Hallmark on May 31, 2023 at 2:05 p.m. in the Oakland County Elections Division, Board of Canvassers/Training Room, 1st floor, West Wing Extension, 1200 N. Telegraph Road, Pontiac, MI 48341. ROLL CALL: MEMBERS PRESENT: Hallmark, Brown, Wittenberg. (3) ABSENT: None. (0) OTHERS PRESENT: Joseph J. Rozell, Director of Elections; Heather Kadulski, Elections Specialist; Ashley Golden, Summer Business Assistant; and Brandon Buck, Corporation Counsel. APPROVAL OF AGENDA: Moved by HALLMARK seconded by WITTENBERG to approve the agenda. Motion carried. APPROVAL OF MINUTES: Moved by BROWN seconded by WITTENBERG to approve the minutes of the May 15, 2023 Board of County Election Commissioners Meeting. Motion carried. NEW BUSINESS: A. APPROVAL OF BALLOTS FOR THE AUGUST 8, 2023 ELECTION. Discussion followed. Judge Hallmark stated that sample ballots were submitted to the commissioners for approval. The commissioners reviewed ballots submitted for Berkley, Precinct 1, Clawson, Precinct 1, Novi, Precinct 1 and Southfield, Precinct 1 & 6. Judge Hallmark asked for a motion to approve the ballots for the August 8, 2023 Election. Moved by BROWN seconded by HALLMARK that the ballots be approved. VOTE ON APPROVAL OF BALLOTS: AYES: BROWN, HALLMARK, WITTENBERG. (3) NAYS: NONE. (0) The ballots were APPROVED. Page Two May 31, 2023 Board of County Election Commissioners Meeting B. ADOPTION OF RESOLUTION #2023-01 CONSOLIDATING ALL APPLICABLE PRECINCTS FOR THE AUGUST 8, 2023 ELECTION. Moved by BROWN seconded by HALLMARK that the resolution be adopted. VOTE ON ADOPTION OF RESOLUTION #2023-01: AYES: BROWN, HALLMARK, WITTENBERG. (3) NAYS: NONE. (0) The resolution was ADOPTED. C. RECALL LANGUAGE Judge Hallmark advised that proper notice had been given for today’s meeting for the recall of Patrick Feeney, Park Commissioner, Township of Holly, Gary Hauff, Board Member, Troy School District, Nancy Philippart, Board Member, Troy School District, Karl Schmidt, Board Member, Troy School District and Nicole L. Wilson, Board Member, Troy School District. She also advised that the purpose of today’s meeting according to MCL 168.952 of Michigan Election Law, is that the Commission shall meet and determine whether each reason for the recall stated in the petitions is of factual and sufficient clarity to enable the officer(s) whose recall is being sought and the electors to identify the course of conduct which is the basis of the recall. I. RECALL OF PATRICK FEENEY “4-27-23 Called Citizen Pig and Asshole at Holly Township Parks Meeting 4-15-23 Shouted at Constituents on Public Sidewalks and inside business 11-07-22 Grabbed Constituents outside Village Council Meeting” Judge Hallmark asked if there was anyone present who wished to come forward to speak as a proponent of the petition. Kristin Watt, Angela Wallace and Joanna Barnes spoke in support of the petition. Judge Hallmark asked if there was anyone present who wished to come forward to speak in opposition to the petition. No one spoke in opposition of the petition. Discussion followed. Moved by HALLMARK seconded by WITTENBERG that the petition submitted by Angela M. Wallace for Patrick Feeney, Park Commissioner, Township of Holly be approved. VOTE ON PATRICK FEENEY PETITION: AYES: HALLMARK, WITTENBERG, BROWN. (3) NAYS: NONE. (0) The petition was APPROVED. II. RECALL OF GARY HAUFF “Gary Hauff’s decision to eliminate the following Honors courses: 9 Honors English Literature/Composition 1, 9 Honors English Literature/Composition 2, Mathematics 6/7 Honors, and Mathematics 7/8 Honors by voting to adopt replacement curriculum in School Board Meeting votes held on February 14th, 2023 and May 16th, 2023.” Page Three May 31, 2023 Board of County Election Commissioners Meeting Judge Hallmark asked if there was anyone present who wished to come forward to speak as a proponent of the petition. Yawen Li, Suril Patel, Ruihua Han, Mei Fent, Jinsong Tang, Jianping Zhang, Huiping Wang and Bo Sun spoke in support of the petition. Judge Hallmark asked if there was anyone present who wished to come forward to speak in opposition to the petition. Karl Schmidt, Fabrice Smieliauskas and Nicole Wilson spoke in opposition of the petition. Discussion followed. Moved by HALLMARK seconded by BROWN that the petition submitted by Alexander Karpowitsch for Gary Hauff, Board Member, Troy School District be disapproved. VOTE ON GARY HAUFF PETITION: AYES: HALLMARK, BROWN, WITTENBERG. (3) NAYS: NONE. (0) The petition was DISAPPROVED. III. RECALL OF NANCY PHILIPPART “Nancy Philippart’s decision to eliminate the following Honors courses: 9 Honors English Literature/Composition 1, 9 Honors English Literature/Composition 2, Mathematics 6/7 Honors, and Mathematics 7/8 Honors by voting to adopt replacement curriculum in School Board Meeting votes held on February 14th, 2023 and May 16th, 2023.” Judge Hallmark asked if there was anyone present who wished to come forward to speak as a proponent of the petition. Suril Patel and Alex Karpowitsch spoke in support of the petition. Judge Hallmark asked if there was anyone present who wished to come forward to speak in opposition to the petition. No one spoke in opposition of the petition. Discussion followed. Moved by BROWN seconded by WITTENBERG that the petition submitted by Alexander Karpowitsch for Nancy Philippart, Board Member, Troy School District be disapproved. VOTE ON NANCY PHILIPPART PETITION: AYES: BROWN, WITTENBERG, HALLMARK. (3) NAYS: NONE. (0) The petition was DISAPPROVED. IV. RECALL OF KARL SCHMIDT “Karl Schmidt’s decision to eliminate the following Honors courses: 9 Honors English Literature/Composition 1, 9 Honors English Literature/Composition 2, Mathematics 6/7 Honors, and Mathematics 7/8 Honors by voting to adopt replacement curriculum in School Board Meeting votes held on February 14th, 2023 and May 16th, 2023.” Judge Hallmark asked if there was anyone present who wished to come forward to speak as a proponent of the petition. PUBLIC COMMENT: Nicole Wilson and Alex Karpowitsch addressed the Election Commission. Moved by BROWN seconded by WITTENBERG that the meeting be adjourned. Motion carried.
