Except as otherwise provided herein, either Party may terminate and/or cancel this
Agreement upon thirty (30) days written notice to the other Parry. The effective
date of termination and/or cancellation shall be clearly stated in the written notice.
Termination of this Agreement does not release any Parry from any obligations that
Party has pursuant to any law.
5. Exhibit I: Financial and Reporting Obligations: For fiscal year 2021 (FY2021), the not to
exceed amount is $21,100; and for fiscal year 2022 (FY2022), the not to exceed amount is
$10,100 , unless the Supreme Court of Michigan fully funds the position for FY 2022, then,
in such case, the not to exceed amount shall increase to $21,100 for FY2022.
For and in consideration of the mutual assurances, promises, acknowledgments, warrants,
representations and agreements set forth in the Contract and this Amendment, and for other good
and valuable consideration, the receipt and adequacy of which is hereby acknowledge, the
undersigned hereby execute this Amendment 3 on behalf of the Parties, and by doing so legally
obligate and bind the parties to the terms and conditions of this Amendment 3.
Except as expressly amended by this Amendment, all of the terms of the Contract shall remain in
full force and effect.
