Moved by Mr. Skarritt, supported by Mr. Law to approve the minutes of the special meeting of October 15, 2001, with the following change: 4- (Commission Meeting, November 7, 2001) After the first sentence reporting the call to order, add the following: "This was in agreement with the Commissioners' request in the meeting of October 10 that a special meeting would be held, if necessary, to approve the Red Oaks Waterpark expansion project contract to meet the completion deadline. Chairman Lewis congratulated Commissioner Law on becoming the Chairman of the Oakland County Board of Commissioners. APPROVAL OF PAYMENTS: Moved by Mr. Korzon, supported by Mr. Vogt to approve the payment of the Payment Summary, which includes the Interdepartmental Payment Register for August and September, 2001 (FM 11 and 12, FY 2001), and the Payment Register, including the Voucher Report Period for September, 2001 (FM 12, FY 2001), and the C.I.P. ACTIVITIES REPORT: The Activities Report for the month of September, 2001 was accepted as filed. AWARD PRESENTATION: Recreation Supervisor Jim Dunleavy presented the Parks Commission with the Governor's Council on Physical Fitness Regional Amateur Athletic Event of the Year 2001 Award received for the Oakland County Sports Camp. Executive Officer Richard presented the Commission with a check from the Clarkston SCAMP in the amount of $3,515.50 for use in youth programming at the Wint Nature Center. These funds are the Parks' portion of the proceeds from the SCAMP/Wint Memorial Golf Outing, which was held on September 7. DEPARTMENT LEGAL SUPPORT: As presented at the October 10 meeting, Oakland County Corporation Counsel Judy Cunningham provided a written opinion that the statute that created the parks and recreation commission created an agency relationship; therefore, as an agent of the county, the Parks Commission would be precluded from retaining outside counsel without the express consent of the Oakland County Board of Commissioners. Commissioner Law noted the intent of the inquiry is to address conflicts, or the appearance of conflicts as determined by the board, plus to handle legal areas in which Corporation Counsel has no expertise. 4-2 (Commission Meeting, November 7, 2001) He suggested the Commission request authorization to identify and hire a firm, on an as needed basis rather than on a retainer, in preparation for possible specific circumstances on contracts and municipal law. Moved by Mr. Law, supported by Mr. McPherson to authorize staff to prepare a resolution for Oakland County Board of Commissioner approval to allow the Oakland County Parks and Recreation Commission to retain outside legal counsel on an as -needed basis to handle specific instances of conflict, perceived conflict, and those areas in which Oakland County Corporation Counsel has no expertise. Also, to set up the procedures for how and when that attorney can be used. Commissioners expressed concern over how this would affect the current working relationship with Corporation Counsel, the definition of conflict, procedural administration of that contract, and the intent of the motion. AYES: Korzon, Kuhn, Law, Lewis, McCulloch, McPherson, Skarritt, Taub, Vogt (9) NAYS: VanderVeen (1) Motion carried on a voice vote. LEASE AGREEMENT — RED OAKS WATERPARK: A proposed lease agreement for the property at the Red Oaks Waterpark has been negotiated between Parks staff, Drain staff, and attorneys. Staff recommended Commission approval of the lease, which includes the following terms: • The lease is for 50 years with option to renew. • Future restoration costs will be shared equally between the Parks and Drain. Although the point covering the restoration costs is different from the Parks' original stance, the possibility of future costs is remote; and Parks and Drain staff believe this is the best compromise between the interested parties. Executive Officer Richard also noted that an environmental assessment phase I was completed on the property approximately 18 months ago; and since nothing has been done on or to the property since that time, staff is comfortable in using that assessment. Moved by Mr. Korzon, supported by Mr. VanderVeen to approve the lease agreement with the George W. Kuhn Drainage District for the property to construct, operate, and maintain the Red Oaks Waterpark facilities. RED OAKS GOLF COURSE UPDATE: Mr. Colaianne, attorney for the Drain Commission, updated the Parks Commission on the progress of the 4-3 (Commission Meeting, November 7, 2001) acquisition of the property from SOCRRA. He noted that negotiations have stalled on the point covering future restoration costs in the Parks' May 3, 2000 resolution and requested consideration for changes. Commission directed this information back to staff for review and recommendation at the December 5 meeting. Moved by Mrs. Taub, supported by Mr. Kuhn to award the following bids as per the information filed in the agenda and as recommended by staff and Purchasing: Aerial photography at Lyon Oaks and Springfield Oaks, plus a topographical survey for Springfield Oaks, to the low bidder, Advanced Mapping Technologies, in the amount of $15,925.00. Purchase of 500 multi -purpose stacking chairs for the Springfield Oaks Activities Center to the low bidder, Virco, Inc., in the amount of $17,000.00. Contract for the roof repairs at the Wint Nature Center at Independence Oaks to the low bidder, G. A. Frisch, in the amount of $25,050.00, plus a contingency of $3,750.00, for a total budgeted amount of $28,800.00. AYES: Korzon, Kuhn, Law, Lewis, McCulloch, McPherson, Skarritt, Taub, VanderVeen, Vogt (10) NAYS: (0) Motion carried on a voice vote. 2002 CAPITAL IMPROVEMENT PROJECTS REVISED BUDGET: As directed by the Commission, staff revised the 2002 Capital Improvement Projects Budget to reflect the project changes approved at the October 10 meeting for the Addison Oaks Campground Renovation Project and the Red Oaks Waterpark Expansion Project. Moved by Mr. Kuhn, supported by Mr. Law to adopt the 2002 Capital Improvement Projects Budget, as revised. HURON VALLEY TRAIL REQUEST — LYON OAKS: Moved by Mr. Skarritt, supported by Mr. Law to approve the expenditure of $92,000 toward the completion of the Huron Valley trail segment at Lyon Oaks along Pontiac Trail from Old Plank Road to the Wixom city limit. There is $40,000 budgeted in the 2002 Capital Improvement Projects budget for this expenditure; an additional $52,000 will be transferred from the 2002 Capital Improvement Projects Budget contingency. SPRINGFIELD OAKS ACTIVITIES CENTER MASTER PLAN UPDATE: Chief of Design and Development Joe Figa reviewed the updates made to the Springfield Oaks master plan to incorporate the planned farmstead, future equestrian facility, and changes to the roadway/parking. Moved by Mr. McCulloch, supported by Mr. Vogt to approve the Springfield Oaks Activities Center master plan update as presented. Waterford Oaks BMX 7-1 ITEM #8 RED OAKS WATER FEATURE The construction of the new water feature expansion at the Red Oaks Waterpark has commenced. One of the essential components in this expansion is the children's large water interactive play structure. This structure will consist of many sprays, water jets, large water -dumping bucket, slides and other interactive water components, similar to but larger than the one installed at Waterford Oaks several years ago. There is a $325,000 allowance for this item in the contract with Aquatic Development Group. We are to purchase this item with installation by our contractor. This structure can be purchased as a basic unit, as was the one installed in Waterford, or with some type of theme. The theming price will be included as an alternate in the bids. It is important that this unit be acquired at this time, as the pool will be started in the near future, and the plumbing connections must be compatible with the unit that is acquired. The item was bid out, with the bids due on Friday, November 30. 'r'L. , ° zi A. 1 .. � - ' y _ .; -• �• _ �. .. —---------'—' � , � air' _ - �J HNtDEE ,: . r. -- 1+w 1 r t 90 The Aercore 1000 can produce up to 600,000 CHEMICALS GOLF COURSES We have received from Purchasing the following bids for the purchase of two pallets (1,920 lbs.) of Daconil Ultrex fungicide for the golf courses: Turfgrass Inc. $8.50 lb. $16,320.00 South Lyon Sumplot Partners $8.50 lb. $16,320.00 Farmington Hills Lesco $9.10lb. $17,472.00 Ohio One and one-half pallets of this fungicide will go to Lyon Oaks and the remaining amount will be distributed to the other three golf courses. This product will be used for fungus prevention and cure in the 2002 season. To take advantage of recent price reductions on this product, we need to purchase before December 17 and take delivery by June 15, 2002. Earlier this season we paid $8.90 per pound for this product. Staff recommends awarding the bid to Turfgrass in the amount of $16,320.00. Turfgrass has always been available for disease problems at Lyon Oaks, and the product is readily available for our pick up. Funds for this purchase are available in each respective golf course's Grounds Maintenance Budget Line Item. 9-3 VENTRAC TRACTOR/MOWER INDEPENDENCE OAKS Bids were requested for a Ventrac Tractor with mower deck, cab, and snowblower for Independence Oaks. This vehicle will replace a ten year -old Steiner tractor. The reasons for replacing the Steiner with the Ventrac are as follows: The Ventrac tractor is safer and easier to operate because it uses a foot pedal as compared to a hand throttle on the Steiner tractor. This allows the operator to have both hands on the steering wheel, making it much easier to control. 2. The Ventrac tractor's wheel base is larger and has more room for the operator. In the Steiner tractor, the operator's knee hits the dash when turning. 3. The Ventrac tractor is easier to service because the engine and other components are not as cramped as in the Steiner tractor. This has been verified by both Cris Ferron at Lyon Oaks and Phil Goulding from FM&O Grounds, as they have both purchased a Ventrac tractor. 4. The Ventrac tractor's wider wheel base is safer for mowing sloped areas. It will not slide like the Steiner tractor. The only bid received for the Ventrac tractor was from Billings Feed Store Inc. of Royal Oak for $21,940.00. Therefore, staff is requesting Commission approval of this purchase from Billings Feed Store Inc. in the amount of $21,940.00. There is $24,000 budgeted in the Operating Equipment Budget for this purchase. 9-4 RED OAKS WATERFEATURE EXPANSION CHILDREN'S WATER PLAY FEATURE Bids were received on Nov. 30,2001 for the main children's water play feature at Red oaks. This water feature is a large interactive waterplay system, which includes a variety of waterjets, sprays, slides and a large water -dumping bucket. It is to be similar to the one at Waterford Oaks but considerably larger. The base bid was for the basic waterplay system with theming as an alternate. The price includes delivery of the system to the site. Our contractor will be performing the installation. Bids were received from the following. Base bid SCS Interactive Inc. $281,130 Tillamook Or. Whitewater W. Ind. Ltd. $283,075 Columbus, Oh Theming alt. $15,000 to $75,000 $$75,000 to$108,500 Staff has review the bids and recommends awarding the contract to SCS in the amount of $281,130 plus up to $25,000 for additional theming and on site supervision on the installation for a total not to exceed of $306,130. An allowance of $325,000 was included for this item in the contract for the construction of the waterfeature expansion with Aquatic Development Group. ITEM 110 ORION OAKS MASTER PLAN Staff has been working with McKenna and Associates and Ludwig and Associates for the last several months on revising the present Orion Oaks master plan, which was adopted in 1987. A steering committee was formed and meetings were held, two public workshops were held in April for citizen input, as well as meetings with the staff and the Parks Commission. A four -week period from October 12 to November 9 was also established where the plan and information was available to the public at our administrative office for additional review and comment. Information was also available on our web site for public comments. Today's public meeting presentation of the proposed plan is the culmination of the past several months of this various input and may be adopted at your discretion. 10-1 ITEM 011 LYON OAKS BUILDING CHANGES Staff recently discovered that a change order in the Lyon Oaks Clubhouse, which was discussed with the Commission in September of 1999, was never officially approved. These changes reduced the cost of construction. They amounted to $6,622.50 and included the following items: • Addition of a function room • Relocation of the banquet room bar • Relocation of the banquet room kitchen access • Relocation of the dance floor • Elimination of the small meeting room • .Relocation of the banquet coat room • Changes to the restrooms, including additional fixtures to golf and banquet restrooms • Additional entrance to bride's room • Relocation of phone areas • Provide two instead of one movable partitionwall • Design banquet room to accommodate 60 round tables instead of 66 • Provide an exterior sidewalk to banquet room for delivery There was also an extra charge of $2,580.00 for additional test digs for the golf course restrooms due to poor soil conditions. Staff is requesting Commission approval of both expenditures, for auditor's review, in the total amount of $9,202.50. Funds for these items will come from the 2002 Capital Improvement Project Budget Contingency. Staff will be available to answer any questions. ITEM 112 RED OAKS GOLF COURSE UPDATE Attached is information from the Drain Commission staff regarding the property at the Red Oaks Golf Course. Staff is requesting approval of this resolution to assist with the finalization of the purchase of the property with SOCRRA. 12-1 RESOLUTION TO: Drainage Board for the George W. Kuhn Drainage District (GWKDD) Southeastern Oakland County Resource Recovery Authority (SOCRRA) RE: Red Oaks Golf Course WHEREAS, on May 3, 2000 the Oakland County Parks and Recreation Commission adopted a resolution where it committed funding to restore the Red Oaks Golf Course and pay for the restoration over the next 20 years in conjunction with bonding of the George W. Kuhn Drain Project, subject to the following conditions: (1) the Oakland County Parks and Recreation millage was secured throughout the 20-year period, (2) the George W. Kuhn Drainage District's acquisition of the 18+/- acres from SOCCRA and (3) any restoration required as a result of future drain improvements will not require Parks and Recreation Commission funding; and WHEREAS, the George W. Kuhn Drainage District and the Southeastern Oakland County Resource Recovery Authority are currently negotiating the acquisition of the property by the drainage district; and WHEREAS, SOCRRA adopted a resolution that the property acquisition by the Drainage District is subject to the condition that current and any restoration and alteration of the Red Oaks Golf Course be the financial responsibility of the Oakland County Parks and Recreation Commission regardless of the need to restore or alter; and, WHEREAS, as a result of the positions of the parties there is an impasse. NOW THEREFORE BE IT RESOLVED, that the Oakland County Parks and Recreation Commission will commit funding to restore the Red Oaks Golf Course and pay for the restoration costs over the next 20 years in conjunction with the bonding of the George W. Kuhn Drain Project or by some other loan, with the following conditions: (1) during the period of time the Oakland County Parks and Recreation Commission is paying off either the project or other loan related to the current restoration costs of the Red Oaks Golf Course, the GWK DD will remain responsible for any golf course restoration costs resulting from future drain improvements; 12-2 (2) for ten (10) years thereafter, the GWK DD and the Parks and Recreation Commission agree to equally share the costs of any future golf course restoration as result of any drain improvements; and (3) thereafter, Parks and Recreation Commission will bear the responsibility of any golf course restoration costs as a result of future drain improvements; FURTHER BE IT RESOVLED, that the Commission authorizes its staff to negotiate with the GWK DD an agreement and funding necessary to restore the golf course; FURTHER BE IT RESOLVED that the May 3, 2000 resolution is amended to incorporate the foregoing. In the meeting, we were informed that the General Government Committee also has the same concerns, and Corporation Counsel is researching this issue for countywide ramifications. A letter from Corporation Counsel Judy Cunningham is attached for your information. As you know, this matter was discussed at length at your November 7 meeting. By way of following up on the attendant issues as detailed in your minutes from that meeting, John Ross (of my staff) and I met with Ralph Richard on November 14. At that time I advised Ralph that a similar question surfaced at the November 8 meeting of the Board of Commissioners — specifically, the issue of attorney conflicts, which is the apparent impetus for this continuing dialogue. As a result of the discussion at the November 8 Board of Commissioners' meeting, I was asked to prepare a comprehensive opinion on this matter. We are currently doing the research and working on this comprehensive opinion, which will not only consider the relevant statutes and case law, but also the applicable Rules of Professional Conduct for all attorneys. Since the Parks and Recreation Commission is an agency of the County [MCL 46.351(4)], the opinion I am drafting for the Board of Commissioners will have implications for your Board as well. In August, 2001, there were 26,335 "hits" on the web page (the largest number of any County department) compared to 10,214 hits in August, 2000. Parks and recreation information is updated quarterly including new services, events, and programs. The site is managed and designed by Public Communications staff members. ---Becky Christiansen of Waterford Oaks Waterpark was awarded a "Golden Guard Award" for 2001. The award is given by the National Pool and Waterpark program. Becky, from Waterford, was one of only 60 lifeguards nationwide to receive this award. ---Driver's safety: On Thursday, December 13, full-time staff will participate in a two-hour driver's training seminar. Part-time Mobile Recreation staff will receive similar training in spring, 2002. The seminar is being provided by St. Paul, the county's motor fleet insurance carrier at no direct cost to the Commission. ---Red Oaks Waterpark construction has begun for the new features and will continue until weather prohibits further progress. Addison Oaks campground road and lagoon expansion is in progress and will continue throughout the winter. If anyone would like to tour these facilities, please let me know. ---The Lyon Oaks clubhouse is now scheduled to be turned over to the Parks on January 15. As you know, this is the third delay with DeMattia on the completion of this building.
