The meeting was called to order at 9:16 a.m. by Chairman Wint in the Commission
Room of the Parks and Recreation Commission's administration office.

STATEMENT OF OPERATIONS AND CAPITAL IMPROVEMENT.PROJECTS BUDGET UPDATE:
Moved by Mr. G. Kuhn, supported by Mrs. Fox to receive the Statement
of Operations for the month ending July 31, 1991, and the Capital Im-
provement Projects Budget Update as of July 31, 1991.

RESTROOM ADDITION - INDEPENDENCE OAKS:
Moved by Mr. R. Kuhn, supported by Mrs. Fox to award the contract for
the addition and modernization of the Twin Chimneys restrooms at
Independence Oaks to the low bidder, Clafton & Keating for the base
bid plus alternates 1, 2, and 3 in the amount of $82,209, plus a 5%
contingency, for a total budgeted amount of $86,320.

ENTRANCE TERRACE RENOVATION - ADDISON OAKS:
Moved by Mr. Olsen, supported by Mr. G. Kuhn to award the contract for
the renovation of the entrance terrace at the Addison Oaks Conference
Center, including removal of the existing stone surface and replacing
with a brick paver, new steps and landings, and lighting, to C & H
Landscaping for the base bid, less alternates, for $50,570, plus a 5%
contingency of $2,528, for a total budgeted amount of $53,098. Prior
to contract, project to.be reviewed for review and suggestions by Kirk -
architecture.

RESTORATION PROPOSAL - ADDISON OAKS CONFERENCE CENTER:
Moved by Mr. R. Kuhn, supported by Mr. Vogt to award the contract for
the restoration proposal for the Addison Oaks Conference Center, in-
cluding field survey and diagnostic annotations, construction cost
estimations, and construction documents/specifications, to Kirkarchi-
tecture in the amount of $5,200.

ENTRANCE TERRACE HANDRAILS - ADDISON OAKS CONFERENCE CENTER:
Moved by Mrs. Fox, supported by Mr. Olsen to award the bid for the pur-
chase of handrails for the entrance terrace at the Addison Oaks Con-
ference Center from the low bidder, ACI Steel Fabricators, in the amount
of $3,042.85.

CONFERENCE CENTER EXTERIOR UPDATE - ADDISON OAKS:
Chief of Design J. Figa updated the Commission on the status of the exterior
repairs at the Addison Oaks Conference Center. Mr. Figa expressed his concern
over the exposed chimneys and requested Commission approval to use whatever funds
are necessary to close up the exposed chimneys before winter weather causes any
further damage.
Commission directed staff to have Kirkarchitecture review the site as soon as
possible for suggestions and recommendations for repairs before completing any
additional work on the chimneys.
NEW BUSINESS:
Tax Rafiinrl
Staff was informed that, in accordance with a court settlement between General
Motors and the City of Pontiac, the Parks Commission owes $100,755 as a refund
for a tax overpayment for the years 1985 through 1990. The amount noted is a
reduction of 5% from the actual amount due, plus no interest has been charged.
Commission directed staff to check with Equalization on other possible assessment
changes that could result from lawsuits.
Moved by Mr. Lewis, supported by Mr. R. Kuhn to authorize a refund of
parks and recreation millage funds in the amount of $100,755 for the
years 1985 through 1990 to General Motors in accordance with a court
settlement. This refund will be made subject to repayment of the funds
if the property is sold at higher than existing market value.

Vehicle Use Policy:
Manager Richard noted that, as part of the Oakland County Board of Commissioners'
study on the use of county -owned vehicles, Parks and Recreation has been included
with recommendations for cutbacks and overnight use.

(Commission Meeting, September 4, 1991)
The fleet policy recommendations will be presented at the September 5 Finance
Committee Meeting. The Parks Commission suggested a resolution be adopted and
presented at that meeting stating the Parks Commission reserves the right to
establish a policy for the assignment and use of county -owned vehicles to Parks
and Recreation staff.
Moved by Mr. R. Kuhn, supported by Mrs. Fox to adopt the following
resolution:
WHEREAS, the Oakland County Parks and Recreation Commission is
a separately funded county department established under Public Act 261;
and
WHEREAS, the Parks Commission operates on a millage approved by
the Oakland County electorate; and
WHEREAS, the Parks and Recreation Commission establishes, approves
and oversees a separate annual operating budget; and
WHEREAS, vehicle use is reviewed as part of the annual budget plan-
ning process; and
WHEREAS, some Parks and Recreation staff are on 24-hour emergency
call; and
WHEREAS, the Parks Commission -appreciates the convenience of a
vehicle pool and service.
NOW THEREFORE BE IT RESOLVED that the Oakland County Parks and
Recreation Commission reserves the right to establish a policy for the
assignment and use of county -owned vehicles to Parks and Recreation
staff.

PARKING LOT ASPHALT REPAIRS
WATERFORD OARS
Asphalt repairs for the parking lot at Waterford Oaks were required
when the utility companies services were disconnected to the old Mobile
Recreation building that had been demolished earlier this year.
Purchasing researched and awarded a contract to the low bidder,
Bush Brothers Asphalt Paving Company, for all county asphalt repairs
for 1991.
Staff requested a bid on the repairs for Waterford Oaks and received
a quote of $4,362.00.
Staff discussed this quote with Purchasing and felt it was an
appropriate bid.
Staff requests Commission approval of this expenditure.
Funds are available in the Capital Improvement Projects Budget
for this contract.

INDEPENDENCE OAKS
Bids were requested for the complete installation of a new 3" well
for the Twin Chimneys restroom addition/renovation at Independence Oaks.
This well will provide the necessary water supply for this facility.
The existing water is only a single outside faucet supplied by
the swimming beach bathroom/concession. Due to the distance, the pres-
sure and supply will not be adequate for the new restroom.

FAIRWAY IMPROVEMENTS, HOLE 15
GLEN OAKS GOLF COURSE
Over the years, the fifth fairway at Glen Oaks has been under water
on numerous occasions and has been unable to maintain any quality turf.
With the renovation in progress at hole #9, staff talked with the
contractor about raising the level of #5 fairway with approximately
12 to 2 feet of sand. For this project, 1,500 yards of soil would be
needed.
Staff is requesting a price for this sand for an amount not to
exceed $6,000; hope to have a firm figure in time for the Commission
meeting for your approval.
Staff feels this is the time to do this project, since the hauling
of this material at this time will not damage any other fairway.

PARKS MILLAGE UPDATE
50 MILL LIMITATION
Earlier this year, in preparing the 1992-93 county executive
budget, staff became aware of some disturbing facts with respect
to our new millage commencing in 1992. It was learned the County
of Oakland has a 50 mill property tax limitation that is constitu-
tionally mandated. In two attorney general opinions it has been
stated millage collection under the 50 mill limitation is to be
prioritized by the County Board of Commissioners on a first passed,
first collected basis up to the 50 mill limitation.
Given this, the fact that the Commission's new millage will
be the last collected of the newly voted millages in Oakland County
and the County will be over the 50 mill limitation, we have been
instructed by County Equalization to anticipate a millage revenue
reduction of approximately $2.7 million in 1992. Equalization,
in addition, (given the aforementioned facts) has stated the Commis-
sion will be unable to realize its full millage potential until
1997. Projected out, this.translates to a reduction in millage
revenue of approximately $16 million over this five year period.
This matter has been reviewed by Corporation Counsel to ascertain
the Commission's status under the 50 mill limitation constitutional
mandate (see attached). Further review and discussion of the matter
will be forthcoming at the Commission meeting.

Attached is a copy of the Memorandum to Dick Caldwell.
The August 7, 1990, millage for Parks and Recreation will be the
first to be rolled back next year as it is the last voted. This
is a Constitutional provision. Amendment of this 50 mill limit
is almost impossible; i.e., a Constitutional Amendment to RAISE
tax limits.
The Huron -Clinton Authority is exempt from the 50 mill limitation
because it is an authority. It is an authority because MCL
119.51 through 119.61 specifically designates the "Huron -Clinton
Authority". I am at this point unclear as to how the Oakland
County Parks and Recreation Commission could be designated as an
authority such as this. Specific legislation would need to be
created, yet Oakland County Parks and Recreation doesn't really
fall into the traditional parameters of an authority as it does
not consist of several jurisdictions.
Next, if the status were changed via new legislation to a new,
totally independent corporate entity, would the August, 1990,
voted 1/4 mill go with it? This is unclear as the vote was not
for another park authority such as Huron -Clinton. It was for
Oakland County Parks and Recreation.
Please let me know what other avenues you would like our office
to explore.

RE: 50 Mill Limitation
You have inquired as to the application of the 50 mill limitation
as contained in Art. 9, Section 6 of the Michigan Constitution,
when the gross millage with Headlee Amendment rollbacks in a
jurisdiction exceeds that 50 mill limitation.
The County Board of Commissioners must, at its October apportion-
ment meeting, assure that the 50 mill limitation is not violated
(1990, Attorney General Opinion, No. 6654). Taxpayers may
challenge proposed millage rates if they believe that proposed
millage rates exceed the 50 mill limitation. Grosse Ile Committee
for Legal Taxation v Grosse Ile Township, 129 Mich App 477 (1983).
The appropriate remedy for millage rates which exceed the 50 mill
limitation is, according to the Attorney General, a reduction of
the last millage increase approved by the voters. According to
the Attorney General, if all of the other millages in Oakland
County are levied up to their maximum allowable rates, the last
voted extra millage increase must be reduced in an amount
sufficient to bring the total millage levied under the 50 mill
limitation.
Furthermore, although prior Attorney General Opinions have indi-
cated that the last millage to be levied, as opposed to approved,
should be reduced, the Attorney General has most recently. taken
the position that it is the date of voter approval and not millage
levy that is determinative in establishing which millage rates have
priority. Absent case law to the contrary, the most recent

because of his ability to get the job done. We

at our Qualifing Games. Because it is a qualifier
year, it is so important to have the games run at
