A member of the Jet Set Club, Rob Rhyndress of Clarkston, will be at the Commission meeting to present a United States flag that traces its significance to World War I. The flag previously belonged to Rhyndress' great uncle, Zivie Best, who bequeathed the flag to his great nephew upon his death. Best was a soldier in The Polar Bear Division that invaded Russia during WW I during the winter of 1917. Since we were unable to get clear agreement on many ques- tions, the Commission tabled the issue for the purpose of getting legal advice so that we may make a proper, long-range decision regarding enforcement in our parks. Therefore, I am requesting of you, on behalf of the Commission, the following: 1. Your complete study and appraisal of the Michigan Motor Vehicle Act, and its Amendments, as it would affect enforcement in the Oakland County Parks system, if adopted. 2. Your consideration of the correspondence from Judge McNally to Eric Reickel regarding how the Act might affect our enforcement of infractions in the County Parks. 3. A resolution is required which guarantees that the Parks and Recreation Commission will maintain it as a park and develop it accordingly. The County Commissioners have passed a resolution stating they would accept the title to this land and insure the park to be used in perpetuity. It is now necessary that the Parks and Recreation Commission adopt the attached resolution. MR. RIGHT-OF-WAY The Grants -In -Aid Division of Oakland County has approached staff as to whether or not they feel the Parks and Recreation Commission would be interested in applying for a grant to acquire 10 miles of right-of-way between Rochester and Lake Orion for the purpose of developing a trail. There is a grant availalble for pilot programs such as this which will provide 90% funding. Permission is requested to submit a preliminary application to see whether or not this right-of-way might receive funding priority. A Program Statement is attached. 3. PROGRAM NARRATIVE STATEMENT I. Description The proposed acquisition is a 10.5 miles, approximately 125 acres, abandoned railroad corridor located in the eastern portion of Oakland County. The property is presently owned by Penn Central Railroad. This corridor traverses through the townships of Avon, Oakland, and Orion; links the cities of Rochester and Lake Orion, and the Rochester -Utica Bald Mountain Recreation areas. See Exhibit 1. The area varies from rolling hardwood forests to low marshlands and abounds in native wildlife. Paint Creek also meanders through- out, adding another dimension to the natural beauty that exists. II. Purpose and Planned Use A. Purpose The intent of this proposed project is to develop a non - motorized bikeway corridor within eastern Oakland County, to provide access to one of the most scenic areas of southeastern Michigan, as well as to link two of its communities. Objective 1. -- Provide a mode of commuting between communities by means of non -motorized transportation. Objective 2. - Provide access for viewing and enjoying this scenic area by all persons within the area. Objective 3. - Provide a bikeway corridor which stresses safety and quality to user. Objective 4. - Provide a means of promoting the bicycle for commuting and recreational use. B. Planned Use The development of the right of way when acquired would consist of constructing an 8' asphalt bikeway the entire length of the corridor. A small landscaped parking area would be provided at the southern end to allow motorists to transport bicycles to the entry point, as well as provide off-street parking area for bicycles. The corridor will also be fenced where required to minimize conflict with pedestrian and other vehicular movement. Rest facilities and picnic tables would be appropriately located along the route, as well as proper traffic controls, signs and landscaping where required. 14-1 III. The second phase consists of the construction of the 10.5 miles of asphalt bike- ways, safety controls, and signs. Phase 3 provides for the necessary rest facilities, picnic tables, appropriate landscaping and parking area. Project Selection Criteria The project meets the criteria outlined in 31.8 of the Federal Register as follows: A. The proposed acquisition is for an existing abandoned railroad right of way owned by Penn Central. The land is available for acquisition at this time. B. The proposed acquisition is located within the Detroit Standard Metropolitan Statistical Area. C. The project will demonstrate public use by: 1. Providing access to a scenic corridor for all residents. 2. Providing recreational opportunity (bicycling) and promote conservation of the land by preventing private development to occur. D. The proposed bikeway corridor will be accessible by all residents. There are approximately 14 access points along the 10.5 mile route, including potential public park access. E. This project links two communities (Lake Orion and Rochester), two major recreation areas (Bald Mountain and Rochester -Utica), and one local park (Rochester Park). See exhibit 1. F. A regional bikeway system plan is presently being developed by Southeast Michigan Council of Government (SEMCOG). This plan specifically identifies the Penn Central abandoned railroad right of way for use as linear bikeway corridors. Several townships within the county have also adopted bikeway plans while others are currently in the planning phase. G. The proposed project will be the first major linear bikeway in the eastern portion of the county. It will also promote both the recreational and commuting aspect of bicycling. H. This project will promote energy conservation by providing a means of commuting between communities and recreation areas by way of a non - motorized form of transportation. This system will also contribute to the beginning of a total system throughout the Oakland County. I. As indicated in I, "Description," this corridor traverses one of the most scenic and natural areas within eastern lower Michigan. By promoting its use as a recreational corridor may prove to be the catalyst in also promoting the preservation of the surrounding areas. J. No acquisition of proposed right of way has occurred at this time. Penn Central has, however, approached other agencies and private concerns for possible acquisition of this right of way. Acquisition by private concerns could cause serious interruptions and may jeopardize this proposed bikeway corridor. K. Once the proposed acquisition occurs, Oakland County would retain ownership of land and assure the public recreation park usage in perpetuity. 14-3 L. Outdoor Advertising Remaining under the theme concept, we also explored the possible use of billboard advertising. Sm.okey the Bear and fire prevention. We envision the creation of a cartoon animal to symbolize the junior ranger and provide the program with a unitized identity. In addition to the symbol, each participant would receive a membership card and a folder explaining the program and what a junior ranger signifies, The key to a successful program however, is the payoff. It will be well to inform you that we have received inquiries pertaining to the elimination of the annual greens fees and you can probably expect some people to be in attendance to request that you reconsider this decision. The only other area I would like to bring to your attention is that we overlooked taking into consideration the non-resident day -use fee and recommend it be raised from $2.50 to $3.00. ITEM #7 ACQUISITION PROPOSALS The following properties were reviewed in our last Executive Session: A. Clinton Design & Development -- Recommended to send a letter of "thanks" but the Commission is not interested in purchasing. B.
