APPROVAL OF MINUTES: Moved by Mr. Crawford, supported by Mr. Richards to approve the minutes of the meeting of March 10, 2004, with the following changes: Page 4-1, reflect Commissioner Palmer's attendance as "excused absence." Page 4-4, in the motion for the installation of cart path paving and recapping, exchange "White Lake Oaks" for "Glen Oaks", and "Glen Oaks" for "White Lake Oaks." AYES: Crawford, Gregory, Korzon, Lewis, McCulloch, Palmer, Richards, Skarritt, VanderVeen, Vogt (10) NAYS: (0) Motion carried on a voice vote. APPROVAL OF PAYMENTS: 4-1 (Commission Meeting, May 5, 2004) Moved by Mr. Korzon, supported by Mr. Richards to approve the Payment Approval Summary, including: - Internal Service Funds Payment Register for March, 2004 (FM 6, FY 2004) - Internal Service Funds Journal Voucher Register for January, February, and March (FM 4, 5 & 6, FY 2004) - Oak Management, Inc. CAPITAL IMPROVEMENT PROJECTS BUDGET UPDATE: The Capital Improvement Projects Budget Update as of March 31, 2004 was accepted as filed. ACTIVITIES REPORT: The Activities Reports for the months of February and March, 2004, were accepted as filed. SPRINGFIELD OAKS MASTER PLAN: Chief of Design and Development Joe Figa reviewed the highlights of the proposed changes for the Springfield Oaks Activity Center master plan, including the proposed equestrian center, Ellis Barn, equestrian trails, event camping, and a bark park area. Two public hearings have been held for public input. Parks Commission will provide input at the next meeting for incorporation into the plan, which will then be brought back for Parks Commission approval. GLEN OAKS TREE REPLACEMENT: Moved by Mr. VanderVeen, supported by Mr. Richards to award the bid for the purchase, planting, maintenance, and warranty of 23 each 2 1/" caliper trees at Glen Oaks to Marine City Nursery in the amount of $8,500. These trees will replace trees removed due to the Emerald Ash Borer. 4-2 (Commission Meeting, May 5, 2004) AYES: Crawford, Gregory, Korzon, Lewis, McCulloch, Palmer, Richards, Skarritt, VanderVeen, Vogt (10) NAYS: (0) Motion carried on a voice vote. BIDS: Moved by Mr. McCulloch, supported by Mr. Korzon to approve the following bids as recommended by Parks and Purchasing staff: Award the contract for the repairs to the back curved wall of the Red Oaks wave pool with factory painted metal sheeting to the low bidder, Frisch, in the amount of $31,865.00, plus a five percent contingency of $1,595.00, for a total budgeted amount of $33,460.00. The amount of $8,460 from the Operating Budget Contingency will be transferred to the park's Building Maintenance line item for this project. Award the contract for the design and installation of a basic mini golf course at Groveland Oaks to Hittle Construction in the amount of $103,000.00, plus a five percent contingency of $5,150.00, for a total budgeted amount of $108,150.00. The amount of $82,150 will be transferred from the Capital Improvement Projects Contingency to the project. Moved by Mr. Korzon, supported by Mr. Richards to approve the contract for the design improvement plan for the Springfield Oaks Golf Course to Raymond Hearn in the amount of $16,000.00; plus a five percent contingency in the amount of $800.00 for incidentals; for a total budgeted amount of $16,800.00. The amount of $16,800.00 will be transferred from the Operating Budget Contingency to the Springfield Oaks Golf Course Contracted Services line item. Commission directed staff to consider the same design work be completed for White Lake Oaks. 4-3 (Commission Meeting, May 5, 2004) LEASE AGREEMENT — RED OAKS WATERPARK: Moved by Mr. McCulloch, supported by Mr. Palmer to approve the agreement between the County of Oakland (through the Parks and Recreation Commission) and the George W. Kuhn Drainage District for the lease of the Red Oaks Waterpark for 50 years, in the amount of $1.00 per year, with an option to renew. The agreement will be forwarded to the Oakland County Board of Commissioners for approval. COMMUNITY SERVICE GARDEN LETTER OF UNDERSTANDING — SPRINGFIELD OAKS: Moved by Mr. VanderVeen, supported by Mr. Crawford to authorize Chairman Pecky D. Lewis, Jr. sign a Letter of Understanding to allow Community Corrections the use of approximately eight (8) acres of land at the Springfield Oaks Activity Center for a garden. EXECUTIVE OFFICER'S REPORT: As part of the Executive Officer's Report filed in the agenda, the following was noted: ---Staff was notified that the grant applications for the Amphitheater entertainment and Emerald Ash Borer tree replacement have been denied funding. ---Staff was contacted by the Court and Law Enforcement Management Information Systems (CLEMIS) for Commission consideration for the placement of a radio tower in Orion Oaks County Park. Staff advised them to obtain local approval before bringing a formal request to the Parks Commission. 4-4 (Commission Meeting, May 5, 2004) ---Date for the annual Parks tour was set for Wednesday, June 23. Parks staff will contact the Board of Commissioners with the date and additional information. ---Construction of the safety path on Clarkston Road between Joslyn and Baldwin roads began May 1. Once completed, there will be a safety path bordering three sides of Orion Oaks. ---Staff provided a brief status report on the Ellis and pole barns destined for relocation to Springfield Oaks. ---Dedication of the youth group campground at Independence Oaks is scheduled for Saturday, May 1. Springfield Township has committed $21,000 for the purchase and installation of the unit. Attached is a map showing the proposed location of the unit and the coverage. The unit will be located adjacent to the judges' stand at the upper arena. Staff is requesting Commission adopt the attached resolution. RESOLUTION WHEREAS, the Oakland County Emergency Management Division is responsible for providing emergency weather notification to residents of Oakland County; and WHEREAS, as part of the effort to provide a county -wide system, Springfield Township has authorized payment of the entire local match (75%) for the cost of this installation; and WHEREAS, Oakland County Emergency Management will pay the balance of the installation costs and all operational and maintenance expenses; and WHEREAS, locating the siren at Springfield Oaks County Park is desirable due to the large number of outdoor events held at the Activity Center and the golfing activities at the park; and WHEREAS, Springfield Oaks is an Oakland County property. The report shows we are in sound financial condition. Our revenue budget had an unfavorable variance of $502,778 as shown on page 18; however, our expense budget had a favorable variance of $2,002,470 as shown on page 19. This results in an additional $1,499,692 for capital projects than originally budgeted and $398,667 more than the revised budget estimate figures we used in the Fiscal Year 2004 Capital Improvement Budget (the $398,667 will be incorporated into the FY2005 Capital Improvement Budget). The audit report reflects the designation change in fund type from a Special Revenue Fund to an Enterprise Fund in accordance with the Governmental Accounting Standards Board (GASB) provisions. This has resulted in two additional reporting requirements: the Management's Discussion and Analysis, and the Combining Statements of Cash Flow —Enterprise Funds. As indicated on page 19 of the audit report, one of our cost centers show an excess of expenditures over budget*; however, the total expenditures for operations are under the total budget. Therefore, in compliance with the Michigan Uniform Local Budgeting Act and the Commission By-laws, staff recommends the Commission amend the FY2003 operating budget to $16,875,233, with the individual amounts for each budget center to be the same as those shown in the "Actual" column of page 19 of the report. The net worth of the Commission as of September 30, 2003 as indicated on page 2 of the Management Discussion and Analysis section was $73,558,662. This includes a Capital assets, net of accumulated depreciation and related debt, balance of $59,122,074 and an Unrestricted fund balance of $14,436,588. However, most of the $14,436,588 was already included in the 2003 Capital Improvement Budget as a funding source. Greenan Excavating completed the first phase of the project and did a satisfactory job. Staff recommends awarding the contract to the low bidder, Greenan Excavating, in the amount of $57,000.00, plus approving a ten percent contingency of $5,700, for a total budgeted amount of $62,700.00. There is $112,136.00 remaining in the Capital Improvement Projects Budget for this on -going project. A-1 ADVERTISEMENT FOR BIDS For 2004 WATER MAIN IMPROVEMENT PROJECT SPRINGFIELD OAKS COUNTY PARK OAKLAND COUNTY. MICHIGAN The work consists primarily of placing approximately 273 11 - 6" water main, 143911 - 1 '/2" copper service leads, 2-1 '/2" Back Flow Preventers with valve housing, one fire hydrant, one gate 6" valve and well, removal and placement of concrete and asphalt pavement and service lead reconnections. All final grading topsoil and seeding will be responsibility of owner. The accepted bidder shall be required to Rirnish a satisfactory Performance Bond, Labor and Material Bond in the amount of 100% of the Contract Price, and a one (1) year Maintenance and Guarantee Bond in the amount of 100% of the Final Contract Price. The cost of the bonds will be paid by the accepted bidder. The Oakland County Parks and Recreation Commission reserves the right to accept or reject any or all bids, in whole or in part, and to waive any informalities, therein when such waiver is in the interest of the Oakland County Parks and Recreation, and to award the contract to other than the low bidder. Bids shall remain firm for a period of sixty (60) days after the date of receipt and cannot be withdrawn during that time period. A-2 PUMP REPLACEMENT RED OAKS WAVE POOL After 17 years of operation, one of our main filter pumps for the Red Oaks Wave Pool was in need of replacement. The cost to rebuild this pump would be more than to purchase a new one. This pump replacement was completed by Hydro Dynamics of Waterford, the company that we have a service contract with for these types of repairs. The cost of this pump alone was $9,035.37. Two other companies quoted prices over this amount for this pump alone. The electric motor for this pump was rebuilt, not replaced. Staff seeks permission to pay Hydro Dynamics $14,854.33 for the cost to replace the pump, rebuild the motor, plus labor. Funds for this expenditure will come from the park's Operating Budget Building Maintenance line item. B-1 ITEM #10 WHITE LAKE OAKS CLUBHOUSE Our administration and golf course staff, in conjunction with Oak Management staff, have had several meeting with our consultants for the design of the White Lake Oaks clubhouse, Gerald Yurk and Associates. We have now come to a consensus and developed a plan for this banquet and golf center, which seems to fulfill most of the needs of the parties involved in a scale that will be both cost effective and functional. In order to accomplish this, the scope of the project increased from the original footprint of 10,250 sq. ft., which was primarily the outline of the existing facility, to approximately 13,975 sq. ft. The majority of the increase resulting from the need for larger restrooms, a function room, a larger kitchen, storage, increase in grillroom size, and a larger foyer. Even with this increase, the facility is 30% smaller than Lyon Oaks. This increase in size also increases the original scope of the design contract by $35,137. This is based on the change in the original construction estimate of $2,000,000 to $2,585.625. This new estimate also includes cost of demolition, minimum site improvements, and landscaping. The fee does not include cost for civil engineering services for the utilities and some site engineering work that will be also be required. Cost for this item is currently being investigated. The architect will be making a presentation on the scope of the facility and the architectural theme and elevations that he has developed. 10-1 ITEM #11 SPRINGFIELD OAKS MASTER PLAN REVISION Staff is waiting for additional comments from the preliminary draft document and plan presented at the last commission meeting. Upon receipt, comments will be evaluated and a final plan will be completed for your review and adoption at the July Commission meeting. ITEM #12 ELLIS BARN AND POLE BARNS SPRINGFIELD OAKS Attached are three documents relating to the Ellis Barn and the two pole barns being donated to the Parks for relocation to the Springfield Oaks Activity Center. The first two documents are donation agreements that were drafted and approved by Oakland County Corporation Counsel; staff recommends approval. The third document, an historic preservation easement for the Ellis Barn, has been reviewed by Corporation Counsel, who recommends approval subject to a minor change. That change adds the phrase, "over the Ellis Barn" into the "Now, therefore," paragraph on page one. The change is noted in brackets and in bold-faced type for your information; it is recommended for clarity purposes. Staff recommends Commission approval of this easement, subject to the change on page one. 12-1 DONATION AGREEMENT This Agreement made and entered into this day of , 2004, by and between RBI 33, LLC, a Michigan Limited Liability Company, whose address is 15135 Charlevoix, Grosse Pointe Park, Michigan 48230 (hereinafter Donor) and the County of Oakland, a Michigan Municipal and Constitutional Corporation, 1200 North Telegraph Road, Pontiac, Michigan 48341 (hereinafter County) for the donation and transfer of all rights, title and interest in property described as the "Ellis Barn", as described below, (hereinafter Barn) currently in place on property owned by Donor in the Township of Springfield, County of Oakland, State of Michigan. Whereas, the Donor desires to donate the Barn to the County of Oakland for use by its Parks and Recreation Commission for the purposes of preserving it and it's attached structures as a historical building for the benefit of future generations; and, Whereas, the County of Oakland desires to accept the Barn and has applied to the State of Michigan and the United States Department of Transportation for grants to accomplish the relocation of the Barn to Springfield Oaks County Park in Springfield Township; Therefore, in consideration of the mutual benefits and other good and valuable consideration exchanged between Donor and County, Donor agrees to donate and County agrees to accept the Ellis Barn upon the following terms and conditions. DONATED PROPERTY 1.1 Donor agrees to donate to County a structure known as the Ellis Barn (described as a Madawaska Twin -design barn) for the purpose of having said Barn removed from Donor's property and relocated to Springfield Oaks County Parks at a site to be determined by the Parks and Recreation Commission in conjunction with the Michigan Department of History, Arts, and Libraries of the State of Michigan. 1.2 The donated property consists of the Barn, the attached stallion building and the stone portion of the ramps leading to the main floor of the Barn as necessary to reconstitute the ramp in as authentic a manner as possible. 1.3 In order to assist in the removal and relocation of the Barn, Donor pledges to contribute Seventy-five Thousand Dollars ($ 75,000.00) to the Parks and Recreation Commission, Ten Thousand Dollars ($10,000.00) of which is acknowledged as received by the Commission. 2. TITLE TO PROPERTY 2.1 Title to the Bata, its structures and other materials necessary to relocate the Barn in an authentic manner to Springfield Oaks County Park shall pass to County upon execution of this document by Donor and County. 2.2 Upon transfer of title to the Barn, County shall be responsible for all insurances and liability associated with the Barn and shall provide Donor with the insurance requirements as stated in Paragraph 6. 2.3 If County is unable to successfully procure grants and other funding necessary to accomplish the relocation of the Barn to Springfield Oaks County Park, then title to the Barn shall revert back to Donor and this Agreement shall be null and void. Donor and County agree to execute any and all documents deemed necessary to accomplish this reversion. 2.4 If title to the Barn reverts to Donor pursuant to paragraph 2.3, then Donor's pledge of $75,000.00 will be extinguished and forgiven in the amount Donor was committed to contribute beyond any amount already contributed. Donor will not be reimbursed for any amount of the pledge contributed to County prior to reversion of the Barn to Donor. 3. ACCESS TO DONOR'S PROPERTY BY COUNTY 3.1 Donor hereby grants to County and County hereby accepts a temporary easement over Donor's property described in Attachment A for the purposes of maintaining the Barn on Donor's property until such time as removal can occur and for the purposes of allowing County's contractor, County staff, County agents, agents of the United States Government, including but not limited to agents of the Department of Transportation and Department of the Interior, and agents of the State of Michigan access to Donor's property to effectuate the removal and transportation of the Barn from Donor's property to Springfield Oaks County Park- 3.2 This easement shall be in effect from the date title to the Barn passes to County up to the date County completes final removal of the Barn structure and selected foundation materials. It is agreed between the Parties that this Agreement, along with Attachment A shall serve as a written instrument evidencing said easement, and can be recorded or attached to another document to be recorded, as necessary. 4. SITE CLEAN-UP 5.1 County will not be responsible for restoration of the easement area (or any other area used by County) to the condition it was in prior to County beginning the dismantling and removal process. County will not be responsible for removing or cutting back to grade the earthen ramps that will remain after the Barn has been removed. County will not be responsible for the removal of any material other than the Barn structure above the foundation and select portions of the stone ramps/foundation. 5.2 County will be responsible for the electricity and the water necessary to effectual the removal of the Barn. Donor agrees that County may attach a separate meter to the electric service available on Donor's property for billing purposes. The meter will be removed when the relocation process is completed. County may utilize the water 4 supply available on Donor's property and will pay Donor any costs associated with utilization of that water supply. 6. INSURANCE 6.1 County will provide Donor with a certificate of self-insurance evidencing County's responsibility for the liability County has while the Barn remains on Donor's property after transfer of title, and for the liability county has arising from the use of Donor's property during the removal and relocation of the Barn from Donor's property. 6.2 At the sole discretion of County, County may purchase a policy of property insurance to cover the Barn and the attached building. 6.3 Donor understands that County will use an independent contractor for the removal and relocation of the Barn and the contractor will be responsible for his or her own insurance requirements. Contractor will name Donor as an additional insured. 7. SEVERABILITY 8.1 If a term, condition, or provision of this Agreement is found by a Court of competent jurisdiction to be invalid, unenforceable, or to violate or contravene federal or state law, then the term, condition, or provision shall be deemed severed from this Agreement; all other terms, conditions, and provisions shall remain in Rill force and effect. 9. CHOICE OF LAW 9.1 Tlus Agreement shall be governed by and construed in accordance with the laws of the state of Michigan that are applied to contracts made and to be performed in this state. Venue in any disputes shall be the Oakland County Circuit Court, the 52 District Court 3rd Division, or the United States District Court for the Eastern District of Michigan, Southern Division, unless this paragraph violates any provisions of the Michigan Court Rules or the United States Code. 10. Whereas, the Donor desires to donate the Barns to the County of Oakland for use by its Parks and Recreation Commission; and, Whereas, the County of Oakland desires to accept the Barns for use by its Parks and Recreation Commission at Springfield Oaks County Park in Springfield Township; Therefore, in consideration of the mutual benefits and other good and valuable consideration exchanged between Donor and County, Donor agrees to donate and County agrees to accept the Barns upon the following terms and conditions. DONATED PROPERTY 1.1 Donor agrees to donate to County two structures commonly referred to as "pole barns" on its property on Ormond Road for the purpose of having said Barns removed from Donor's property and relocated to Springfield Oaks County Parks at a site to be determined by the Parks and Recreation Commission. 1.2 The donated property consists of the Barns, and other foundation material necessary to relocate and rebuild the Barns at Springfield Oaks County Park. 2. TITLE TO PROPERTY 2.1 Title to the Barns, its structures and other materials necessary to relocate the Barn to Springfield Oaks County Park shall pass to County upon execution of this document by Donor and County. 2.2 Upon transfer of title to the Barn, County shall be responsible for all insurances and liability associated with the Barn and shall provide Donor with the insurance requirements as stated in Paragraph 6. ACCESS TO DONORS PROPERTY BY COUNTY 3.1 Donor hereby grants to County and County hereby accepts a temporary easement over Donor's property described in Attachment A for the purposes of maintaining the Barn on Donor's property until such time as removal can occur and for the purposes of allowing County's contractor, County staff, County agents, and agents of the State of Michigan access to Donor's property to effectuate the removal and transportation of the Barn from Donor's property to Springfield Oaks County Park. 3.2 This easement shall be in effect from the date title to the Barn passes to County up to the date County completes final removal of the Barn structure and selected foundation materials. It is agreed between the Parties that this Agreement, along with Attachment A shall serve as a written instrument evidencing said easement, and can be recorded or attached to another document to be recorded, as necessary. 4. Kalamazoo Street, P.O. Box 30740, Lansing, Michigan 48909-8240 ("Grantee"). RECITALS: This Agreement is based on the following recitals: A. The Federal Highway Administration awarded a grant-in-aid to Grantor, through the Transportation Equity Act for the 21St Century, for aid in the relocation, rehabilitation and preservation of the Ellis Barn, which substantially enhances the value of the premises to Grantor. B. Grantee, through its Department of History, Arts and Libraries is authorized to accept preservation and conservation easements to protect property significant in national and state history and culture. C. Grantor and Grantee recognize the architectural, historic and cultural values and significance of the Ellis Barn, and have the common purpose of conserving and preserving the aforesaid historic preservation values. D. Grantor desires to grant to Grantee, and Grantee desires to accept, a historic preservation and conservation easement in gross pursuant to Subpart 11 of Part 21 of Article I of the Natural Resources and Environmental Protection Act, MCL 324.2140 et sere . for the purpose of ensuring that the Ellis Barn will be relocated, rehabilitated and preserved. NOW, THEREFORE, for and in consideration of the foregoing recitals, and other good and valuable consideration, the receipt and adequacy of which is hereby acknowledged and witnessed, Grantor voluntarily grants and conveys to the Grantee an historic preservation easement in gross [over the Ellis Barn] for a period of fifty (50) years on the terms and conditions set forth below. 1. The exterior and character -defining interior features of the Ellis Barn shall be maintained and repaired by the Grantor at no cost to the Grantee, so as to preserve the historical integrity of the features, materials, appearance, workmanship, and environment. Further, the Grantor shall not perform major visual or structural changes which will affect the historical integrity of the Ellis Barn unless such changes are first approved in writing by the Department of History, Arts and Libraries and are in conformance with the Secretary of the Interior's Standards for Rehabilitation and Guidelines for the Rehabilitation of Historic Buildings (National Park Service, 1990). 2. The Ellis Barn shall be administered so that the public shall have access to the exterior and first floor of the interior of the Ellis Barn not less than twelve (12) days a year on an equitably spaced basis and at other times by appointment. Nothing in this Agreement shall restrict the use of the Ellis Barn. 4. Any notice which either Grantor or Grantee may desire or be require to give to the other party shall be in writing and shall be delivered by one of the following methods - by overnight courier postage prepaid, facsimile transmission, registered or certified mail with return receipt requested, or hand delivery: If to Grantor, then at: Oakland County Parks and Recreation 2800 Watkins Lake Rd. Upon request by Grantor, Grantee shall promptly furnish Grantor with certification that, to the best of Grantee's knowledge, Grantor has complied with the obligations under this Agreement. 6. With the consent of Grantor, representatives of Grantee shall be permitted at all reasonable times to inspect the interior of the Ellis Barn. Grantor covenants not to withhold unreasonably its consent in determining dates and times for such inspections. 7. Grantee may, following reasonable written notice to Grantor, seek a temporary, preliminary, and/or permanent injunction to enforce Grantor's obligations under this Agreement. In the event Grantor is found to have violated any of its obligations, Grantor shall reimburse Grantee for any costs or expenses incurred by Grantee in enforcing the terms of this Agreement, including all reasonable court costs, and attorney's, architectural, engineering, and expert witness fees. 2 Grantee's exercise of one remedy under this Agreement shall not have the effect of waiving or limiting any other remedy, and the failure to exercise any remedy shall not have the effect of waiving or limiting the use of any other remedy or the use of such remedy at any other time. 8. Grantor shall deliver to Grantee copies of any notice of violation or lien relating to the Property received by Grantor from any government authority within five (5) days of receipt by Grantor. Upon request by Grantee, Grantor shall promptly furnish Grantee with evidence of Grantor's compliance with such notice or lien where compliance is required by law. 9. Grantor shall promptly notify Grantee in writing of any proposed sale of the Ellis Barn and provide the opportunity for Grantee to explain the terms of the Agreement to potential new owners before sale closing. 10. Grantor agrees that Grantee may provide and maintain a plaque on the Ellis Barn, which shall not exceed 24 by 24 inches in size, relating the historic significance of the Ellis Barn and the existence of this Agreement. 11. The obligations imposed by this Agreement shall be effective for a period of fifty (50) years and shall be deemed to run as a binding servitude with the Property. This Agreement shall extend to and be binding upon Grantor and Grantee, their respective successors in interest and all persons claiming under or through Grantor and Grantee, and the words "Grantor" and "Grantee" shall include all such persons. Any right, title, or interest granted to Grantee also shall be deemed granted to each successor and assign of Grantee and each such following successor and assign, and the word "Grantee" shall include all such successors and assigns. 12. At its own costs, Grantor shall promptly record this instrument in the land records of Oakland County, Michigan. Grantor and Grantee intend that the restrictions arising under this Agreement take effect on the day and year this instrument is recorded in the land records of Oakland County, Michigan. 13. Grantor shall comply with the Elliot -Larsen Civil Rights Act, 1976 PA 453, MCL 37.2101 et seq., the Persons with Disabilities Civil Rights Act, 1976 PA 220, MCL 37.1101 et seq., and all other state, federal and local fair employment practices and equal opportunity laws and covenants that it shall not discriminate against any employee or applicant for employment, to be employed from the grant described in Recital D with respect to his or her hire, tenure, terms conditions, or privileges of employment, or any matter directly or indirectly related to employment, because of his or her race, religion, color, national origin, age, sex, height, weight, marital status, or handicap that is unrelated to the individual's ability to perform the duties of a particular job or position. Grantor agrees to include in every contract to be funded from the grant described in Recital D the terms of the covenant in this paragraph not to discriminate in employment. 14. Grantor shall ensure that neither Grantor's name nor the name of any subcontractor, manufacturer or supplier of Grantor to be fiinded from the grant described in Recital D appears in the unfair practices register compiled by the Michigan Department of 3 Consumer and Industry Services pursuant to the Employers Engaging in Unfair Labor Practices Act, 1980 PA 278, MCL 423.321 et seq. 15. Grantor shall consult with Grantee's Michigan Historical Center when ensuring that any contracts to be funded from the grant described in Recital D comply with the applicable barrier free design requirements of the Architectural Barriers Act of 1968, Pub. L. No. 90-480, as amended, 42 U.S.C. 4151 et seq., and the Utilization of Public Facilities by Physically Handicapped Act, 1966 PA 1, MCL 125.1351 et seq. Grantor may apply for any applicable exemptions to the requirements of these statutes. 16. This Agreement reflects the entire agreement of Grantor and Grantee. Any prior or simultaneous correspondence, understandings, agreements, and representations are null and void after this Agreement is recorded, unless set out in this instrument. Conway Its: State Historic Preservation Officer M ITEM #13 EXECUTIVE SESSION Staff is requesting an Executive Session to discuss a proposed land acquisition. 13-1 ITEM # 14 EXECUTIVE OFFICER'S REPORT --- As part of the Group Sales Program, T & C Credit Union will be selling Oakland County Parks vehicle permits and waterpark tickets at six branches in Oakland County. Locations include Waterford (2), Pontiac, Orion, Clarkston, and White Lake. ---Glen Oaks Pro Shop Restrooms/Grill Room: Staff has been in the process of developing plans for renovating the existing Glen Oaks grillroom/pro shop. A majority of the air handling units need to be replaced. This item was identified in the 2004 building maintenance budget. This, and the fact that the facility has not been updated for 25 years, presents us with the opportunity to renovate this area. Design Resources, through our blanket contract for design services, are developing plans. When complete, we anticipate that our technical support crews will complete a major part of the renovation with a portion (the mechanical systems) to be contracted. As soon as the plans are complete, staff will update the Commission. ---Denise Young, of Lincoln Park, has donated a portable agility course for Orion Oaks Dog Park. Denise is a certified agility trainer and visits Orion and Lyon Oaks. ---Two previous lifeguards, Stephanie Ball, Head Guard from Red Oaks Waterpark and Katie Piechura, Head Guard at Independence Oaks, are now auditors for the National Pool and Waterpark program. Approximately 20 auditors are chosen from the 800 that apply. ---The grand opening of the day use park at Lyon Oaks will be held on June 19, 2004 from 1:00 - 4:00 p.m. Activities include a cricket demonstration, dog events, and guided remote control gliders. ---The AEDs are now located at all the golf courses, day use parks and waterparks. ---Lewis E. Wint Nature Center received a $700 donation from the Clarkston Club. The center used the money to go into the Clarkston schools and do seven programs on birds. ---May 20 - 23 the Mighty Oaks CP Sports Team, 16 athletes from Oakland County, participated in the Michigan Sports Festival for Athletes with Disabilities at Michigan State University. The team is co -sponsored by Oakland County Parks, Waterford Township, and the City of Pontiac. ---The Spring Mountain Bike Race scheduled for Saturday, May 22 and Sunday, May 23 at Addison Oaks was canceled due to the large amount of rain. It is rescheduled for May 29 and 30. The event will be co -sponsored by the Michigan Mountain Bike Association. ---Oakland County Parks has received $3,000 worth of dog waste bags for the dog parks from Pet Supplies Plus. To date, Pet Supplies Plus has donated over $30,000 worth of bags. ---Staff is working on the 2005 budget preparation. The Commission's budget review will be Wednesday, July 21, directly following the regular meeting that morning. ---Staff has tentatively decided not to open the waterparks this Memorial Day weekend, due to the projected poor weather conditions. 14-1 The cool rainy weather throughout May has resulted in one of the weakest attendance and income figures for the Parks on record. Staff has already been asked to review their budgets for this year, in order to stay in line with projected costs. ---The National Recreation and Park Association's Annual Congress will be held October 12-16 in Reno, Nevada. Please contact Karen ASAP to let her know whether or not you are planning to attend this conference, as lodging is already being reserved. ---We will be co -hosting a National Trail Day Event with the City of Wixom on Saturday, June 5. Everyone is invited to participate; you can either bike or hike this event, which will take place from 10 a.m. to 1 p.m. Participants will meet at the Wixom Habitat, tour the Habitat, hike or bike to Gibson Park and tour that facility, then continue to Lyon Oaks to explore the new park facilities.
