OAKLAND COUNTY PARKS AND RECREATION COMMISSION MEETING March 7, 1990 The meeting was called to order at 9:18 a.m. by Vice Chairman Jean Fox in the Commission room of the Parks and Recreation Commission's administration office. APPROVAL OF PAYMENTS: Moved by Mr. Lewis, supported by Mr. Law to approve the payment of Vouchers 2-176 through 2-292. ROLL CALL VOTE: AYES: G. Kuhn, R. Kuhn, Law, Lewis, Olsen, Tomboulian, Fox (7) NAYS: (0) A sufficient majority having voted therefor, the motion carried. 3 - 1 (Commission Meeting, March 7, 1990) Manager Richard introduced Roger Coles from Central Michigan University. Mr. Coles will be the facilitator at the Commission's retreat in April. RECYCLING/COMPOSTING PROGRAMS: Anne Hobart, Community Relations Coordinator for the County's Solid Waste Depart- ment, informed the Commission of the status of the County's search to find up to three sites for the proposed yard waste composting program. The County is willing to either buy or lease the sites; if leasing, the lease must be for a minimum of ten years. Ms. Hobart noted that a county park had been suggested as a possible site. Susan Drew, Resources Recycling Systems, gave a short slide presentation on yard waste recycling. The Commission concurred on the importance of this program, but expressed concern over possible misunderstanding by the public, especially during our millage cam- paign. Therefore, Commission determined to wait for the results of the County's Request for Site Proposals before offering a county park as a possible site. PRELIMINARY FINANCIAL STATEMENT: Staff presented a preliminary financial statement showing projected revenues over expenditures for the year ending 1989. A final statement will be presented for approval after the audit has been completed. Moved by Mrs. Tomboulian, supported by Mr. Law to accept the Preliminary Financial Statement as of 12-31-89. AYES: Fox, G. Kuhn, R. Kuhn, Law, Lewis, Olsen, Tomboulian, Vogt (8) NAYS: (0) Motion carried on a voice vote. PROPOSED LAND/PROPERTY PURCHASE POLICY: Staff requested approval of the finalized Land/Property Purchase Policy as directed by the Commission. Moved by Mr. R. Kuhn, supported by Mr. Vogt to approve the following Land/Property Purchase Policy: 1. The Parks and Recreation Commission will entertain an offer to purchase property, only after a certified appraisal is completed for their review. The Commission shall then have the option to approve an offer to purchase, or pursue other options as deemed appropriate. 2. Offers to purchase property, once approved by the Commission, will be presented to the seller or his/her agent by an undisclosed principal. 3. Any exceptions or changes to the above procedures must first be discussed and approved by the Commission. 3 - 2 (Commission Meeting, March 7, 1990) AYES: Fox, G. Kuhn, R. BIDS: As per the information filed in the agenda, the following bids were approved: Moved by Mrs. Tomboulian, supported by Mr. Law to award the bid for 50,000 reprints of the 2-color general parks brochure to the low bidder, Dearborn Lithographic, in the amount of $7,286.00. Kuhn, supported by Mr. Law to approve the expenditure of $6,420.00 to Chris Keast for the printing of 75,000 millage infor- mation pamphlets. Commissioner Olsen reiterated the importance of saying "one time, one year only" whenever we mention the Orion Oaks millage, both verbally and in our written ma- terial. AYES: Fox, G. Kuhn, R. Kuhn to award the bid for the purchase of 240,000 wood, imprinted golf tees for all the golf courses to the low bidder, Atlas Pen and Pencil, in the amount of $3,139.20. AYES: Fox, G. Kuhn, R. RSA (Commission Meeting, March 7, 1990) INDEPENDENCE TOWNSHIP SAFETY PATH PROGRAM: Chief of Design and Development Joe Figa noted that Independence Township is requesting the Commission participate in the township's safety path program by helping to pay for the construction of an 8 ft. wide concrete safety path from Clarkston Road north across the front of Independence Oaks to the park's entrance. The township also requested Commission consideration to extend the safety path, sometime in the future, north of the park's entrance across the entire park front along Sashabaw Road. The township receives a 1/4 mill to help pay for the path; however, much of the revenues raised from this millage are used to acquire easements. Staff was in favor of linking the park into the township's safety paths, noting it would connect the park to other important areas in the township, such as the Village of Clarkston, the township library, and the schools. Discussion followed on the width of the path, cost of the path that would extend across the park front north of the entrance, and whether or not it is advantageous for the park to be linked into the township's path program. Staff was directed to meet with the township to let the officials know the Commis- sion is willing to connect the path north to the park's entrance, but will not entertain a request now or in the future to pay for the construction of the path from the entrance north across the park along Sashabaw Road. Commissioner Law also requested the size of the path be reviewed and requested a copy of the written requirements. OAKLAND PARKS FOUNDATION: Executive Director Fran Greenebaum reviewed the Foundation's current and upcomping activities, including the "Protecting the Natural World" conference in April, the Foundation's annual dinner on May 2, and the fundraising benefit, Jesus Christ Superstar, at the Birmingham Theatre on May 18. MANAGER'S REPORT: In addition to the Manager's Report filed in the agenda, the following was noted: ---Assistant Manager Jon Kipke updated the Commission on the activities of the millage awareness campaign committee. ---A short video was shown on the newly -constructed addition to the Addison Oaks Conference Center. Also attached is a cost schedule delineating the fixed and variable costs associated with the contract. The costs for 1990 include fixed costs of $142,767, plus variable costs of $92,016, for a total cost fo $234,783. For 1991, fixed costs are $149,715 and variable costs are $96,153, for a total cost of $245,860. Staff requests commission approval of this contract to become effective March 1, 1990. 6-1 Attachment D Oakland County Board of Commissioners Miscellaneous Resolution # Date: AGREEMENT FOR LAW ENFORCEMENT SERVICES THIS AGREEMENT made and entered into this lst Day of March, 1990 by and between the Oakland County Sheriff, hereinafter referred to as "SHERIFF," and the Oakland County Parks and Recreation Commission, hereinafter referred to as "PARKS AND RECREATION". WITNESSETH: WHEREAS, Parks and Recreation is desirous of contracting with the Sheriff for the performance of Park Patrol functions within its County Parks system; and WHEREAS, the Sheriff is agreeable to rendering such services on the terms and conditions as hereinafter set forth; NOW THEREFORE, IT IS AGREED AS FOLLOWS: 1. The Sheriff agrees to provide police protection within the jurisdiction of Parks System, including all private roads, said protection to consist of the enforcement of State statutes and Parks ordinances, including the writing of tickets therefore; for the purpose of performing such functions, the Sheriff shall furnish and supply one (1) Deputy II, two (2) Deputy I's and fifteen (15) Part -Time Non -Eligible Park Deputies, equipment, communication facilities and other necessary supplies needed in order to perform such services, including all insurances, liability insurance and other protection or benefits of whatever nature. Notwithstanding anything heretofore contained, it is agreed that in all instances where special supplies, such as stationery, notices, forms, appearance tickets, and the like needed to be executed in the name of Parks and Recreation shall be required, they shall be supplied by Parks and Recreation at its cost and expense. The Sheriff agrees to hold Parks and Recreation harmless and defend it against any suit, claim, cause of action, etc., as the result of any act, and/or omission to act, on the part of the Sheriff or its deputies, and/or agents while such patrol officer employees and/or agents are under the control of the Oakland County Sheriff or his designated representative. 2. The standards of performance, the discipline of the deputies and other matters incident to the performance of such services and the control of the deputies so assigned to provide such service shall remain in the Sheriff's Department; however, the standards of 6-2 performance shall not be lower than that furnished another jurisdiction in Oakland County, nor shall the caliber and the ability of the deputies supplied by lower than that furnished other jurisdictions in Oakland County. 3. Parks and Recreation shall not be required to assume any liability for the direct payment of salaries, wages or other compensation to the County for any Sheriff's Department personnel performing the services set forth in this document except as herein otherwise specified. 4. The law enforcement service to be provided by the Sheriff shall consist of furnishing one (1) Deputy II, two (2) Deputy I's, and fifteen (15) Part -Time Non -Eligible Park Deputies. Training time shall be considered as Law Enforcement Service. The commencement time of the shift is to be determined by the usual shift starting and ending time established by the Oakland County Sheriff's Department. Law Enforcement Services beyond the scope of this contract are available upon request by Parks and Recreation to be paid for at the established overtime rate or by Part -Time Non -Eligible Park Deputies. 5. Parks and Recreation agrees to pay for such law enforcement service at the established rate consistent with the attached payment schedule, such sum to be paid monthly. Billing shall commence on the date the deputies are assigned to Parks and Recreation. Fractional months services will be prorated on a work day basis for the month involved. 6. The Sheriff shall not be required to fill-in for any time said officer is not present due to annual leave, sick leave, personal leave or any other authorized leave time granted unless requested by Parks and Recreation to be paid for at the established overtime rate or by Part -Time Non -Eligible Park Deputies. 7. This twenty-two (22) month agreement shall be effective March 1, 1990 and shall terminate December 31, 1991 provided that said agreement may be renewed for mutually agreed contract periods thereafter by Parks and Recreation, at rates established by the County, by giving its intentions to renew said agreement in writing to the Sheriff at least 45 days prior to the expiration date. Said notice is to be sent to the Oakland County Executive and the Oakland County Sheriff., and be it provided further that either party hereto may elect not to renew same by giving written ,notice thereof to the opposite party at least 45 days prior to the expiration date. 6-3 8. In the event said Parks and Recreation elects not to renew said Agreement by giving notice as provided in paragraph 6, Parks and Recreation agrees that if it establishes its own Parks Patrol it will give consideration to employ to the Oakland County Sheriff's Deputies, if any, who will be laid off by virtue of the termination of said agreement, but in no event does Parks and Recreation agree that it shall be obligated to hire such personnel. 9. Parks and Recreation may terminate said agreement, upon sixty (60) days written notice delivered to the Oakland County Executive and the Oakland County Sheriff. F. Miller $3,245.00 These reels will attach to our existing Jacobsen Greensmower and be used daily on the greens. The life of these reels should be five years. This piece of equipment is a new attachment for greensmowers and has proven to promote grass shoot growth and eliminate grain on a green. Staff recommends you award the bid to the single supplier, W. Specifications were based on the Tennant 186 Sweeper/Scrubber and the companies were asked to bid on it or the approved equal. Staff recommends awarding hte bid to the sole bidder and single supplier of this machine, the Tennant Company, for $8,936.00. The life expectancy of this machine is 15 years. Four years ago, park staff identified a picnic table frame with top and seat board specifications that meet our expectations and are functioning very well in our park operations. Annually this tractor costs several thousand dollars to maintain, and in 1990 there are several major repairs expected due to the age of the tractor. The tractor currently has 2,148 hours of service. The original purchase price was $9,994.80, and staff expects $6,000 to $7,000 from the sale of this tractor at the spring county auction. The new tractor will perform general maintenance functions, such as road grading and grounds maintenance, plus assist with capital improvement projects. This tractor will also serve as the back-up for beach maintenance and will be used in field area mowing operations. The life expectancy of the new tractor is between 15 and 20 years. Wells, Recreation Supervisor INTRODUCTION Since the inception of the Mobile Recreation program in 1974, the primary objective has been to provide an outreach prograrn to areas of Oakland County lacking in recreational resources such as staff or facilities. In addition, the mobile units and staff allow our agency to develop and expand a positive public image. Due to the limited financial resources of many municipal parks and recreation departments (especially adversely affected in recent years), non-profit community groups and block clubs, even our modest fee schedule covering basic direct costs only (wages, fuel and depreciation), make our units unavailable to them. BACKGROUND In order to get a total perspective of this request it is important to understand the past history of grant programs for Mobile Recreation. From 1975 through 1980, the Oakland County Parks and Recreation Commission received federal funds administered through the Community Services Administration at a rate of approximately $20,000 per year, for such purposes. As a result of the budget reduction action of the 1981 federal administration, this program was eliminated. 12-2 In 1981, Mobile Recreation operated without any grant in aid support for the first time. Many groups, especially the low-income from areas such as Pontiac, Ferndale, Hazel Park and others, were unable to use the services of this program. However, in response to numerous letters of support from municipal representatives of these groups, this Commission in late June of 1982, established its own $15,000 grant program entitled the Community Assistance Program. The 1982 program was well received, and in the limited time of its operation, we granted 163 no charge visits at an estimated value in excess of $12,000. Each year since 1982, the Oakland County Parks and Recreation Commission has approved funds for the Community Assistance Program to send an average of three free units to eligible communities. Other visits are made available to non- profit organizations. 1990 OAKLAND COUNTY PARKS AND RECREATION COMMUNITY GRANT REQUEST The request from the Mobile Recreation staff for 1990 is as follows: 1. The grant program will not exceed the amount of $20,000 and should include approximately 300 visits. 2. Unit requests eligible for this grant program will be from June 6 to August 24, 1990. 3. Priority for the distribution of the grant visits will be based upon staff evaluation of the expressed and perceived needs of the municipal parks and recreation organization and socioeconomic factors. Every effort will be made to insure the equitable distribution of these visits. All groups evidencing such need and the inability to pay a reduction or the total price of the units, will be considered. Priority of requests by groups will be: 12-3 a) parks and recreation agencies b) municipalities/government c) non-profit organizations d) private agencies 4. All requests are accepted on a first come, first -serve basis. 5. This grant is on a trial basis only. There is no guarantee that this money will be available in subsequent years. 6. The Sportmobile, Skatemobile, Mimes, Bleachers and Puppetmobile units would be the only units available in this program. Each unit will have a $25 fee to offset the cost of the gasoline, staff etc. 7. This grant program has been established by funds appropriated to the Oakland County Parks and Recreation Commission and is not a federal or state funded program. 8. Evaluation of the Community Assistance Program will take place at a date to be named. 9. Additional units budgeted under C.A.P. go to the Park Awareness Program. c r r x x x x A T l r The Mobile Recreation Community Assistance Program is an excellent opportunity to provide recreational services for the residents of Oakland County.
