September 18, 1991
The meeting was called to order at 9:15 a.m. by Chairman Wint in the Activity
Center Building at Haas Lake Park in New Hudson, Michigan.
COMMISSION MEMBERS PRESENT:

them for their hospitality in hosting the meeting at their park.

of the meeting of September 4, 1991, as written.

ACTIVITIES REPORT:
Moved by Mr. Olsen, supported by Mr. G. Kuhn to receive the Activities
Report for August, 1991.

50 MILL TAX LIMITATION:
Chief of Administrative Services Frank Trionfi informed the Commission that staff
has been notified by Equalization that our newly -renewed millage may be severely
reduced because of the constitutional 50-mill limitation.
Staff will be meeting with Equalization to discuss possible recourses.
Staff was requested to work towards a solution to the problem. Some suggestions
from the Commission included hiring a tax attorney to review our situation, along
with an audit of the tax figures at Equalization.
PARKING LOT ASPHALT REPAIRS - WATERFORD OAKS:
Moved by Mr. Vogt, supported by Mrs. Tomboulian to approve the expendi-
ture of $4,362.00 to Bush Brothers Asphalt Paving Company for the parking
lot repairs at Waterford Oaks.

MOUNTED PATROL SERVICES:
Commission requested the Mounted Division provide figures showing their expenses
incurred during their park patrol for the 1991 season.
Moved by Mr. Olsen, supported by Mr. Law to table the approval of the
payment for the Mounted Division's services for 1991 until the next
Commission meeting.

RESTROOM ADDITION WELL - INDEPENDENCE OAKS:
Moved by Mr. Vogt, supported by Mrs. Tomboulian to award the contract
for the installation of a 3" well for the Twin Chimneys restroom addition/
renovation at Independence Oaks to the low bidder, Jim Layman Well Dril-
ling, in the amount of $5,849.43.

PICNIC TABLES - WATERFORD OAKS:
Moved by Mrs. Tomboulian, supported by Mr. Olsen to award the bid for
the purchase of 100 picnic tables for the Waterford Oaks Wave Pool to
the low bidder, R. J. Thomas, in the amount of $10,160.00.
Commissioner Tomboulian requested staff investigate additional brands of recycled
plastic picnic tables for possible use within the parks system.

#5 FAIRWAY IMPROVEMENT - GLEN OAKS GOLF COURSE:
While the construction/renovation is taking place at Glen Oaks for the Pebble
Creek Drain, staff would like to raise the level of #5 fairway 11-2 to 2 feet with
approximately 1,500 yards of sand.
Staff is in the process of receiving bids to purchase and haul this material and
requested Commission approval of an amount not to exceed $6,000 to do this work.
Moved by Mr. G. Kuhn, supported by Mr. Law to approve an amount not
to exceed $6,000 to purchase sand to raise the level of #5 fairway at
Glen Oaks Golf Course.

MANAGER'S REPORT:
The Manager's Report is as filed in the agenda.
NEW BUSINESS:
---Manager Richard noted that, as lessee of the Red Oaks Golf Course, the Commission
has been named as a liable party for the cost of clean-up of alleged contaminations
found at the incinerator site.
Staff has contacted Corporation Counsel for further instructions and will keep
the Commission updated on any progress.
The next Commission meeting will be at 9 a.m. on Wednesday, October 2, 1991.

HAAS LAKE PARK:
Gary Rickard described the facilities available at Haas Lake Park, along with
special interests the owners have for some of their patrons.
The meeting was adjourned at 11:12 a.m. to a tour of Haas Lake Park and the
Rookery.

ELECTRICAL RENOVATION
ADDISON OAKS CONFERENCE CENTER
Proposals were received for the purpose of retaining the services
of an electrical engineering consultant for designing electrical renova-
tions for the conference/banquet center at Addison Oaks.
The electrical design work would include the following:
Survey - An extensive survey would be completed indicating all
electrical outlets, fixtures, circuiting, panels, etc., plus an existing
conditions drawing and a report covering code and safety problems, design
deficiencies, risk analysis, and an electrical construction budget cost
estimate.
Construction Bid Documents - Plans and specifications would be
prepared to bring this facility up to current codes, correct any safety
and/or design deficiencies and add new outlets and fixtures as may be
required to meet owner's and users' needs.

ADDISON OAKS
Attached is the proposed agreement between Oakland County Parks
and Dinosaur Hill as recommended by Corporation Counsel.
We are recommending you enter into this agreement based upon con-
currence with Dinosaur Hill.

LAND LEASE FOR CONSTRUCTION OF MOVEABLE BUILDINGS
THIS MEMORANDUM OF LEASE AND AGREEMENT, entered into this
day of , 19 , to be effective the flay
19 , by and between the OAKLAND COUNTY PARKS AND
RECREATION COMMISSION, hereinafter called the COUNTY, and DINOSAUR
HILL ASTRONOMICAL SOCXETY, hereinafter. called DHAS:
WHEREAS the COUNTY owns and operates the Addison Oaks County
Park, Addison Township, and has certain plots of ground available
which can be leased to the Lessee upon the conditions hereinafter
specified; and
WHEREAS DHAS is desirous of Leasing said plot of ground upon
said conditions for the purpose hereinafter set forth.
NOW THEREFORE THIS AGREEMENT WITNESSLTH:
1) The COUNTY hereby lets and leases to DHAS and DHAS hereby
leases from the COUNTY for a period of three (3) years from and
after. the date of this lease for a term commencing
and expiring ,
the hereinafter described property. DHAS shall have the right of
renewal of this lease at the expiration thereof upon such terms and
conditions as shall be agreed upon between the parties hereto.
Said property Located in the Addison Oaks County Park in Addison
Township, Oakland County, Michigan, and described as follows:
2) DHAS agrees it will use said property in compliance with
the laws and regulations of the Township in Addison, Oakland
County, State of Michigan, and the United States.
3) DHAS agrees that the privileges herein granted, in whole
or in part, shall not be assigned, transferred or in any manner
disposed of without the approval of the COUNTY.
4) DHAS agrees that in the use of said above: -described land,
no obstruction shall be made or any inconv6nience caused to the
COUNTY in the business of operating and maintaining the Addison
Oaks County Park.
5) It is further agreed that the enjoyment and use in common
with others upon the Addison Oaks County Park of all entrances,

exits, and approaches shall not be interfered with or interrupted
by any act of DHAS during the term of this lease.
6) DHAS hereby agrees to construct up to 3 approved type
buildings on the above -described property within one (1) year from
the date of this lease at its own cost and expense, said plans to
be approved by the COUNTY.
7) Any grading of land, drilling of well, installing of
udrgrcndsleo-or telephone cable, septic tank, or any other
facility above or below ground shall be done at DHAS' own expense,
i.ncluding._ ter=- etr and general maintenance.
8) DHAS convenants and agrees that it will keep the exterior
of the buildings constructed by DHAS and the appurtenant grounds
covered by this lease in tidy condition, the mewee , and that
the grounds shall be kept free from rubbish and other
unsightly objects or things.
9) The COUNTY agrees that at the expiration of this lease or
any renewal thereof, DHAS may within a reasonable time remove any
and all buildings, structures and other improvements or part of
buildings, structures or other improvements placed or erected on
said premises by DHAS during the term thereof or any renewal
thereof; all expenses connected with such removal to be borne by
DHAS.
10) DHAS agrees at the expiration of this lease, the COUNTY
shall have the right to ownership of all buildings and other
permanent improvements erected or placed upon the premises and they
shall become its property in fee simple without process of law if
DHAS does not exercise its right in Paragraph 9.
11) DHAS as part of the consideration hereof, hereby
undertakes and agrees to indemnify and save the COUNTY harmless of
and from all loss, injury or damage to person or property of the
COUNTY, employees of the COUNTY or others which may arise or be
alleged to arise through, on account of or ovt of the privilege
herein granted, whether caused by theft, fire or otherwise. DHAS
shall provide liability insurance in the amount of _ ►
with the COUNTY, its agents and employees as additionai named
insureds.
12) DHAS undertakes and agrees that in case any claim is made
or suit is brought against the said COUNTY for any said loss,
injury or damage, which may arise or be alleged to arise through,
on account of or out of the privilege herein granted, DHAS will
upon notice from the COUNTY, settle, adjust and defend the same at
DHAS' sole cost and expense and will pay any judgment rendered
together with costs of court,
13) As part of the consideration of this lease, conditioned-
upon payment of the applicable entry fee, the COUNTY hereby grants
to DHAS the right to use in common with others having that right,

parking facilities for automobiles of DHAS, its guests and
invitees, which are now owned or which may hereafter be developed
by the COUNTY, at such times during day or night and days of the
week as shall be established from time to time by such rules and
regulations as may be prescribed for the use thereof by the COUNTY,
acting through its Park supervisor.
14) If contingencies arise in the future whereby the COUNTY
adopts a general policy of charging a revised entry fee, then upon
due notice, DHAS shall pay such fee, provided however that other
users of the County Park are charged a similar fee.
15) it is expressly understood tht the present rules and
regulations now in effect governing the Addison Oaks County Park,
or any future amendment thereto, shall be binding and shall be
considered a part of this lease and shall be complied with by DHAS
in all details.
16) It is agreed that the COUNTY and its duly authorized
employees shall have the right of ingress and egress to said leased
premises, including all buildings or appurtenances placed or
erected on said premises for inspection purposes or for any purpose
occasioned by emergency.
17) The COUNTY shall have the right, but not the
responsibility, to enter upon the leased premises to maintain,
repair., renew or remove sewers and underground telephone or
telegraph conduits or other installations. The COUNTY agrees to
perform any work wi.th reasonable dispatch and to leave said
premises in as good order and condition as the same were in prior
to the commencement of the work.
18) With prior approval, DHAS may conduct fund raising events
for the purpose of maintaining or improving the facility, but no
signs, posters or similar devices shall be erected, displayed or
maintained in vei.w of the general public in, on or above the space
herein leased without written approval of the park Supervisor, and
any not approved by him shall be removed by the COUNTY at the
expense of DHAS.
19) DHAS further agrees to pay any taxes or Ispecial
assessments hereinafter legally levied by a governmental agency
against the buildings or personal property of DHAS. The non-
payment of any such taxes by DHAS for ninety (90) days shall be
grounds for cancellation of this lease by the COUNTY.
20) DHAS for itself, its personal representatives, successors
in interest and assigns as a part of the consideration hereof, does
hereby covenant and agree as a covenant running with the land that
(1) no person on the grounds of race, color or national origin
shall be excluded from participation in, denied the benefits of or
be otherwise subjected to discrimination in the use of said'
facilities; and (2) that in the construction of any improvements
on, over or under such land and the furnishing of services thereon,

no person on the grounds of race, color or national origin shall
be excluded from participation in, denied the benefits of or
otherwise be subjected to di.scrimi.nation, and (3) that the Lessee
shall use the premises in compliance with all other requirements
imposed by or pursuant to Title V1 of the Civil Rights Act of 1964,
and as said regulations may be amended.
21) That in the event of breach of any of the above
nondiscrimination covenants, the COUNTY shall have the right to
terminate the lease and to re-enter and repossess said land and the
facilities thereon, and hold the same as if said lease had never
been made or issued.
22) This lease shall be non-exclusive and subordinate to the
provisions of any existing or future agreement between the COUNTY
and other governmental bodies relative to the operation or
lmai.ntenance of the Park, the execution of which hasibeen or may
be required as a condition precedent to the expenditure of funds
for the development, operation or maintenance of the Park.
23) The COUNTY reserves the right to further develop or
improve the area of the Park as it sees fit, regardless of the
desires or views of the DHAS and without interference or hindrance.

hands and seals the day and year first above written.

Just as the weather cools
and trees prepare for the tran-
sition from summer to winter,
the Oakland County Parks and
Recreation Commission be-
gins its preparations for the
fall and winter.
The transition between the
busy summer and the slower
fall and winter months started
for the parks about two weeks
ago when the water slides,
wave pools and the beaches
closed on Labor Day, said
Janet Pung, public communi-
cation officer.
The closing of the water ac-
tivities and beaches brought to
an end one of the busiest sum-
mers Oakland County parks
has experienced in its 25-year
history.
While county officials have
yet to determine the final tally
for summer attendance, Pung
said they anticipate atten-
dance to be up at all nine Oak-
land County parks.
"Attendance is always at its
peak during the summer
months, but this year was a
premier year as far as weath-
er was concerned," Pung said.
With a busy summer behind,
cleanup, renovation and
preparation for the winter and
next summer has begun.
At Addison Oaks County
Park, clerk Beverly Lalone
said construction crews are
racing against winter to put
the finishing touches on addi-
tions and renovations to sever-
al of the park's facilities.
At Waterford Oaks County
Park, director Tom Jackson
said his crew has been busy
closing down the park's wa-
terslide and wave pool and
storing away summer equip-
ment.
"We drain our pool just
enough to clean and plug the
inlets and outlets, but we don't
drain our pool completely,"
Jackson said. "If you take
water out of a pool, the frost
and freezing can pop the pool

this summer and the beginning
of next summer, most of the
park activities take on a new
appearance.
Gone are the sunbathers,
boaters and swimmers. The
hikers,cross- country skiers
and hunters will replace them
this fall and winter.
Hunters will descend on
Orion Oaks County Park for
another season of bow hunting
from Oct. 1 through Dec. 31.
And in other parks like Glen
Oaks, Red Oaks and Indepen-
dence Oaks, golf, hiking,
camping and miniature golf
are activities that Pung said
can extend into early Novem-
ber if the weather remains
mild.
Personally, though, Pung
hopes for snow this winter.

Michigan is supposed to be the
`Winter Wonderland.' But we
haven't experienced much of
that kind of winter in recent
years.,
When the snow finally hits,
Pung said county residents ca
look forward to cross-country
skiing, snowmobiling, ice
skating and other winter
sports.
In addition, less traditional
winter activities like a covere
golf driving range, nature cer
ters and platform tennis are
available year-round.
If the snow doesn't arrive
this year, Pung said county
residents should stick around
until the winter of 1993 when
Waterford Oaks will open a re
frigerated toboggan run. She
said the run will need no snoNs

Pung said the commission
recently received a matching
grant for the toboggan run
from the state Department of
Natural Resources so the pre
ject can go ahead.
