PA 152 provides for certain limitations (i.e. caps) on the amount a public employer may contribute toward the annual cost of employee medical benefits. Each year since the act went into effect and pursuant to specific provisions of Act 152, Oakland County has exercised its legal right to exempt itself from this act. The County Executive recommends that Oakland County again formally exercise its legal right to exempt itself from the Act for calendar year 2023. The annual cap amounts for 2023 are set by the State of Michigan at $7,399.47 for single coverage, $15,474.60 for two-person coverage and $20,180.43 for family coverage. This represents a 1.3% increase over 2022 cap levels. Oakland County is self-insured for the majority of our medical plans, the HR Brokerage firm, Marsh & McLennan (MMA) completes an actuarial calculation to provide an analysis of costs incurred. Employee and medical prescription coverage is $61,206,067, the annual cap amount for 2023 based on the number of employees enrolled in medical plans was $51,084,248 thus our costs are currently 19.8% higher than the cap amounts for 2023. Oakland County has a long history of proactive budget practices that have resulted in balanced budgets that are fiscally sound, as demonstrated by decades of actual performance and a AAA Bond rating. The residents and taxpayers of Oakland County have been well served by the County's consistent utilization of its nationally recognized triennial budget process, a process that uses thoughtful, detailed planning and employs incremental changes over time to yield significant results without serious disruption in service delivery and in a manner that is fair to both taxpayers and employees. The County Executive Recommended Triennial Budget for Fiscal Years 2023 - 2025 is balanced and maintains a responsible general fund equity balance. POLICY ANALYSIS This is a request to exempt Oakland County from the requirements of PA 152 for calendar year 2023. The exemption has been exercised annually, dating back to 2012. Legislation: PA 152 of 2011 (MCL 15.568 Sec 8) allows an exemption to this act with a 2/3 vote of the governing body each year. NOW THEREFORE BE IT RESOLVED that pursuant to the authority granted a county under Section 8 of Public Act 152 of 2011, the Oakland County Board of Commissioners hereby exempts Oakland County from the requirements of PA 152 for calendar year 2023. As we have in the past, the County Executive is recommending to opt out of PA152 for calendar year 2023. Currently, we are in the process of executing a five year strategic plan to minimize internal benefit costs with dependent eligibility and claim audits, benefit carrier contract bidding and negotiations. We are seeking additional healthcare saving measures that work best for our organization.
