As required by Urban Cooperation Act 7 of 1967 - MCL 124.510(4), a copy of the signed agreement and amendment with the County of Oakland and the Charter Township of Oakland, and the authorizing Board of Commissioners Resolution are enclosed for filing by your office. PLEDGE OF ALLEGIANCE AND ROLL CALL Supervisor Abbate led the reciting of The Pledge of Allegiance. Clerk Buxar called the Roll. Members Present: Dominic Abbate, Supervisor Robin Buxar, Clerk John Giannangeli, Treasurer Jack Elder, Trustee Dave Mabry, Trustee Lana Mangiapane, Trustee Andy Zale, Trustee Absent: None Also Present: Adam Kline, Township Manager Dan Kelly, Township Attorney Roxanne Thatcher, Deputy Clerk A quorum was present. ANNOUNCEMENTS AND PROCLAMATIONS Supervisor Abbate and Mindy Milos-Dale had a tribute to Alice Tomboulian, who recently passed away. She was a very active person in the Township for such a long time and she will be greatly missed. There was also a certificate of appreciation awarded to District Chief Chuck Beach. He has been with the Oakland Township Fire Department for 26 years and is retiring at the end of 2021. He will be greatly missed. AMENDMENTS/APPROVAL OF THE AGENDA Trustee Zale added under Pending Business – Item #11 Update Gallagher Road Easement Agreement and Treasurer Giannangeli added under Pending Business - Item #12 Approval for a Point and Pay contract. Approval of Bills a) November 11, 2021 in the amount of $22,858.28 b) November 23, 2021 in the amount of $230,390.48 c) December 1, 2021 in the amount of $5,614.83 d) December 8, 2021 in the amount of $120,605.62 e) December 14, 2021 in the amount of $469,977.92 f) Payroll via ACH 2. Approval of Minutes a) November 9, 2021 3. Vistas of Oakland Completion Agreement 4. Resolution to Participate in Opioid Settlement MOTION by Buxar, supported by Mabry to approve the Consent Agenda as read. FOIA Appeal 2146 Mr. Yager submitted a FOIA Appeal for #2146 that was fulfilled on November 22, 2021. MOTION by Buxar, supported by Mabry to deny the Appeal and direct the Township Attorney to provide a written response as required under the Michigan Freedom of Information Act (MCL 15.240, et seq). Community Development Block Grant (CDBG) Approval This is a program we participate in every year. We are required to adhere to the allocation restrictions as outlined in the agreement. CHARTER TOWNSHIP OF OAKLAND BOARD OF TRUSTEES DECEMBER 14, 2021 – REGULAR MEETING PAGE 3 of 7 MOTION by Buxar, supported by Mabry to approve allocation of PY 2022 Community Development Block Grant funds in the approximate amount of $23,348 as follows and authorize the Supervisor to sign the application and the conflict-of-interest certification, and submit the documents to Oakland County: Public Service (Transportation Services): $3,500, Public Services (Battered and Abused Spouses): $3,500, Mobile Home Minor Repair: $16,348 for a total of $23,348. Roll Call Vote: Ayes: Abbate, Buxar, Elder, Giannangeli, Mabry, Mangiapane, Zale Nays: None Absent: None Motion carried 7/0. 3. 2022 Preliminary Budget This was just submitted to the Board for their review. Manager Kline also suggested a few dates for scheduling the budget workshops in January and February. 4. Paint Creek Junction Grant Agreement Mindy Milos-Dale, PRC Director, explained this is a grant from the Michigan Natural Resources Trust Fund and the project period for the grant terminated on November 30, 2021. They have submitted an extension request. The project is getting very close to being completed, but they will be running into delays now with winter approaching. MOTION Buxar, supported by Mabry to approve resolution regarding amendment #2 to the MNRTF Agreement for Paint Creek Junction Northern Trailhead Project TF18-0098 to extend the time period for the project completion to May 31, 2022 and submit the request for final reimbursement within 90 days of the project completion and to comply with all other provisions of the agreement which shall be in full force and effect and authorize the Clerk to sign. Lost Lake Nature Park Expansion Acquisition This is to move forward with the closing of the Township’s purchase of the Lost Lake Nature Park Expansion Acquisition and to obtain the grant proceeds that have been applied for. MOTION by Buxar, seconded by Elder to recuse Trustee Zale due to his conflict of interest on this item. MOTION by Buxar, seconded by Mabry to approve the resolution to purchase the properties commonly known as Parcel # 10-09100024 1404 Lake George Road, Oakland MI 48363 and Parcel #10-04376011 and authorize the Township Supervisor and the Township Clerk to execute all documents necessary to close on the subject properties and obtain partial reimbursement for the purchase pursuant to the Township’s approved MNRTF Grant. Signage for Paint Creek Junction and Marsh View Park The Board saw a presentation from Brian Blust, PRC Chair. MOTION by Giannangeli, seconded by Buxar to approve the alternate signage for Paint Creek Junction and Marsh View Park as presented to the Board which includes the words “Oakland Township” on the bottom. Furthermore, that these signs be used as a template for future Township signs where appropriate. Cider Mill Concessionaire Contract The Board heard a summary from Dan Kelly, Township Attorney. MOTION by Giannangeli seconded by Mangiapane to approve the concession agreement as provided to the Board with the revision of paragraph 4) # 17 to indicate that the committed hours would be from Labor Day until Halloween 9:00 AM to 7:00 PM, 7 days a week. The remaining months of the year would be from 11:00 AM to 7:00 PM, Monday through Saturday and 12:00 PM to 6:00 PM on Sundays and that the concessionaire would make a good faith effort to open the first weekend of April 2022 from 9:00 AM to 7:00 PM, 7 days a week. MOTION by Buxar, seconded by Mabry to authorize approval of the 2022 No Haz agreement and authorize the Township Manager to sign. MOTION by Buxar, seconded by Mabry to approve the 2022 No Haz Resolution and authorize the Township Manager to sign. MOTION by Buxar, seconded by Mangiapane to appoint Assistant Manager Jamie Moore as the Oakland Township Municipal Agent to the No Haz Board. Request to Purchase Building Security System MOTION by Buxar, seconded by Elder to table this item until the next Board meeting on January 11, 2022 and request the Township Manager to provide all the comparable information be compiled together in a chart. CHARTER TOWNSHIP OF OAKLAND BOARD OF TRUSTEES DECEMBER 14, 2021 – REGULAR MEETING PAGE 6 of 7 10. 2022-2024 Law Enforcement Contract After an extensive negotiation process the rates will only increase an average of 1.82% for 2022, an average of 2.70% for 2023, and an average of 2.78% for 2024. MOTION by Buxar, seconded by Mabry to approve the resolution agreement for the Oakland County Sheriff’s office 2022-2024 Law Enforcement Services Agreement with the Charter Township of Oakland and authorize the Township Supervisor and Clerk to execute the same. Update Gallagher Road Easement Agreement MOTION by Zale, seconded by Buxar to approve the proposed changes to the permanent safety path easement and temporary construction easement to be granted to the Township by Janice and Thomas Capaldi. Approval for a Point & Pay contract This contract is to set-up a new software system to process credit card payments on our website for the Building Department for building permits. MOTION by Giannangeli, seconded by Mabry to approve the contract for Point and Pay for credit card processing and the associated fees for set-up and maintenance. TOWNSHIP MANAGER’S REPORT The Manager’s Report was in the packet. Mr. Kline wanted to publicly thank all the first responders that rushed to Oxford High School the day of the shooting. A special thanks to CHARTER TOWNSHIP OF OAKLAND BOARD OF TRUSTEES DECEMBER 14, 2021 – REGULAR MEETING PAGE 7 of 7 our Oakland Township Sheriff Deputies and our Oakland Township Fire Department personnel that responded. Lieutenant Dooley addressed the Board regarding the Oxford High School shooting. BOARD REPORTS & CORRESPONDENCE Supervisor Abbate – wanted to wish the Board, staff and all employees a very Merry Christmas. He also thanked the Board for all their help in making the meetings so productive. Clerk Buxar – commented about the Oxford HS shooting and how thankful we are for our fist responders. Our thoughts and prayers are with them and the community. She also wished everyone a Merry Christmas and a Happy New Year. Treasurer Giannangeli – spoke about the Oxford HS shooting and that our thoughts and prayers go out to them. He thanked all the first responders. He also wished everyone a very Merry Christmas and a Happy New Year. Trustee Elder – wanted to extend his thoughts and prayers to everyone affected by the Oxford HS shooting and extend a thank you to all the first responders. He also wished everyone a Blessed and Happy Holidays. Trustee Mabry – commented about the tragedy at Oxford HS. We are thankful to the first responders and our prayers and thoughts are with everyone touched by this. He also pointed out that gun locks are available for free at all police stations and reminded everyone to be a responsible gun owner. Trustee Mangiapane – wanted to wish everyone a Merry Christmas and a Happy New Year. She also commented how great our first responders are. Trustee Zale – wished everyone a Happy Holidays, a Merry Christmas and a Happy New Year and wished everyone the best in 2022.
