PARKS AND RECREATION COMMISSION
SPECIAL MEETING
May 21, 1976
The meeting was called to order at 11:30 A.M. in the Parks and
Recreation Commission Room by Chairman E. Frank Richardson.
COMMISSION MEMBERS PRESENT:
Chairman E. Frank Richardson, Secretary Velma Austin, Betty Fortino,
Fred Harris, George Kuhn, Dr. Joseph Montante, Richard Vogt,
Marjorie Walker.
COMMISSION MEMBERS ABSENT:
Vice -Chairman Lewis Wint
ALSO PRESENT:
Jon J. Kipke; Robert J. Bomia; Bill Willoughby, Daily Tribune.
WATERFORD-OAKS WAVE POOL, CARPETING BIDS:
Mr. Bomia reported the following bids were received on May 6 for
3,100 square yards of carpeting (Turf Grass) to be installed on
the pool deck:
Edward Jones Floor Covering, Inc. $54,353.99
Artificial Leisure Lawn Corporation 43,228.99
Michigan Pool Refinishing Company 41,553.00
The estimate for this work was $31,711.00, but this was based on
2,700 square yards of carpeting. The unit cost, also, was approxi-
mately $1.70/sq. yd. higher than originally estimated. According
to the Construction Manager, all contracts, extras, general conditions
and their fee to date, including carpeting, now amounts to
$1,410,725.28 which is approximately $90,000.00 less than the
$1.5 million not to exceed figure.
Staff concurred with recommendation of the Construction Manager
to award the contract to the low bidder, Michigan Pool Refinishing
Company for $41,553.00.
Moved by Mrs. Fortino, supported by Mrs. Austin to
approve low bid of Michigan Pool Refinishing Company,
in the amount of $41,553.00 for Waterford -Oaks Wave
Pool carpeting, contingent upon State Department of
Natural Resources approval.
Mr. Bomia stated the three companies who bid the project have the
type carpeting approved for pools by the Michigan State Health
Department.

RED RUN GOLF COURSE. TEST WELL BIDS:
Mr. Bomia reported the following bids were received, through
Central Purchasing, for the drilling of a six-inch diameter test
well, 200 feet deep, as a source of water for the Red Run Golf
Course:

Staff recommended the contract be awarded to the low bidder,
James N. Layman for $3,445.00.
Moved by Mrs. Austin, supported by Mrs. Walker, to
award contract to the low bidder, James N. Layman
in the amount of $3,445.00 for a test well at the
Red Run Golf Course.

RED RUN GOLF COURSE:
The U. S. Army Corps of Engineers requested a resolution from the
Oakland County Parks and Recreation Commission holding the
United States free from any damages resulting during construction
and operation of a park on the drain site....
"Prior to granting approval to the Oakland County
Parks and Recreation Commission, the Red Run Drain
Inter -County Drain Board shall obtain and deliver
to the District Engineer, Detroit District, a

resolution from the Oakland County Parks and Recrea-
tion Commission which also holds and saves the
United States free from damages resulting from the
construction and operation of the park and which
also agrees to maintain the park after completion
in accordance with regulations prescribed by the
Secretary of the Army."
Discussion followed.
Moved by Dr. Montante, supported by Mrs. Fortino,
to prepare a resolution from the Oakland County
Parks and Recreation Commission to "hold harmless"
the United States from any damage resulting during
construction and operation of a park on the Red
Run Drain.

SOUTHEASTERN OAKLAND COUNTY INCINERATOR AUTHORITY AGREEMENT:
Moved by Mr. Harris, supported by Mr. Kuhn to
femove Southeastern Oakland County Incinerator
Authority Agreement from table for discussion.
Motion carried.
Chairman Richardson stated the Parks Commission wanted to use two-
thirds of the land owned by the Incinerator Authority for a period
of 25 years and the Authority is requesting we pay 2/3 of their
$10,000 service charge per annum to the City of Madison Heights.
Lease was referred to respective attorneys for their perusal.
Robert Allen, Civil Counsel, stated the document was a land lease
with the Incinerator Authority for "X" amount of dollars as a
service charge for leasing the land. The charge is not in lieu of
taxes, nor do we pay taxes.
Mr. Bomia explained the contractor had equipment on the site,
ready to proceed with the project and it was essential to resolve
the lease so that construction of the golf course could commence
immediately or the opening would be set back a year due to the
delay in sedding the course.
Commissioner Austin felt the signing of the lease agreement, as
proposed, would leave the Parks Commission in a difficult situation
as far as the other parks were concerned.
Discussion conducted on all aspects of the proposed lease.

Moved by Mr. Harris, supported by Mrs. Fortino to
amend the motion to have the contract read as
follows: Page 3; the word "no" be deleted, "rent"
and the following language be continued with
deletion of "as such": "shall be payable from the
TENANT to LANDLORD during the term of this Lease
at a rate of $7,000 per year payable annually" and
the following language be deleted in its entirety:
"Provided, however, that TENANT shall reimburse
LANDLORD in the amount of two-thirds (2/3) of any
service charge or fee and taxes paid by LANDLORD
to the City of Madison Heights. It is acknowledged
that such service charge currently is the amount of
Ten Thousand and no/100 ($10,000) Dollars per annum,
and that such service charge is subject to possible
increases during the term of the Lease.
The TENANT covenants and agrees that it will, at its
own expense, pay and discharge any and all special
assessments levied against said leased premises
before the same shall become delinquent and all further
and other taxes of any kind and nature that may be
properly and lawfully levied against said leased
premises of the TENANT's property or equipment thereon,
before the same shall become delinquent."
Amendment to motion carried unanimously.

approve contract as amended.

motion carried.
Moved by Mr. Harris, supported by Mr. Kuhn that
the Chairman and Director be authorized to execute
modified contract on behalf of Commission.
Motion carried unanimously.
BASEBALL BACKSTOPS:
Mr. Kipke reported the following bids were received by Central
Purchasing for three baseball backstops; two for Addison -Oaks and
one for Groveland-Oaks:

Staff recommended awarding bid to the low bidder, Herbert Jennings,
Inc., for $1,803.75.
Moved by Dr. Montante, supported by Mr. Harris
to accept low bid of Herbert Jennings, Inc., in
the amount of $1,803.75 for three baseball
backstops; two for Addison -Oaks and one for
Groveland-Oaks.

TENNIS TOURNAMENT:
Mr' Kipke explained the Greater Detroit Tennis Association is hosting
a tennis tournament at the Fairlane Club in Dearborn, Michigan, on
July 4 and asked to borrow 2,000 bleacher seats from Springfield -
Oaks Park. They will provide insurance as well as a bond to insure
the bleachers are not damaged and will provide necessary labor to
pick up and return the bleachers.
Based upon approval of the Director, Mr. Kipke recommended the
bleachers be loaned to the Greater Detroit Tennis Association.
The Chair directed Mr. Kipke to proceed as recommended and keep
the Commission apprised of activity.
SWIM MOBILE:
Received preliminary notice from City of Detroit offering to purchase
one of the two SwimMobiles owned by Oakland County Parks and Recrea-
tion Commission for $22,500.00.
Moved by Mr. Kuhn, supported by Mr. Harris to
approve sale of one SwimMobile to the City of
Detroit for $22,500.00.
