May 24, 1989
The meeting was called to order at 9:12 a.m. by Chairman Wint in the conference
room of the Oakland County Parks and Recreation Commission.

Moved by Mr. G. Kuhn, supported by Mr. Olsen to approve the minutes
of the meeting of May 3, 1989, with the following correction:
Page 3 - 1, under TRUSTY PROGRAM: The phrase "Camp Oakland Trusty Work
Program" be changed to read "Michigan Department of Corrections Trusty
Work Program."
Motion carried.
As per the information filed in the agenda, the following bids were approved:
Moved by Mr. Olsen, supported by Mr. R. Kuhn to award the contract to
pave approximately 28,000 sq. ft. of cart paths at Glen Oaks and White
Lake Oaks to the low bidder, Apex Asphalt, in the amount of $18,128.

Motion carried.
Moved by Mr. Korzon, supported by Mrs. Tomboulian to award the contract
to reroof approximately 1,500 sq. ft. of the flat roof on the White
Lake Oaks Clubhouse to the low bidder, Energy Shield, in the amount
of $4,190.00.
Commission directed staff to double-check the guarantee for this roof.
Motion carried.
Mobile Recreation intern Becky Brown from Central Michigan University and Thera-
peutic Recreation intern Sally Martin from Wayne State University were introduced
to the Commission.
ORTON OAKS:
Ketchum Feasibility Study Follow-up:
Bill Carlton, from the consulting firm of Ketchum, Inc., answered questions from
staff and the Commission concerning the fund-raising feasibility study.
Mr. Carlton clarified a point made by interviewees for the study regarding day
use that they feel all groups, as wells as individuals, should be able to use
the park. Also, the groups using the facility should not be just exclusively
"special" use, but have the park available for everyone.
Mr. Carlton reiterated the importance of a strong committee leadership heading
the capital campaign.
A fee of $186,600 was proposed by Ketchum to conduct the Commission's fund-raising
campaign. The fee is based on a percentage of the total projected goal of $3
million; the fee will not be lower or higher based on the actual funds raised.
Mr. Carlton also noted that, if after six months the campaign is not going well,
a reassessment can be made.
Concerns were raised about the wisdom of running the capital fund-raising campaign
and the millage renewal campaign so close together. Staff will address specific
millage concerns at the next Commission meeting.
The Oakland Parks Foundation board met on May 23; they agree that professional
help is needed for this campaign. However, they feel another firm could do the
work at a lower fee and would like to negotiate a contract with someone else.
Also, they are unable to pay for this service in advance or by payments if the
capital funds are not raised.
The Commission offered to guarantee payment for the fee and to arrange a repayment
from the Foundation when the funds are raised.
Some Commissioners voiced their concerns about changing the consultant at this
point; they felt Ketchum has a proven track record and'has been upfront with the
Commission.

The Commission was supportive of proceeding with the capital campaign and directed
staff to research and negotiate a contract with Ketchum, Inc. and other firms
to conduct the campaign, subject to a proposal being brought back to the Commis-
sion for review and approval.
Master Plan Review:
Todd Schmidt, consultant from Schmidt Copeland Parker Stevens, reviewed the new
Phase I development plans for the park, which were revised after receiving input
from staff and the feasibility study.
Wetlands approval is not expected until late fall of this year; time table for
the opening of the first phase is now June, 1991.
Commissioners raised concerns about losing the Lions Clubs support in the con-
struction of the three small group cabins as a result of delays in beginning Phase
I; Jim Becher from the Lions Clubs agreed that it is very important for the Com-
mission to make a commitment on this project soon in order to retain the Lions'
support.
Operating Budget:
Staff presented a proposed operating budget for the park through 1994. This bud-
get was based on the "worst scenario" predictions for facility programming. Com-
missioners directed staff to present a proposed operating budget based on more
"realistic" predictions of facility use.
MANAGER'S REPORT:
---Manager Richard distributed copies of preliminary information on the Commis-
sion's millage renewal.
---Distributed copies of a news release reporting on the City of Madison Heights'
approval of the concept of additional recreational features at the Red Oaks Golf
Dome by Oakland Golf Associates, including a miniature golf course, batting cages,
putting greens and picnic areas. Manager Richard noted that the Oakland County
Drain Commission staff has also been supportive of this project. John and Vince
Paglino will be at the next meeting to present their proposed expansion plans.
---Oak Management has put the Addison Oaks Conference Center addition on hold
until we receive word on the possible time frame for the lagoon system study for
the park. Staff has notified them that they will be responsible for a portion
of the cost for this unforeseen project.

ROUGH DRAFT
LEASE
This Lease is made this day of , 1989, by and
between the COUNTY OF OAKLAND, through its PARKS AND RECREATION
COMMISSION (LESSOR), 2800 Watkins Lake Road, Pontiac, Michigan,
and OAKLAND GOLF DOME, INC., a Michigan Corporation, 2320 Deer
Path Court, Troy, Michigan.
1. LEASED PREMISES. LESSOR leases to LESSEE real
property in the City of Madison Heights, Michigan (Premises)
as described in Attachment A, together with all easements, rights
or appurtenances pertaining hereto.
2. TERMS. This Lease shall commence on January 1, 1990
and extend for twenty (20) years, terminating on December 31,
2009.
3. DOME. LESSEE shall maintain at its sole expense,
an air structure golf dome, two 18-hole miniature golf courses,
children's play area, picnic area, batting cage development,
mini -car track, outdoor driving range and putting area on the
Premises on a seven day per week, twelve month per year basis.
4. FACILITIES AND USE OF PREMISES. LESSEE will, at
its own expense, construct, install and/or equip all of the above
facilities up to the standards of the PARKS AND RECREATION COM-
MISSION and the codes of the city of Madison Heights, along with
authorization for such from the Oakland County Drain Commission.
Any additional use of the premises must first be approved in
writing by the PARKS AND RECREATION COMMISSION and terms related
thereto shall be covered in an additional agreement.
5. INSPECTION. LESSOR may inspect the facility and
Premises from time to time in order to assure compliance with
this Lease, the standards of the OAKLAND COUNTY PARKS AND RECRE-
ATION COMMISSION and the applicable state and local laws.
6. INSURANCE. LESSEE shall maintain a policy of insur-
ance against public liability and property damage with limits of
at least Five Hundred Thousand Dollars ($500,000.00) for damages
to one person, One Million Dollars ($1,000,000.00) for damages
from one casualty, and One Hundred Thousand Dollars ($100,000.00)
for damages to property. LESSEE shall name the COUNTY OF OAKLAND
and the OAKLAND COUNTY PARKS AND RECREATION COMMISSION as insureds.
The LESSEE shall furnish LESSOR with a Certificate of Insurance
evidencing such insurance. The policy shall require prior notice
to LESSOR in the event of change or cancellation.
7. RENTAL RATE. LESSEE shall pay as rental and as
compensation for the right and privilege of operation the park
facility the following amounts on a quarterly basis:
a. Years one through three (January 1, 1990 - December
31, 1992): Twenty-four Thousand Dollars ($24,000.00)
per year or three percent (3%) of gross revenue from
all sources, whichever sum is greater.
b. Years four through five (January 1, 1993 - December
31, 1994): Thirty Thousand Dollars ($30,000.00) per
year or four percent (4%) of gross revenue from all
sources, whichever sum is greater.
C. Years six through seven (January 1, 1995 - December
31, 1996): Thirty-three Thousand Dollars ($33,000.00)
per year or five percent (5%) of gross revenue from all
sources, whichever sum is greater.
d. Years eight through nine (January 1, 1997 - December
31, 1998): Thirty-five Thousand Dollars ($35,000.00)
per year or six percent (6%) of gross revenue from all
sources, whichever sum is greater.
e. Years ten through twenty (January 1, 1999 - December
31, 2009): Forty Thousand Dollars ($40,000.00) per year
or seven percent (7%) of gross revenue from all sources,
whichever sum is greater. 8-2
LESSEE shall furnish LESSOR a statement by a certified
public accountant setting forth the aggregate amount of gross
revenues for the yearly term, within 90 days of the end of the
year's term. LESSOR shall have the right to audit LESSEE'S
records on an annual basis.
At the completion of the 20th year of the contract, LESSOR
and LESSEE will meet to discuss how facility will be left at
the end of the 25th year of the contract. This could mean re-
modeling, taking down or replacement of old facilities up to the
standards of the Oakland County Parks and Recreation Commission.
8. GROSS REVENUE. As used herein, "Gross Revenue" shall
mean all sums paid LESSEE in connection with the operation of
the Premises, including gross profit (sale price less cost of
goods sold) on the sale of equipment or any other goods, net
income from vending machine sales, and any commissions, rental,
including premises rental, or other sums paid by others to LESSEE
for the privilege of providing services or making sales within
the facility. Regardless of when actually received, Gross Reve-
nues received shall be deemed to have been received in the year
to which they are attributable. There shall be excluded from
Gross Revenue, sales tax, the proceeds of any borrowings, capital
contributions, insurance recoveries, condemnation, damage, or
other compensible recoveries (including those generated by any
litigation except amounts received by collection actions to recover
gross revenues as defined above), excepting any portion thereof
specifically attributable to;loss of business.
9. EMPLOYEES. LESSEE may employ or contract for services
with such persons as may be required in the operation, management
and maintenance of the facility and its appurtenances. LESSEE
will not discriminate against any employee or applicant because
of race, sex, age, creed, color, or national origin.
10. MAINTENANCE, TAXES AND UTILITIES. LESSEE shall,
at its own expense, maintain the Premises to OAKLAND COUNTY PARKS
AND RECREATION COMMISSION'S standards including maintaining the
driveways, sidewalks and parking lots, free from ice, snow and
debris; maintaining the reception building, grounds (including
lawn maintenance), light standards, and fencing; maintaining
the air structure dome and equipment related thereto including
repairs and replacement. LESSEE shall pay all utilities, taxes
(including real property, personal property and sales), all jani-
torial and grounds maintenance costs.
11. CONFORMITY TO LAW. LESSEE shall promptly observe,
perform, execute, and comply with all applicable and valid laws,
ordinances and regulations of every duly constituted governmental
authority or agency relating to the Demises Premises.
12. REMOVAL OF PERSONALTY. LESSEE may remove at the
termination of this Lease any trade fixtures or equipment owned by
it. Trade fixtures shall include property placed in the Premises
by LESSEE and removable without material damage to the Premises;
provided, however, the upper deck, stairways and related hand-
rails, baffles, and light fixtures shall not be removed. The
Provisions of Section 17 relating to the surrender of the air
structure (dome) shall apply.
13. INDEMNIFICATION. LESSEE shall indemnify and hold
the LESSOR harmless from and against all liability, actions,
claims, demands, costs, damages or expense of any kind which
may be brought or made against the LESSOR arising from LESSEE'S
negligent acts or omissions or upon the Premises.
The LESSOR shall indemnify and hold the LESSEE harmless
from and against all liability, actions, claims, demands, costs,
damages or expense of any kind which may be brought or made
against the LESSEE by reason of the LESSOR'S negligent performance
of obligations under this Lease.
14. LESSEE'S DEFAULT. LESSEE shall be deemed to be
in default, if it failed to fulfill any provision of this Lease.
15. RIGHT OF RE-ENTRY. In the event that LESSEE shall
default, LESSOR may re-enter and repossess the lease Premises
and all improvements (including the air structure and related 8-3
support equipment subject to any encumbrance on said equipment)
thereon for the purpose of removing and putting out the LESSEE
and those occupying under the LESSEE.
16. SUBLEASE OR ASSIGNMENT. This Lease may not be as-
signed nor may LESSEE sublease the Premises without the prior
written consent of LESSOR, which consent shall not be unreasonably
withheld.
17. SURRENDER. On the last day of the term hereof (as
extended), or upon termination of the Lease, LESSEE will surrender
the Premises and all permanent improvements thereon owned by
LESSEE.
18. RE -NEGOTIATE CONTRACT. At the end of the 18th
year of the contract, if both parties agree, they will work to
re -negotiate the lease at the beginning of the 21st year.
19. NOTICES. All notices required to be given by either
party hereunder shall be in writing and sent by registered or
certified mail.
20. MODIFICATIONS. This Lease may be modified or amended
only by the written agreement of LESSOR and LESSEE.
21. GOVERNING LAW. This Lease shall be interpreted
under and governed by the laws of the State of Michigan.
22. SEVERABILITY. If any provisions of this Lease,
or the application thereof to any extent be invalid or unenforce-
able, the remainder of this Lease, or the application of such
provision to the parties or circumstances other than those to
which it is invalid or unenforceable, shall not be affected
thereby, and each provision of this Lease shall be valid and
enforceable to the fullest extent permitted by law.
23. WAIVER. One (1) or more waivers of any covenant,
condition or agreement by LESSOR shall not be construed as a
waiver of a subsequent breach of the same covenant, condition
or agreement. No breach of a covenant, condition or agreement
of this Lease shall be deemed to have been waived by LESSOR unless
such waiver be in writing signed by LESSOR.
24. ENTIRE AGREEMENT. This Lease and the Exhibits
attached hereto constitute the entire agreement of the parties
hereto with respect to the Premises, and all prior negotiations,
agreements and understandings, either oral or written, are hereby
merged herein.
25. BINDING EFFECT. The terms and conditions of this
Lease shall be binding and shall inure to the benefit of the
parties hereto and their respective heirs, representatives, suc-
cessors and assigns; provided, however, that no rights shall
inure to the benefit of any assignee of LESSEE unless the assign-
ment to such assignee has been approved by LESSOR.
IN WITNESS WHEREOF, the parties have executed this Lease
on the day and year above written.

OAKLAND COUNTY PUBLIC SAFETY SERVICES
The Oakland County Public Safety Division has been providing
services to the Commission since 1974. The Oakland County Parks and
Recreation Commission has developed a widely -recognized reputation for
well -maintained and safe parks for the public.
The services provided by Oakland County Public Safety include the
mounted patrol, park services, incident investigation, new employee
processing, alarm systems, key and lock services, special event coverage
and Oakland County Sheriff's trusty detail supervision.
Other services include training (CPR, first aid, lifeguard swim
tests and radio communications), coverage of Waterford Oaks at no charge
and general administration and supervision at no charge.
Private security services are not certified, deputized officers
and have no arrest powers. They would have very limited function in
our parks operations.
Exhibit 1 illustrates the public safety officers' 12-month sched-
ule. Please note that the trusty program dates are variable based upon
availability of supervision, transportation and the weather.
The 1989 contract with Oakland County Public Safety was recently
finalized. Exhibit 2 details the expenses of this service.
The services provided by Public Safety are essential to the opera-
tions of our park facilities and are an effective public relations/law
enforcement tool for us.
Park staff and the administrators of Oakland County Public Safety
Division will be available to answer any questions.

PUMP REPAIR
GLEN OAKS GOLF COURSE
The primary pump for our irrigation system at Glen Oaks was not
performing correctly, so this February staff took it in to Hydro Dynamics
of Pontiac to be rebuilt.
Purchasing has a contract set up for repair of vertical turbine
pumps with this company.
This 7-year old 50 hp vertical turbine pump needed to be completely
rebuilt, which Hydro Dynamics did.
The cost of rebuilding this pump was $3,037.15. The cost of a
new pump would be approximately $5,000.
Staff requests approval of payment for the repair of this pump.
Funds for this repair have been budgeted in the golf course's
grounds maintenance account in the Operating Budget.

PUMP REPAIR
RED OAKS WAVE POOL
The two (2) 8" 10 hp circulating pumps for the Red Oaks Wave Pool,
which are located in a 20 ft. deep pit, needed to be removed and rebuilt
this spring.
These pumps have been completely submerged three times, which con-
tributed to their failure.
We have installed alarms on these pits and purchased a large port-
able pump to try and prevent this flooding from happening again.
The cost for removing and reinstalling these pumps from the pit was
$2,983.92, and the cost for rebuilding these two pumps was $3,680.62.
Purchasing has a contract set up with Service Plumbing and Heating,
the company we used for these repairs.

WATERSLIDE REPAIR
RED OAKS WATERPARK
At the May 3, 1989 meeting, staff requested Commission approval
to proceed with the seam repair of the Red Oaks Waterslides and report
back when we had a complete bid summary.
Eight fiberglass repair companies were contacted and asked to sub-
mit a bid for repairs of these slides. Three companies came out and
looked at the job, and the two companies listed below submitted a bid.

But if a booklet holder shows upon a weekend
with the family in tow, they are not turned
away.
Huron Clinton Metropoliltan Authority
(HCMA) parks have a system similar to
Oakland County's according to information
officer John Sterling.
In addition to pass booklets, however, the
HCMA also issues vehicle entry permits, or
stickers, which can be attached to auto -
vehicle windshields, he said.
The permits, valued at $10 each, are dis-
tributed to all state legislators, the county
executives of Wayne and Oakland counties,
members of the county boards of commis-
sioners and HCMA employees. They can be
used to gain annual entry at all parks.
Pass booklets — booklets with 10 coupons
each worth the $2 daily entry — are distrib-
uted to the HCMA area's U.S. representa-
tives and senators, county executive staff
personnel including the deputy executive,
and the directors of public services, central
services, personnel, public works, corpora-
tion counsel, economic development, man-
agement and budget, community and
minority affairs, public information, com-
puter services, institutional and human
service, federal and state aid official, and
the coordinator of the county executive's of-
fice.
Pass booklets are also sent to county
clerks, treasurers, prosecutors and their
chief assistants; the county drain commis-
sioner and his chief engineers; township su-
pervisors; Oakland County parks and
recreation commissioners and staff; and the
county road commission.
Also included on the list of those who re-
ceive the pass booklets is the board of direc-
tors of the First Federal Savings Bank and
Trust Company, on which sits HCMA com-
mission chair James Clarkson, and each
branch bank manager.
The HCMA also allows director William
P. Sherman, deputy director Frank Sudek,
controller David Wahl, secretary Donald
Beem and the information officer to mail
pass booklets, Sterling said.
Sherman has a list of 246 names — includ-
ing 111 former HCMA commissioners and
staff — on his mailing list; Wahl has a list of
47 names, and he maintains a list of 115
names, Sterling said. Sudek and Beem do not
maintain a list.
According to Sterling, pass booklets are
also provided to other Lansing and. govern-
ment officials, agencies doing business with
the HCMA, the media, and other individuals.
Sterling said the entry permits and pass
booklets are distributed for the same reason
as Oakland County parks distributes its — so
that booklet and permit holders may see and
visit the metroparks and learn about them.
From time to time, the HCMA relies on
every one of the people who receive the tick-
ets for some valuable service, Sterling said,
adding the permits allow people to see the
results of their service.
The HCMA operates 13 metroparks
throughout the counties of Wayne, Oakland,
Macomb, Livingston and Washtenaw. In
1989, 232 annual use permits were issued,
and 1,862 booklets were sent out with a com-
bined value of $39,560.
Usage, however, does not match distribu-
tion, Sterling said. Of the 16,300 pass booklet
coupons distributed, only 4,756 were used.
There is no way of telling how many times
entry permits were used, he said.
The permits and pass booklets can only
be used for entry, Sterling said. Golf, boat
rentals or any other services offered at the
parks must be paid for separately.
Metro Beach, located in Harrison Town-
ship in Macomb County, redeems more
passes and counts more permits than any
other HCMA facility. In 1988, the facility re-
ceived 1,839 pass book coupons.
Stony Creek, located in Shelby and Oak-
land townships on the Oakland and Macomb
border and Wilcott Mill, located near Romeo
in Macomb County, redeemed 963 coupons.
Kensington Metropark, located in Milford
and Lyon townships in Oakland County, re-
deemed 944 pass booklet coupons.
The remaining parks redeemed far fewer
pass booklet coupons. Lower Huron, Willow
and Oakwoods metroparks in Wayne County
redeemed 572 pass booklet coupons com-
bined; Lake Erie metropark redeemed 251 -
tickets; and Hurson Mills, Dexter -Huron and
Delhi metroparks redeemd 167 coupons.
HCMA chair Clarkson said that, as in the
case of Oakland County parks, the HCMA is
attempting to get the attention of the people
who control funding and grants.
"We've been purported to be one of the
best (park authorities) in the country," he
said. "This is kind of a sales gimmick"
State legislators and county commission-
ers are often called on for financial and
moral support, Clarkson said, as are town-
ship supervisors.
Clarkson said county parks and recrea-
tion commissioners and staff work closely
with the HCMA in joint efforts to improve ,
parks. Therefore, he said the passes are pro-

vided so supporters can see the fruits of their
labors.
This is just another tool to let them know
who we are and what we do," he said.
The same applies to county road commis-
sioners, who help provide the needed roads
leading to HCMA parks, he said.
As for providing pass booklets to First
Federal Savings Bank and Trust company
board of directors and branch managers,
Clarkson said the bank and its offices are of-
ten used as a vehicle for getting information
about the HCMA out to the public.
HCMA literature is passed out at bank
branches and it is not uncommon for a per-
son to ask questions about the metroparks,
Clarkson said.
First Federal Savings Bank and Trust
also helps out the HCMA with advertising,
Clarkson said, at no cost to the authority.
"And we don't accept (HCMA) bank de-
posits," he said. Because he sits on the
bank's board of directors, Clarkson said he
has gone to great lengths to make certain the
bank and HCMNs financial business are
kept separate to avoid a "conflict of inter-
est"
Clarkson also said that he is not certain
how often the booklets and permits are used,
but doubts the number is high.
"The parks are still aimed at the general
public and that's what we direct our efforts
to," he said. "If you want to take your family
out for a weekend, you can't find a more
beautiful place.
"But," he added, "you can never get
enough advertising."
Some parks, however, do not use permits
or passes to allow people to come out at their
own discretion. Michigan state parks and
recreation areas, including Proud Lake,
Highland recreation and Bald Mountain in
Oakland County, are run by the Michigan de-
partment of natural resources (DNR).
Parks director Jack Butterfield said state
parks do not issue general use permits or
pass booklets.
They do have official -use permits that are
sent to state legislators for park inspections
and other types of official uses, but the same
passes are not valid for a weekend of camp-
ing, he said.
The official -use passes are also available
at park offices for temporary purposes, he
said. Contractors who do work in the parks,
the media who might be doing a story on a
park, or government staff doing work have
occasionally used official -use passes.
But the official -use passes are easily rec-
ognized and, when a holder uses one, the
parks manager is called to accompany the
user on whatever official business he or she
might be conducting, Butterfield said.
Holders are made aware of the rules that
apply to official use, he said; adding that to
his knowledge, no state legislator has ever
pulled into a park with a camper in tow and
flashed an official -use pass. "We just don't
allow it," he said.
Butterfield said that he recognizes the
need for legislators to occasionally inspect
the parks, but avoiding the appearance of
showing favoritism to state officials has
long -been against DNR policy.
"If they're using the park (for recrea-
tional purposes) they have to pay like every-
one else." he said.

regarding potential funding for Orion Oaks.
Mr. Hall was able to tell us that on the basis of formula,
Michigan received $591,475 for fiscal year 1989 from the Land
and Water Conservation Fund. If you are interested in inquiring
about that funding you should contact Mr. Scherschlight, the
Chief of the Division of Recreation at the Michigan Department
of Natural Resources. His number is (517) 373-1660. Mr. Hall
went further to explain to me that if the American Heritage
Trust Fund Act (HR 876) is passed in Congress this year, it will
mean a tremendous increase in park funding. The bill is
expected to pass the House Floor in the coming weeks, and would
take effect in fiscal year 1991.
We are currently researching other possibilities for federal
funds for Orion Oaks. We will keep you informed on any progress
we make. In the meantime, if you have any questions, please

Thank you for contacting me expressing your interest in the
American Heritage Trust Act. As you may know, this bill did not
receive final consideration during the 100th Congress, but has
been reintroduced in the 101st Congress as S. 370.
The American Heritage Trust Act proposes to establish a permanent
federal fund that would produce $1 billion each year to help State
and local communities purchase open space.
The bill would amend the Land and Water Conservation Act by
changing the current Land and Water Conservation Fund into a real
trust fund. This would be accomplished by taking the current
unappropriated balance of $6 billion together with the existing
flow of $900 million in revenues each year, and investing them in
Government Securities that earn interest. Once the fund is large
enough to earn interest of $1 billion per year, the flow of
revenue into the fund would end and the interest would
automatically be appropriated. Thus, eventually, the fund would
become self-financing.
I have long supported the LWCF. It is important that as a nation
we pursue a policy of preserving our resources for the future.
Please be assured that I will keep your views in mind as I review
the American Heritage Trust act.
