SECTION I - GENERAL PUBLIC Any group or gathering of fifty (50) or more persons may use certain designated areas within Commission property to the exclusion of others by making applica- tion, depositing a fee, and being granted a permit by the Director, or his designated representative of the Oakland County Parks and Recreation Commission. SECTION II - D7:_'MITS a) Application for a permit for reserved park space shall be made upon forms to be furnished by the Commission. (b) In the event more applications for reserved space are received than space is available, such applications shall be considered in the chronological order received. (c) Nothing contained herein shall operate to exempt the users of reserved space from full compliance with all rules of the Commission relating to use and conduct on Commission property. SECTION III - HOURS No person shall remain upon property administered by or under the jurisdiction of the Commission between sundown and 8:00 a.m., excepting at designated park areas. Provided, however, that upon application to the Commission or its authorized agent said hours may be extended. It shall be unlawful for any person to enter any portion of park lands or waters which have been designated as closed to public use or entry.. SECTION IV - DESTRUCTION OF BUILDINGS, MARKERS, MONUMENTS AND OTHER PROPERTIES ido person shall upon the property of the Commission: (a) 'rlillfully destroy, deface, alter, change or remove any monument, stone marker, bench mark, stake, post or blaze, marking or designating any boundary line, survey line, or reference point. ( ) Cut, break, mark upon or otherwise injure any building, equipment, bridge, drain, wall, fountain, lamp post, -Fence, gate, hedge, or other structure. a Park Rules Page 2 (c) Deface, destroy, or remove any placard, notice or sign, whether permanent or temporary, posted or exhibited within or upon park property. (d) Appropriate, excavate, injure or destroy any historical or pre- historical ruin or any object of antiquity, without permission of the Commission. SECTION V - DESTRUCTION OF PLANTLIFE AND NATURAL SURROUNDINGS No person shall upon the property of the Commission: (a) Cut, remove, or destroy any tree, sapling, seedling, bush or shrub, whether alive or dead, or chip, blaze, box, girdle, trim or other- wise deface or injure any tree or shrub, or pick, gather, uproot, re;-ov-= cr destroy any flower, plant or grass. (t;! Remcve or ca:;se to be removed any sod, earth, humus, peat, boulders, gravel or sand, without written permission of the Commission. IZCTION VI - FIr:=S (a) No person shall willfully set or cause to be set on fire any tree, woodland, brushland, grassland or meadow within or upon the property of the Commission. (b) No person shall build any fire upon Commission property except within the fireplace, receptacles of open spaces approved and designated by the Commission for such purposes. (c) No person shall drop, throw or otherwise scatter lighted matches, burning cigars, cigarettes, tobacco paper or other inflammable material within or upon any property of the Commission. SECTION VII - r'I'"ALS AND BIRDS No person shall 'hunt, trap, catch, wound or kill or treat cruelly, attempt to trap, catch, Ground or kill any bird or animal, molest or rob any nest., of any bird or any lair, den or burrow of any animal in or upon any land or waters administered by or under the jurisdiction of the Commission. Provided, however, fishing will be permitted within or upon Commission pro- perty in accordance with the laws of the State of Michigan and the rules of the Department of Natural Resources of the State of Michigan in such areas designated for such purposes. (a) Ice Shanties I. All shanties must be made of sturdy material. The manager at each park will determine if the construction and materials are suitable. Park Rules Page 3 2. All shanties _must be registered at the park office. Drivers license or similar credentials must be shown at time of reei tration. 3. All shanties must have owner's name and address displayed on all sides in accordance with the State of Michigan Fishing Laws. 4. all shanties will be removed from the lake by February 24. If not removed by this date, park personnel will remove the shanties and a service charge will be made 5. Parks and Recreation Commission will not be responsible for any d;-ace or vandalism to shanties. 6. All s^anties must be placed on lake by using the prescribed boat ra.­p. SECTION VIII - CONTRABAND All game animals, fowl, birds, fish and other aquatic life, hunted, killed, taken or destroyed, bought, sold, bartered or had in possession, contrary to any of the provisions hereof, shall be and the same are declared to be contraband and the same shall be turned over to the State of Michigan Depart- ment of Natural Resources for disposal. Provided further, that any weapon or object carried or used by any person in violation of these rules, shall be subject to seizure by the Commission or its agents and disposed of according to law. SECTION IX - SWIMMING, BATHING AND WADING No person shall: (a) Swim, bathe, wade or scuba dive in any of the watercourses, lakes, ponds, or sloughs located within or upon the properties administered by or under the jurisdiction of the Commission except at such times and places as may be provided or designated for such purpose. Persons must abide by posted s•,iim rules. (b) Carry or consume any food or beverage of any kind, nor have in their possession any glass or metal container on any beach or in the water adjacent thereto. (c) Use any flotation devises, inflatable or otherwise, in any watercourses, lakes, ponds, or sloughs under the jurisdiction of the Commission except in specifically designated areas where posted. Park Rules Page 4 SECTION X - BOATING No person shall bring into, use or navigate any boat, yacht, canoe, raft or other watercraft upon any watercourse, lagoon, lake, pond or slough located within or upon the properties administered by or under the juris- diction of the Commission, except at such time or place as may be provided or designated for such purpose. All watercraft shall comply with and be used in compliance with Public Act 303 of the Public Acts of the State of Michigan, of 1967 as amended and such regulations as may be adopted under the authority of the Act. Air mattresses, inner tubes and other inflatable devices are prohibited except in designated swimming areas. No gasoline powered watercraft are allowed on any Commission waterways. Electric motors are not to exceed 24 foot pounds of thrust/24 volt system SE'CTIOIN XI - CAh1PTNG It shall be unlawful to camp except in such areas as may be provided and designated for such purposes by the Commission. No person shall camp '�ithout a issued by an authorized representative of the Commission. _t shall be unl,r"ul: (a) For more than one family to occupy an individual camp site. A family consists of a mother, father, brothers and sisters living at home. (b) For more than two cars, two tents or one house trailer to occupy an individual camp site. Each car must be registered on the camp permit. (c) For any person or persons between the hours of 11:00 p.m. and 7:00 a.m. of the following day, to cause, create, or make any noise or disturbance which is a hindrance to the peace, quiet and tranquility of the camping area. (d) For any person or persons to wash dishes at pumps or drinking fountains; to fail to clean camp sites daily or to discharge waste waters or any other wastes, except into designated containers, drains or dumping stations. (e) To dig a trench or make any excavation on any camp site. (f) To occupy a camp site after check-out time, i.e., 3:30 p.m. on the last day covered by the permit. (g) To occupy camp sites contrary to assignments as may be made by the Commission's authorized representative. (h) For non -campers to visit campers between the hours of dusk and 8:00 a.m. l �`. (j) Upon violation of any rules the Commission or authorized representative may revoke the permit and expel the person and his equipment from t-he park. SECTION XII - CONTINUOUS WALKING OR CRUISING IN AND NEAR CAMP GROUNDS It shad be unlawful to continuously walk into or cruise in any motor driven vehicle in, through and around campgrounds for the purpose of attracting or distracting persons or visitors using camp sites -- or for the purpose of using a boas ramp, beach, building or other camping facility, except registered campers or Cora fide visitors to a specific registered camp. SECTION XIII -=�.RKING IN PROHIBITED AREAS Standing for loading or unloading in certain places: (a) It shall be unlawful for the operator of a vehicle to stop, stand or park said vehicle in any place marked as a passenger or loading zone, other than for the expeditious loading or unloading of passengers, or for the unloading and delivery or pick up and loading of materials. (b) It shall be unlawful for the operator of a vehicle to stop, stand or park such vehicle upon any roadway or in any parking area in such manner as to form an obstruction to traffic thereon. SECTION XIV - HORSES (a) It shall be unlawful for any person to ride, lead or cause or suffer a horse to be upon any property administered by or under the jurisdiction of the Commission except on specifically designated and posted areas or bridle paths or by permit on field trail areas. (b) It shall be unlawful for any person to ride a horse in a careless, negligent or reckless manner so as to create a nuisance or to endanger the life-, property of persons of others on any lands administered by or order the jurisdiction of the Commission. �c) The driver of any vehicle shall yield the right of way to any person riding a horse on marked bridle paths where such bridle paths cross streets or road,rays. Park Rules Page 6 SECTION XV - MOTOR -DRIVEN VEHICLES It shall be unlawful for any person to: (a) Operate a motor -driven vehicle of any kind of nature except on designated roads and parking areas. (b) Operate a motor -driven vehicle on any park road at a speed exceeding 15 miles per hour or at any speed greater than that posted. (c) Operate any motor -driven sled, toboggan or snowmobile, or any other r-rotor-driven vehicle on any property under the management, supervision or control of the Commission except where permitted by posted notice. (d) Operate a motorcycle, trail bike, all -terrain vehicle or similar type of sport ����icle on any road or property under control of the Commission exce;D'ihe' E E-CTION XVI - _=-K.ATION OF BICYCLES :) Bicycles shall be operated as closely to the right-hand curb or right- hand side of the path, trail or roadway as conditions will permit and not more than two bicycles shall be operated abreast. (b) It shall be unlawful for the operator of any bicycle where upon any path, trail or roadway to carry any person upon the handlebar or frame of any bicycle, or for any person to so ride upon such bicycle. (c) Bicycles may be operated upon such paths, trails, or roadways as may be posted allowing such use; provided, however, no such use shall be allowed between sunset and sunrise. SECTION XVII - LIVESTOCK No person shall drive or cause to be driven any horses, cattle, sheep, goats, swine, or ether livestock upon or across any property administered by or under the Jturisdiction of the Commission, without the written permission of the Commmission. SECTION XVIII - PEDDLING AND SOLICITING I-;; shall to unlawful for any person to peddle or solicit business of any nature whatever, or to distribute handbills, or other advertising matter, to post unauthorized signs on any lands, waters, structures, or property administered by or under the control of the Commission, or to use such lands, waters, structures or property unless first authorized in writing by the Commission or its authorized agent. Park Rules Page 7 SECTION XIX - UNLAWFUL OBSTRUCTION No person, firm or corporation shall by force, threats, intimidations, unla,;;Fui fencing, enclosing or by any other means, prevent or obstruct any person frog entering, leaving or making full use of any property administered by or under the jurisdiction of the Commission. SECTIO� XX - HINDERING iPLOYEESR� person shall interfere with, or in any manner hinder any employee or agent of the Cc=issien while performing their official duties. SECTION XXI - RESISTING PARK EMPLOYEES 'c person sha-�- interfere with any park employee in the discharge of his duties; or fail or re=::Se to obey any lawful command of any park employee. SECTION XXII - IMPERSONATION OF PARK EMPLOYEES No person shall impersonate any employee or contracted employee of the Commission for any reason whatsoever. SECTION XY,III - PERSONAL CONDUCT (a) It shall be unlawful for any person to be under the influence of intoxi- cants, narcotics, or other mind -affecting drugs, or to engage in any violent, abusive, loud, boisterous, vulgar, lewd, wanton, obscene or otherwise disorderly conduct tending to create a breach of the peace, or to disturb or annoy others, while in or on any property administered by or under the jurisdiction of the Commission. (b) It shall be unlawful to conduct or to participate in any form of gambling, lottery or game of chance upon park property except as permitted by state law and approved by the Commission. (c) Alcoholic beverages may be brought into the parks to be consumed in moderate amoun's it conjunction with picnics camping and reserved group functions. At resarved Group areas all beverages whether they be alcohol or otherwise must be served in unbreakable containers. SECTION XXIV - USE OF LOUDSPEAKER It shall be unlawful to use a loudspeaker, public-address system or amplifier ,within or upon Commission property without a written permit issued by the Commission. Park Rules Page 8 SECTION XXV - FIREWORKS �o person shall fire, discharge or have in his or her possession any rocket, firecrackers, sparklers, torpedo, squib, or other fireworks or any substance of an explosive or dangerous nature within or upon the property of the Commission unless the Commission or its authorized agent shall have authorized same by the issuance of a permit therefore. Any permit issued hereunder shall not relieve a person desiring to use fireworks from obtaining the necessary permits as required by law from the local governing authority wherein this park is located. SECTION XXVI - FI REAR; ;S No person shall, at any time, bring into or upon the properties of the Commission, nor have in their possession, nor discharge or set off anywhere upon sai" prcperties, a revolver, pistol, shotgun, rifle, air rifle, air gun, w.,ater gun or Gny gun, rife, firearm or bow or other weapon that discharges projectiles by air, explosive substance or any other force. Provided, '-3wever, hat ", s section shall not apply to any deputy sheriff, police cfficer, peace officer, park ranger or other duly appointed law enforcement officer while c-arrying out the duties and responsibilities of their position nor to any person while upon designated target ranges or areas. SECTION XXVII - LITTERING AND POLLUTION OF WATERS It shall be unlawful: (a) To discard, to deposit refuse of any kind or nature in or upon the property of the Commission except by placing said refuse in containters provided for such purpose. (b) To throw, cast, lay, drop or discharge into or leave in waters administered by or under the jurisdiction of the Commission any substance, matter or thing, liquid or solid, which may or shall result in the pollution of said waters. SECTION XX`JIII - SKATING AND COASTING (a) No person shall use roller skates within or upon Commission property except at such time and upon such places as may be designated or maintained there- fore. (b) No person shall skate, sled, walk or go upon any ice, or snowshoe, or ski, except at such times and upon such places as may be designated or maintained therefore. (c) No person shall within or upon Commission property coast with handsleds, bobs, carts, or other vehicles on wheels or runners except at such times and upon such places as may be designated or maintained therefore. Park Rules Page 9 SECTION XXIX - BALLOONS, AEROPLANES AND PARACHUTES No person shall make any ascent in any balloon or aeroplane or any descent in or from any balloon, aeroplane or parachute on any lands or waters administered by or under the jurisdiction of the Commission. SECTION XXX - PUBLIC EXHIBITION Ne person shall exhibit any machine or show, or any animal, or indulge in any acrobatic exhibitions in or upon any property of the Commission nor shall any person: carry on any performance or do anything whatsoever, which shall cause persons to congregate so as to interfere with the proper use of such property b� t�;e general public or to obstruct the passage of vehicles or persons, first having obtained written permission from the Commission. SECTION XXXI - :-.NIMALS AND BIRDS It shall be unlawful for any persons while on Commission property to: (a) Cause any animal or fowl to run at large; (b) Bring, drive or lead any animal onto Commission property; excepting that horses and other beasts of burden and draft animals may be ridden by persons in charge thereof or driven before a vehicle attached thereto, on such portions of Commission property as may be designated for riding or driving by the Commission; (c) Bring, drive, lead or carry any dog or other animal or pet which is unleashed, or upon a leash more than six feet in length, under immediate control of a competent person; (d) Suffer his dog or pet to enter any public building or to be upon any designated beach, except a trained and working leader dog; (e) Cause or permit any horse or other animal to stand on any Commission property unless securely hitched or in.charge of some competent person; (f) Torture, ili-treat or neglect any animal or fowl. SECTI OPd ,XI i - SPECIAL PERMITS (a) No erection, construction or maintenance shall be made above or below ground, across or beneath the property of the Commission by any person, firm or corporation �,,ithout first having obtained written permission from the Commission authorizing such installation or construction and a permit specifying in detail the work to be done and the conditions to be fulfilled to the terms of such approval. Park Rules Page 10 (b) Notwithstanding any of the provisions hereof, the Commission or its agent may, upon written application grant specific use permits for special uses when in the opinion of the Commission or its agents special consideration is warranted. SECTION XXXIII - FEES AND CHARGES It shall by unlawful for any person to use any facility, land or area for which a fee and charge has been established by the Commission without payment for such fee or charge. SECTION XXXV - FINES AND IMPRISONMENT Any person violating any provision of the foregoing rules shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not more than $100.00 and costs of prosecution, or imprisoned in the County jail for a period not exceeding 90 days or both, for each offense. DEFINITIONS: 1. "Commission" shall mean the Oakland County Parks and Recreation. Commission or its Director. 2. "ComLmissicr: property" shall mean all lands, waters and property administered by or under the jurisdiction of the Oakland County Parks and Recreation k,C—k;;ml411ss ton. 3. "Person" or "persons" shall mean individuals, male or female, singular or plural; firms, corporations, or any group or gathering of individuals. 4. "Camping" means the overnight lodging or sleeping of person or persons in a tent, trailer -tent, trailer coach, vehicle camper, motor vehicle, or in any other conveyance erected, parked or placed on the premises within any park or recreation area administered by the Oakland County Parks and Recreation Commission. 5.
