In response to your recent inquiry re liquidated
damages, it is legal to include in contracts a
provision for liquidated damages. The damages,
however, must be real and actual and may not be
excessive and in effect a penalty. .For example,
if it costs $25'a;00 per day for an inspector on
a job, then -the liquidated damages may only.be
in the amount of $25.00 and not the amount of
let us say, $100.00. The $100.Q0 would be
considered a penalty and therefore illegal..
I also caution you -that the counts in recent
cases have started a trend which, in effect;
says if you have a provision for liquidated '
damages, then you should make some provision
for payment -for finishing prior to the required.
date. In 'other words, a bonus for swiftness.

PHILADELPHIA, PA. —The Phila-
delphia Spectrum, home of the World
Champion Philadelphia Flyers Hockey
Team, professional tennis and basket-
ball teams, has added professional
IRA rodeo to its roster next month
with fiver performances scheduled
Oct. 23 thru 26.
The rodeo will be produced by
Longhorn World Championship
Rodeo of Nashville, Tenn. with
$12,000 in added money- equally
split among six major events. Posi-
tions will be drawn and there will
be no trading out.
Longhorn president, Bruce Lehrke,
stated, "Our multi -year contract with
The Spectrum guarantees automatic
increases in purses over the years and
we feel that even in its first year this
will be one of the major rodeos in the
country. With the promotion abilities
of The Spectrum's and our crews we
expect it will become one of the
fastest growing and most popular
rodeos ever staged on the professional
level."

In Wreck
Four of the IRA's top cowboys
were involved in an automobile
accident while traveling between two
rodeos in Michigan, but all escaped
without serious injury.
The occupants of the car included
seven times world saddle bronc riding
champ, Gene Maynard, currently
ranked second in that event, who
came out with a black eye; 1970
Rookie of the Year, Bill Poulos,
presently second for the bareback
title and third for the all around,
who escaped with a cut arm; fourth -
ranked saddle bronc rider, Dale
Haskins, last year's rookie saddle
bronc rider of the year, who got
some stitches in his head; and Eddie
Biegler, also in the top ten of the
classic event listings.
Reportedly, the car flipped enc
over end and was completely de-
molished. Two bronc saddles strap-
ped to the outside of the trunk, how-
ever, survived unscathed.

the Longhorn circuits this year.
The rodeo company has additional
buildings of this size scheduled to join
its ranks over the next three years.
