WHITE LAKE -OAKS
M-59 PROPERTY
As you recall, at the meeting of December 12, 1975,
the Commission authorized donating to the Michigan
Department of State Highways, .7 acres for the
purpose of widening the M-59 corridor to the new
M-275.
It has been declared illegal by our Civil Counsel
that we cannot donate any property. Through the
results of meeting with representatives of the
Michigan Department of State Highways and Bob Allen,
Civil Counsel, it was determined an easement would
be in order.
It is requested that the Michigan Department of State
Highways be given an easement for $1.00 to enable'them
to proceed with the widening of the M-59 corridor and
it be referred to the County Planning and Building
Committee for County action.
This is the same procedure we use in all of our parks
where County roads are involved.

In reference to your letter of January 29, 1976 on surveying
Parcels #1 and #2 in Section 9, Independence Township, we propose
two estimates as follows:
Estimate No. 1 is for the field work to be done
immediately in the deep snow: The not -to -exceed cost
to be $1400.00.
Estimate No. 2 is for the field work to be done
after the deep snow is gone, in March or April: The
not -to -exceed cost to be $1200.00.

RED RUN GOLF COURSE DESIGN AGREEMENT
Staff has had various meetings with representatives of
the Drain Commission in an attempt to determine what
is necessary to commence with the design of the Red Run
Golf Course.
The original thought was that we would attempt to get
a private entrepreneur to build this course and have
him do it on a design -build basis. It has been de-
termined that it is absolutely necessary that the Parks
and Recreation Commission design this course because
of the many restrictions involved with the operation
of the drainage box as well as the pending agreement
with the Incinerator Authority.
In order to do this properly, it is recommended that
the Commission go into agreement with the firm of Bills
and Childs for the purposes of final design and, in the
meantime, an effort will be made to seek out an entre-
preneur as to the feasibility of private monies developing
this. Financing may be difficult due to all the
restrictions involved.
We intend to budget in the Capital Budget, Commission funds
to develop this golf course if private funds are not
available. No matter which way we go, our goal will be to
have the groundbreaking no later than the first of May.

to answer any questions that may be necessary.

Project Description: The Red Run Drain Golf Course Project shall consist of the de-
velopment of a complete nine hole golf course in accordance
with the approved master plan dated November 24, 1975
SECTION 1 - BASIC SERVICES
A. General
1. The ARCHITECT shall act as a professional consultant in Golf Course Archi-
tecture and Site Development Planning to the COUNTY.
2, The ARCHITECT agrees to perform professional services in connection with
the PROJECT as hereinafter stated and shall coordinate all phases of his
work with the Parks and Recreation Commission and staff and all other in-

and Sedimentation. The ARCHITECT will file locally the required Act 347 data.
6. Additional or extended services on construction inspection made necessary by
(1) prolongation of the construction contract time by more than 25% or 1 year
after completion of contract documents or (2) contract default due to delin-
quency or insolvency.
7, Presentation of the plans to any special citizen groups, agencies or communi-
ties in special meetings other than the Oakland Country Parks and Recreation
Commission and staff.
8. Additional service resulting from the Project involving more than two general
construction contracts.
9, .additional meetings or presentations requested by the client above and beyond
those specified herein.
SECTION 3 - RESPONSIBILITIES OF THE COUNTY
The COUNTY wi I I
1 . Provide full information as to the requirements of the Project.
2. Assist the ARCHITECT by placing at his disposal all available information
pertinent to the site of the Project including previous reports of any other
data relative to design and construction.
3. Furnish topographic data and boundary survey.
4. Furnish general soils data.
5. Furnish detailed locations, requirements and construction .limitations on .
the storm drain system and other existing utilities on the Project site.
6. Obtain approvals and/or permits from all governmental agencies having
jurisdiction over the project. .
7. Advertise for proposals from bidders, open the proposals at the appointed
time and place and pay for all costs incidental thereto.
8. Designate a person or persons to act as the COUNTY'S representative with
respect to the work to be performed under this Contract, such persons to have
full authority to transmit instructions, receive information, determine con-
tractors compliance with the plans and accept completed work.
9. Furnish architectural plans for all buildings or cause them to be furnished by
a prebuilt or modular built manufacturer.
SECTION 4 — PERIOD OF SERVICE
1. Following acceptance of this Agreement, together with procurement of all basic
data, the ARCHITECT will initiate services as specified within this Contract
2. Final design, construction details and specifications and contract documents will
be completed within 60 days after acceptance of preliminary plans and receipt of
written authorization to proceed.
SECTION 5 — -PAYMENT TO THE ARCHITECT
A. Payments for Basic Services
The COUNTY will pay to the ARCHITECT a fee for basic services performed according
to the following schedule:
1 . Retainer, upon enactment of this Agreement $ 1,200.00
2. Upon completion of contract documents for basic golf
course only. Ten sets of plans and specifications are
included as a part of this fee structure 8,000.00
(Fee based on estimated cost of $ 250,000 x 6% _
$ 15,000 less $ 3,100 master plan fee)

1 . The COUNTY will pay the ARCHITECT for additional services performed
as per Section 2 at the rate of total payroll cost of salaries and wages
times a factor of 2.5 to provide for general overhead and profit, plus the
actual cost of reimbursable expenses as defined hereinafter.
2. Reimbursable expenses shall mean the actual expense of transportation and
subsistance of principals and employees when traveling in connection with

Plaintiff Louise M. Husk, by her -attorneys, complains
against defendant, as follows:
I
Facts as to the capacity
of plaintiff Louise M. Husk
to bring this action:
1. On May 26, 1975, Frederick Brian Husk, born Decem-
ber 20; 1968, late of the City of Clawson, Oakland County, Michigan,
cameto his death in the manner hereinafter pleaded,dying intestate.
2. On November 4, 1975, by an order of Judge"Donald
E. Adams, duly given, made,, and entered in the Probate Court for
Oakland County, Michigan, plaintiff "was duly appointed Administratrix..
of.the..estate.of her said minor son, Frederick Brian Husk.
3. Plaintiff duly qualified by both accepting the
trust and filing a bond which was by said Court duly approved and
letters. of authority were duly issued to her November 4, 1975,
which are attached hereto and made a part hereof, and plaintiff
ever since has been and now is the duly appointed, qualified, and
acting Administratrix of said estate.
4. This action is for wrongful death of her son,
Frederick Brian'Husk, being brought under RJA 1961, §2922; MCLA
600.2922; MSA 27A.29,22, as his personal representative.
II
Facts as to the injury and death
of Frederick Brian Husk:
1. On May 26, 1975, plaintiff's son, Frederick Brian
Husk, of the age of..six years, four months, and 26 days, while.a
business invitee at Addison Oaks Park, a proprietary recreational
area operated and maintained by the defendant Oakland County Parks
and Recreation Commission and financed and supervised by the Oakland
County Board of Commissioners, and wading in a pool for minors,.which
was roped off from the deeper swimming areas,. and. under the .supervi�,
lion of two lifeguards, defendants John Doe .and Jane Roe., was per-
mitted to submerge and drown as a result of their negligence, and to
remain undiscovered for one-half hour..as .a result of their further
negligence in conducting a search on land when his absence was made
known to -them.
2.
Facts as to the liability
of defendants:
I.At all times herein pleaded, defendant Oakland
County Board of Commissioners was financing and supervising, and
defendant Oakland County Parks and Recreation Commission was oper-
ating and maintaining a so-called Addison Oaks Park, in Addison
Township, Oakland County, Michigan,,which, in reality, was a propri-
etary recreational area., charging an admission of $2.00 for non-.
Oakland County residents, and $1.50 for Oakland County residents,'
and operating for profit both a food pavilion and a boat livery,.,
.2. As part of this profitable enterprise, defendant
Oakland County Parks and Recreation Commission engages so-called
lifeguards to supervise the swimming and wading areas, who are sta-
tioned on high platforms to survey the water areas, and I.among.thcse
so engaged and acting on the date of the pleaded occurrence were
defendants John Doe and Jane Roe, whose true names and -identity -are.
not presently known, but whose persons and actions as pleaded herein
are well known;
3. On May 26; 1975, while plaintiff, her brother,
her son, Frederick Brian Husk, and several neighbors were admitted
as business invitees to the so-called Addison Oaks Park for recre-
ational purposes,. in a common picnic party, her son,. Frederick Brian'
Husk, in the company .of his "buddy," an 11-year-old boy, utilized the*
wading pool under thesupervision of defendants John Doe and Jane Roe.

4. Plaintiff, having gone to the food pavilion to
purchase food, returned after an absence of.ten (10) minutes to find
her son's "buddy" on the shore, and,inquiring as to the whereabouts
of her son, Frederick Brian Husk, she was informed that, "he was still

5. Calling to defendants John Doe and Jane Roe, she
told them that her son was missing, and that his "buddy" insisted he
was "still in the water;" that said defendants John Doe and Jane Roe,
thereupon, in the exercise of unreasonably negligent judgment, and
negligence in fact, began a search of the land areas of the park, re
turning after 15 minutesto wade into the pool to find the apparently
lifeless body of her son, Frederick Brian Husk, at the bottom.
6. Defendants John Doe and Jane Roe owed a duty to
all minors utilizing the wading pool, including plaintiff's son,

Frederick Brian Husk, .such duty being to provide the strictest super=
vision and keenest of observation of youngsters of the toddling kind,
but breached said duty in the following manner:
(i) by inattention to the youngsters
in the wading.pool;
(ii) by compounding such inattention
while engaging in conversation
with swimmers;
(iii) by searching the land areas of -
the park for plaintiff's son,
after they had been told that
he was "still in the water,."
during which period of .dawdling,
discovery of the submerged body
of plaintiff's son might have per-
mitted his resuscitation; and,
(iv) failure.to.provide effective and
sophisticated resuscitation to
plaintiff's son upon discovery
of his submerged body.

7. Defendants Oakland County Parks and Recreation
Commission and Oakland County Board of Commissioners, jointly and
severally, owed a duty to the plaintiff and her minor son, Frederick
Brian Husk, and other invitees of the proprietary recreational area
.known as Addison Oaks Park to provide competent and knowledgeable
lifeguards for the swimming and wading areas of the so-called park,
who would provide strict supervision and keen observation of such
dangerous water areas,, particularly, to safeguard youngsters of the
toddling kind, and who would exercise reasonably sound and mature
judgment.in cases of emergency.
8. In disregard of its duty to the plaintiff and her
minor son, Frederick Brian Husk,'and as a breach of such obligation,
..however, defendants Oakland County Parks and Recreation Commission
and Oakland County Board -of Supervisors, jointly and severally, hired
and maintained as lifeguards the defendants John Doe and Jane.Roe
who were unqualified by reason of training, knowledge, and experience
to provide strict supervision and keen observation of swimmers, par-
ticularly youngsters of the toddling kind, which defendants were neg-
ligent under the circumstances' and in the manner described in this
complaint, paragraph 6, subparagraphs (i) through (iv).

tiff as a direct and proximate result of the negligence of defend-
ants Oakland County Parks and Recreation Commission, Oakland County
Board of .Commissioners, John Doe,'and Jane Roe, jointly and severally,
resulting in th.e death of her.said minor son, has suffered the follow-

ing.damages, recoverable under the Wrongful Death Act:
(i) Funeral and burial expense;
(ii) Loss of pecuniary=interest; and,
(iii) Loss of love, companionship, and
society of Frederick Brian Husk
as a member of the family unit.

Ad damnum clause:
WHEREFORE, the plaintiff Louise M..Husk, as the
Administratrix of the Estate of Frederick Brian Husk, and as his
personal representative in this action under the Wrongful Death Act,
suffering the injury and damage as described herein, solely and'
proximately caused by the negligence of defendants Oakland County
Parks and Recreation Commission, Oakland County Board of Commissioners,'
John Doe, and Jane Roe, jointly and severally, asks verdict and judg-
ment of three hundred thousand dollars in money damages, or such
amount as may reasonably and fully compensate her, to which should
be added interest, costs of this litigation, and reasonable fees.
