INTRODUCTION AND BACKGROUND
This is a project from the Public Services/Animal Shelter with Facilities overseeing the construction
for the project. See attached memo for additional information on this project.
POLICY ANALYSIS
This is a request for authorization for the renovation and expansion of the Kennel Project for the
Oakland County (OC) Animal Shelter. The Department of Public Services has been working with
Facilities Management to determine the project costs, the feasibility, and to oversee the
project. The project cost is estimated at $2,088,731 for the 19 outside kennels of various sizes,
including a storage shed, the landscaping and masonry. The project is an outcome from the report
by Dr. Sarah Pizzano, DMV, MA of Team Shelter USA. In 2021 the Board of Commission
contracted with Dr. Sarah Pizzano, to complete a comprehensive assessment of the operations at
the OC Animal Shelter and Pet Adoption Center (OCASPAC), contract #006176.
The report indicates that the renovation and expansion of the outdoor kennel project will enhance
the well-being of the animals, create efficiencies within the shelter operations, and contribute to the
adoption for some of the animals. The funding will be supported by the unexpended proceeds of
the previous sale of bonds (MR #15-221), the unexpended funds from lapsed projects from the
County’s Covid-19 response (MR #22079), and from the OC Animal Shelter and Pet Adoption
Center Legacy Fund. The Legacy Fund is entirely funded from donations that come from customers
who adopt an animal from the shelter, or who arrive to purchase a dog license, or from people who
just come in to look at the animals.
This is an eligible expense of ARPA funds and has been confirmed by Guidehouse. An approval
from the Michigan Department of Treasury is not required per the bond counsel from Miller Canfield
(see attached). Any unexpended funds from the OC Animal Shelter and Pet Adoption Center
Legacy Fund, at the end of the Project, will be returned to the Fund. A budget amendment is
required as reflected in the Schedule A-Budget Amendment.

Facilities Management - Renovation and Expansion of Outdoor Kennel Project for the Animal
Shelter
Chair and Members of the Board:
WHEREAS the Department of Public Services has engaged with the Department of Facilities
Management to determine the feasibility and cost of the Renovation and Expansion of the Outdoor
Kennel Project (Project) for the Oakland County Animal Shelter; and
WHEREAS the plan creates 19 outside kennels of various sizes, including a storage shed,
landscaping and masonry, that will enhance the well-being of the animals and create efficiencies
within the shelter operations; and
WHEREAS the estimated cost of the project, including contingency, is $2,088,731; and
WHEREAS $502,602 of the project cost will be provided by unexpended proceeds from the previous
sale of bonds for the original construction of the shelter as allowed by MR #15-221, Appendix 1-
Lease Contract – Section 4. Funds Remaining After Completion, that is in the project work fund; and
WHEREAS $500,000 of the project will be furnished through unexpended funds (MR #22079) from
lapsed projects that were part of the County’s coronavirus response; and
WHEREAS the remaining $1,086,129 will be funded by the Oakland County Animal Shelter and Pet
Adoption Center Legacy Fund.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners authorizes
the Renovation and Expansion of the Outdoor Kennel Project for the Oakland County Animal Shelter
for the total amount of $2,088,731.
BE IT FURTHER RESOLVED that the Board of Commissioners authorizes the remaining funds of
$502,602 from the 2015 Animal Shetler bond to be used for the Renovation and Expansion of the
Outdoor Kennel Project for the Oakland County Animal Shelter (PROJ-103640).
BE IT FURTHER RESOLVED that the Board of Commissioners authorizes the following transfer of
funds for the Renovation and Expansion of the Outdoor Kennel Project for the Oakland County
Animal Shelter (PROJ-103640):
• $500,000 from the ARPA - Local Fiscal Recovery Fund (#21285) to Project Work Fund
(#40400)
• $1,086,129 from the Oakland County Animal Shelter and Pet Adoption Center Legacy Fund
(#21310) to Project Work Fund (#40400)
BE IT FURTHER RESOLVED that any unexpended funds from the Oakland County Animal Shelter
and Pet Adoption Center Legacy Fund, at the end of the Project, will be returned to the Fund.
BE IT FURTHER RESOLVED that the FY 2023 budget shall be amended as reflected in the attached
Schedule A – Budget Amendment.

Rationale for Shelter Expansion
In 2021 the Board of Commission contracted with Dr. Sarah Pizzano, DMV, MA of Team Shelter USA to
complete a comprehensive assessment of the operations at the Oakland County Animal Shelter and Pet
Adoption Center (OCASPAC). This study was in response to concerns raised by the public and animal
welfare organizations. The report concluded that the OCASPA was well run and had many positive
attributes including a Live Release rate of 90% and a Return to Owner rate of over 60%. Both these
percentages are well above the national averages of 79% and 22% respectively. However, Dr. Pizzano
also provided several recommendations that, if implemented, would ensure the continued success of
the OCASPAC well into the future. Many of those recommendations have already been integrated into
shelter operations except for modifications to the facility design. On page 43 of the report Dr. Pizzano
specifically states that a visual barrier should be built between the indoor and outdoor runs in order to
reduce the high level of fear, anxiety or stress the dogs may encounter when they are able to see each
other. This is one component of the project being proposed. While Dr. Pizzano does indicate that we
have ample outdoor space, the problem is that the current space is one large expanse or play area. A
majority of our dogs are considered “bully breeds” which makes it difficult, and perhaps dangerous, for
many dogs to be in the area at the same time. Creating multiple, separate, smaller pens will allow for
more dogs to engage in smaller or individual outdoor playgroups. Currently we can only accommodate
at a maximum 2-3 dogs in the space. This new design will allow us to have 19 or more dogs utilizing the
outdoor space at the same time. Additionally, amongst the new 19 outside kennels, will be 3 larger
kennels designated as “play yards” for a few dogs who are socialized to play together. Beginning on
page 31, Dr. Pizzano states that “it cannot be stressed enough that playgroups will eliminate many
unwanted behaviors seen in shelter dogs as a result of pent-up frustration and anxiety.” This project and
creation of these additional outdoor spaces is designed to increase the health, wellbeing, and safety of
both the dogs and staff. Happier dogs are more likely to be adopted and help the OCASPAC to maintain
a high Live Release rate.
Efficiencies
The major efficiencies created with this project will be the time spent cleaning cages and the quality
with which those cages are cleaned. Today, in order to clean a dog cage, we must move the dogs from
one side of the cage to the other and then lower the guillotine separating the two sides. After we clean
the vacant side, we have to raise the guillotine, move the dog to the clean side, lower the guillotine once
again, and then clean the now vacant side in order to complete the cage cleaning operation. This
method takes time and is inefficient. By removing the dog into the new outside pens, multiple cages can
be thoroughly cleaned and sanitized much easier and much more quickly.
Another additional efficiency of building the outside pens will occur when the quality of life for the dogs
is enhanced. The fresh air and outside environment are proven ways to make a dog happier and better
behaved which will result in that animal being a much better shelter occupant. One of the things that all
kennels struggle with is called “cage craze.” The longer a dog is locked in the kennel, the more it affects
their mental attitude. By moving nineteen dogs outside into the fresh air for a few extra hours per day
will result in making those dogs more manageable when they are back inside the kennel, and thus more
adoptable to the public.
Legacy Fund
The Oakland County Animal Shelter and Pet Adoption Center “Legacy Fund” is an account where all
monetary donations to the shelter are deposited. It is entirely funded from donations that come from
customers who adopt an animal from the shelter, or who arrive to purchase a dog license, or from
people who just come in to look at our animals. The donations can range from a few cents to large sums
of money. In the past 18 months, three people who died left money to the Oakland County Animal
Shelter totaling over $1.15 Million dollars. The entire fund is made up of donated dollars and cents.
Before any monies are spent from the Legacy Fund, requests are made by the animal control division
first through the administration and then through the BOC. Both units must approve any use of that
money.
The legacy fund was established by Oakland County in the 1980’s, however we cannot find any record of
a miscellaneous resolution doing so.

You have asked if remaining proceeds of the $15,450,000 Building Authority Bonds,
Series 2015 (the “2015 Bonds”) issued by the Oakland County Building Authority (the “Building
Authority”) may be used to renovate and expand the outside kennel area (the “Kennel Project”) of
the Oakland County Animal Shelter and Pet Adoption Center (the “Shelter”). Although we were
not bond counsel to the County or Building Authority at the time the 2015 Bonds were issued, we
have reviewed the relevant documents from that transaction and we believe proceeds of the 2015
Bonds may be used for the Kennel Project.
The Contract of Lease (the “Contract”) between the County and the Building Authority—
which is a key document governing the 2015 Bonds and use of proceeds—and related 2015 Bond
authorizing proceedings describe construction of the Shelter itself as the “Project” for which the
2015 Bonds were issued. However, the Contract and proceedings also provide the following:
Any unexpended balance of the proceeds of the sale of the [2015] Bonds remaining
after completion of the Project may be used to improve or enlarge the Project upon
the approval of the Planning and Building Committee of the Board of
Commissioners provided that such use of the funds in the construction fund has
been approved by the Municipal Finance Division of the Michigan Department of
Treasury, if necessary, and the County.
The Kennel Project is adjacent to and functionally integrated into the Shelter and therefore
may be justified as improving or enlarging the Project, as authorized pursuant to the above-quoted
language. Moreover, the use of proceeds on the Kennel Project would not trigger any need for
approval by the Municipal Finance Division of the Michigan Department of Treasury. Therefore,
if the Planning and Building Committee of the Board of Commissioners, as well as the full Board

of Commissioners approve the use of such funds, we believe the expenditure of unspent 2015 Bond
proceeds for the Kennel Project would be permissible under the 2015 Bond documents.
