Motion carried on a voice vote. DRAIN COMMISSIONER – 2001 LAKE LEVEL ASSESSMENTS FOR OPERATION AND MAINTENANCE The Oakland County Drain Commissioner operates and maintains 35 level control devices/structures and 6 lake augmentation pumps that regulate the legally established w ater level of 53 lakes located in Oakland County. The Drain Commissioner incurs costs for such operation and maintenance that are recoverable via assessments against the various benefiting properties and government entities comprising the assessment rolls of the respective Lake Level Districts. For the year 2001 the Drain Commissioner proposes to assess 28 separate Lake Level Districts for the total aggregate amount of $479,036.07, for operation, maintenance and repair purposes. Garfield moved approval of the attached suggested resolution. Supported by Webster. Motion carried on unanimous roll call vote with Dingeldey, Brian and Gregory absent. DRAIN COMMISSIONER – 2001 CHAPTER 4 DRAIN MAINTENANCE ASSESSMENT RESOLUTION The Oakland County Drain Commissioner operates and maintains a number of open ditch or enclosed drains at various locations throughout Oakland County. The Drain Commissioner incurs costs for such operation and maintenance that are recoverable via assessments against the various benefi ting properties and government entities comprising the assessment rolls of the respective Drainage Districts. For the year 2001 the Drain Commissioner proposes to assess 25 Drainage Districts in the amount of $75,353.56 for the maintenance, operation, cl ean out and repair of 25 drains, all in accordance with the said $2,500.00 per mile of drain per year limitation. Garfield moved approval of the attached suggested resolution. Supported by Webster. Motion carried on unanimous roll call vote with Brian and Gregory absent. DRAIN COMMISSIONER – 2001 CHAPTER 18 DRAIN MAINTENANCE ASSESSMENT RESOLUTION The Oakland County Drain Commissioner operates and maintains a number of open ditch and/or enclosed pipe drains at various locations in Oakland and West Bloo mfield Townships. The Drain Commissioner incurs costs for the operation and maintenance of these Drains that are recoverable via assessments against the various benefiting properties and government entities comprising the assessment rolls of the respective Drainage Districts. For the year 2001 the Drain Commissioner proposes to assess eight Drainage Districts in the total amount of $23,673.03 for the maintenance, operation, clean out and repair of eight drains in accordance with the said $2,500.00 per mil e of drain per year limitation. Obrecht moved approval of the attached suggested resolution. Supported by Dingeldey. Motion carried on unanimous roll call vote with Brian and Gregory absent. Planning & Building Committee Agenda Page 3 September 11, 2001 MR #01214 BOARD OF COMMISSIONERS – SUPPORT OF HOUSE BILL 5038 Legislation has been introduced in the Michigan House of Representatives to extend the success of Oakland County's process throughout the State of Michigan, enabling the review of zoning cas es and township master plan changes that involve an adjacent community. This Resolution supports that legislation. Webster moved to Report to the full Board with the recommendation MR #01214 be adopted in concurrence with the General Government Committee Report of September 10, 2001 amending the resolution. Further that the title be changed to read as follows: "Board of Commissioners – Support the Concept of Local Planning Coordination Patterned after that of Oakland County's" Supported by Obrecht. Motion carried on a roll call vote: Palmer, Webster, Obrecht, Garfield, Dingeldey – Yes Melton and Sever – No Brian and Gregory – Absent MR #01215 BOARD OF COMMISSIONERS – SUPPORT OF OPEN SPACE PRESERVATION LEGISLATION This legislation requires communities to include in their local zoning ordinances an option enabling developers to cluster residential development in 50% of the developable land area, leaving the remainder of the property in an undeveloped, natural state. Land in the undeveloped area would n ot include a golf course, but may include a recreational trail, picnic area or children's play area. Webster moved to Report to the full Board with the recommendation MR #01215 be adopted in concurrence with the General Government Committee Report of Sept ember 10, 2001 amending the resolution. Supported by Obrecht. Motion carried on unanimous roll call vote with Brian and Gregory absent. Commissioner Sever requested Representative Johnson send a copy of the proposed bills to the Planning and Building Committee when they are finalized.
