Board of Commissioners -Resolution Support for Human Trafficking House Bills 4091 -4113 and 4214 -
4215
Chairperson and Membersof the Board:
-WHEREAS in February of 2021,a bipartisan package of new legislation,House Bills 4091-4113 and 4114-
4215,were introduced by state lawmakers on humantrafficking -a crime against humanity that violates the
most basic human rights,andvictims suffer a horrible injustice;and
WHEREAS the human traffickingbills,recommended by the Michigan Human Trafficking Commission,are
aimed to strengthen tools to hold traffickers accountable,to expand protections for victims of trafficking,tofundamentallyalterthecriminaljusticesystem’s approach to commercial sexual activity,otherwise known as
prostitution,and expandtraining standardsto various licensed professionals;and
WHEREAS to hold traffickers accountable,the proposed legislation will amend expert testimony for humantraffickingcases,expand statutory immunity for compelled testimony to the human trafficking chapter,and to
include humantrafficking in propensity evidence expansion;and
WHEREAS recommendationsin the proposed legislation include expanding protections for the victims oftraffickingthatincludeexpandedminorrebuttablepresumption,provisions for the expansion of adult andjuvenilehumantraffickingvictimexpungementinHB4091andHB4093,and HB 4092 provides an
affirmative defense for victims of trafficking;and
WHEREAS recognizing the inescapable overlap betweensextrafficking andprostitution the proposedlegislationincludesoveradozenproposalsthatfundamentallyalterthecriminaljusticesystem’s approach toprostitutionbyreplacingtheterm“prostitution”throughout Michigan law with the defined term:commercialsexualactivityandtodefineinthehumantraffickingchapteras“a sex act provided in exchange for somethingofvalue”;and
WHEREAS in addition,numerous bills relate to the expansion of mandated training on human trafficking forvariouslicensedprofessionalsthatincludecommercialdrivers,educators and educational-based counselors,andcosmetologists;and
WHEREAS the Michigan Attorney General stated that by adopting “these policies in our laws to protectsurvivorsandhelpmeettheirintenseneeds,we can break the cycle of silence demonstrating to traffickers theirtacticswillnolongerprovesuccessfulandmayencouragevictimstosafetycomeforwardandreporttraffickers,which is the strongest evidenceto hold traffickers responsible”;and
WHEREAS Oakland County remains unrelenting in its efforts to end the exploitation and injustice suffered byvictimsandthroughacollaborativeeffortofferservicestosupportthevictimsofhumantrafficking.
NOW THEREFORE BE IT RESOLVED thatthe Oakland County Board of Commissioners hereby supports
House Bills 4091 -4113 and 4114 -4215 and urges the prioritization of rights for humantrafficking victims and
to strengthen the means for prosecutors to hold traffickers and exploiters accountable.
BE IT FURTHER RESOLVED that the Oakland County Clerk/Register of Deeds is requested to forward
copies of the adopted resolution to the House Judiciary Committee,the Michigan Human Trafficking
Commission,the State House Speaker and Minority leader,the membersof the Oakland County delegation totheMichiganLegislature,Sheriff Michael Bouchard,and the Board of Commissioner's legislative lobbyist.
