David VanderVeen, Director Karl Randall, Manager CORPORATION COUNSEL Judy Cunningham, Corporation Counsel INFORMATION TECHNOLOGY Ed Poisson, Director GENERAL PUBLIC Bruce Fealk, Citizen BOARD OF COMMISSIONERS Helaine Zack, Commissioner, District #22 Sheryl Mitchell, Senior Analyst Pamela Worthington, Committee Coordinator PLEDGE OF ALLEGIANCE PUBLIC COMMENT Mr. Fealk handed out a copy of a letter that was written by Ruth Johnson, Oakland County Clerk/Register of Deeds regarding the Election Systems & Software M -100 voting machine tabulators. She indicated a concern with the integrity of these machines due to performance and design. The primary issue is dust and debris build -up on the sensors inside the M-100. Mr. Fealk indicated his concern and requested that the Board of Commissioners pass a resolution indicating that if ballots needed to be counted by hand due to this problem, Oakland County would pick up the cost. Supported by Jacobsen. Motion carried on a voice vote. AGENDA Jacobsen moved to accept the amended agenda, which added MR #08256, MR #08255 as Items #1 and #2, and the Board of Commissioners’ Appointment to the Library Board as Item #5. Supported by Greimel. Motion carried on a voice vote. AGENDA ITEMS 1. MR #08256 – BOARD OF COMMISSIONERS - SUPPORT FOR HOUSE BILL 6455 – AMENDMENTS TO THE MICHIGAN VEHICLE CODE TO ALLOW FOR REINSTATEMENT OF DRIVER’S LICENSE FOR THOSE WITH OUTSTANDING DRIVER RESPONSIBILITY FEES The resolution reflects that the Oakland County Board of Commissioners supports House Bill 6455, as passed by the House, and encourages its passage in the Michigan Senate. House Bill 6455 would amend the Michigan Vehicle Code to allow for the reinstatement of the driver’s license of a person whose license was denied, suspended or revoked solely due to a failure to pay driver responsibility fees by establishing a payment plan to pay said fees. However, if the driver failed to make timely payments, the person’s license would then be suspended. House Bill 6455 would allow the Secretary of State to authorize installment payments for any amount owed to be paid for up to 24 months. Kowall moved approval of the attached suggested resolution. MR #08255 – BOARD OF COMMISSIONERS – SUPPORT FOR SENATE BILL 1066 – AMENDMENTS TO THE MICHIGAN VEHICLE CODE TO ALLOW INDIVIDUALS CHARGED WITH CERTAIN DRIVING OFFENSES TO ATTEND A BASIC DRIVER IMPROVEMENT COURSE The resolution reflects that the Oakland County Board of Commissioners supports Senate Bill 1066, as passed by the Senate, and encourages its passage in the House. GENERAL GOVERNMENT COMMITTEE Page 3 November 10, 2008 Senate Bill 1066 would amend the Michigan Vehicle Code to allow individuals charged with certain driving offenses to attend a basic driver improvement course. Once the individual successfully completes this basic driver improvement course, the Secretary of State would neither enter the points corresponding to the individual’s driving violation nor make information concerning that violation available to any insurance company. There are certain conditions for individuals to be eligible for the basic driver improvement course. For instance, the violatio n cannot be a criminal offense or a violation in which 4 or more points may be assessed. This program has been tested in other states such as Ohio, and they have indicated positive results. Jacobsen moved approval of the attached suggested resolution . Supported by Nash. CENTRAL SERVICES DEPARTMENT/AVIATION AND TRANSPORTATION DIVISION – REPLACEMENT OF CONTRACTED SERVICES WITH PTNE POSITIONS The Aviation and Transportation Division currently contracts with New Hudson Aero, LLC for general helper/maintenance at the Oakland/Southwest Airport, and the contract is expiring on December 31, 2008. They are requesting approval to create four Proprietary Revenue-funded, part-time, non-eligible, 1,000 hour/year General Helper positions to perform the work that New Hudson Aero, LLC is currently performing at the Oakland Southwest Airport. The current contract amount for 2008 is $8,600 per month ($103,202 per year). The cost to create these four positions in 2009 would be $47,132, resulting in a potential savings of $56,070. Gregory moved approval of the attached suggested resolution. Supported by Nash. Motion carried unanimously on a roll call vote with Gingell, Hatchett, Potter and Clark absent. 4. COUNTY CLERK/REGISTER OF DEEDS – ELECTIONS DIVISION – AGREEMENT TO UTILIZE THE SERVICES OF THE OAKLAND COUNTY BOARD OF CANVASSERS BY THE CHARTER TOWNSHIP OF BLOOMFIELD In 1997, Miscellaneous Resolution #97232 was adopted by the Oakland County Board of Commissioners to authorize the establishment of a revised Board of Canvassers’ Service Fee of $25.00 per precinct to help defray the cost of election certification as provided by Public Act 116 of 1954, as amended. The Charter Township of Bloomfield is requesting to utilize the services of the Oakland County Board of Canvassers for five years. Oakland County Corporation Counsel drafted an agreement between Oakland County and the Charter Township of Bloomfield to utilize the services of the Oakland GENERAL GOVERNMENT COMMITTEE Page 4 November 10, 2008 County Board of Canvassers for the cost of $25.00 for each election precinct within the municipality. Potts moved approval of the attached suggested resolution. Supported by Kowall. Motion carried unanimously on a roll call vote with Gingell, Hatchett, Potter and Clark absent. 5. BOARD OF COMMISSIONERS – APPOINTMENT TO THE LIBRARY BOARD Jeff Potter’s term on the Library Board had expired on August 24, 2008, and he indicated his interest to be reappointed to the Library Board for an additional five-year term. Kowall moved to report to the full Board with the recommendation that Jeff Potter be reappointed to the Library Board for a five-year term ending August 24, 2013. Supported by Nash. Motion carried unanimously on a roll call vote with Gingell, Hatchett, Potter and Clark absent. 6. BOARD OF COMMISSIONERS – REVIEW APPLICATIONS FOR THE MICHIGAN DEPARTMENT OF HUMAN SERVICES AGENCY BOARD Mary Eddy’s term on the Michigan Department of Human Services Agency Board expired on October 31, 2008. She had indicated that she did not wish to be reappointed. Press releases were issued, and information was available on our website. We received ten applications for the general public position. Chairperson Long suggested that the commissioners take a few minutes to review the applications to determine which applicants the committee should interview at the December 1, 2008 meeting. RECESS AT 10:12 A.M. MEETING RESUMED AT 10:20 A.M. Jacobsen made a motion to interview Shirley Black, Douglas Brown, Marc Craig, Dr. Elen Granader, David Moffitt and Linnie Taylor at the December 1, 2008 General Government Committee meeting. OTHER BUSINESS/ADJOURNMENT Chairperson Long indicated that there was a copy of the Women’s Commission application attached that the commissioners could use for their representatives to complete for the new term. Commissioner Potts informed the commissioners that there is some pending legislation in the Senate regarding an attempt to change the authority of the Friend of the Court Citizen’s Advisory Committee from county boards of commissioners to the Chief Judge. He encouraged the commissioners to contact their legislators to reconsider removing the authority from the board of commissioners.
