SHERIFF’S OFFICE – STANDARD LAW ENFORCEMENT SERVICES AGREEMEN T WITH THE CITY OF ROCHESTER HILLS, JANUARY 1, 2017 – DECEMBER 31, 2018 The Sheriff’s Office is requesting approval of the law enforcement services contract for Rochester Hills for the next two years. 1l. SHERIFF’S OFFICE – STANDARD LAW ENFORCEMENT SER VICES AGREEMENT WITH THE CHARTER TOWNSHIP OF SPRINGFIELD, JANUARY 1, 2017 – DECEMBER 31, 2018 The Sheriff’s Office is requesting approval of the law enforcement services contract for Springfield Township for the next two years. 1m. SHERIFF’S OFFICE – LAW ENFORCEMENT SERVICES FOR THE PARKS AN D RECREATION COMMISSION FOR 2017/2018 The Sheriff’s Office is seeking approval of the law enforcement services contract for Parks and Recreation Commission for the next two years. Scott moved to recommend approva l of the attached suggested resolution s on the Consent Agenda. Supported by McGillivray. Motion carried unanimously on a roll call vote with Kowall absent . Spisz moved to directly refer the attached suggested resolutions to the Finance Committee. Supported by Jackson. Motion to refer carried on a roll call vote with Kowall absent. PUBLIC SERVICES COMMITTEE Page 4 November 29, 2016 REGULAR AGENDA ITEMS 2. DEPARTMENT OF PUBLIC SERVICES/COMMUNITY CORRECTIONS DIVISION – MICHIGAN DEPARTMENT OF CORRECTIONS/OFFICE OF COMMUNITY CORRECTIONS, COMMUNITY CORRECTIONS COMPREHENSIVE PLAN GRANT ACCEPTANCE FOR FY2017 The Department of Public Services/Community Corrections is requesting approval of the plan and acceptance of the State of Michigan grant funds. The annual grant is $1.7 million. The contract has gone through the grant process; however, it has not been approved due to outstanding issues. Ms. Shortley explained that changes to the Michigan Department of Corrections (MDOC) handbook were negotiated. Several areas of concern still exist after the first revision and are addressed in letters dated October 28, 2016 and November 3, 2016 to the Deputy Director and Administrator , respectively. There has been no response to the letters, emails and phone calls. The top issues set forth in the letters regarding the MDOC Vendor Handbook are as follows: The right to issue Stop Orders to County employees without due process ; Required compliance with MDOC Rules, Policies, Procedures and Regulations that have not been identified ; Medication Reporting Requirements pertaining to certain prescription drugs or medical marijuana usage, which is believed to conflict with federal and state laws ; and Prohibition on Firearms Possession , which is not conducive to Sheriff’s Office employees who carry guns. This is the first year a handbook has come with the grant and all employees are required to sign the handbook and return it to the State. County employees supported by the grant funds would be affected if funding was not provided. A brief discussion was held. Scott moved to recommend approval of the attached suggested resolution. Supported by Spisz. McGillivray moved to amend the resolution by adding the following paragraphs : “BE IT FURTHER RESOLVED that the Board of Commissioners approves the grant agreement with the understanding that in the event of a conflict between the terms of the MDOC Vendor Handbook for Employees Working with Probationers and Parolees Under Supervision with MDOC (Vendor Handbook) and any Federal or State laws or regulations, Grantee labor agreements, and Grantee Human Resources and Sheriff’s Department policies and procedures, the Federal or State laws or regulations, Grantee labor agreements, Grantee Human Resources and Sheriff’s Department policies and procedures will supersede any contrar y terms contained in the Vendor Handbook. BE IT FURTHER RESOLVED that the Clerk of the County of Oakland is directed to forward a copy of this resolution and the three -page October 28, 2016 Letter to the Michigan Department of Corrections Deputy Director from Oakland County Corporation Counsel to the members of the Michigan congressional delegation, the Governor of the State of Michigan, State Senate Majority and Minority Leaders, the State House Speaker and Minority Leader, members of the Oakland County delegation to the Michigan Legislature and the Director of the State of Michigan Department of Corrections .” Supported by Spisz. Motion to amend carried unanimously on a roll call vote with Kowall absent. Main motion, as amended, carried unanimously on a roll call vote with Kowall absent. SHERIFF’S OFFICE – FISCAL YEAR 2017 AUTOMOBILE THEFT PREVENTION AUTHORITY (ATPA) GRANT ACCEPTANCE The Sheriff’s Office is seeking acceptance of the Automobile Theft Prevention Authority grant from the Michigan State Police. Undersheriff McCabe is the Governor’s appointee for the ATPA. The annual $1 assessment fee on auto insurance policies nets a return of $58 in reduced auto policy costs. Jackson moved to recommend approval of the attached suggested resolution . Supported by McGillivray. Motion carried unanimously on a roll call vote with Kowall absent. OTHER BUSINESS Chairperson Dwyer thanked Commissioner Scott for his service as a Commissioner and Committee member. COMMUNICATIONS A. Circuit Court – FY2016 Urban Drug Court Initiative (UDCI) Program – Amendment #1 within 15% of Original Agreement McGillivray moved to receive and file the Communication s. Supported by Jackson. Motion carried on a voice vote.
