OAKLAND COUNTY PARKS AND RECREATION COMMISSION MEETING October 6, 1999 The meeting was called to order at 9:12 a.m. by Chairman Pecky D. Lewis, Jr. in the commission room of the Parks and Recreation Commission's administration office. COMMISSION MEMBERS PRESENT: Chairman Pecky D. PUBLIC COMMENTS: There were no questions asked by, nor comments received from, the public. 3-1 (Commission Meeting, October 6, 1999) STATEMENT OF OPERATIONS: The Combined Statement of Operations for the month ending August 31, 1999, was accepted as filed. ACTIVITIES REPORT: The Activities Report for August, 1999, was accepted as filed. After discussion on the golf courses, Commissioner Law requested staff consider adjusting the weekend golf tee time reservation policy by allowing residents to make their reservations one day before non-residents. TWELVE TOWNS DRAIN PROJECT - RED OAKS: Joe Colaianne, Assistant Counsel from Oakland County Corporation Counsel, gave the history of the Red Ru n Drain, the agencies involved in the upcoming drain expansion project, and the issues directly involving the Parks Commission and Red Oaks County Park. Mr. Colaianne specifically noted the following issues that will directly affect the Parks Commission: • Restoration costs for the golf course; project cost vs. budget plans • Lease or acquisition of property currently occupied under lease with SOCRRA • Lease between Parks Commission and Red Oaks Golf Dome and Sports Village Mr. Colaianne recommended staff encourage the Drain Commission's engineering staff to meet with Parks staff to discuss the preliminary project design plans to see if there are additional ways to minimize the golf course destruction. He also suggested it may be beneficial to have staff attend the Advisory Committee and Drain Board meetings, or maintain communication with them, on any issues that affect Parks and Recreation. Commission discussed additional possible courses of action, including hiring independent counsel to review the lease with SOCRRA; hiring a golf course designer to provide an estimate of restoration costs; and sendin g a letter to the Drain Board requesting we be kept informed of any issues that affect Parks and Recreation. Moved by Mr. VanderVeen, supported by Mr. Coleman to authorize Chairman Pecky Lewis, Jr., send a letter on behalf of the Parks and Recreation Commission to the Oakland County Drain Board requesting they ensure Parks staff is informed of all issues on the Twelve Towns Drain Project that may affect the Parks Commission. AYES: Coleman, R. Kuhn, Law, Lewis, McConnell, Skarritt, VanderVeen (7) NAYS: (0) Motion carried on a voice vote. 1999 OPERATING BUDGET AMENDMENT_: Moved by Mr. R. Kuhn, supported by Mr. Skarritt to approve the transfer from the FY1999 Operating Budget Contingency in the amount of $10,500; $2,600 to the Waterford Oaks Toboggan Complex Building Maintenance, and $2,300 to the Grounds Maintenance line items; plus $5,600 to Mobile Recreation Equipment Repair and Maintenance line item. AYES: Coleman, R. Kuhn, Law, Lewis, Skarritt, VanderVeen (6) 3-2 (Commission Meeting, October 6, 1999) NAYS: (0) Motion carried on a voice vote. :s As per the information filed in the agenda, the following bid was approved as recommended by staff and Purchasing: Moved by Mr. Coleman, supported by Mrs. McConnell to award the bid for the purchase of the four each 20 ft. x 40 ft. frame tents complete with sides, two each for Independence Oaks and Mobile Recreation, from the low bidder, Armbruster Manufacturing Co., in the amount of $19,950.00. Funds will be transferred to Independence Oaks and Mobile Recreation's Small Tools/Equipment line items ($9,980.00 each) from FY2000 Operating Budget Contingency. AYES: Coleman, R. Kuhn, Law, Lewis, McConnell, Skarritt, VanderVeen (7) NAYS: (0) Motion carried on a voice vote. LYON OAKS UPDATE: Chief of Design and Development Joe Figa updated the Commission on the progress of the golf course construction at Lyon Oaks County Park, noting the contractor is currently on schedule. Executive Officer Ralph Richard noted that discussion has been taking place on the need for a distinctive name for the golf course at Lyon Oaks. Any input/suggestions from the Commissioners should be directed to Mr. Richard. HYDROLOGICAL STUDY AND WELL INSTALLATION: Chief of Design and Development Joe Figa explained changes in the well installation portion of the development project at Lyon Oaks and requested Commission approval of the additional costs. Moved by Mr. Law, supported by Mr. Coleman to approve the expenditure of $14,860.52 to Soils and Materials Engineering, Inc. for additional costs incurred as part of the hydrological study and well installation at Lyon Oaks. AYES: Coleman, R. Kuhn, Law, Lewis, McConnell, Skarritt, VanderVeen (7) NAYS: (0) Motion carried on a voice vote. EXECUTIVE OFFICER'S REPORT: In addition to the Executive Officer's Report filed in the agenda, the following was noted: 3-3 (Commission Meeting, October 6, 1999) ---The Class C liquor license has been obtained by Oak Management for the clubhouse at Lyon Oaks. Staff reported that the Parks own the license and Oak Management must petition the Liquor Control Commission to use it. The lease with Oak Management states that Oak Management must reassign its interest in the license back to the county at the end of the lease. ---Requests For Proposals have been sent out for the master plan revision of Orion Oaks. ---Administrator of Parks Dan Stencil updated the Commission on the needy family camping at Groveland Oaks ---Mr. Richard reviewed a letter sent to Oakland County Commissioner Nancy Dingeldey in answer to her questions regarding sewer/water issues at Lyon Oaks. The next meeting will be at 9 a.m. on Wednesday, November 3, 1999. The meeting was adjourned at 10:47 a.m. Richard D. This event has been very successful in educating the individuals with disabilities, as well as staff and volunteers, on how easy it is to adapt this sport for everyone. Carl's is the event sponsor. They have donated over $7,500 in cash and prizes to this program, which has enabled us to provide scholarships to disabled golfers and to create opportunities for individuals with disabilities to participate in sports. Roger McCarville, a disabled golfer and avid volunteer/supporter of our parks, was a key to securing Warren Orlick and Carl's Golfland. 7-1 ITEM #8 AWARD PRESENTATION Executive Officer Ralph Richard will present a Beautification Award received from Farmington Hills. 8-1 ITEM #9 HORSE BARN SPRINGFIELD OAKS Mrs. Holli Day, a member of an equestrian group, has approached Oakland County and Oakland County 4-H with a request to build a horse pavilion on the grounds at Springfield Oaks. Staff has met with her, along with Commissioner J. David VanderVeen, and feel this is a worthwhile venture. Mrs. Day is planning to raise the $100,000 in funds necessary to build this facility. The parties involved have met at the park and agreed on a location for the pavilion; we believe it will make a nice addition to the park. Mrs. Day will be at the meeting to make a formal presentation. 9-1 ITEM #10 SOFTWARE CONVERSION ADDISON, GROVELAND, AND INDEPENDENCE OAKS Addison Oaks has been using a registration software program at their facility since 1990. Groveland Oaks and Independence Oaks are currently using the same program to a lesser degree. We have been informed this program is not Y2K compliant and will no longer be supported. Omni Computer Consultants, Inc. is completing the Creation Section database conversion and is currently under blanket contract with the county. Consequently, staff is requesting commission approval to contract with Omni Computer Consultants, Inc. of Grosse Pointe Farms, Michigan, to convert the current database program to Microsoft Access. Groveland Oaks and Independence Oaks are scheduled for the Microsoft Access conversion program upon completion at Addison Oaks. The conversion at all three parks, which includes the transfer of over 17,000 data files, will be at a cost of $48/hour (approximately 660 hours of conversion time) not to exceed $32,000. The $32,000 will be transferred from operating budget contingency to the Addison Oaks, Groveland Oaks, and Independence Oaks computer operations line item at a suggested distribution of $16,000 for Addison Oaks (50%), $8,000 for Groveland Oaks (25%), and $8,000 for Independence Oaks (25%). 10-1 ITEM #11 FLEET VEHICLE REQUEST LYON OAKS With the work on the golf course being done at Lyon Oaks, we anticipate transferring full-time staff there at the beginning of April. To accommodate this move, staff is requesting three vehicles be added to the Parks' fleet. To accomplish this, we must receive your approval, then forward the request to Purchasing and the Board of Commissioners. ITEM #12 LYON OAKS UPDATE Mr. Figa will update the Commission on how the golf course project is progressing at Lyon Oaks. Along with this, staff is requesting Commission approval to proceed with the building of restroom facilities to be placed on the golf course similar to the facilities recently completed at Springfield and White Lake Oaks. Cost for these restrooms would be approximately $100,000. We anticipate using funds from the 1999 budget year surplus. The timetable for this project was planned in this manner in order to be completed without slowing down the entire project. With your approval, staff will begin the project planning plus obtaining the township's approval. 12-1 ITEM 113 EXECUTIVE OFFICER'S REPORT ---Attached is a letter from Joe Colaianne of Corporation Counsel for your information regarding the Twelve Towns Drain Project at Red Oaks. Also, in discussion with Corporation Counsel, Jerry Poisson will take the lead as the official Parks and Recreation legal counsel representing us and the Oakland County Board of Commissioners on this project. This representation is independent of any for the Drain Board or any other group. Background: Prior to 1949 the Red Run Intercounty Drainage District was established under former Michigan drain law, since recodified under Chapter 21 of the Drain Code of 1956. This drainage district is a separate public corporation administered by a three -member board consisting of the drain commissioners from Oakland and Macomb Counties and the Michigan Secretary of Agriculture. In the late 1940's the United States government, through its Army Corps of Engineers, undertook the federal Red Run Flood Channel Improvement Project in an effort to control flooding in the southeast end of Oakland County. In order to undertake the flood control project, the United States government, via eminent domain, acquired the property along the Red Run River [n/k/a the Red Run Drain]. Upon completion of the flood control project, the United States government transferred, via quit claim deed, certain properties to the Red Run Intercounty Drainage District. Subsequently, on May 14, 1956, the drainage district conveyed, via quit claim deed, a portion of the property it received in the deed from the U.S. government to the Southeastern Oakland County Garbage and Rubbish Authority [n/k/a the Southeastern Oakland County Resource Recovery Authority (SOCRRA)]. The Southeastern Oakland County Sewage Disposal System [SOCSDS] is a regional sewerage system serving the needs of 14 communities in Oakland County. This system was established by the Oakland County Board of Commissioners on April 21, 1942 pursuant to Act 342 of 1939. The western half of the SOCSDS contains the 12 Towns Drainage District, an area of combined sewers. A combined sewer is one that serves a dual purpose: it transports sanitary flow to a treatment facility during dry weather; and during wet weather events transports storm water runoff collected in the district along with the sanitary sewage. The system is operated by the county agency, the Drain Commissioner. In 1969, the Natural Resources Commission for the State of Michigan notified the Oakland County Drain Commissioner [then Daniel Berry], as agent of the SOCSDS, regarding his failure to adequately control the frequency, duration, and pollution content of sewage and waste discharges from the SOCSDS/Twelve Towns Drainage District to the Red Run Drain. The Drain Commissioner and the 14 communities were ordered to abate this pollution. This resulted in the construction of the 2.2 mile long pollution control facility, i.e., the retention treatment facility, within the United States government easement occupied by the Red Run Drain, According to the Drain Commissioner's staff, it was common practice to obtain the 13-2 Court Tower - West Wing • 1200 North Telegraph Road — Dept 419 • Pontiac, Michigan 4834t.0419 0 (248) 858.05W • Fax (248) 858-1003 Ralph Richard, P & R, letter (October 15, 1999) Page 2. property in total as opposed to obtaining an easement when undertaking a project. Consequently, the County of Oakland obtained much of the property necessary to build the retention treatment facility, with the exception of certain properties retained by the Red Run Intercounty Drainage District and SOCRRA. After completion of the pollution control facility there was a considerable amount of discussion and later authorization to construct a county golf course on approximately 122 acres of surface area occupied by the pollution control facility. Although no lease was entered into between the Oakland County Parks and Recreation Commission and the Red Run Intercounty Drain, minutes from the Chapter 21 Drain Board meetings indicate that Parks and Recreation were permitted to install and operate a golf course subject to the paramount rights of the drainage district. Moreover, the minutes reflect that if it ever became necessary to improve, enlarge, or modify the drainage or pollution control facilities, the park facilities were to be removed without expense to the Red Run Intercounty Drainage District, SOCSDS or the United States Government [Minutes dated July 29, 1974, Red Run Intercounty Drain.J There is also a Parks and Recreation resolution dated June 21, 1974, which provides that, "it is understood that the granting of this authority to use the surface area will in no way impede the primary functions and maintenance commitments of the" SOCSDS pollution control facility. There is a 25-year lease between Parks and Recreation and SOCRRA for a portion of the property owned by SOCRRA. This lease became effective July 1, 1976, and is due to conclude on June 30, 2001. In addition, the County of Oakland, through its Parks and Recreation Commission, on August 11, 1989, leased a portion of County property to the Red Oaks Golf Dome and Sports Village. This is a 20-year lease and will not expire until December 31, 2009. Finally, there is also a "license agreement" between the Drain Commisisoner [licensor] as agent for the SOCSDS, and the Red Oaks Golf Dome and Sport Village [licensee]. This license agreement was designed to have the owners of the golf dome acknowledge the existence of the pollution control facility [which exists underneath the property occupied by the dome] and the paramount rights of the SOCSDS. The SOCSDS pollution control facility is regulated by the Federal Clean Water Act of 1977, 33 USC 1251 et seq. and is authorized to discharge treated combined sewer overflows (CSOs) into the Red Run Drain which is tributary to the Clinton River. In the fall, 1998, the Michigan Department of Environmental Quality mandated that the 14 Twelve Towns communities make certain improvements to the pollution control facility. These 14 communities have chosen to use Chapter 20 of the Drain Code of 1956 to implement the necessary improvements. Under Michigan law, this newly created Chapter 20 Drainage District, known as the George W. Kuhn Drainage District, is a separate and independent legal corporation. Outstanding Issues: I related three distinct outstanding issues as they relate to the proposed improvements to the SOCSDS RTF. First, I noted that the 25-year lease between Parks and Recreation Commission and SOCRRA is due to expire in 2001. At the same time, the proposed improvements to the pollution control facility by the George W. Kuhn Drainage District will be well underway. Issues relative to what legal entity should acquire or lease this property [i.e. George W. Kuhn Drainage District or the County/Parks and Recreation] will need to be resolved. In addition, there are particular environmental risk exposures. The property owned by SOCRRA has been identified by the MDEQ as being contaminated due to its prior use as a landfill and incinerator site. Consequently, these environmental issues related to the SOCRRA property would have to be addressed and resolved before the property is acquired or a new lease entered into. Secondly, I addressed the issue of the restoration costs of the golf course. These costs have not been added or made a part of the proposed project plan for the new improvements to the SOCSDS retention treatment facility. Further, the issue as to what entity would be responsible for paying the cost of the restoration has not been resolved. It is my understanding that restoration of the golf course may be "grant eligible." That is, the cost for restoration may be included as a part of the cost of the project that could receive State Revolving Fund (SRF) financing. 13-3 Court Tower - West Wing . 1200 North Telegraph Road — Oept 419 . Finally, I indicated that the property leased to the Red Oaks Golf Dome and Sports Village by the County through its Parks and Recreation Commission will not expire until 2009 [20-year lease]. It is likely that this facility or portions thereof will be removed during construction at a considerable loss to the owners. Replacement and possible loss revenues, and what entity will be responsible for the restoration of the Golf Dome and Sports Village [County, GWK Drainage District, SOCSDS, Parks and Recreation, or the owners of the golf dome] have not been calculated or determined. Based on the foregoing, it is recommended that the Parks & Recreation Commission intensify its dialogue with the Drain Commissioner's staff and the 14 Communities in an effort to resolve the issues outlined above. It is suggested that a representative from Parks and Recreation attend the Drainage Board meetings of the George W. Kuhn Drainage District and the 12 Towns Advisory Committee meetings.
