McGillivray PUBLIC SERVICES COMMITTEE Page 2 May 12, 2009 SHERIFF’S OFFICE –PAINT CREEK TRAILWAYS CONTRACT FOR LAW ENFORCEMENT SERVICES FOR THE 2009 SEASON The Paint Creek Trailways Commission has requested the Sheriff to provide l aw enforcement patrol services and has propos ed a contract for Part time Non -Eligible Mounted Deputies for the 2009 season. The hourly rate for each mounted deputy is $16.57; hourly overtime rate is $24.85 for 2009. Taub moved approval of the attached suggested resol ution. Supported by McGillivray. Commissioner McGillivray pointed out the contract signature page indicates “Rock Blanchard, Chairperson, Oakland County Parks and Recreation Commission” and should be corrected to read, “Rock Blanchard, Chairperson, Paint Creek Trailways Commission. M r. Cunningham indicated it was indeed an error and will be corrected. Motion carried unanimously on a roll call vote with Potter and Runestad absent . Vice Chairperson Runestad assumed the Chair at 1:42 p.m. SHERIFF’S OFFICE – CONTRACT FOR LAW ENFORCEME NT SERVICES AT THE MICHIGAN RENAISSANCE FESTIVAL – 2009 SEASON The Michigan Renaissance Festival has requested the Sheriff to provide deputies for law enforcement services for the upcoming 2009 season . The Sheriff has agreed to supply deputies on an avai lability overtime hourly basis, the number of man -hours to be determined by the Sheriff’s Office. The hourly overtime rate for a Sergeant is $71.48 and $62.80 for a Deputy II. Middleton moved approval of the attached suggested res olution. Supported by Zack. Motion carried unanimously on a roll call vote . Chairperson Potter assumed the Chair at 1:47 p.m. MR #09109 COUNTY EXECUTIVE/ADMINISTRATION – TRANSFER OF EMERGENCY RESPONSE & PREPAREDNESS TO DEPARTMENT OF HEALTH AND HUMAN SERVICES Oakland County’s emergency management functions are mandated by the Michigan Emergency Management Act to provide for the coordination of all matters pertaining to emergency services, disaster preparedness, and recovery assistance within the County. The Emergency Respon se and Preparedness unit has several common activities involving areas within the Department of Health and Human Services and transferring the unit to the Department of Health and Human Services will lead to operational and organizational efficiencies. This resolution proposes to transfer the Emergency Response & Preparedness Unit and retitle it the Homeland Security Division under the Department of Health and Human Services. In addition the proposed transfer requests the transfer several positions and to retitle their classification. The current appointed position of Administrator – ERP will be upwardly reclassified to Manager -Homeland Security. The transfer of a function from one department to another requires a public hearing. Taub moved the Public S ervices Committee Report to the Board with the recommendation MR #09109 be adopted. Supported by Zack. PUBLIC SERVICES COMMITTEE Page 3 May 12, 2009 MR #09109 COUNTY EXECUTIVE/ADMINISTRATION – TRANSFER OF EMERGENCY RESPONSE & PREPAREDNESS TO DEPARTMENT OF HEALTH AND HUMAN SERVICES (Continued) Middleton moved to amend MR #09109 by adding a fourth and fifth BE IT FURTHER paragraph as follows: “BE IT FURTHER RESOLVED that the Home land Security Division shall report to the General Government Committee. BE IT FURTHER RESOLVED that the 2009 Board Rules, Sections XI.B and Sections XI.E. will be amended to strike references to “Emergency Response & Preparedness” and to reflect that the Home Land Security Division will report to the General Government Committee.” Supported by Zack. Motion to amend carried on a voice vote with Burns dissenting. Main motion as amended carried unanimously on a roll call vote . INFORMATIONAL ITEMS Middleton moved to Receive & File Items B, C, D, E and G B. Sheriff – 2009 State Criminal Alien Assistance Program (SCAAP) Grant Application C. Multi-Department: Sheriff’s Office, Community Corrections, Circuit Court, Prosecuting Attorney and 52-3 District Court – 2009 Recovery Act: Edward Byrne Memorial Justice Assistance Program – Grant Application & Intergovernmental Agreement D. Sheriff’s Office 2009 N.E.T. Restore – Byrne JAG Stimulus (American Recovery and Reinvestment Act of 2009) Grant Application E. 52/3 Rochester Hills District Court – 2009 Recovery Act: Edward Byrne Memorial Competitive Grant Application – FY 2010 Sobriety Court Expansion G. Prosecuting Attorney – FY 2010 Victim Rights – Grant Application Supported by Burns Motion carried on a voice vote Item A – HAVEN – Safe Therapeutic Assault Response Team (START Program) October 1, 2008 – December 30, 2008. Commissioner Taub has concerns regarding the prosecution of suspects when the victims are 13, 14 or 15 years of age. She will contact HAVEN for that information. Item F – 52-1 Novi District Court, FY 2010 SCAO Grant – Drug Court Grant Application. Commissioner Taub pointed out #6 in the Fiscal Report “However, in direct conflict with the Gosling Amendment the Michigan Drug Court Grant Program (MDCGP) application states assurance three, “Applicants must provide assurance of the intention of the jurisdiction to continue the program after funding from the Michigan Drug Court Grant Program (MDCGP) has been exhausted.” It was determined the request for application will be Received & Filed at this time but will be referred to Corporation Counsel for their review and recommendation. Also if and when a grant acceptance is requested this issue will be scrutinized for compliance with the Gosling Amendment. McGillivray moved to Receive & File Items A and F. Supported by Potts. Motion carried on a voice vote.
