The meeting was called to order at 9:03 a.m. by Chairman Pecky D. Lewis, Jr. in
the commission room of the Parks and Recreation Commission's administration
office.

of the meeting of May 19, 1993, with the following corrections:
Page 3 - 2, under Approval of Payments: Voucher 4-30 should be
changed to read 4-380.
Page 3 - 4, under World Championship of BMX Race 1994; at the end
of the 3rd paragraph add the following sentence: "Commission
directed staff to send Chairman Lewis and up to four staff members."

World Championship of BMX Race 1994 and present an updated report.
Commission also directed staff to prepare a letter to be addressed to the
Oakland County Board of Commissioners in recognition of the recent publicity on
this race and as an effort to clear up any misunderstandings.

Interdepartmental Payment Register for the April charges paid in
May.

STATEMENT OF OPERATIONS:
The Statement of Operations for the month ending April 30, 1993 was accepted as
filed.
CAPITAL IMPROVEMENT PROJECTS BUDGET UPDATE:
The Capital Improvement Projects Budget Update as of April 30, 1993 was accepted
as filed.
OAKLAND PARKS FOUNDATION REQUEST:
Moved by Mrs. Fox, supported by Mr. Skarritt to approve the Oakland
Parks Foundation's request to use Springfield Oaks Golf Course on
September 24, 1993, for the First Annual Lewis Wint Memorial Golf
Outing planned to raise funds for the expansion of the Independence
Oaks Nature Center.

DNR/HCMA RESOLUTIONS:
Moved by Mrs. Fox, supported by Mr. Lozano to adopt the following
resolution to be sent to the Governor of the State of Michigan:

(Commission Meeting, June 16, 1993)
WHEREAS, the Oakland County Parks and Recreation Commission
was established in 1966 under Public Act 261 for the purpose of
providing recreational activities for its and residents and
acquiring and developing lands for park usage; and
WHEREAS, the Oakland County Parks and Recreation Commission
has worked with the Huron -Clinton Metropolitan Authority over these
years in the best interests of the residents of Oakland County; and
WHEREAS, the Oakland County Parks and Recreation Commission
believes in continually striving for the best way of using the tax
money from the residents of Oakland County; and
WHEREAS, after reviewing the plan submitted by the Huron -
Clinton Metropolitan Authority on the proposed use of Indian Springs
Metropark and the existing Pontiac Lake Recreation Area, the Oakland
County Parks and Recreation Commission believes that combining these
areas underneath one management/agency would be in the best
interests of the people of the area; and
WHEREAS, the Oakland County Road Commission, the Huron -
Clinton Metropolitan Authority, and the Michigan Department of
Natural Resources will be working together on the safety improvement
issues of Williams Lake Road for the best interests of the residents
of Oakland County; and
WHEREAS, the Oakland County Parks and Recreation Commission,
by resolution, requests that the Michigan Natural Resources
Commission give consideration to making Pontiac Lake Recreation Area
land available to the Huron -Clinton Metropolitan Authority as a
joint park to improve the quality of recreation for the residents
of Oakland County, recognizing all of the existing use of the
property including hunting, snowmobiling, horseback riding, mountain
biking, a shooting range, and integral recreational activities
within the Pontiac Lake Recreation Area.
NOW THEREFORE BE IT RESOLVED that the Oakland County Parks and
Recreation Commission, in the spirit of intergovernmental coopera-
tion, herewith requests the State of Michigan Natural Resources
Commission to transfer the Pontiac Lake Recreation Area to the
Huron -Clinton Metropolitan Authority, to assure the maintenance of
existing programs and to provide a comprehensive and integrative
program of recreational activities for the people of Southeastern
Michigan.
LET IT BE FURTHER RESOLVED that the Oakland County Parks and
Recreation Commission adopts this resolution and authorizes its
transmittal to the Governor of the State of Michigan, along with
copies forwarded to the Natural Resources Commission, the Director
of the Department of Natural Resources, and the Chairman of the
Huron -Clinton Metropolitan Authority.

Moved by Mr. Lozano, supported by Mr. Olsen to adopt the following
resolution to be sent to the Governor of the State of Michigan:
WHEREAS, the Oakland County Parks and Recreation Commission
has worked with the Oakland County Road Commission on the concerns
of safety for the residents of Oakland County; and
WHEREAS, the Oakland County Road Commission, working with the
government agency of Waterford Township, would like to have the
property here below specified deeded to the Oakland County Road
Commission to accommodate the proposed relocation of that segment
of Williams Lake Road in Waterford Township, Oakland County.
NOW THEREFORE BE IT RESOLVED, that the Department of Natural
Resources convey the Oakland County Road Commission the property in
Waterford Township bounded by Gale Road on the north, existing
Williams Lake road on the east, M-59 on the south, and the west
township line of Waterford Township on the west.
LET IT BE FURTHER RESOLVED that the Oakland County Parks and
Recreation Commission adopts this resolution and authorizes its
transmittal to the Governor of the State of Michigan, along with

of the Department of Natural Resources, and the Chairman of the

for the design, purchase, and installation of a play equipment

in the amount of $65,000.00, subject to approval by the Michigan
Department of Natural Resources as part of a matching grant from the
Land and Water Conservation Fund.

McCarthy Construction in the amount of $16,705.00 for the Groveland
Oaks storage/workshop facility concrete.

for the installation of approximately 1,265 feet of 5 ft. chain -
link fence, reinstallation of approximately 500 feet of existing
fence fabric, repairs to two areas of fencing, and repairs and
fabric to two existing gates for the Addison Oaks Wastewater Treat-
ment Facility to Durable Fence in the amount of $12,500.00 for the
base bid, plus a ten percent contingency, for a total budgeted
amount of $13,750.00.

the repair of two chimneys at the Addison Oaks Conference Center to
the low bidder, Akins Construction, in the amount of $11,623.00,
plus a $3,000.00 contingency, for a total budgeted amount of
$14,623.00.

Chief of Design Joe Figa updated the commission on the status of the
refrigerated toboggan run, noting the final package should be ready to go out
for bid within the month.

the purchase of 42 Santana Poly —mar restroom doors/partitions and
two urinal screens for Section A, Section C, and The Pines restroom
buildings at Groveland Oaks to the low bidder, Giant Plumbing/
Heating, in the amount of $15,190.00.

Brothers, in the amount of $10,925.00, plus a ten percent con—

1992 UNEMPLOYMENT BENEFIT CHARGES:
Chief of Administrative Services Frank Trionfi informed the Commission of the
1992 unanticipated fringe benefit charges of $33,634.00 for unemployment
compensation benefits paid to part-time employees. Staff noted that the main
portion of these charges was paid to retirees who collected during the winter
months.
Discussion followed on the eligibility to receive these benefits and what staff
can do to keep a closer watch on the department's costs.
Commission directed staff to contact the Michigan Recreation and Park
Association with a request to work on this problem, which other parks and
recreation agencies across the state must be experiencing. Commission also
suggested staff contact the county executive to request help from his lobbying
staff.

---The golf dome structure at` Red Oaks blew down in a recent storm; the
Paglino's insurance is replacing the structure.
---Manager Richard reviewed a letter recently received from Kevin Kirkpatrick
of the Waterford Schools Golf League, which plays at Springfield Oaks Golf
Course, along with staff's response letter to him.
---Chairman Lewis reported on the Special Park Districts Forum recently held in
Akron, Ohio; it was noted that the 1995 forum will be co -hosted by the Oakland
County Parks and Recreation Commission and the Huron -Clinton Metropolitan
Authority.
---Commission/staff retreat: New date for the retreat was set for Tuesday, July
13, at the Addison Oaks Conference Center. The agenda will plan for an all -
day conference with no regular meeting items.
The meeting was adjourned at 11:55 a.m.
The next meeting will be 9 a.m. on Wednesday, July 7, at the Waterford Oaks Wave
Pool, to be followed by a park tour and lunch.

REFRIGERATED TOBOGGAN RUN
Staff received the following bids for the purchase of 200 each 8-foot
toboggans and pads for use at the refrigerated toboggan run at Waterford
Oaks, which is scheduled to open in December.

No bids were received from either Entretires or Ziffco.
The price per toboggan is $150.00, which includes the wooden toboggan
and a foam pad.
Each toboggan will hold up to four individuals and will be transported to
the tower by staff.
Due to the importance in design of the chute, plus the strength and
weight of the toboggans, the Woodbender toboggan is the only toboggan that
meets specifications.
A reference check found that the Cleveland Metroparks utilized the Paris
toboggans from 1986-1988. These toboggans lasted structurally for one year,
then became weak. Cleveland Metroparks now use the Woodbender toboggans,
whose longevity is 3 - 4 years.
Staff concurs with Purchasing's recommendation to purchase 200 toboggans
and pads from Woodbenders, for a total cost of $30,000.00.
Funds for this purchase are available in the Recreation Supplies line item
of the Refrigerated Toboggan Run's Operating Budget.

FUEL TANK REPLACEMENT
RED OAKS AND SPRINGFIELD OAKS
We have received an invoice for $6, 208.00 from RV Seaman,
the company we contracted with to replace our fuel dispensing
systems at Red Oaks and Springfield Oaks.
This invoice was for necessary changes and additions not
covered in the original contract. Most of these additions were
mandated by the state fire marshall.
These additions include the following: relocating of the
monitor panels, containment pans under pumps, hose breakaways
and splash guards, and emergency shut-off buttons.
Also included in this invoice is a charge of $2,508.00 for
additional environmental services needed to monitor and report
removal of contaminated soil.
Staff requests approval of the payment of this expenditure.
Funds for this expenditure will come from the Capital
Improvement Projects Budget contingency.

TOPSOIL LOADING AND TRUCKING
CONTRACT AMENDMENT
INDEPENDENCE OAKS
At the May 5, 1993, Commission Meeting, approval was given for staff to
contract with Mueller Carnago Company of Lake Orion to load and truck 1900 cubic
yards of topsoil (previously approved contract Jan. 20, 1993, for processing by
AAA Topsoil - Ortonville from 1988 Oakland County Road Commission road project)
from Independence Oaks to Addison, Groveland, and Red Oaks.
On Friday, May 25, when these contract services were performed, staff, with
Purchasing's approval, requested the contractor to move compost materials at the
park maintenance building and haul topsoil to the beach ball field dredging
spoils reclamation project using their 5 cu. yd. loader.
The amendment request for this contract is as follows:

BEACH BALL FIELD DREDGING SPOILS
RECLAMATION PROJECT CONTRACT AMENDMENT
INDEPENDENCE OAKS
In December, 1992, staff contracted the dredging of the boat rental lagoon
and boat launch area on Crooked Lake at Independence Oaks. The dredging spoils
were pumped to two sediment lagoons at the park's ball field area to separate
the solids from the liquid materials. Staff determined in May that the marl in
the sediment pools was 4'-6' deep and, due to its instability/wetness, would need
to be removed.
Staff solicited bids to remove the marl and rough grade the project area.
Purchasing awarded the contract to Purves Excavating of Davisburg for $2,950.00.
During the project, staff and the contractor mutually determined that
additional fill dirt and topsoil (both available at the park) would be required
(hauled and graded) in order to complete the project. Comparable prices were
solicited by staff with Purchasing's approval to amend the original contract with
Purves Excavating as follows:

MANAGER'S REPORT
---Attached is information the Commission requested regarding the
corrections workcamp program we have been using over a number of
years.
As you remember, we cannot use the program because there is no
contract.
The attached paperwork spells out our present situation. Any
questions will be answered at the meeting.
---For your information: A copy of "On the Desk of..." is
attached, which lists on -going projects and who oversees them.
If you have any questions, please let us know; we will be happy to
respond.
---Information will be available at the meeting on the BMX World
Race, plus an article from the Spinal Column on passbooks.
---NRPA: Please notify Karen Smith if you are planning to attend
any special tours offered by NRPA during the national congress.
Information should be given to Karen by the end of July in order
for Karen to confirm your registrations; these programs tend to
fill quickly.
---Staff has been contacted by Ameritech regarding a possible tower
at Orion Oaks, in addition to the one at Addison Oaks. The tower
at Orion would be on the west side of Baldwin Road, where the Com-
mission has 30 acres of property we have no plans for.
A presentation may be made to the Commission in the future on this
proposal, if Ameritech can work out the details with Orion
Township.
---Attached is a list of honors and awards the Oakland County Parks
and Recreation Commission has received over the past 15 months.
---A tour of Waterford Oaks will immediately follow the Commission
meeting.

Attached is a letter from Corporation Counsel concerning the pending contract
with the Michigan Department of Corrections Work Camp Program.
As you can see, the concern centers on striking the Damages and Save Harmless
.Clause from our contract, per the request of the Michigan Department of
Corrections. Citing Corporation Counsels recommendation, Purchasing cannot
allow the County to enter into a contract with the Department of Corrections
unless they compromise on the damage and hold harmless issue.
Please review this matter with the Michigan Department of Corrections.
Hopefully, we can come to some sort of compromise. If you need any
assistance in your dicussions,_feel free to give me a call.

This office has had an opportunity to review the materials provided by Purchasing regarding the above
program. The Michigan Department of Corrections' requests to strike contract boilerplate Paragraphs 4
(Damages and Save Harmless Clause), 7 (Insurance), and 11 (Guarantees).
There is little problem from the perspective of this office if the State strikes Paragraphs 7 & 11. The State
is presumably self —insured and the work to be done Is not the type to which guarantees would be
applicable.
Striking Paragraph 4 Is out of the question. It is especially in this type of situation that we would need a
hold harmless agreement. A convict could be injured on our property. While the County would not
necessarily be directing his/her activity, it is a certainty that the County would be named in a suit.
Additionally, the possibility exists that a convict could injure a County employee or park patron.
It remains a business decision and not a legal one to decide whether the low cost ($5.00 per day per
worker) is a sufficient inducement to eliminate the protections afforded by Paragraph 4. This office would
recommend that the contract not be entered into without the protections of Paragraph 4.

SUBJECT: MDOC STATE TRUSTY WORK PROGRAM
Per your request I have reviewed the subject contract for the Michigan
Department of Corrections' State Trusty Work Program and I support Mrs.
Wasielewski's comments in her memo of December 17, 1992 to Amy Moore-Luettke.
In addition to her comments, there is a substantial problem raised by the
possibility that if these convicts were injured on our premises, they could be
held, under several decided Michigan Supreme Court cases, to be our employees
and thus eligible for worker's compensation and medical benefits. As you may
know we are self insured up to the first $400,000.00 of any workers'
compensation claim and thus would have a substantial exposure in this area.
If you wish to discuss this matter further, please do not hesitate to
