Chairperson Long called the meeting of the General Government Committee to order at 9:35 a.m. in
Committee Room A of the Commissioners’ Auditorium Wing, County Service Center in Pontiac,
Michigan.

APPROVAL OF THE AGENDA
Gershenson moved the agenda with the addition of the Health Division – 2010 Zero to
Three Secondary Prevention Grant Acceptance. Supported by Jacobsen.

1. DEPARTMENT OF HEALTH AND HU MAN SERVICES/HEALTH DIVISION - 2010
MICHIGAN DEPARTMENT OF HUMAN SERVICES ZERO TO THREE SECONDARY
PREVENTION GRANT AGREEMENT ACCEPTANCE
The Health Division is requesting acceptance of a $1,146,251 Michigan Department of Human
Services Zero to Three Second ary Prevention Program grant for the period May 1, 2010 through
September 30, 2012. These funds will allow reinstate ment of the Nurse Family Partnership
program, designed to prevent child abuse and neglect of children ages birth to three years. It is
estimated that 100 families will be assisted each year by the program. The grant match of
$341,314 will be provided from the Michigan Community Health Block Grant and in -kind sources.
Jacobsen moved approval of the attached suggested resolution. Supported by Scott. .
Motion carried unanimously on a roll call vote with Schwartz absent.

2. MR #10116 – BOARD OF COMMISSIONERS – COST RECOVERY FOR STATE POLICE
SERVICES PROVIDED TO LOCAL COM MUNITIES
The resolution was introduced by Commissi oners Potter, Coulter, et. al and recommends that the
Governor and Legislature seek to progressively and permanently eliminate state subsidized local
police services by the Michigan State Police to local m unicipalities, except in such cases where
compelling economic necessities may warrant consideration, with action to begin in the 2011 -2012
fiscal year.
A sheet of “Sample Communities Receiving “Free” Local Patrol and Primary Response from the
Michigan S tate Police, sourced from the Southeast Michigan Council of Governments, was
distributed containing comparison data on population and household income for Brighton Township
in Livingston County, Salem Township in Washtenaw County and Groveland Township in Oakland
County. Also distributed were a 2005 Detroit News article on this topic and a letter Commissioner
Potter has submitted to the Spinal Column regarding same.
Mr. DePalma noted that Groveland Township is 46% parkland and has provided the state police
with a facility at no cost.
Commissioner Jacobsen stated that R ose and Groveland Townships are very different from
Brighton, having no city center, being very rural and including park property. Having a police
millage would be burden to these smalle r populations. If the state was to consider some type of
provision based on taxable value, etc., he would be more inclined to consider it.

Ms. Hatchett stated that the City of Pontiac is having financial difficulties but pays for this service
and believes this is an equity issue.
Scott moved to report to recommend approval of the attached suggested resolution.

3 MR #10110 – BOARD OF COM MISSIONERS – RESOLUTION AND ORDINANCE
BANNING THE SALE, DISPLAY FOR SALE AND POSSESSION OF SYNTHETIC
CANNABINOIDS IN OAKLAND COUNTY
The resolution was introduced by Commissioners Greimel and McGillivray and would authorize the
enactment of an ordinance prohibiti ng the sale, display for sale and possession of synthetic
cannabinoids anywhere in Oakland County . Violation of the ordinance would be considered a
misdemeanor with fines of $1,000 and/or a sentence of up to 90 days in jail. Subsequent violations
would incur fines of up to $5,000 and a sentence of up to 1 year in jail, all at the discretion of the
sentencing judge.
Commissioner Greimel explained that synthetic cannabinoids are man made to mimic marijuana,
are mostly manufactured overseas and marketed and sold as incense and potpourri. The packing
does not contain a list of the synthetics, which can have severe side effects. The State is currently
considering a ban. Commissioner Greimel distributed a copy of a recent Detroit News article on this
subject and a resolution from the Oakland County Association of Chiefs of Police in support of
banning synthetic cannabinoids and including it as a controlled substance under the Michigan
Public Health Code. The State bans the sale of marijuana and has harsher p enalties than local
ordinances but typically most police agencies use the local ordinance to prosecute because it is
easier to enforce with lesser penalties.
Runestad moved to report to recommend approval of the attached suggested resolution.
Supported by McGillivray
Gershenson moved to report to amend the resolution as follows.
BE IT FURTHER RESOLVED that a first-time violation of this ordinance shall
be a misdemeanor punishable by a fine of up to $1,000 $500 and/or a sentence of
up to 90 93 days in jail, in the discretion of the sentencing judge.
BE IT FURTHER RESOLVED that a second or subsequent violation of this
ordinance shall be a misdemeanor punishable by a fine of up to $5,000 and/or a
sentence of up to 1 year in jail, in the discretion of the s entencing judge.
BE IT FURTHER RESOLVED that this ordinance shall be immediately
effective once notice of the adoption of it is published in a newspaper of
general circulation in Oakland County, as required by MCL 46.11(j).
Supported by Hatchett.

McGillivray moved to report to amend the resolution as follows.

BE IT FURTHER RESOLVED that this matter be referred to Corporation
Counsel to draft an ordinance in accordance with the resolution.

4. MR #10119 – BOARD OF COMMISSIONERS – EQUITABLE FUNDING
Introduced by Commissioner Taub, et. at, the resolution requests the County’s sta te legislators to
disallow a larger percentage of General Fund cuts to be targeted to Oakland County citizens; insist
that the Michigan Department of Community Health not implement the new Medicaid funding
formula that reduces Oakland County rates; minimize any reduction of services to persons with
disabilities (through MDCH and DHS) and not support the reductions and redirection of substance
funding or forced consolidation of Coordinating Agencies. Mr. Brown spoke regarding the details of
the resolution.
Taub moved to report to recommend approval of the attached suggested resolution.
Supported by Nash.
McGillivray moved to report to amend the resolution as follows.
BE IT FURTHER RESOLVED that the Oakland County Clerk is requested to
forward copies of this adopted resolution to Governor Jennifer M. Granholm, the
Michigan Department of Community Health, the Oakland County Community Mental
Health Authority, the Wayne County Community Mental Health Agency, the
Wayne County Board of Commissioners, the Macomb Community Mental
Health Agency and the Macomb County Board of Commissioners, Oakland
County’s delegation to the Michigan Legislature and Oakland County’s legislative
lobbyists.

5. DEPARTMENT OF HEALTH AND HUMAN SERVICES – HOMELAND SECURITY
DIVISION – ACCEPTANCE FOR 2009 FEMA STATE HOMELAND SECURITY GRANT
PROGRAM – OAKLAND COUNTY
Homeland Security is requesting authorization to accept U.S. Department of Homeland Security,
through the Federal Emergency Management Agency, State Homeland Security reimbursement for
qualified expenses up to but not exceeding $148,218 for the State Homeland Security Progra m and
$1,474,714 for the Urban Area Security Initiative for a total of $1,622,932 for the period August 1,
2009 through April 30, 2012. Funding will be leveraged to support the four mission areas of
homeland security (prevent, protect, respond and recover ) and address the 8 national priorities and
37 target capabilities as they relate to terrorism and to strengthen preparedness planning. Projects

will be selected by the County’s Grant Allocation Committee.

6. DEPARTMENT OF HEALTH AND HUMAN SERVICES – HOMELAND SECURITY
DIVISION – ACCEPTANCE FOR 2009 FEMA STATE HOMELAND SECURITY GRAN T
PROGRAM – MONROE COUNTY FIDUCIARY
Homeland Security is requesting authorization to act as Monroe County’s fiduciary and Subgrantee
for its U.S. Department of Homeland Security, 2009 Homeland Security Grant Program
reimbursement award of up to $49,178 an d $489,290 for the Urban Area Security Initiative for a
total of $538,468 during the period August 1, 2009 through April 30, 2012. Funds will be used to
purchase equipment and services on Monroe’s behalf to build capabilities to prevent, respond to
and recover from Incidents of National Significance, including threats of incidents of terrorism.
Jacobsen moved to recommend approval of the attached suggested resolution. Supported
by Scott.

7. DEPARTMENT OF HEALTH AND HUMAN SERVICES – HOMELAND SECURITY
DIVISION – ACCEPTANCE FOR 2009 FEMA STATE HOMELAND SECURITY GRANT
PROGRAM – REGIONAL FIDUCIARY
Homeland Security is requesting authorization to accept from the State of Mic higan U.S.
Department of Homeland Security, Federal Emergency Management Agency funding of up to but
not exceeding $270,998 from State Homeland Security and $2,696,320 from the Urban Area
Security Initiative for a total of $2,967,318 and to authorize the I nterlocal agreement for this
program. Oakland County will act as fiduciary on behalf of Region 2 Homeland Security Board
members - the City of Detroit and the Counties of Macomb, Monroe, Oakland, St. Clair, Washtenaw
and Wayne. Oakland County may retain up to 5% of the total award for management and
administrative expenses to cover the period of August 1, 2009 through April 30, 2012. The grant
would continue two Special revenue full-time eligible Homeland Security Division – Regional SAP
positions. In addition, with Oakland County acting in the capacity of fiduciary and subgrantee, one
full-time eligible special revenue Homeland Security UASI Regional SAO position in the Homeland
Security Division and one full time non -eligible Buyer II position in the Purchasing Division will be
continued for Management and administrative purposes. Funds will be used to build capabilities to
prevent, respond to and recover from Incidents of National Significance, including threats of incident
terrorism.

8. BOARD OF COMMISSIONERS – APPOINTMENT TO THE JURY BOARD
As required under the statute, the C ircuit Court has submitted its recommendation, which is to

reappoint Arlene Schell to the Jury Board for Oakland County for a six-year term beginning April 30,
2010. Ms. Schell has been endorsed by the chairperson of the Oakland County Democratic Party.
Mr. Oeffner explained that in a County of less than two million people, the Jury Board consists of
three members appointed by the board of Commissioners on recommendation of the County’s
judicial circuit court judges, with no more than two being of the same p olitical party.
Scott moved to report to recommend appointment of Arlene Schell to the Oakland County
Jury Board for a six-year term to being May 1, 2010 and end April 30, 2016.

Motion carried unanimously on a roll call vote with Capello and Schwartz absent.
