The Excuti.ve Board of C,A.P.E. on September 2, 1975
discussed the content and implications of a letter presented
to the Oakland County Parks Commission dated August 7, 1975
from Bills/Childs Associates, We feel that as a matter of
record and for the purpose of clarification about this docu-
ment that a statement from our Board.is necessary in order
to alleviate any possible misinterpretation and that will
cause further misunderstanding about C.A.P.E. -
We feel that by implication, the for mentioned letter does
not convey nor correctly focus upon the position stated in
our four points that must be considered and resolved and our
petitions which were submitted to this -Board, also enclosed
is a copy of our press release dated June 13, 1975 stating
our four points and a copy of our citizens petitions for your
records and re --clarification, -
'Ne feel that upon examination of these documents the
letter from Bills/Childs Associate does not deal in substance
or content in relationship to initiating any substanctial
progress toward resolving our questions about the Park Expansion.
It is our Boards !wish that further meeting and or com-
munications may 'be implemented toward the discussion of these
question, and that we will be able to clearly began to move
toltard a j utualy acceptable understanding and resolution: on
this issue.
Towards this end we welcome any opportunity that will
maintain and hopefully strengthen our communication so that
progress may be made in the near future.

CAPE EXECS TALK WITH REPRESENTATIVE LARSEN'
The executive board members of CAPE (Citizens Against Park Expansion), a non-
profit organization of: Oakland County, met with State Representative Mel Larsen
Tuesday, June 3, to discuss their concerns with proposed plans for the expansion of
Addison -Oaks park.
Spokesman for the CAPE organization, Ralph Hogg, said, "Our initial concern in
April of this year was the Oakland County`s announced plans to.turn Addison Oaks park
into a carnival. It was at that time that the County Park Commission publicly said
that they were going to develop Addison -Oaks into,a high traffic volumn park. They
are planning to build a hotel -convention site with a gigantic wave -tech surf swimming
pool and an overhead trolley.
"We find this to be.a total waste of a beautiful natural area said Hogg. "In
our meeting with Representative Larsen, we told him that we have met with great_opposi-
tion from the County Park Commissioners to even discuss any of our concerns with. them.
It is just like they have removed themselves from having to answer any questions and
are appearing to us totally unresponsible to the public that they are charged to serve.
"We are not against developing our County Parks. We just feel that there should'
be some care and judgement used as these precious sites are developed," said Hogg.
Hogg outlined four points that CAPE, a 7,000 member Oakland.County organization,
proposes for consideration by the County, Park Commission. These four points are:

1) No part of any plan will be implemented unless the required environmental
impact- study has been made. This study shall include statements on effects
such expansion would have on schools, roads,.public safety, sewers, water
and drainage.
2) No tax or property tax money will be used to subsidize any park concession
which is competitive with similar privately financed, tax paying businesses.
3) Concessions operating on County Park property will have to pay the equiva-
lent of the property taxes which would be collected if they were privately
owned and operating on private property: this tax is to be paid to the
local ;overnmental bodies, including school districts wherein taxing
jurisdiction rests.
4) Particularly at Addison -Oaks, the sewage disposal systems shall be so
designed as to not add to the surface water levels of the surrounding
swamplands.
Representative Larsen assured .the CAPE board members that a meeting would soon be
held between them and the Oakland County Park Commission so that mutual solutions could
be developed between them on the concerns that CAPE has for the future development of
Oakland County parks.

Site Work, County Project 75-13
Dear Commissioners:
On September 9 bids for the Site Work portion of the
referenced project were received. A total of five bids were
received ranging from $92,700 to $131,450 (see attached
Bid Tabulation Sheet). The estimate for this work was
$165,000 which is the amount included in the not to exceed
figure of $1,500,000.
The background of the low bidder, I believe, is already
known to you and thus a Contract in the amount of $92,700
should be awarded to Briar Building Company contingent upon
State approval of funding for this project.
Additional funding for the entire project as listed below
is also requested at this time:
Architect/Engineer Fees $ 42,000
General Conditions 100,000*
Construction Manager Fee 44,000*
Construction Supervision 12,000
Administrative 12,000
Contingency 75,000*
TOTAL $285 ,000
Again this allocation should be made contingent upon State approval
of the Grant.
*Included in the not to exceed cost of $1,500,000

of the work as recommended by the Construction Manager scheduled
to be ready within the next two weeks.

Re: White Lake -Oaks Parking Lot and Golf Cart Paths,
Our Project 75-17
Dear Commissioners:
On August 27 bids were received for the referenced project.
A total of 10 bids were received ranging from $22,950.00 to
$63,847.50 as shown on the attached Tabulation. The estimate
for this work was $31,000.00.
Briar Building Company, the low bidder, proposes to use
two subcontractors for this work which based on the information
furnished us can do the work proposed. Thus, a Contract in the
amount of $22,950.00 can be awarded to Briar Building Company
for this work.
However, since this project has been advertised and bid,
further evaluation of the use of asphalt for the golf cart paths
has occurred and it is now recommended that this portion of the
project ($12,672.00) be eliminated from the Contract by a
Change Order after the Contract has been awarded. The golf cart
paths for this location and Springfield -Oaks could be bid next
spring as one project, allowing maximum time to fully evaluate
materials for use.
If there are any other questions, I plan to be at your
September 12 meeting to answer them.

Please be advised that Act 261 of the Public Acts of 1965, as
amended, provides in Section 14 that the Parks and Recreation
Commission may appoint park rangers to maintain order and enforce
park rules in the various county parks under your jurisdiction.
The park rangers have all the necessary powers and duties to
enforce park rules without being regular or special deputies.
Section 14(4) provides as follows:
"A county or regional commission may appoint
park rangers who may be deputized by a sheriff
to enforce the laws of the state and the ap-
prehension of violators thereof. Park rangers
may enforce the rules adopted by a county or
regional commission whether deputized or not, and
shall have the powers, privileges and immunities
conferred upon peace officers by the laws of this
state. No park ranger shall be appointed unless he
or she meets the minimum standards established by
the law enforcement officers training council.
Park rangers shall exercise their authority and
powers only on lands, waters and property administered
by or under the jurisdiction of a county or regional
commission."
I am of the opinion that pursuant to Section 14(4) of Act 261 of
the Public Acts of 1965, as amended, the Oakland County Parks and
Recreation Commission may appoint Park Rangers who may or may not
be deputy sheriffs and if not deputy sheriffs; have the power to
enforce the rules adopted by the County Parks and Recreation Com-
mission with the powers, privileges and immunities conferred upon
peace officers by the laws of this State.

Following a busy legislative season which we know ran longer
than you anticipated, but feel some good things were accomplished.

Fall Campout on September 20, 1975.
This campout will be held at Oakland County Groveland Oaks Park on
September 19, 20, 21, 1975. Our Legislative Tour of the entire
campground is set for 12.30 P.M. on Saturday September 20, 1975,

PARK COMMISSION SEEKS MILLAGE LEVY IN NOVEMBER ELECTION
The Genesee County Parks and Recreation. Commis-
sion last Thursday (August 21) voted unanimously to request
that the Genesee County Board of Commissioners approve the
placement of a proposal for one mill levy for 10 years to
support the county park system on the ballot for the November
4, 1975 general election.
Action came following the recommendation by a
special study committee which has been working for the
past several months under the direction of Richard A.
Hammel, vice chairman of the County Board of Commissioners
and a member of the Parks Commission.
The proposed millage, if approved, would succeed
the existing one -quarter mill levy and be used to continue
and improve the current level of park and recreation services
as well as to institute a basic capital improvement program
to be used primarily to upgrade existing county park areas
and facilities.
The County park's existing 1/4 mill levy, which was
approved by a two to one vote of all Genesee County residents
nine years ago, expires this year.

Hammel, chairman of the special study committee,
noted that a Citizen's Steering Committee would be
appointed in the near future by Commission President
Everett A. Cummings to provide guidance and work for
the passage of the proposal.
Reasons for the Committee's decision to request
a millage election at this time were three -fold.
Hammel explained the Committee felt the institution
of a fee system would defeat the basic purpose of providing
recreation _facilities and opportunities for all Genesee
County residents. Hairriel noted this proposal would continue
the existing Commission policy of providing general recrea-
tiona! facilities for the public and only charging for
special use facilities such as campgrounds.
He explained because of the existing strain on the
county's general fund budget, increased support from the
County Board of Commissioners would be tenuous at best and.
subject to drastic changes from year to Year.
Finally, he rioted a predictable income from a levy
would give funding stability for a set. period of time and
allow for orderly budgeting over a jong _,or od of time.

--operating funds for the Historical Crossroads
Village, Genesee County's official Bicentennial project
and a re-creation of a 1860-1880 community, opening July
4, 1976;
.---increased park ranger coverage as well as the
establishment of a mounted park ranger patrol to cover
high use facilities, trails, -paths, and other areas
inaccessible by vehicle;
---increased maintenance of existing park areas
and facilities to insure neat and clean parks;
----expansion of nature interpretive programs to
school -;age children, senior citizens, the handicapped, and
general public;
--free recreation equipment check-out service at
heavy use areas;
--bus transportation for retiree groups augmenting
public transportation to major pare facilities; and
--providing increased services and recreational

He stated these projects include.zhe building of 14
new and replacement picnic pavilions, 10 new tennis courts
and the resurfacing of one existing _ennis court, 40 new
shuffleboard courts, 40 new horseshoe pits and two new
softball diamonds.
Twelve miles of paved and unpaged bicycle paths
would be added as would 14 miles of hiking -trails and
another 11 mules of equestrian trails.
Other major projects include ne construction of
a new six -lane boat launching facility on the Holloway
Reservoir, playground equipment, new paved nature trails
for the handicapped, -tree planting, blacktopping exist-
ing gravel park roads, two new pole 6 a= ns . Dew gravel
parking lots and warming shelters in _._ i _ i,er use areas,
and continued development of the His,.,orical Crossroads
Village and Elora -Mar Nature Preserve and Arboretum. Addit-
ional minor improvements would also be _rude.

We are writing at the request of Eric Reickel, Director of the
Oakland County Department of Parks and Recreation to review
procedures being followed for planning, bidding and construction
on this project.
As you know, we are using a Construction Management Firm on the
Project. They have presented a guarantee not to exceed cost of
$1,500,000.00 based upon the final preliminary design development
documents. The plans and budget cost have been approved by the
Oakland County Department of Parks and Recreation Commission.
This guaranteed cost includes all site earthwork, utilities, road,
parking and other related work as well as construction of the
pool, deck and bathhouse facilities. Included in the pool work
are the pool construction, wave making machinery, filtering equip-
ment and all related mechanical, electrical and architectural
work. All portions of this work will be competatively bid, with
any savings realized through bidding returned to the Owner.
Because time required for design engineering and manufacture of the
wave making machinery is about 10 months, plans for this equipment
were advertised for bidding in advance of the other project elements
for direct purchase by the County.
While the bidding on this portion of the work was legally advertised,
and competition was encouraged, it was not surprising that only
one quotation was received, because this pool will be only the second
one of this nature in the United States.

Wave-Tek Automated Pools are licensed and experienced in this type
of pool. They provided the equipment on the Decatur pool, and
although the system is relatively new in our country, it has been
successfully used on at least fifty pools throughout Europe and
Japan.
The wave making equipment portion of this work also includes the
engineering and technological input for the pool shell so that
the waves generated travel the length of the pool and provide
maximum recreational use.
All installation of the machinery, related piping and electrical
work, will of course be competitively bid as will all other aspects
of the project. Interest already expressed assures active competi-
tive bidding for all other aspects of construction.
While we are in full accord with avoiding proprietary items to the
greatest degree possible, this is an instance where no one else
is at this time qualified to guarantee providing wave making machinery
to meet the performance requirements of the drawings and specifi-
cations. Without the wave making machinery the whole concept of
the pool is destroyed.
Time of course is of the essence since plans call for operation of
this pool to begin on Memorial Day of 1976. If we can lie of
further assistance, please contact us.

A bill to amend section 4 of Act No. 139 of the Public Acts of 1973, entitled
"An act to provide forms of county government; to provide for county managers
and county executives and to prescribe their powers and duties; to abolish
certain departments, boards, commissions, and authorities; to provide for
transfer of certain powers and functions; to prescribe powers of a board of
county commissioners and elected officials; to provide organization of adminis-
trative functions; to transfer property; to retain ordinances and laws not in-
consistent with this act; and to provide methods for abolition of a unified
form of county government,"
being section 45.554 of the Compiled Laws of 1970.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Section 1. Section 4 of Act No. 139 of the Public Acts of 1973, being
2 section 45.554 of the Compiled Laws of 1970, is amended to read as follows:
3 Sec. 4. (1) On the date the optional unified form of county government
4 becomes effective all appointed boards, commissions, and authorities except
5 the apportionment commission, airport zoning board of appeals, board of county
6 canvassers, boards of determination for drainage districts, civil service

4 oversee retirement programs, any plat board, any mental health board, any hos-

6 lisped by the county individually or in conjunction with another unit of

8 county offices except those of county commissioner, prosecuting attorney,
9 clerk, register of deeds, treasurer, sheriff, elected county auditors, and
10 drain commissioner are abolished and the tenure of persons holding the offices
11 or appointments are terminated. Termination shall take effect whether or not
12 it coincides with the end of a term of office or appointment. All county
13 departments in conflict with the departmental organization established by this

SPRINGFIELD-OAKS CLUBHOUSE
WELL
The attached letter from James N. Layman, well driller,
explains a condition at Springfield -Oaks that should
be corrected this fall.
The present well is not supplying enough water to pro-
vide the necessary volume to adequately operate the
Clubhouse.
Staff recommends that bids be taken to drill a 6" well
that will provide us with the gallons per minutes
necessary to operate the Clubhouse efficiently.

WHITE LAKE -OAKS
PARKING LOT AND GOLF CART PATHS
Bids have been received for this project and the
breakdown list is attached.
Also, it may have been brought to your attention that
there was a petition circulated with 500 signatures
to preserve two blue spruce trees that are located on
the parking lot site.
It should be noted that these two trees will be
preserved at the expense of losing four parking spaces.
It was never brought to our attention there was any
objection to the removal of these two trees.
Staff did take them under consideration and felt that
eventually, due to the compaction of the vehicles
and the radiation of the eventual blacktop, that the
trees would have their life span shortened and would
eventually have to be removed at additional expense
to the Commission. We thought we would avoid this by
removing the trees now but it is by no means necessary.

RED RUN GOLF COURSE
Don Childs will be available to present an alternate
proposal as requested by the Commission. It is to
include a 9 hole golf course from John R. to 13 Mile
Road as well as a proposed driving range at John R.
and/or 13 Mile Road.
Estimated costs for construction as well as proposed
revenues and operating costs will also be available.
