ITEM CATEGORY SPONSORED BY Resolution Yolanda Smith Charles INTRODUCTION AND BACKGROUND Oakland County recognizes there is a persistent need for citizens of all ages and abilities to be able to use reliable and dependable public transportation services to access jobs, health care, community resources, colleges/universities, shopping, and recreational opportunities. The request is to create a 2023 Interim Local Transportation Reimbursement Program to provide reimbursement funds to maintain existing public transportation services in Oakland County municipalities. It is anticipated that the millage from the November 8, 2022, ballot proposal will generate $66,163,000 in the first year. These funds have been allocated towards supporting countywide public transportation services provided by SMART, NOTA, WOTA, and OPC and to improve transit opportunities for transportation for disadvantaged individuals. SMART contracts with local municipalities and provides Municipal Credit funds, which are made available to it by the Michigan Legislature pursuant to Michigan Public Act 51 of 1951. The distribution formula will be based upon the following factors: Municipal Credits received from SMART and the current municipal approved FY 2023 budgeted amount for public transportation services.. Eligible municipalities will be responsible for contracting directly with local transportation providers or operate a Community Partnership Program. Oakland County Reimbursement Funds will be used to supplement Municipal Credits received from SMART for eligible public transportation expenses. The qualified municipalities interested in participating in this reimbursement program must submit an application to the Oakland County Department of Economic Development, which will administer the program. The participating municipalities awarded funds through the Program will approve an Interlocal Agreement between Oakland County and the municipality. POLICY ANALYSIS This is a request to approve the creation of the Local Transportation Reimbursement Program and an authorization for a one-time appropriation of $500,000 from the County’s Public Transportation Millage Fund Balance Account. The purpose of establishing the Local Transportation Reimbursement Program to continue current transportation services in northwest and southwest Oakland County. The Local Transportation Reimbursement Program shall be administered in conformance with federal, state, and local legal requirements, Oakland County Policies and Procedures. The Program will be administered by the Department of Economic Development will administer the Program and the distribution of allocated funds to the participating municipalities for expenditures incurred that meet the eligibility requirements for the Local Transportation Reimbursement Program. The Department will provide a report back to the Economic Development and Infrastructure Committee and the Board of Commissioners no later than January 30, 2024, detailing the performance metrics of the program. The FY 2023 budget shall be amended as reflected in the attached Schedule A – Budget Amendment. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the creation of the 2023 Interim Local Transportation Reimbursement Program and hereby authorizes a one-time appropriation of $500,000 from the County’s Public Transportation Millage Fund Balance Account for the purpose of establishing the 2023 Interim Local Transportation Reimbursement Program to continue current transportation services in northwest and southwest Oakland County. BE IT FURTHER RESOLVED that the 2023 Interim Local Transportation Reimbursement Program shall be administered in conformance with federal, state, and local legal requirements, Oakland County Policies and Procedures. Since that time, Oakland County Administration and staff have been working to put in place contracts with the local transportation providers identified in the ballot language, which include: SMART, NOTA, WOTA and OPC. In addition, meetings have been conducted with officials from local cities, villages and townships to discuss the current transportation services offered to residents. The County recognizes that not all communities are presently served by SMART, NOTA, WOTA, or OPC. As a result, for these communities, the County seeks to establish a program to provide reimbursement funds to support existing public transportation services. The Local Transportation Reimbursement Program will distribute limited Public Transportation Millage funds to assist eligible municipalities with public transportation related expenditures incurred that meet the following criteria: •Must be a city, village or township in Oakland County •Not served by a SMART fixed route •Does not receive Community Credits from SMART •Not currently served by NOTA, WOTA or OPC •Under a current contract or currently budgeted in FY2023 •Services provided between January 1, 2023 through December 31, 2023 State funding, pursuant to Michigan Public Act 51 of 1951, is made available to SMART which passes funds on to local communities in the form of Municipal Credit funds. Oakland County Reimbursement Funds shall be used to supplement the Municipal Credits received from SMART for eligible public transportation expenses. The distribution formula of available reimbursement funds shall be based upon the following factors: Municipal Credits received from SMART and the current municipal approved FY 2023 budgeted amount for public transportation services.
