STATEMENT OF OPERATIONS: The Statement of Operations for the month ending September 30, 2003 was accepted as filed. CAPITAL IMPROVEMENT PROJECTS BUDGET UPDATE: The Capital Improvement Projects Budget Update as of September 30, 2003 was accepted as filed. Commissioner McCulloch requested staff provide information on available CIP funds at the next meeting. ACTIVITY REPORT: Administrator -Parks Operations Dan Stencil explained the new reporting procedures for calculations of visitors at the day use parks. The new counting method will not provide for accurate comparisons from previous years, so 2004 figures will not have comparisons to the previous year. The Activity Reports for October and November, 2003 were accepted as filed. ELECTION OF OFFICERS: Chairman Lewis requested Commissioner McCulloch assume the position of Temporary Chairman for the purpose of electing new officers for 2004. Commissioner McCulloch assumed the Chair and opened the floor to nominations. Moved by Mr. Crawford, supported by Mr. VanderVeen to re-elect Pecky D. Lewis, Jr. as Chairman, Richard Skarritt as Vice Chairman, and Fred Korzon as Secretary of the Oakland County Parks and Recreation Commission for 2004. AYES: Crawford, Gregory, Korzon, Lewis, McCulloch, Palmer, Richards, Skarritt, VanderVeen, Vogt (10) NAYS: (0) Motion carried on a unanimous voice vote. Chairman Lewis re -assumed the Chair. MASTER CALENDAR: The Parks' master commission meeting calendar for 2004 was accepted as presented. 4-2 (Commission Meeting, January 7, 2004) CLUBHOUSE RENOVATION DESIGN SERVICES — WHITE LAKE OAKS: Proposals were received for the design, engineering, and project management for the renovation of the White Lake Oaks clubhouse. Parks staff will provide a survey of the immediate area and the footprint of the existing facilities. We will also provide any additional engineering services that may be required as a result of changes or modifications to the existing septic and water systems as required by code and/or the health department, plus any site modifications required by the township or other review or permitting agencies. Oak Management will hire a separate kitchen design consultant for this renovation. Staff recommended Commission award the contract to the low bidder, Gerald Yurk Associates, for Phase I (analysis of existing facility structural conditions, conceptual plan, and cost estimates), Phase II, (construction drawings and specifications, and bid assistance), Phase III (project management), and Miscellaneous (utility evaluations, site plan reviews for a total contract amount of $93,061, plus reimburseables. Vice Chairman Skarritt requested staff double-check with the Road Commission for Oakland County to ensure there will be no conflict with any proposed rights -of -way for that corner. Moved by Mr. McCulloch, supported by Mr. Richards to award the contract for the White Lake Oaks clubhouse renovation architectural design services to the low bidder, Gerald Yurk Associates, in the amount of $93,061 plus reimburseables, plus a ten percent contingency of $9,300, plus an additional $10,000 for permits and/or review fees associated with the construction, for a total budgeted amount of $112,361. This amount does not include unforeseen costs associated with the existing septic or water system that may need modifications as a result of the reviews by the local agencies, state and/or county health departments, or changes in the scope of the project. Staff were directed to provide at the next meeting a memo reaffirming these bids, detailing and clarifying the costs for the phases and miscellaneous; plus a list of the firms who received a bid package, along with a list of those firms who responded. Commissioner Vogt also directed staff to contact White Lake Township regarding a possible sewer connection. ELECTRICAL EASEMENTS —ADDISON OAKS AND INDEPENDENCE OAKS: Moved by Mr. McCulloch, supported by Mr. VanderVeen to approve the permanent electrical easement to upgrade the electrical service to 42 campsites at Addison Oaks, and the permanent electrical easement to provide electrical power to the new organizational youth campground at Independence Oaks, to the Detroit Edison Company. The Amphitheater will host groups such as Harpbeat with Donna Novack, Wildlife Encounters, San of the Group Musical Gemini, Rosco the Clown, puppet show with Eugene Clark, and Michigan Magic Revue with Gordon Russ. Performances range from 30 — 60 minutes in length. The focus of "On Stage" is to increase exposure and promote appreciation for the educational and cultural aspect of music and theatre, as well as the Oakland County Parks and Recreation Commission. The project is rather large scale in that it includes mainline and valves for the future nine -hole golf course expansion, as well as irrigation for the athletic/play fields with future provisions for the roadways, nature center, day use area and corporate picnic area. The project includes work not normally encountered or experienced by the typical contractor that specializes in commercial or residential installations. Therefore, we included fairly basic yet specific bidder requirements. We say "basic" in that we did not limit the experience to golf projects only, nor did we apply a time frame or limit of how long ago the projects were done. Specifically, we required the contractor show evidence of the successful completion of three projects where: 1. Scope and size of the project is similar to that of the proposed system. 2. A computer central programmer is utilized and required the installation of communication wiring and grounding 3. 6" and 8" pipe, fittings and valves operate under constant pressure ofl00 PSI or greater pressure The low bidder for the project was Michigan Automatic. In my letter of December 17, 2003, 1 stated we personally had a less then ideal outcome on the last few projects with Michigan Automatic. I think it is fair to say that all Contractors, from time to time, perform at less than peak ability. Much has to do with the workload and personnel at any given time. Checking current references produced several positive comments regarding their work. Therefore, I don't feel it would be fair to hold the past mentioned projects as evidence that they will or will not perform in the future. Therefore, my comments will be limited to the stated bidder requirements and whether they meet the intent, if not the letter, of the specification. 1. Projects of similar size and scope. Michigan Automatic has done many projects of similar size and in fact, many far more complicated than the one proposed. We have no issue with this requirement. 127 W. Their experience is limited in this regard, but they did provide evidence of three projects including Calderone Farms Golf Course (2002-2003), City of Troy (2004) and Port Huron Golf Course (1996). All three references did mention the man ufacturerldistributor of the control system offered valuable on -site assistance to the Contractor, which is common and would be expected at Lyon Oaks. 3. 6" and 8" pipe, valves and fittings operating under constant pressure of 100 PSI or greater. We consider this the most important of the three qualifications and the area where the most consequential problems could occur if not installed properly. We had difficulty verifying this requirement for Michigan Automatic, calling all eight references provided as evidence of installation of 6" and 8" pipe. A few indicated that 4" was the largest size pipe; only one was operating at a constant pressure of 100 PSI, and only one had 8" pipe. However, we did find three that meets the "intent' of the specification although not the exact requirements. They are: 1. Caledrone Farms Golf Course. This is a fairly recent project and meets the letter of the specification. Bill Newcomb, Golf Course Architect, confirmed the installation of both 6" and 8" pipe and system pressure of 100 PSI. 2. Friendship Park (athletic field complex). This project was installed approximately five years ago, has 6" pipe, and operating pressure is 90 PSI. 3. Ferris Estate. This is a private estate on 90 acres. The project contact confirmed there is "quite a bit" of 4" and 6" pipe operating under a constant pressure of 80-85 PSI (approx.--although he was not certain) If the County is inclined to demand full compliance with the specification, I do not believe Michigan Automatic would meet the standard. However, we find the above examples do demonstrate the general level of experience we are seeking. If the County chooses to award the contract to Michigan Automatic as the low bidder, we could support the decision. However, based on their limited experience with larger pipe, we do think the County would do well to pay very close attention to the materials and work under construction. In fact, I have a quick story. We ran into a woman at Costco a couple of months back who recognized us from the early meetings before bark park opened. She may have called you, I gave her your name when she asked if we thought it might be possible for a park employee to open the bark park service drive for her to bring in her terminally ill Newfoundland, Noah. Only 5 years old, dying of cancer, unable to walk more than a few feet. She wanted him to have the chance to be at bark park one more time before he was gone. I don't know her name but l recognized her, too. Bark park clearly made a powerful impact on her, she was in tears while telling us this. That kind of strong emotion shows just how highly valued bark park facilities are to the folks that partake. This is a sad story in some ways, but very revealing that OC Parks & Rec have done and are doing a fine thing with bark park. Michigan State Parks currently have park rangers issue a citation with an envelope to the park user for non -permit compliance. If the park user returns the envelope with payment for a daily permit on the same day that it was issued, the citation is voided out. There is a mail slot in the park office door where the envelope can be dropped off. We cannot use this type of program because park staff is not commissioned to issue citations. We tried this system with the sheriff department, but were discontinued by the courts, because once the citation has been issued, it cannot be voided out. Some other locations have a metal pipe buried in the ground with a slot for payment with a paddle lock. There are envelopes made available for payment with a tear -off section to put on the vehicle showing payment. If the park staff come around and check the pipe and payment was not made and the vehicle is still, there a citation is issued. This is basically an honor system, which we have already tried by issuing warning notification, which did not work. This type of system is prone to vandalism, due to the implication of money being in the pipe as well as the pipes being located in isolated areas. All of these types of programs are honor system programs, unless staff is capable of issuing citations and available to check areas to ensure compliance. We could no longer continue having the sheriff department issue citations for non- compliance, as the deputies would have no way of knowing if someone complies or not. Staff recommends we continue with the procedures currently in use. Park staff will be made available at these locations to sell daily permits and annual permits while performing other maintenance duties. Park deputies will continue to issue citations for non -permit compliance. Additional signs will be displayed notifying park patrons that permits can now be purchased on line. 15-15
