OAKLAND COUNTY PARKS AND RECREATION COMMISSION
Revised Proposed By -Laws
May 24, 1972
OFFICERS of the Commission shall be: Chairman - Chairman
shall chair all meetings of Commission when present except for
the election of the office of Chairman itself, and shall pre-
pare the agenda for all regular meetings. Vice -Chairman - Vice
Chairman shall chair meetings in absence of Chairman. Secretar
Secretary shall keep in good detail all minutes of regular
meetings or shall delegate authority to do so to a qualified
shorthand stenographer. Election of officers shall be the first
(lst) meeting of each year.
THE COMMISSION SHALL MEET regularly twice a month, on the
second (2nd) and fourth (4th) Friday. Special meetings may be
called as needed by the Chairman or by three (3) members of the
Commission.
C0MMITTEES shall be appointed by the Chairman and shall
meet under the same conditions and rules as does the Commission.
Any three (3) or more members of the Commission appointed by the
Chairman may constitute a committee. Each committee will be
reappointed one month after election of officers.
A QUORUt-f: In accordance with Public Act 261 of the year
1_965, as amendbd, six (6) members of the Commission present and
voting shall constitute a quorum.
ON (QUESTIONS OF SUBSTANCE, passage shall require a sub-
stantial majority of those present and voting, not merely a
simple majority. A full ten (10) members being present and
voting, seven (7) members voting in league shall constitute a
substantial majority. Nine (9) members being present and voting,
six (6) members voting in league shall constitute a substantial
majority. In the instance of eight (8) members, or any lesser
number of members being present and voting, five (5) members
voting in league shall constitute a substantial majority. All
questions of substance shall be taken by a call of the roll.
A gUESTION OF SUBSTANCE shall be determined by the chair
in all instances not covered by these rules. Automatic questions
of substance shall be: Purchase of lands by the Commission;
approval of contracts; a challenge and overriding of a decision
of the chair; to limit debate to one hour; filling of Director
position in case of vacancy; discharging of Director; expenditures
other than budgeted items of one -thousand dollars ($1,000.00) or
more; approval of the yearly budget; and waiving of any of the
by-laws or rules adopted.
ANY PERSON may address the Commission at a request to the
Commission at least ten (10) days prior to the next scheduled
meeting, unless a majority of the members present and voting
shall object.
STAFF MEMBERS may attend seminars and educational conferences.

COMMISSIONERS shall tour the parks at least once a year
and make a personal check of the buildings and grounds.
THE COMMISSION MAY NOT stand in recess over -night or until
the next day.
ALL MEMBERS shall be notified of meetings in writing forty-
eight (48) hours in advance of said meeting.
ONE HOUR LIMITATION OF DEBATE: A one hour limit may be
called for on any item on the agenda or any item properly before
the Commission. When the question of limiting time of debate
to one (1) hour has carried by a substantial majority, the Chair-
man shall divide the time equally between the members present
and voting. Members may yield their allotted time to another
member.
A MEMBER shall be recognized by the chair before addressing
the Commission.
THE AGENDA ITELIS not considered at a regular meeting shall
automatically be carried over to the next meeting and will be
considered within one month of their first appearance on the
agenda.
THE,DIRECTOR shall bear responsibility for the preparation
of the budget and shall submit such a budget to the Commission
at the beginning of each fiscal year (beginning January 1st) for
their approval.

NO EXPENDITURES Above one-throusand dollars ($1)000.00) may
be approved by the Director unless it be previously approved in
the budget, without a substantial majority of the Commission's
approval.

Staff recommends the purchase of the Aerator for $3,355.00 from Wilkie
Turf who is the only bidder. This company is the only distributor in
our area. It is also recommended that the two (2) fairway mowers be
purchased from W. F. Miller, who is the low bidder at $17,359.00 for
both units. The low bid for the four (4) trucksters was Ray Ellis
Sales of Kalamazoo, Michigan. Their bid was $364.27 less than the
other bidders. His delivery is also 8-12 weeks.
The second low bidder is Golf Car Distributors. They are an Oakland
County firm based out of Pontiac. They also have these vehicles in
stock and we could have 'them imaediately. They can also provide
immediate service to the purchased vehicles. For these reasons, it
is the staffs recommendation that the bid be awarded to the second
low bidder, Golf Car Distributors in the amount of $13,739.67 for the
four (4) vehicles.

SPRINGFIELD-OAKS
AGREEMENT - "BATTLE OF THE BANDS"
Attached for your review is a proposed agreement
between the Oakland County Parks and Recreation
Commission and Space Time Productions, Inc., the
promotors of the musical concert "Battle of the
Bands".
We sponsored this event at Springfield last year
with excellent results. Staff recommends approval
of this agreement.

WHITE LAKE -OAKS PROPERTY
You will find attached to your report a copy of the
correspondence from the two appraisers pertaining to
the 27 acres west of White Lake -Oaks. This is an
important piece of property and should be an acquisition
of the commission.
Staff recommends purchase of this property at the
requested price of $2100 per acre by the realtor.

Re: Letter of Consultation for 27.77 acres of land adjacent
to the wast of White Lake Oaks Golf Course.
Dear Mr. Reickel:
In accordance with our recent conversations, I herewith submit
a "Letter of Consultation" regarding the above referenced
property. This is a "Letter of Consultation" and should not be
construed as a full narrative type appraisal.
Portions of my reasoning and data utilized are contained on the
attached pages.
in summary, it is my opinion that the market value of "ordinary"
vacant land in this area would range from $2,500. to $3,500. per
acre. It is also my opinion that subject property, with its
unusual shape, topography, and access, would fall in a range of
value of about 60 per cent of "ordinary" land or from $1,500. to
$2,000. per acre.
This land is currently being offered to the Cormnission at $2,100.
per acre. It is my advice that the Commission accept this pro-
posal and attempt to negotiate a purchase at the earliest
convenience.

BRIEF DESCRIPTION OF PROPERTY
Subject property is irregular in shape and contains approxi-
mately 27.77 acres of land areas. It is estimated that probably
two-thirds of the land area is low and unbuildable for ordinary
residential construction methods. The high land is basically in,
two area; one to the extreme north__-n boundary adjacent to the
golf course and the other high area is near the south central
portion. A portion of the Huron River traverses the extreme,
southwest corner®
The western boundary is a perpendicular north --south lire
measuring 2623.36 feet. The southern boundary is 727.51 feet
and extends into a small lake. The northern boundary is 332.54
feet. The eastern boundary, adjacent to the golf course, is ex-
tremely irregular and bulges in and out around the golf course.
(Without survey, it appears from the aerial photographs that
possibly some of the golf course site improvements lie within
the boundaries of this adjacent ownership.)
This land, in and by itself, is legally landlocked. ?Io,-i-
ever, the present owner also owns the property to the north
which allows him access to M-590

POTENTIAL OR POSSIBLE USES
In order to arrive at an intelligent decision or to recc=mtend
a course of action, it is necessary to consider the potential or
possible uses of the subject property.
In my estimation, the most practical use of the subject
property would be some sort of multiple family (apartments), at-
tached condominiums, or "cluster" single family residential.
These uses all allow a developer to calculate density on the
total acreage but utilize only a small portion of that acreage
fo- the actual building sites.
This is the only practical way that I feel this land could
be developed. The sub -soil conditions are uncertain and it would
be necessary to concentrate the buildings on the limited amount
of high ground.
It should be noted, that the possibility of "cluster" type
housing is very realm In 1974, Waterford Township, adjacent to
the east, passed an ordinance allowing such housing. It is con-
ceivable that this could be obtained in White Lake Township with
very little troubles
GENERAL CONSIDERATIONS
Real estate appraisers often talk in terms of "market value,"
This is the concept of willing buyer, willing seller, open rnar-
ket, fLIll knowledge, reasonable time, etc.

Another tefm discussed in real estate circles is "market
price." Price and value are not always equal. Price is a figure
which may be acceptable to buyer and seller for various reasonsb
Often time we must consider the "value in use." Sometimes we
must consider "the value to the owner". In the situation at
hand we must consider the "assemblage increment" and "value to
the adjacent owner."
RECOMMENDATION
Now we come to the crux of the matter. What action should
the Oakland County Parks and Recreation Commission take?
In my judgment, the Commission should accept a proposal
from Realty World, agents for the owners, and tender an offer
of $2,100000 per acre. In my discussions with the Broker, it
was my impression that the owners considered this the "rock
bottom" price. The land was previously offered to Oakland County
at a substantially higher price,
REASONING
If one looks at an aerial map of White Take Oaks Golf Course
with the subject property adjacent, it is almost obvious that
Oakland County should own the subject property. It will square
off the ownership into an even 160 acres. It will give the
Parks Commission complete control of the small lake at its south-
ern boundary,

The proposed acquisition will give Oakland County control
of a portion of the Huron River, This could be a very important
water source in the future. Natural water is much more useful
for irrigation purposes than well water.
Another major factor in favor of this acquisition is that
it will virtually guarantee a "buffer" zone between the golf
course and any incompatible uses.
And of course, the final consideration is the potential
for future expansion of the golf course or golf course related
facilities. Some revisions were made a few years ago when Oak-
land County acquired this property and it is conceivable that
further extensions could be made if the County cane into title
of the subject property®
The area proposed for acquisition could easily allow the
County to develop a "Par 3" or 11Executive" golf course for use
principally by beginners, children, women, and elderly.
Incidentially, there is virtually no other direction for
expansion. Williams Lake Road lies to the east, a residential
subdivision lies to the south, and M-59 is a short distance to
the north.

PvlARKET DATA
The following page of this report contains a list of various
comparable sales by township. These sales were considered and
related to the subject property. You will note that acreages
in White Lake Township vary from slightly more than $1,000.00
per acre to a high of $3,500.00 per acre. Commerce Township
values run-.1fom $1,800.00 per acre to $4,280.00 per acre. Water-
ford Township values extend from $2,200.00 per acre to $4,000.00
per acre. Springfield Township has a narrow range from slightly
more than $1,000.00 per acre to more than $2,100.00 per acre.
Independence Township also has a rather narrow range from $1,350.00
per acre to $2,500.00 per acre.
It is interesting to note that two significant parcels come
to mind. One is a 35 acre parcel in Section 16 of Independence
Township which was purchased by the Township for park purposes.
This property sold at $1,612.00 per acre, with very poor access.
Another significant factor is a parcel that was considered
by the Oakland County Parks and Recreation -Commission in Sec-
tions 9 and 10 of Independence Township, This 90± acres was
offered to the Commission at $l1350.00 per acre and is adjacent
to the Independence Oaks County Park.
On the other hand, Waterford Township recently made a pur-
chase of some 17 acres in Section 27 at the rate of $3,615.00
per acre; for a proposed park.

These items are note worthy only in the fact that there is
very little correlation which can be taken from past acquisi-
tions for park purposes.
it is also note worthy that few if any comparables were
found along the "M-59 Corridor." In my opinion, this is the
most desireable area within White Lake Township. M-59 is
presently a major artery and plans by the Michigan Department
of State Highways are designed to improve this road to a five
lane thoroughfare.
M-275, limited access freeway, is designed for construction
about four miles west of the subject property. The point is,
that I do not feel land values will decrease in this vicinity.
Conversely, it is almost certain that the current trend of in-
flation will continue and the cost of land will rise.
