The County Airport Committee has hopefully

finalized an Oakland -Orion airport leaving some

150 acres of land available for other use.

Rather than leasing or selling this surplus

property the Airport Committee would rather lease
it to the County Parks Commission for $1.00 for
possibly twenty-five(25) years, so a recreation
area could be developed for the benefit of all
County residents.
The Airport Committee would like to have
confirmation from the Parks Commission stating
their willingness to enter into this arrangement
when and if the entire Board of Commissioners
accepts the Airport Committee's land use recom-
mendation of this airport.
I would concur with this program, although
the land amenities are not what we normally de-
sire. It would seem a unified approach to a
single problem would be worthy action for the
benefit of our entire County.

You have requested my opinion as to the legality of advertising
for and receiving bid proposals without bid bonds. You have also
asked whether a contract may be awarded to a bidder who did not
have a bid bond with his proposal.
I have reviewed the Michigan Statutes and can find no requirement
that a proposed bid on a public improvement project must be ac-
companied by a bid bond. Therefore, I am of the opinion that the
action taken by your Commission in receiving bids without the re-
quirement of bid bonds is valid.
Further, the contracts may be awarded to the lowest responsible
bidder without that bidder having included in his bid proposal
a bid bond.
This opinion must not be construed to mean that the Parks and
Recreation Commission may riot in its discretion, require the sub-
mission of bid bonds. Further, this opinion must not be construed
to mean that performance and labor bonds must not be submitted with
the contract documents by the contractor. There are definite
statutory requirements on public improvement projects to submit
performance and labor material bonds on public improvement projects.
