HomeMy WebLinkAboutResolutions - 2022.04.14 - 35447BOARD OF COMMISSIONERS April 14, 2022 MISCELLANEOUS RESOLUTION #22-120 Sponsored By: Kristen Nelson Human Resources - Resolution Approving a Second Annual Leave Buy Back Option under Merit Rule 23 Chairperson and Members of the Board: WHEREAS Miscellaneous Resolution #16311 authorized a once per year buy back a minimum of 20 hours to a maximum of 40 hours annual leave time in one -hour increments, until a minimum of 40 hours remains in their annual leave bank, for full-time employees who have a minimum of 60 hours in their annual leave bank; and WHEREAS Miscellaneous Resolution 420103 revised Merit Rule 23 to allow the Human Resources Department to administer the program once per calendar year, on a flexible timeline; and WHEREAS increased workloads related to the COVID-19 pandemic, and employee concern over travel during the pandemic, has continued to result in less use of annual leave and employees continue to reach maximum annual leave time accumulation; and WHEREAS it is proposed by the Human Resources Department to provide two (2) opportunities for employees to cash out annual leave time for calendar year 2022, with proposed pay out dates of June and December of 2022; and WHEREAS the anticipated impact of the additional Annual Leave Buy Back option in calendar year 2022 is $660,000 and no additional funding is required in the individual departmental budgets as the annual leave buy back hours will be paid from the Fringe Benefit Fund. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves two (2) opportunities in calendar year 2022 for the buyback of annual leave time for full-time employees following the adopted parameters within Merit Rule 23. BE IT FURTHER RESOLVED that the payment received as a result of annual leave cash out shall not be included in the final average compensation (FAC) for employees on the defined benefit plan and no additional contributions will be made to an employee's defined contribution plan by the County or the employee as a result of the payment. BE IT FURTHER RESOLVED all annual leave time cashed out is subject to all payroll income tax withholding requirements as well as any garnishment, wage assignment, levy, income withholding order requirements, employee benefit contributions and/or arrearages. BE IT FURTHER RESOLVED that the FY 2023 budget shall be amended as reflected in the attached Schedule A - Budget Amendment. Lynch, Deputy County Executive RE: Additional Annual Leave Buy Back Option DATE: March 16, 2022 Employees who have over 60 hours of Annual Leave have the option of cashing out 40 hours of their banked time. This is typically done once a year in the month of August. There have been multiple requests to allow for another opportunity to purchase time. Those that hit the maximum amount of carry over lose any additional hours they accrue until their Paid Time Off (PTO) Leave bank is below that threshold. The only way they can reduce the number of hours is by taking days off, or participating in the Annual Leave Buy Back. COVID continued to have a dramatic impact on our workforce, in particular the months between October 2021 through the end of February 2022. The amount of absences from employees being sick, quarantined, or caring for sick family members at peak times were at an approximate 30% abesentism rate. To ensure that services were not impacted, many employees were unable to take time off, and requests to use PTO and Personal Leave were denied. Even after relief from employee shortages, employees needed to work more to catch up on productivy. Another factor faciliting this request is that those employees who start losing time then try to stop the loss by asking for days off that are not planned, causing a further hardship for supervisors trying to keep shifts filled and services moving forward. Requests for time off have to be considered and approved carefully. It's a balance of wanting to ensure we are fully staffed, but trying to support employees who are losing their banked hours. A portion of PTO held by employees is earmarked as liabilities within the fringe fund and we hold those liabilities in that fund until they are paid in full. Providing an additional Annual Leave Buy Back opportunity will have no impact on departmental budgets and will be taken from the fringe fund. On average, approximately $1,436.87 in Annual Leave time is requested during the once a year allotment. We would speculate that we could see the same for the second option. Given these circumstances, I am respectfully asking that eligible County employees be offered two (2) buy back opportunities this year, in June and December.
