She passed out a folder with literature on facts about smoking. She said people are dying every day from second -hand smoke, and other counties have implemented the same types of policies. APPROVAL OF THE PREVIOUS MINUTES Long moved approval of the minutes of July 26, 2006, as printed. Supported by Wilson. Motion carried on a voice vote. AGENDA ITEMS 1. DEPARTMENT OF INFORMATION TECHNOLOGY – REQUEST TO EXTEND THE EMERGENCY TELEPHONE OPERATIONS SURCHARGE FOR CALENDAR YEAR 2007 In 1999, the Board of Commissioners adopted MR #99279, which authorized the various telephone companies throughout the County to levy a $.57 per wire line surcharge for emergency telephone operations. The wire line surcharge will cease on December 31, 2006. The enabling legislation has extended wire line and wireless surcharges for the 2007 calendar year and will be collected state-wide, distributed under an existing State formula (anticipated to be $1 million annually to help fund the operations of the Radio Communications Fund) and will be addressed as part of the permanent solution relating to the surcharge legislation. The extension of the surcharge is estimated at $.28 per telephone line, which includes $.19 per telephone line to cover operations and anticipated loss of lines (due to Voice over Internet Protocol (VOIP) plus another $.09 per telephone line (one-time charge) for the IP-based call taking equipment. The resolution authorizes the extension of the surcharge per telephone line for the period of January 1, 2007 through December 31, 2007 in the amount of $.28 per wire line to cover the cost of the operations and necessary provisions of the Radio Communications Fund. Wilson moved approval of the attached suggested resolution. Supported by Coulter. Motion carried on a roll call vote with Crawford absent. 2. DEPARTMENT OF INFORMATION TECHNOLOGY – 2005/2006 MASTER PLAN QUARTERLY STATUS EXECUTIVE SUMMARY The Master Plan Quarterly Status Executive Summary is an overview of the projects contained in the 2005/2006 Master Plan, and it is updated quarterly for the Board of Commissi oners’ review. The summary details actual hours worked and a project completion date. This particular summary shows 203 Enhancement and New Development projects on the 2005-2006 Master Plan across the 11 Leadership Groups. Of these projects, 84 are completed, 103 are in process and 16 have not been started. As of June 30, 2006, 127,596 hours of Information Technology labor have been expended on project-based work. Mr. Bertolini highlighted on a few points in the summary. In the past, Information Techn ology has always tried to keep their fixed labor at a minimum, and 60% to 80% is considered optimum. For the third quarter of 2005/2006 77% of IT’s labor force was spent supporting and maintaining the GENERAL GOVERNMENT COMMITTEE Page 3 August 15, 2006 County’s current systems (including Customer Support, Maintenance, Planned Maintenance and Upgrades, Team Management and non -project time. The remaining 23% of IT’s labor force was spent implementing systems requested by various County Divisions through the IT Leadership Group Process. Mr. Bertolini indicated that the Oakland County e-mail extensions will be changed from co.oakland.mi.us to oakgov.com effective August 19, 2006. The old one will be kept alive for one year to allow time for the transition to take place. There will be a tag in place for anyon e sending someone an e-mail within the County informing them of the new change and suggesting that they change their address books. Gregory moved to receive and file the 2005/2006 Master Plan Quarterly Status Executive Summary. Supported by Hatchett. Motion carried on a voice vote with Crawford absent. 3. MR #06157 – BOARD OF COMMISSIONERS – SUPPORT FOR RACKHAM GOLF COURSE AND PRESERVING HISTORIC GREEN SPACE Commissioner Zack stated that the Rackham Golf Course is located next to the D etroit Zoo property, and historically the Rackham family deeded this property to the City of Detroit in the early 1920s designating that the property remain as a recreational piece of property. The property is located in Huntington Woods. In June, Mayor Kwame Kilpatrick or his deputy mayor tried to do a deal to sell Rackham Golf Course to a developer without going out for bids, and the City of Huntington Woods has jurisdiction over the zoning of this property. Since that time the City of Huntington Woods is trying to purchase the property to keep it green. The property is 122 acres, and it has a tremendous historical significance. The resolution reflects that the Oakland County Board of Commissioners supports urban initiatives to enhance the quality of life in communities by offering recreational parkland and the community-based efforts to maintain Rackham Golf Course as a recreational green space that can be enjoyed by residents throughout the region for many generations to come. The resolution reflects that the Oakland County Board of Commissioners urges the City of Detroit and the City of Huntington Woods to collaborate in the true spirit of regional cooperation to seek a solution that affirms the intangible value that the Rackham Golf Court brings to the region. Hatchett moved to report to the full Board with the recommendation that the resolution be adopted. Supported by Wilson. Motion carried on a roll call vote with Crawford absent. 4. MR #06155 – BOARD OF COMMISSIONERS – OAKLAND COUNTY CLEAN INDOOR AIR REGULATION ELIMINATING SMOKING IN PUBLIC AND PRIVATE WORKSITES AND PUBLIC PLACES, NOT INCLUDING BARS AND RESTAURANTS IN OAKLAND COUNTY The resolution reflects that the Oakland County Board of Commissioners prohibits smoking in all private worksites and public places in Oakland County, with the exception of bars and food service establishments in Oakland County, following a public hearing. The resolution also approves the attached Oakland County Clean Indoor Air Regulation eliminating smoking in private worksites and public places effective 90 days from the date of adoption. Commissioner Melton expressed GENERAL GOVERNMENT COMMITTEE Page 4 August 15, 2006 concern about asking private clubs where you have to pay a membership fee to become non - smoking establishments. There would be a cost involv ed to purchase and post all the signs necessary to inform members of this change. He also was concerned about who would write the tickets, the City or the County? Who would collect the money, and where would the money go? Who would be called to write the tickets, the County Sheriff? Would the County have to hire health inspectors? He inquired about what the other counties that have implemented this policy are doing in regards to these issues. Ms. Webb, American Lung Association, stated that she had worked with the areas that have gone smoke-free. What happens is they end up using very little effort. What they do in regards to violations is the first time there’s a letter of warning ; the second offense there is a small fee; and then the third offense the fine goes up. The person that’s working with this is usually the person that works in the Health Department, under the Tobacco Division. She said that usually when laws are passed, people usually submit to those laws. They usually apply them. She said that if this resolution passes, things would proceed rather quickly. Other communities have stipulated that the non-smoking order would be completed within 90 days or 120 days. Information goes out in the communities, and the Health Department in the county helps them get that information out. As far as signage, the American Lung Association has stockpiles of signs, as well as the American Cancer Society. She suggested that tickets and violations could be handled through the Health Department. She said that the Michigan Department of Health would help. She said that the American Lung Association has attorneys that are from Washtenaw County that have helped all of the counties that have gone smoke-free. Dr. Gordon, Director of Health and Human Se rvices, stated that the State of Michigan does nothing for enforcement. It would be up to the local communities to do it. It simply becomes a local issue under a local ordinance. He agreed that this is definitely a good idea for health reasons, but before he could render an opinion he would have to look at the information to determine if it could feasibly be implemented in Oakland County. Commissioner Kowall expressed her concerns about the fiscal ramifications of the mailings to businesses, decals at entrances, etc. Hatchett moved to postpone this item until the September 11 th General Government Committee meeting to allow Dr. Gordon and Corporation Counsel some time to review the documents that were presented today and give their opinions. MR #06156 – BOARD OF COMMISSIONERS – EXPANSION OF SMOKING BAN FOR ALL OAKLAND COUNTY GOVERNMENT BUILDINGS The resolution reflects that the Oakland County Board of Commissioners expands the Oakland County No Smoking Policy to provide that no smoking shall be permitted within (50) fifty feet of an exterior entrance to or exit from a county government building, room or facility. The resolution GENERAL GOVERNMENT COMMITTEE Page 5 August 15, 2006 requests that the County Executive implement, post and enforce the expanded no smoking policy upon adoption by the Oakland County Board of Commissioners. In addition, the resolution reflects that the Oakland County Board of Commissioners requests the Directors of Facilities Management and Human Resources, or their designees, to revise county and/or departmental policies, procedures and issuances to conform with this expanded no smoking policy. Commissioner Wilson moved to postpone consideration of this item in order to give County Administration time to review the resolution and render their opinion of this proposed expansion of the Oakland County No Smoking Policy. COMMUNICATIONS A. June 28, 2006 – Oakland County Library Board Minutes B. HAVEN – Safe Therapeutic Assault Response Team (START) 1st, 2nd & 3rd Quarterly Reports Commissioner Coulter brought to the committee’s attention that just in the last nine months 110 individuals have received medical examinations through the START program from various communities in Oakland County, and that it’s a wonderful program. Coulter moved to receive and file the Communications. Supported by Hatchett. Motion carried on a voice vote.
