vIlater Resources Commissioner - Resolution Northwest Oakland Sewer General Fund Transfer to
Drainage District Account
Chairperson and Members of the Board:
WHEREAS the Oakland County Water Resources Commissioner ("WRC") has conducted Conceptual studies
regarding the protection of the environment and the provision of sanitary sewer service to serve certain areas
located within the Village of Ortonville and within the Townships of Grm eland, Holly, and Brandon
(collectively the Oakland County "Communities") through an extension of service from Genesee County; and
WHEREAS the Communities have petitioned for the creation of the Northwest Oakland Sanitary Drain
Drainage District (the "District") to be formed under Chapter 20 of Act No. 40 of the Public Acts of Michigan
of 1956, as amended ("Drain Code"), to conduct the :Northwest Oakland Sanitary Drain Feasibility Study (the
"Project") to extend sanitary sewer service from the Oakland County border with Genesee County to serve
certain areas within the Communities, negotiation of an agreement with Genesee County to determine the
feasibility of providing additional capacity consisting of the extension of services to the Oakland County border
'with Genesee County, an exploration of, and request for, applicable grants and other finding sources: and
WHEREAS The District has agreed to share the cost of preliminary engineering work including topographical
survey and wetlands delineation with Genesee County to extend sewer to the Oakland Comity border in the
amount of $11 OK and
WHEREAS the District plans to engage the services of an attorney to begin negotiations with Genesee County,
to hire a financial advisor, and complete the Project for a budgeted amount of S90,000; and
WHEREAS prior to the formal petition for the creation of the Northwest Oakland Sanitary Drain Drainage
District, the Communities authorized resolutions within their respective communities and advanced fiends to the
County in the amount of S200,000 in FY 2022 to cover the referenced preliminary costs; and
WHEREAS the S200.000 advanced from the Communities was initially recorded in the General Fund tinder
the Water Resources Commissioner's Office; and
WHEREAS the revenue and expenditures associated with the Project needs to be recorded within the
petitioned (Northwest Oakland Sanitary Drain Drainage District.
NOW THEREFORE BE IT RESOLVED that the Oakland Couunty Board of Commissioners acknowledges
that the $200,000 of funds advanced by the Communities and initially recorded in the General Fund, is to be
transferred and accounted for in the Northwest Oakland Sanitary Drain Drainage District.
BE IT FURTHER RESOLVED that no budget -amendment is required as the fiords will be corrected with a
journal entry to properly account for the Northwest Oakland Sanitary Drain Drainage District activity.

SUBJECT: Northwest Oakland Sanitary Drain Drainage District
Accounting of Funds Received from Communities

Over the past two years, the Water Resources Commissioner has been working with communities in
northwest Oakland County to study the feasibility of extending sewer service from Genesee County to
several municipalities in northern Oakland County.This project is needed to protect the lakes,
streams, and headwaters of the Flint River Watershed in these communities and others by eliminating
existing aged and deteriorating septic systems. Specifically, this project will address failing septic
systems within the townships of Groveland, Holly and Brandon and in most of the Village of
Ortonville. It will provide much -needed service to the economic corridors of these communities.
In November 2021, each community referenced above adopted a resolution of support for the project
and collectively authorized payment of $200,000 to cover costs associated with the planning and
study phase of the project. This phase includes preliminary engineering and legal services to acquire
needed sewer capacity and to negotiate an agreement with Genesee County which would provide
transport and treatment of sanitary sewer from this area.
In December 2021, and prior to the establishment of the Northwest Oakland Sanitary Drain Drainage
District, payments were received from the communities. The funds were temporarily deposited in
Oakland County's General Fund while the drainage district was being created.
On May 25, 2022, with the acceptance of petitions from the communities, the District was officially
established. It is now appropriate to transfer these funds from the General Fund to the new accounts
established for the drainage district.
Recommended Action: Transfer the $200,000 advanced by the communities and initially
recorded in the County's General Fund to the Northwest Oakland Sanitary Drain Drainage
District.

A RESOLUTION OF THE GROVELAND TOWNSHIP BOARD
REGARDING APPROPRIATION OF AMERICAN RESCUE PLAN ACT FUNDS
WHEREAS the Groveland Township has been working with the office of the Oakland County
Water Resources Commissioner (WRC) to study the feasibility of extending sanitary sewer service
from Genesee County to serve certain properties located within the Village of Ortonville, and
within the Townships of Groveland, Holly, and Brandon (collectively referred to as the
Communities); and
WHEREAS this need is critical to protect public health from failing septic systems by providing a
method for adequate removal and treatment of sanitary sewage from homes, buildings, and
schools; and
WHEREAS this need is imperative to protect the environment within our communities and
Oakland County including the lakes, streams, and headwaters of the Flint River Watershed
through elimination of the aged septic systems; and
WHEREAS the WRC, through its contracted engineering firm, produced a report which
demonstrates the need for the Project and that construction of the Project Is feasible; and
WHEREAS the first and most pressing phase of the Project is to acquire capacity in the Kearsley
Creek Interceptor, proposed by the Genesee County Drain Commissioner, to allow future phases
of construction to serve Groveland Township; and
WHEREAS the WRC estimates that an additional $200,000 is needed from the Communities
collectively to continue the administrative process required to begin the Project by acquiring the
needed system capacity to replace the failing septic systems, as identified in a letter from WRC;
and
WHEREAS the above referenced report estimated the total capacity needed for each community
and proposes a cost allocation on that basis, and
WHEREAS the proposed cost allocation to Groveland Township is $50,361; and
WHEREAS American Rescue Plan Act funding is appropriate to spend on the allocated cost as
sewer infrastructure is one of the designated uses of such funding; and
WHEREAS Oakland County has also received American Rescue Plan Act funding which may be
pursued to serve as a match to cover administrative costs of the sewer infrastructure Project.
NOW THEREFORE BE IT RESOLVED that $50,361 of the American Rescue Plan Act funding received
is hereby authorized for expenditure on the first phase of the Project, as referenced in this
Resolution.
NOW THEREFORE BE IT FURTHER RESOLVED that the Supervisor, Robert DePalma is authorized
to seek funding for administrative costs of the Project from the grant for said costs being funded
by Oakland County,

REGARDING APPROPRIATION OF AMERICAN RESCUE PLAN ACT FUNDS

service from Genesee County to serve certain properties located within the Village of Ortonville,
and within the Townships of Groveland, Holly, and Brandon (collectively referred to as the
Communities); and
WHEREAS this need is critical to protect public health from failing septic systems by providing a
method for adequate removal and treatment of sanitary sewage from homes, buildings, and
schools; and
WHEREAS this need is imperative to protect the environment within our communities and
Oakland County including the lakes, streams, and headwaters of the Flint River Watershed

Project.

funding once received is hereby authorized for expenditure on the first phase of the Project, as
