AGREEMENT Mr. Richardson has been informed that the City of Madison Heights is in no position to waive the fee that the Incinerator Authority requested we assume in their agreement. Mr. Richareson requests that the Commission approve this agreement without any fanfare and that we con- tinue to negotiate with the Incinerator Authority and Madison Heights rather than hold up the progress of this golf course. Director Division Director (313) 858-0137 May 18, 1976 Oakland County Parks and Recreation Commission 2800 Watkins Lake Road Pontiac, Michigan 48054 Re: Waterford -Oaks Phase I Development, Carpeting Bids, County Project 75-13 Dear Commissioners: On May 6 bids for the carpeting to be installed around the pool were received. Three bids were received ranging from $41,553.00 to $54,353.99 (see attached Bid Tabulation Sheet). The estimate for this work was $31,711.00, but this was based on approximately 2,700 square yards while the final bid was based on 3,100 square yards. The unit cost, also, was approximately $1.70/ square yard higher than originally estimated. The Construction Manager has reviewed the qualifications of the low bidder, Michigan Pool Refinishing Company of Plymouth, Michigan, and recommends award of contract in the amount of $41,553.00 contingent upon State DNR approval. Carpeting is avail- able immediately and should take about three weeks for installation. The approval of this contract will complete all the contract bidding on this project. According to the Construction Manager, all contracts, extras, general conditions and their fee to date including carpeting now amounts to $1,410,725.28 which is approximately $90,000.00 less than the $1,500,000.00 not to exceed figure. My counsel has prepared this agreement to provide mutual assurances to both parties for the development and maintenance of the Red Run Right -of -Way reach between Interstate 75 and Dequindre Road for recreation and park purposes. And, WHEREAS, the Red Run Inter -County Drain Board adopted resolu- tions on January 12, 1950, and January 26, 1951, pursuant to the requirements of the aforesaid public law. Said resolutions, among other things, provided that the Red Run Inter -County Drain Board would hold and save the United States free from damages ,resulting from the construction and maintain the project works after completion in accordance with the regulation prescribed by the Secretary of the Army. And, r: - WHEREAS, the Oakland County Parks and Recreation Commission has requested the use of approximately 121 acres of land controlled by the Red Run Inter -County Drain'Board for park, purposes. And, WHEREAS, the District Engineer pursuant to 33 C.F.R. HAYS Colonel, Corps of Engineers District Engineer (2) Continue to maintain the project works, the Red Run Drain, after the completion_ of the aforesaid park in accordance with the regulations prescribed by the Secretary of the Army, and (3) Prior to granting approval to the Oakland County Parks and Recreation Commission, the Red Run Drain Inter -County Drain Board shall obtain and deliver to the District Engineer, Detroit District, a resolution from the Oakland County Parks and Recrea- tion Commission which also holds and saves the United States free from damages resulting from the construction and operation of the park and which also agrees to maintain the nark after completion in accordance with regulations prescribed by the Secretary of the Army. The parties further agree that this agreement is in addition to and controlled by the aforesaid resolution entered into between the United States of America and the Red Run Drain 'Commission on or about January 12, 1950. In any instance where this agreement conflicts with the aforesaid Resolution made on or about January 12, 1950, the assurances provided on or about January 12, 1950, shall in all cases prevail over this agreement. And that the Resolution adopted January 12, 1950, is in no way altered or waived by reason of the approval hereby !given in this agreement. Walker Dear Mr. Daly: The status of the Red Run project, as of this date, is as follows: The Parks and Recreation Commission, at its May 14 meeting, awarded the bids for the purpose of building the 9 hole golf course At the Red Run Drain. The bid was awarded to the Jack Anglin Company of Novi, Michigan, for a low bid price of $253,318. This is for the construction of the golf course, tees, greens, and irrigation system. There were a total of seven bids received with the low from Anglin of $253,318. to a high of $364,729. The Commission also awarded bids for the removal and installation of fencing in and along the proposed golf course to the low bidder, Universal Fence. We are still in the process of purchasing two small pieces of property which we hope to have consummated within the next month as we cannot proceed with this -project until these two pieces of property are purchased. The Commission also granted permission for staff to design and go out for bid for a maintenance building which will be built this construction year. The last phase of the development will be the building of the parking lot and starter building which will be scheduled for early spring of 1977. The signing of the agreement to use 19 acres in the center of the Incinerator Authority property is still pending and we hope to have that signed by the Commission on May 28.
