The public hearing for the grant applications was called to order at 9:03 a.m. by Chairman

Chief of Design Joe Figa noted that the Department of Natural Resources notified staff
that the deadline to submit applications to request matching Land and Water
Conservation, Natural Resources Trust, and Recreation Bond funds is April 1. This is the
first required review.
A public hearing is also a requirement of the DNR to qualify for funds. Notice of the
hearing was advertised in area newspapers.
The projects staff selected are as follows:
Carpenter Lake Acquisition
Lyon Oaks Acquisition
Independence Oaks Restroom Renovation
Staff presented the projects; no comments were made or questions asked by the public
on the grants for the Lyon Oaks Acquisition or the Independence Oaks Restroom
Renovation.

Each citizen spoke in favor of the county acquiring the property for a park, citing
preservation of the property's natural beauty and wildlife, the opportunity for acquiring
another county park in the south end of Oakland County without cost to the taxpayers,
and the benefit of this park to the community.
Manager Richard explained the grant application/approval process.
With no other comments received or questions asked, Chairman Lewis declared the
Public Hearing closed at 9:31 a.m.

PUBLIC COMMENTS:
The following citizens commented on/questioned the golf course policy change regarding league
make-up times:

Staff answered questions and concerns.
Mrs. Stark, a coordinator for a league that plays at White Lake Oaks, noted she has been working
with Pro Shop Supervisor Nancy Seets setting up a league substitute list. She indicated how her
league will be handling cancellations/substitutes for their league play and suggested other leagues
may be interested in the same procedure.
Oakland Press Reporter Buck Sralla responded to a comment from Commissioner Patterson
regarding a recent "Letter to the Editor" and subsequent footnote from the Press.

STATEMENT OF OPERATIONS:
The Statement of Operations for the month ending January 31, 1995, was accepted as filed.
CAPITAL IMPROVEMENT PROJECTS BUDGET UPDATE:
The Capital Improvement Projects Budget Update as of January 31, 1995, was accepted as filed.
ACTIVITIES REPORT:
The Activities Report for February, 1995, was accepted as filed.
AWARD PRESENTATION:
Chief of Recreation Sue Delridge presented to the Commission an award of appreciation received
from the Michigan Mountain Bike Association.
GRANT APPLICATION SUBMISSION:
Chief of Design Joe Figa noted that the Department of Natural Resources notified staff that the
deadline to submit applications to request matching Land and Water Conservation, Natural
Resources Trust, and Recreation Bond funds is April 1. This is the first required review.
A public hearing, which is a requirement of the DNR to qualify for funds, was conducted. Notice
of the hearing was advertised in area newspapers.
The projects staff submitted are as follows:
Carpenter Lake Acquisition
Lyon Oaks Acquisition
Independence Oaks Restroom Renovation
Carpenter Lake Acquisition consists of approximately 30 acres located in the southwest section
of the City of Southfield, near the intersection of Inkster and Ten Mile Road. The property is
wooded with a portion of the western boundary fronting on Carpenter Lake, a small impoundment
of the Rouge Tributary.
The estimated cost for this acquisition is $475,000 and will be a 70/30 matching grant of
$332,500 from the Michigan Natural Resources Trust Fund and $142,500 from the Oakland
County Parks and Recreation Commission. A donation from the owners will also be involved.
Lyon Oaks Acquisition consists of approximately 13.8 acres and is surrounded on three sides
by Lyon Oaks. The property is currently being farmed, although it is zoned light industrial.

The estimated cost for this acquisition is $200,000 and will be a 70/30 matching grant of $140,000
from the Michigan Natural Resources Trust Fund and $60,000 from the Oakland County Parks
and Recreation Commission.
Independence Oaks Restroom consists of a renovation of the bathhouse facility to enlarge the
present restroom and add new barrier -free facilities in order meet current new ADA standards and
better accommodate park users.
The estimated cost for this renovation is $35,000 and will be a 70/30 matching grant of $24,500
from the Recreation Bond Program and $10,500 from the Oakland County Parks and Recreation
Commission.
Staff requested Commission approval of a resolution to submit the grant applications.
Moved by Mr. Olsen, supported by Mrs. Johnson to approve the following
resolution for the submission of grant applications:
WHEREAS, the Oakland County Parks and Recreaation Commission has
been notified by the Department of Natural Resources that applications for cost
sharing grants from the Michigan Natural Resources Trust Fund and Recreation
Bond Program may be submitted by April 1, 1995; and
WHEREAS, the Oakland County Parks and Recreation Commission has
identified and established priorities for acquisitions and improvements within the
adopted Recreation Master Plan; and
WHEREAS, the Oakland County Parks and Recreation Commission
recommends the filing of the following applications to the Department of Natural
Resources for a matching grant:
Lyon Oaks Acquisition
Independence Oaks Restroom Renovation
NOW THEREFORE BE IT RESOLVED that the Oakland County Parks and
Recreation Commission recommends submission of the above -said grant
applications with the appropriate matching funds to be designated from the one -
quarter mill.

WHEREAS, the Oakland County Parks and Recreation Commission has
been notified by the Department of Natural Resources that application for cost
sharing grants from the Michigan Natural Resources Trust Fund and Recreation
Bond Program may be submitted by April 1, 1995; and
WHEREAS, the Oakland County Parks and Recreation Commission has
identified and established priorities for acquisitions and improvements within the

Discussion followed, in which commissioners expressed their concerns over this acquisition,
including: future costs, such as the dam repair and lake dredging; going against a basic premise
of the Parks Commission not to duplicate local facilities; pursuing this acquisition against local
government wishes; and not being able to service the residents on a county -wide level with this
purchase.
Other commissioners noted that this acquisition is a golden opportunity to acquire land in the
south end of the county virtually cost-free.
Commissioner Patterson suggested that, in the next Southfield city-wide election, put a question
on the ballot asking residents whether or not they would be in favor of this acquisition by the
county.
Chairman Lewis related a conversation he had with Southfield Mayor Fracassi, in which Mayor
Fracassi noted he would support the county's efforts if both the 30-acre parcel and the 17-acre
parcel adjacent to it were purchased, feeling that would be a more viable park for the county.
Moved by Mr. Patterson, supported by Mr. G. Kuhn to amend the motion for the
Carpenter Lake grant application submission as follows:
...to approve the following resolution for the submission of a grant application..."if
the 17 acres adjacent to the 30-acre parcel can be acquired and the Southfield city
officials approve the county park there."

SPRINGFIELD OAKS ACTIVITY CENTER PAVING:

paving of the entrance drive and new drive to the upper parking lot at the
Springfield Oaks Activity Center to the low bidder, F. Allied Construction Company,
in the amount of $133,329, which includes Alternate #1, a deduct for using on -site
material for required fill in the amount of $27,350, and Alternate #2, unit cost, plus
a ten percent contingency of $13,300, for a total budgeted amount of $146,629.
This also includes contracting with Giffels-Webster to supervise the project during
construction for the amount of $3,360, as presented in their original proposal.

landscaping of the new entrance drive and entrance to be constructed at the
Springfield Oaks Activity Center to the low bidder, J. Swayne Custom Landscape,
in the amount of $8,064 for the base bid and Alternate #1, plus a ten percent
contingency of $806, for a total budgeted amount of $8,870.

WATERFORD OAKS WAVE POOL RENOVATION:
Consultants from Giffels/Hoyem-Basso and Water Technology presented a preliminary design for
the renovation of the Waterford Oaks Wave Pool.
The conceptual scheme for Phase 1 will include a children's water feature, a new family ride,
expanded concession area, and renovated bathhouse.
Phase II is planned to include a lazy river, sand play area, inner tube and body slide, and tube
rental.
Commission directed staff to prepare a cost benefit/cost usage report, along with an overlay of
existing vs. proposed features at the facility, and present that information at the next meeting.
MANAGER'S REPORT:
The Manager's Report is as filed in the agenda.
NEW BUSINESS:
---Commission requested a tour of the Mobile Recreation equipment at the April 5 meeting.
---Mrs. Fox announced a party being held in her honor in Farmington Hills on Friday, March 31,
at 3:30 p.m.
The next meeting will be at 9 a.m. on Wednesday, April 5, 1995.

GLEN OAKS
GREENING ROAD PAVING
The request from the City of Farmington Hills for assistance in the paving of Greening
Road was presented at a previous commission meeting. The primary items requested were
additional property along Glens Oaks' westerly boundary of approx. 101, moving and
reinstalling the existing fence, installing a drainage line along a portion of Greening Road,
and paying a portion of the paving costs.
Correspondence was forwarded to them requesting clarification, additional
information, and an on -site field visit to determine a more accurate identification of the
amount of property that they require for Right of Way easement necessary for the
construction of this project.
A response has been received and their engineer and our staff met with them on the
site. We have included this correspondence for your review and discussion.
Oakland County Parks and Recreation has customarily cooperated in the past with local
governments and the Road Commission in the conveyance of additional R . 0. W and installation
of fencing on the proposed rather than the existing R . 0. W .
Staff recommends that we also cooperate with the City of Farmington Hills and assist
them with the fence relocation, drainage along the westerly boundary, and conveyance of
the required R.O.W.
A representative from Farmington Hills will be at the meeting to answer any questions
regarding this project and their requests.

The above project was presented at the Jan 4, 1995 Parks Commission meeting.
During the discussion several concerns were expressed which require resolving
prior to any further action by our commission. The concerns are as follows:
1. The value of the road improvements to our facility in
relationship to our costs.
2. A value will be assigned by our property management
division to the Glen Oaks property that is proposed for
conveyance for Greening Rd. improvements. This will
provide a base value for working out costs .
3. It was suggested that perhaps a trade of equal value or
equal proportion of the 5 ac . parcel of land to the north
and west of Glen Oaks might provide a solution.
4. A reliable budget should be developed of our costs in
relationship to the total cost of the project.
5. An accurate alignment of the reinstalled fence should be
established. This would require the exact location of the
westerly property boundary in relationship to the existing
fence so that the appropriate footage of conveyance can be
determined, as well as any disturbed plant material.
6. Our commission is also concerned with the height of the
fence once it is moved back. Will this allow for more golf
balls to leave the park, therefore requiring us to extend
the height of the fence, altering views in both direction
and bearing additional cost for the fence extension and/or
additional tree plantings.

7. The commission would like to pursue an acceptable
procedure that would exclude Oakland County from
responsibility from damage from golf balls that hit the road
and deflect onto the houses or cars. We feel that the fence
relocation and asphalt paving may amplify deflection than
the present condition.
We are confident that the above concerns can be resolved in a cooperative and
equitable manner as we know we will receive from the City of Farmington Hills if
decision is made to pursue our addition to the clubhouse.

RE: Request for Participation in Glen Oaks Subdivision Road Improvement Program
Dear Mr. Richard:
In response to your letter of January 6, 1995 our office has the following comments which
hopefully will provide beneficial input for action by your Commission.
1. The value of the road improvement - typically, a road improvement project results in
benefits which include the following: improved road surface, improved vehicle handling,
improved vehicle stopping distance, better defined road, improved access from private
property to the roadway, improved traffic control at the intersections, improved dust
control, and improved drainage. With the large access gate that the golf course has to
Greening Street, many of the road benefits addressed have some impact on the benefits
to the golf course. Of particular concern is the permanent dust control and the improved
drainage for the area, as well as the goodwill nature of co-operation with the City and
residents in the Glen Oaks subdivision.
2. Property Value - You have indicated that a value will be assigned by your property
management division for the conveyance of Greening Road right-of-way. We look
forward to your input on this and note that our City Assessor has indicated that
easements normally are priced at sixty cents per square foot.
3. City Park Property - The consideration of a possible trade of property of equal
proportion for portions of the five acre parcel that the City owns due north of the golf
course may be something that can be explored in the future.
4. Bud2et - You have communicated a need to develop a reliable budget should the Oakland
County Parks & Recreation Commission decide to participate. Please note that the
overall road project amounts to $437,000.00. We have asked for your participation in
the amount of $60,369.30. This equates to a participation of approximately 14.5
homesite units. In addition, there is a fence relocation cost which we have previously
addressed, and it is approximately $32,000.00 for the Glen Oaks Golf Course frontage
and $18,000.00 for the City property frontage. We ask that along with the above
participation, the golf course attend to the relocation costs for the fence adjacent to their
frontage on Greening. Finally, there is also a storm drainage cost which is warranted
in the area adjacent to the third green where the fence cannot be relocated and a storm
sewer is necessary. This cost is estimated at $10,300.00 and we ask that the golf course

consider being responsible for this particular cost inasmuch as the fence cannot be
relocated in this area.
Recognizing that the Glen Oaks Golf Course abuts approximately 1600 1. f. of frontage
on Greening and that it is not obligated to an assessment, the existence of the frontage
does create a hardship to the other properties should the golf course decide not to
participate.
5. Fence Alignment - An accurate alignment of a re -installed fence has been established.
Our survey crew met previously with Mike Thibodeau and Skip Roche of your
organization relative to the appropriate layout. It is approximately 10 ft. east of the
existing fence line and is currently staked with stakes every 100 ft. It is our feeling that
this location would adequately accommodate the City as well as the golf course. We ask
that you obtain input from Mike Thibodeau or Skip Roche on this proposed offset.
6. Fence Height - You question the height of the fence once it is moved back and its impact
on allowing more golf balls to leave the park. This is a question that your personnel will
have to address. However, it is our feelings that the fence line relocation will have
minimal effect on play as it is not normally in the line of direct play.
7. Liability - Relative to a procedure that would exclude the county from being responsible
- for damage from golf balls that hit the roadway, we have attached a copy of our City
attorney's correspondence relative to this issue. Hopefully this will that help present
some input that can help resolve this concern.
With the above in mind we believe the above referenced comments should provide adequate
support for the Commission to consider our request as outlined in items A, B. and C in our
letter of December 15, 1993. Thank you for your help. We look forward to hearing from you
and should have any questions, please do not hesitate to contact this office. Finally, please note
that with summer construction imminent, it is important that we get this issue resolved by April

You have requested my comments on the concerns expressed by
the Oakland County Parks and Recreation Commission regarding
the paving of Greening Street. I understand the Commission
fears increased liability for errant golf balls which may
bounce further on asphalt than compacted dirt and gravel.
I believe the Commission's concern is misplaced, There are
two (2) broad theories of Tort -law under which a governmental
entity may be held liable in damages. The first, is for
negligent conduct, Under Michigan law the Commission enjoys
immunity from liability for negligence. MCL 691-1401 et seq,
City of Detroit v County of Oakland, 353 Mich 609, 92 NW2d 47
(1958); Adam v Sylvan Glynn Golf Course, 197 Mich Tapp 95, 494
NW2d 791 (1992). Of course, no immunity exists for intentional
or reckless conduct.
Linder the second 1.theory of recovery, the Parks and
Recreation Commission may be subject to liability for
situations which amount to a trespass -nuisance. That is the
situation where damage is caused by the intrusion of an
instrumentality upon private property as a result of action
under the control of the government, Hadfield v Oakland Count
Drain Commissioner, 430 Mich 139 (1988).

To avoid liability for trespass nuisance, the Parks and
Recreation Commission must take care in the design and
maintenance of the tees and fairways to assure that every
reasonably foreseeable golf shot will stay within the bounds of
the site. The golf course has no liability for bad golf play.
That may be the golfer's responsibility alone. It is the
course's responsibility to reasonably minimize the opportunity
for a typical shot to leave the course.
If liability exists, it exists now at that location.
Though a golf ball may bounce further on asphalt than dirt, or
may not, is not the issue. The issue is whether the golf ball
leaves the golf course property.
For example, a golf ball which bounces on asphalt and
breaks a window on the west side of Greening creates no more
liability for the golf course than a ball which hits a dirt
Greening Street and dents a car. If any liability exists at
all, it will be due to what steps the course has taken within
its boundaries to keep the customary golf shot from leaving the
property.

For the past year or so staff has been discussing with representatives of the 4H
Fair Association the feasibility of their managing the Springfield Oaks Activity Center.
Over the years, use of this facility and the success and type of programming provided
there have been subject of many discussions.
Staff would like to get the Commission's input and philosophy of such an
arrangement before staff or the representatives from 4-H devote a great deal of
additional time into working details and getting a draft agreement processed through
Corporation Counsel and Risk Management.

WAVE POOL RENOVATION
The renovation of the Waterford Oaks wave pool was discussed at the last
commission meeting.
The first phase, as presented by our consultants, consists of the proposed
development of a new children's play feature, a family or group tube slide ride, the
renovation of the existing bathhouse/concession building, and other miscellaneous
site considerations. Staff has been working with the consultants in refining this
proposal to include engineering costs as well as present and future budget expense
and revenue projections.
A presentation on the details of this project and a recommendation will be
presented at this meeting.

INDEPENDENCE OAKS
MASTER PLAN
Our consultants, Carlisle and Associates, have completed the revised master
plan for Independence Oaks. This plan is the culmination of staff and citizen input,
park user survey, commission review and input, correlation of the existing and
proposed uses, existing site conditions and natural features.
The final plan also incorporates the changes as discussed at the January 4,
1995 commission meeting.
We feel the plan will provide us with the direction required for future
development and grant submissions. Staff recommends that this plan be adopted.

We have received from Purchasing the following bids for the purchase of three
small sized pick-up trucks.

condition.
Specifications were written for a spike -proof carpeting available from Kraus.

The per yard price for this carpet, including installation, is approximately $17.50 per square yard.

PARK SYSTEM
ENTRANCE SIGN PROGRAM
Staff has been working on the development of a new design for entrance signs at the
parks for the past several months. The present signs, which are 18 to 20 years old, are
outdated and the two at Springfield have deteriorated and must be replaced. The project,
which includes three types of signs, will begin to standardize our present sign system.
The main sign is composed of two fieldstone columns with a wooden sign in the center.
It has our new logo with emphasis on Oakland County Parks and Recreation as well as the
name of the park. This type of sign will replace the existing signs at Waterford Oaks and
Springfield Oaks.
The second type of sign is similar to the main one, only smaller in scale. It will replace
the temporary sign at Addison Oaks. This was designed smaller, as future development calls
for three possible entrances to this park.
The third sign type will replace only the sign portion and not the existing base. Three
of the parks have cut fieldstone bases which still are very acceptable, structurally sound and
fit well into the new sign theme. These signs will be used at Groveland Oaks, Independence
Oaks, and White Lake Oaks.
All of the signs are constructed of redwood for durability and are two sided to allow
visibility in both directions. The sign, when completed, should remain for the next 25 years.
This design will also be used for new entrance signs in the undeveloped parks when
development occurs.
Bids were received on March 14,1995 for the sign program which includes the eight
signs ( double sided equivalent to 16 signs) .

MOBILE STAGE
MOBILE RECREATION
Bids were requested for the purchase of one mobile stage for the Mobile
Recreation program.
We currently have two stages that we use as rentals and for Oakland County
Parks & Recreation Commission special events.
Staff would like to purchase an additional stage to increase the revenues
for the Mobile Recreation program and meet the needs of our users. During
the past two years we have recorded 60 rentals that we were unable to
accommodate. This would be approximately $13,800.00 in additional revenue.
Since 1989, the mobile stages have gone out 738 times, serving 1,014,012
people in Oakland County. On an annual basis one stage generates
$10,000.00 in revenue.
This mobile stage will be accessible for everyone, by having a handicapped
access lift which will mount to the stage, providing wheelchair access to
the stage deck.
The anticipated life expectancy of this equipment is 10 years.

* Automatic deployable deck support truss with two 35,000 lb. jacks,
eliminates the hassle of multiple telspar legs. Leveling of folding
stage deck is much quicker and simpler.
There is $56,000 budgeted in the 1995 Mobile Recreation Operating Equipment
Budget.

SPRAY SHOT
RED OAKS WATERPARK
As an added attraction to the activities at the Red Oaks Waterpark, staff has
been working with Masters Group International who handles a piece of equipment for
a game of basketball in which, when the game is over, the losing player gets sprayed
with water. Staff has had the opportunity to view the equipment and have it
demonstrated and feels it would be compatible with the waterpark activities.
This equipment (game) is available for purchase for $22,750.00. The company
is located in Madison Heights and is very anxious to locate a unit in a waterpark
setting. They have offered a three-year contract to provide a unit for Red Oaks for only
a deposit of $2,750.00. If after 3 years we decide to purchase the unit, the deposit
would be applied towards the purchase price.
The game does require money to play. We feel $.50 per game could be
charged. At this rate the deposit should easily be recovered over the three-year period.
It is also felt that several thousand dollars could be collected each year if the game is
popular.
Parks and Recreation's cost would include a concrete pad, electric, and water
to the location. This would be in close proximity to the mechanical building, so would
not pose a serious problem or cost.
Attached is the proposed contract that staff recommends for Commission
approval.

---As per our master calendar, the meeting of April 19 is tentative. Would like to discuss
to see if should be confirmed and scheduled.
---REMINDER: Please mark your calendars for the morning of Friday, May 12, for the
Parks Commission's joint meeting with the county commissioners and state
representatives at White Lake Oaks. A copy of the letter of invitation being sent under
Chairman Lewis's signature is attached. This is a great opportunity for us to share our
parks with these officials.
---The following is information from U.S. District Court regarding major points about
specifications for product purchasing:
SPECIFICATION AUTHORITY DEFINED BY COURT
The specifying engineer/architect has clear authority - plus responsibility and
accountability for specifications.
This has been verified by the refusal of the United States Supreme Court to hear
further appeal or review of the decision handed down by the U.S. District Court,
Massachusetts and affirmed by the Federal First Circuit Court in the case of Whitten
Corporation vs. Paddock, Inc. (April 12, 1974).
Major Points:
This landmark decision clarifies four major points about specifications, and should
be of interest to everyone... particularly those involved in any phase of making or meeting
job specifications.
1. A one -brand -only specification is not a violation of the anti-trust law. The court
states that trained professionals/specifiers make informed judgments on systems which
best serve clients' needs.
2. Suppliers (manufacturers) can qualify as "or equal" only when the specifier
waives specifications.
3. The specifier "will waive specifications in order to obtain a better product for his
client."
4. The burden is on the supplier who has not been specified to convince him (the
specifier) that another product is equal or better for the purposes of a particular project...
Powerful Judgment:
The highly respected magazine Specifying Engineer call this "one of the most
powerful judgments in engineering construction law history." SE editors go on to say
"Technically, few brands of equipment are exactly alike. If the engineer decides to limit
his specification to one source, he has the responsibility to do so and enforce it."
"It is clear that the CONTRACTOR CANNOT decide that another supplier is
"equal." The specifier is charged with that responsibility and judgment."

this program. REMINDER: We are planning a tour of the Mobile Recreation trailers after
the meeting.
---The 1995 NRPA Congress for Recreation and Parks is being held on October 5 - 9 in
San Antonio, Texas. This year NRPA is offering a special registration package: Register
three members for a full package and receive the fourth registration package free --a
savings to the department of $240.
In order to receive the discount, however, our registrations must be received by May 5.
Therefore, please let Karen Smith know whether or not you are planning to attend no
later than April 12 in order for us to take advantage of this offer.

to an informational, 2nd annual breakfast meeting on Friday, May 12, 1995, at 9
a.m. at White Lake Oaks Golf Course in White Lake Township.
The purpose of this get together is to share with you present and future
plans of your Oakland County Parks and Recreation system. The invitees include
the state legislators of Oakland County, the Oakland County Commissioners, and
your host, the Oakland County Parks and Recreation Commission.
After this breakfast, we would like to invite you to participate in an 18-
hole scramble golf outing hosted by the parks commission that morning. Tee -off
time will be approximately 10 a.m., finishing approximately at 3 p.m. Lunch will
