BOARD OF COMMISSIONERS – OPPOSITION TO GOVERNOR’S EXECUTIVE ORDER NO. 2009-36 TO ABOLISH THE DEPARTMENT OF HISTORY, ARTS AND LIBRARIES The resolution would support the action taken by the Oakland County Library Board acting as advocates of the people and in support of resources that ensure a high qual ity of life for all Oakland County residents and strongly urges the Michigan Legislature to: • Oppose Executive Order No. 2009-36 • Support all legislative efforts to maintain library services and keep their functions whole under the Library of Michigan within state government; • Maintain funding levels to sustain the MeLibrary online subscription resources and the MeLCat interlibrary loan system. Potter moved approval of the attached suggested resolution. Supported by Capello. Gershenson moved to postpone thi s item until the next regular meeting of October 19, 2009 to obtain additional information. Supported by Runestad. DEPARTMENT OF HEALTH AND HUMAN SERVICES/HEALTH DIVISION – AMENDMENT TO EXTEND THE INTERGOVERNMENTAL AGREEMENT WITH OAKLAND SCHOOLS FOR INFANT TODDLER ASSESSMENTS The Health Division is requesting authoriza tion to enter into an amendment to its intergovernmental agreement with Oakland Schools to provide Infant/Toddler Assessments which are used to determine eligibility for Oakland School’s Early On Program. The Agreement was originally adopted pursuant to MR #09043. The amendment will authorize an extension of the agreement for the period July 1, 2009 through June 30, 2010 with Oakland Schools paying an additional not-to-exceed amount of $49,500 for additional assessments . Existing Health Division staff wi ll continue to perform these assessments. Taub moved approval of the attached suggested resolution. Supported by Runestad. Motion carried unanimously on a roll call vote. 3. MR #09180 – BOARD OF COMMISSIONERS – REQUIRING OAKLAND COUNTY TO PARTICIPATE IN THE FEDERAL E-VERIFY PROGRAM Introduced by Commissioner Tim Greimel, Tim Burns and Steven Schwartz, the resolution would establish a County policy requiring Oakland County to register, participate in and utilize the E -Verify Program (or any successor program) when hiring new employees after September 8, 2009 to verify the authorization status of newly hired employees. The resolution directs the County Executive to formulate rules and procedures to include a clause that the County’s Human Resources de partment must implement the provisions of this resolution. Those rules and procedures must be presented to GENERAL GOVERNMENT COMMITTEE Page 3 October 5, 2009 the Board of Commissioners by October 1, 2009 for approval before implementation. The Administration would report to the General Government Committ ee on the anniversary of implementation of this E -Verify policy for employees as to its effectiveness, accuracy and burden and that upon receipt, review and approval of t his report by the Committee, Board of Commissioners approval shall be required for con tinued effect. Hatchett moved to report to recommend approval of the attached suggested resolution. Supported by Runestad. Taub moved to amend the resolution as follows. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby establishes a county policy that Oakland County shall register with, participate in, and utilize the E -Verify Program (or any successor program implemented by the federal Department of Homeland Security and/or the federal Social Security Administration) when hiring new employees after September 8, 2009 February 1, 2010. BE IT FURTHER RESOLVED that Oakland County shall not hire any new employees after September 8, 2009 unless it utilizes the E -Verify Program (or any successor program implemented by the fed eral Department of Homeland Security and/or the federal Social Security Administration) to verify the work authorization status of the newly hired employees. BE IT FURTHER RESOLVED that the County Executive County’s Human Resources Department shall formulate rules and procedures that include a clause that the County's Human Resources Department must implement the provisions of this resolution to implement the provisions of this resolution. BE IT FURTHER RESOLVED that said rules and procedures be presented to the Board of Commissioners by October 1, 2009 for approval before implementation. Human Resources Committee on or before February 1, 2010 BE IT FURTHER RESOLVED that the administration shall report to the General Government Human Resources Committee on the anniversary of the implementation of this E -Verify policy for employees as to its effectiveness, accuracy, and burden and that upon receipt of this report and the review and approval by the General Government Committee that the Oakland County Board of Commissioners’ approval be required for continued effect . BE IT FURTHER RESOLVED that copies of this resolution approving implementation of the E -Verify program be sent to Michigan’s Congressional delegation, its State Legislative delegation, and all its l ocal units of government in support of our nation’s immigration laws. Chairperson, we move the foregoing resolution. Supported by Nash. Motion to amend carried unanimously on a roll call vote. Main motion, as amended, carried unanimously on a roll call vote. 4. BOARD OF COMMISSIONERS – APPOINTMENTS TO THE SOLID WASTE COMMITTEE Terms for the 14-member Solid Waste Committee will expire on October 11, 2009. Supported by Schwartz. Motion carried unanimously on a roll call vote. Several applications were received for the Township Government seat and the one remaining General Public seat. Jacobsen moved to interview for the one open seat representing Township Government. Supported by Capello. Motion carried unanimously on a roll call vote . Capello moved to interview for the one remaining General Public seat. Supported by Jacobsen. Motion carried unanimously on a roll call vote. COMMUNICATIONS A.
