MEETING October 6, 2004 Chairman Pecky D. Lewis, Jr. called the meeting to order at 9:10 a.m. in the commission room of the Parks and Recreation Commission's administration office. QBS Coalition of Michigan Orion Historical Society PUBLIC COMMENTS: Ralph Richard, Executive Officer Frank Trionfi, Administrator — Administration Daniel Stencil, Administrator — Parks Operations Joseph Figa, Chief of Design and Development Jan Pung, Public Communications Officer Sue Wells, Chief of Recreation Sheila Cox, Accountant IV Mike Donnellon, Architectural Engineer II Jon Noyes, Architectural Engineer I Joan Daniels, Buyer LC Scramlin, General Manager Deputy Alspaugh Larry Falardeau, Planner Sue Dorris, Marketing Coordinator Marcus Anderson Ron Brenke, Executive Director Bruce Kuffer, Board of Directors Sara VanPortfleet Leslie Pielack Mr. Marcus Anderson, of Soft Touch Painting, Inc., requested Commission place a hold on the contracts awarded at the September 8, 2004 meeting for the painting at Springfield Oaks and the Red Oaks Waterpark until he received further clarification on the Commission's decision to split the bid. Commission and Purchasing staff reiterated the county's policy that allows abstracting a bid in a manner that best suits the department, which Mr. Anderson acknowledged he had been aware of and signed. Splitting this particular bid saved the Parks Commission approximately $25,000. Commission concurred to continue moving forward with the contract and encouraged Mr. Anderson to contact Purchasing for clarification of terms and procedures when bidding on future projects. APPROVAL OF MINUTES: Moved by Mr. Palmer, supported by Mr. VanderVeen to approve the minutes of the meeting of September 8, 2004, with the following corrections. 4-1 (Commission Meeting, October 6, 2004) At the top of page 4 — 3, add the following paragraphs to the resolution motion: WHEREAS, supplemental objectives were developed in response to identified needs and deficiencies to be incorporated into the "February 6, 2002 Parks Recreation Master Plan Update;" and WHEREAS, the goals and objectives will assist the Oakland County Parks and Recreation Commission in determining future planning by lending direction while remaining flexible to allow for adjustments by creative and responsible management. NOW THEREFORE BE IT RESOLVED that the Oakland County Parks and Recreation Commission adopts the "February 6, 2002 Parks Recreation Master Plan Update" as amended. On page 4 — 6, under the Executive Session, substitute Mr. Korzon's name for Mr. Lewis in the Aye votes. On page 4 — 7, at the top of the page, substitute Mr. Korzon's name for Mr. Lewis in the Aye votes. Moved by Mr. Gregory, supported by Mr. Palmer to approve the minutes of the September 8, 2004 Public Hearing for the Amendment to the Overall Recreation Master Plan, as written. APPROVAL OF PAYMENTS: Moved by Mr. Skarritt, supported by Mr. Palmer to approve the Payment Approval Summary, including: - Internal Service Funds Payment Register for August, 2004 (FM 11, FY 2004) - Payment Register, including Voucher & CIP Report for August (FM 11, FY 2004) 4-2 (Commission Meeting, October 6, 2004) AYES: Gregory, Lewis, Palmer, Skarritt, VanderVeen, Vogt (6) NAYS: (0) Motion carried on a voice vote. COMBINED STATEMENT OF OPERATIONS: The Combined Statement of Operations for the month ending August 31, 2004 was accepted as filed. ACTIVITIES REPORT: The Activities Report for the month of August, 2004, was accepted as filed. COUNTY INVESTMENT STRATEGY: Oakland County Treasurer Pat Dohany presented the Parks Commission with information on the county's investment strategy, including legislation and adopted investment policy under which the department operates. Treasurer Dohany reported that the Parks are part of the county's overall centralized pool investment, which allows for greater investment opportunities and liquidity. QBS: Bruce Kuffer and Ron Brenke, from the American Council of Engineering Companies, presented information on the qualifications -based selection (QBS) for professional service contracts. Oakland County Purchasing currently has established guidelines for QBS. Commission recommended staff invite some commissioners to be involved in the selection process when using this procedure. BIDS: Moved by Mr. Palmer, supported by Mrs. Vogt to award the bid for the purchase of replacement trees throughout the parks to the low bidder for each species to the following vendors in the amount noted, for a total purchase amount of $33,824. Marine City $2,915 Discount Trees $4,375 Scapes Supply $1,140 Shemin Nursery $21,668 Christensens $3,729 Commission also approved a transfer from the Operating Budget Contingency to each respective park's Ground Maintenance line item. AYES: Gregory, Lewis, Palmer, Skarritt, VanderVeen, Vogt (6) NAYS: (0) Motion carried on a voice vote. PAINTING — RED OAKS WATERPARK: Staff clarified the sequence of events in reaching a final decision for the contractors painting the Red Oaks 4-3 (Commission Meeting, October 6, 2004) Waterpark buildings. The final authorization awarded the bid to Hermes Painting in the amount of $25,000, plus a five percent contingency of $1,250, for a total budgeted amount of $26,250. 2005 CIP BUDGET AMENDMENT: Moved by Mr. Palmer, supported by Mr. Skarritt to adopt the following resolution for the amendment to the 2005 Capital Improvement Projects Budget: WHEREAS, at its September 8, 2004 meeting the Oakland County Parks and Recreation Commission approved the adoption of the Oakland County Parks and Recreation Commission's 2005 General Appropriations Act incorporating the 2005 Operating budget, and also approved the adoption of the Commission's 2005 Capital Improvement Projects Budget; and WHEREAS, said budgets were approved by the Oakland County Board of Commissioners at their September 23, 2004 meeting; and WHEREAS, misrepresentations were identified in the approved 2005 CIP budget referencing $750,000 in contributions to the proposed equestrian center at Springfield Oaks Activities Center; and. WHEREAS, the Oakland County Board of Commissioners have made no formal commitment to the proposed equestrian center project and have requested that the Oakland County Parks and Recreation Commission amend the 2005 CIP budget accordingly. NOW THEREFORE BE IT RESOLVED that the Oakland County Parks and Recreation Commission amends its 2005 CIP Budget as noted in the attached summary page and on the Springfield Oaks Activities Center page. LYON OAKS NORTH RECREATION FIELD PHASE II DEVELOPMENT: Moved by Mr. VanderVeen, supported by Mr. Palmer to approve the transfer of $35,000 from the 2005 Capital Improvement Projects Budget Contingency to the Lyon Oaks North Recreation Field, Phase II Development (Cricket Facility) Project. AYES: Gregory, Lewis, Palmer, Skarritt, VanderVeen, Vogt (6) NAYS: (0) Motion carried on a voice vote. WHITE LAKE OAKS CLUBHOUSE UPDATE: Chief of Design and Development Joe Figa provided an update on the progress with the White Lake Oaks Clubhouse, noting staff is waiting on a decision to connect to the Waterford Township sewer system. Staff is expecting to present bids for Commission approval at the February, 2005 meeting. 4-4 (Commission Meeting, October 6, 2004) GLEN OAKS GRILL ROOM RENOVATION: Moved by Mr. Skarritt, supported by Mr. VanderVeen to approve the transfer of $115,000 from the Operating Budget Contingency to the Glen Oaks Building Maintenance line item for the renovation of the Glen Oaks Clubhouse grill room. AYES: Gregory, Lewis, Palmer, Skarritt, VanderVeen, Vogt (6) NAYS: (0) Motion carried on a voice vote. GROVELAND OAKS MINIATURE GOLF: Moved by Mrs. Vogt, supported by Mr. Gregory to approve the increase to the contingency of the contract with Hittle Construction in the amount of $13,420 for the rough grading of the mini -golf course at Groveland Oaks. AYES: Gregory, Lewis, Palmer, Skarritt, VanderVeen, Vogt (6) NAYS: (0) Motion carried on a voice vote. ELLIS BARN UPDATE: The Memorandum of Agreement (MOA) has been completed; we are waiting for the Donation Agreement to be signed by the Oakland County Board of Commissioners. Bids are expected back to the Commission at the December meeting, at which time the Commission must decide whether or not to move forward on this project. Staff will provide a project summary at that time to ensure Commission has all the information necessary to make a fully informed decision. MASTER DESIGN IMPROVEMENT PLAN — SPRINGFIELD OAKS GOLF COURSE: Moved by Mr. Skarritt, supported by Mr. VanderVeen to approve the increase in the contract with Ray Hearn Golf Course Designs from $16,000 to $19,829 for the development of accurate site plans for the master design improvement plan at the Springfield Oaks Golf Course. AYES: Gregory, Lewis, Palmer, Skarritt, VanderVeen, Vogt (6) NAYS: (0) Motion carried on a voice vote. GROVELAND OAKS RECREATIONAL PAVILION — FIREPLACE REPAIR: Moved by Mr. Gregory, supported by Mrs. Vogt to increase the contract with Held & Held, Inc. to complete the necessary grinding, tuck -pointing, and replacing of brick for the fire brick and fireplace hearth at the recreational pavilion at Groveland Oaks, in the amount of 4-5 (Commission Meeting, October 6, 2004) $2,450, for a total of $27,750. The Commission also approved a budget adjustment of $2,450 from the 2005 Operating Budget Contingency to Groveland's Building Maintenance line item. Thank ,you, _ J LC Scramlin-- _ _ , D oleman General Manager, President - 1 10-2 ITEM #11 HELICOPTER FOR AERIAL SURVEY Request for quotations were sent out by Purchasing to rent a helicopter to perform the Oakland County Parks and Recreation's aerial deer surveys. Parks that will be surveyed are Addison Oaks, Groveland Oaks, Independence Oaks, Waterford Oaks, Orion Oaks, Rose Oaks. and Springfield Oaks. Oakland County Parks staff surveys the number of deer as part of the system's Natural Resources Program. One bid was received, as follows: Magnum Helicopters $ 240.00/hr. 2 - seat Helicopter Waterford, MI $ 580.00/hr. 4 - seat Helicopter Staff is requesting to award the contract to Magnum in the amount not to exceed $10,000.00. Three parks were surveyed last year, at a price of less than $4,000. Staff anticipates total expenditure to be approximately $6,000.00. Monies for this service are budgeted under the professional service line item of each park. ITEM #11a 2005 GET MICHIGAN YOUTH MOVING MPRA GRANT REQUEST Parks staff is requesting approval to submit an application for a mini -grant through the Michigan Recreation and Park Association. This $4,000 grant would be an 80/20 matching grant, with 80 percent coming from MRPA and 20 percent coming from existing Oakland County Parks and Recreation funds. The grant will be a collaborative effort with the Boys and Girls Club of Southeastern Michigan in Oakland County to get young, at -risk girls active using the county's trail system. There is also a nutritional and fitness component to the program. Staff is requesting Commission approval to submit this grant. More information will be available at the meeting. 11a - 1 ITEM #12 GRILL ROOM UPDATE GLEN OAKS Plans for the Glen Oaks improvements have been completed and submitted to Farmington Hills. Review is taking considerably longer than they indicated. The mechanical portion went out for bid; we received only one bid, which was considerably over the estimate. Staff has been working with Purchasing and the bidder to resolve that issue. Staff anticipated the project to start the end of October or early November. As a result of these issues, the project will be delayed 30 days. As soon as the issue with the bid is resolved, it will be presented to the Commission. 12-1 Glen Oaks Grill Room Renovation Mechanical Construction Bids were received for the installation of the mechanical equipment for the Glen Oaks Grill Room Renovation. This construction included all the material and labor for the installation of all the mechanical systems for this renovation including a new 20-ton HVAC unit, a kitchen air make-up unit, new ducts servicing an older unit, exhaust fans and other miscellaneous work. Only one bid was received: DanBoise Mechanical Inc. $194,028.00 Farmington, MI This bid was appreciably over the budgeted amount of $115,000. Staff re -looked at the project and determined that there were several items that could be completed by our park crews. These items are as follows: • All demolition, including installation of ceiling area planking, for the installation of all ductwork • The installation of new HVAC to be connected to existing gas and electrical lines • The installation of two exhaust fans to be completed by park crews • Duct work to be stubbed for existing 5-ton HVAC to 25 tons *Additional cost for increasing the new 20-ton to 25-ton. In reviewing this with Dan Boise Mechanical Inc., a new quote was received in the amount of $126,834, plus $3,282 for increasing the new 20-ton to 25-ton, for a total mount of $130,116. Staff recommends awarding the contract to DanBoise Mechanical Inc. in the amount of $130,116, plus a contingency of $2,884, for a total budget amount of $133,000. This project is part of the approved Glen Oaks Building Maintenance Budget for 2005. ITEM #13 GOLF COURSE IMPROVEMENTS SPRINGFIELD OAKS In May of this year, the Commission awarded to Raymond Hearn Golf Course Design a contract to develop a master plan for improvements to the Springfield Oaks Golf Course. On display for your viewing and enclosed are the final design improvements that Raymond Hearn has recommended, along with an estimated price for the proposed changes or work to be completed. Staff has had several meetings with Raymond Hearn on this project, and their input is incorporated in these plans. Staff recommends we proceed with obtaining construction plans for this project and bid out the construction of this work on a phased -in work schedule. This will allow us to avoid disrupting play and to address the items that need attention first, such as rebuilding sand trips. First, I would like to provide a history of when each of these courses was obtained and the manner in which it was obtained. Springfield Oaks — Originally a 9-hole course donated to the Oakland County Parks in 1966. The Parks Commission then completed the construction of an additional 9 holes, with the added recreation aspects of cross-country skiing and a preservation plan. White Lake Oaks — Purchased in 1970 from owners who were in financial danger of losing the course. The community requested our involvement, and we saw how the Parks could turn it around and offer recreation, plus pay for itself. Red Oaks — This was a combined effort with the Oakland County Drain Commission to take an open pit drain and to provide another recreation activity in the highly populated southeast section of Oakland County, which the Commission did in 1976. Glen Oaks — Purchased from the Moslem Temple, A.A.O.N.M.S. in 1978. At that time, it was run down and under consideration for development into condos or other housing. The community wanted us to help save the green space, preserve the historic banquet center, and keep the golf course, which the Parks Commission reviewed and completed. Lyon Oaks — Parkland was acquired in 1992, and the golf course was opened in 2001. The course was developed after a planning session with residents and Parks Commissioners to help the 1,000-acre site become self-sustaining. In order to do this, a golf course was built. All of these courses are here today as county parks with no intention of abandoning the public ownership of these lands. These parks are open year round for golf and winter cross-country skiing. Some of the revenues from the golf courses go right back to the Oakland County communities. This past year over $2.4 million went back for full and part-time salaries and wages for employees, including seniors and students. Over $1 million defrayed costs to operate other facilities in the county parks system. Attached is a list of golf courses located in Oakland County, noting those that have changed ownership or who owns them today. Also attached is the number of people who golfed at the Oakland County golf courses over the last two years (Budget year 2004 — 214,452 golfers). Finally, attached are copies of letters to the editors written in response to the recent story published in The Oakland Press. Parks staff will be available to answer any questions you may have. I have some sympathy with the private sector golf courses, but see no reason for the County Parks Commission or the Oakland County Commission to take an interest in this matter. The number of courses available to the public are numerous in Oakland County, but many residents cannot afford the rates charged by the private courses. The public courses insure that the economies bf scale make the recreational facilities available to all residents of Oakland County, as well as any visitor to our region. I see no conflict of interest. The public votes for and supports the millages for the operation of the parks. The parks also generate funds to operate for the public benefit. That the Oakland County Parks commissioners do an outstanding job of creating and maintaining excellent facilities is hardly a reason for criticism. It is far more plausible that the general market forces for golf courses are the cause for distress. The value of property in Oakland County is well known, and the resulting costs to live, work and prosper here are equally high. The public does not owe the private sector any guarantee of profitability. In the larger scheme of things, there are many more private courses that are doing very well than there are county owned public courses in Oakland County. I am sure that given a choice, which they have when they vote, residents will choose a golf course before another subdivision or commercial development. Please take my opinion and comments into your consideration of this matter. Soil borings on the proposed site are being analyzed in preparation of a site plan submittal to Orion Township. This review and approval process is expected to take a minimum of six months. They will be presented at the December 1 Commission meeting, along with as complete a budget as we can provide. 15-2 MISCELLANEOUS RESOLUTION #04278 September 22, 2004 BY: Finance Committee, Chuck Moss, Chairperson IN RE: BOARD OF COMMISSIONERS - 2004 COUNTY GENERAL FUND PROPERTY TAX AND PARKS AND RECREATION TAX RATES To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the County has a fixed millage rate of 5.26 mills (voter approved 8/8/78) and a voter approved (8/8/00 - Term 2002-2011) 0.2500 mill for Parks and Recreation; and WHEREAS the Huron -Clinton Metro Parks Authority has requested the County to apportion a 0.25 mill property tax rate; and WHEREAS Michigan ,Law (MCL 211.34d(16) permanently reduced the County's Maximum Allowable Tax Rate to the 2004 "Headlee" rollback (Article 9, Section 31 of the Michigan Constitution) tax rate of 4.2359 mills, a Parks and Recreation maximum allowable tax rate of 0.2422 mill and a Huron -Clinton Authority maximum allowable tax rate of 0.2154 mill; and WHEREAS Public Act 42 of 1995, "Truth in Budgeting" Act, allows the County Board of Commissioners to hold a single public hearing as a prerequisite to both approval of the Property Tax Levy -and Budget adoption, if the recommended property tax rate necessary to support the ensuing year's operating budget is included in the General Appropriations Act; and WHEREAS the Board of Commissioners, upon the recommendation of the County Executive, adopted Miscellaneous Resolution #98217 establishing a 1998 County Property Tax rate of 4.1900 mills, 0.273 mills less than the Maximum Allowable Tax Levy as constrained by State law, equivalent to a total tax reduction of $10.7 million in 1998, the tax rate of 4.19, unchanged for tax years 1999 through 2003, has resulted in total tax reduction of $9.6 million in 1999, and $7.9 million in 2000, $6.5 million in 2001, $5.0 million in 2002 and $3.7 million in 2003 respectively, for a six -year total taxpayer savings of $43.4 million; and WHEREAS the County Executive recommends that the County 2004 tax rate be set at 4.1900 mills, the same since 1998, 0.0459 mill below the Maximum Allowable Tax'Levy as constrained by State law, equivalent to a tax reduction of $2.6 million, without jeopardizing the County's ability to deliver quality public services; and WHEREAS the Finance Committee recommends that the 2004 County General Fund Property Tax rate be set at 4.1900 mills, 0.0459 mill below the maximum allowable tax rate; the Oakland County Parks and Recreation Tax rate be set at 0.2422 mill, the maximum allowable tax rate; and the Huron -Clinton Metro Park Authority Tax rate be set at 0.2154 mill, the maximum allowable tax rate; and WHEREAS $234,583,397 is the estimated amount of the Fiscal Year 2005 County General Fund Budget to be raised by taxation based on the 2004. The Walled Lake School System sees the propertyas a potential solution to growing enrollment. The township is open to suggestions. Members of the Save Our State (SOS) land committee would like it to remain the undeveloped recre- ation land it has been for more than a half -century. "We don't believe there's need for another school," said Robert Phillips, an SOS chair- man. "We've had one enormous school built already. There's a lot of vacant land there that could be used to build another school. Our problem is we're becoming overdeveloped, and' the last thing we have for open land' is our parks." Phillips said citizens are rarely notified of any develop- ment plans, and the next thing they know, land is bought up and "tilled up to your property line." "It seems that construction doesn't work like it once did," Phillips said. "It seems as if the environment is not as much of a concern as it used to be. They used to build within a forested section or build around trees. Now they just go through and level an area. "It's kind of outra- geous to take parks that we are used to seeing and develop them into something else." Since the 195os, the land in question has been used at vari- ous times as a place to store missiles, as a home to nature trails for hiking and biking and as a spot to try and turn around at -risk youth. At other times, young peo- ple and adults have visited there to openly break the law, said Paul Yauk, land program manager for the state parks and recreation department. "It's"really a former Nike site a leftover from the Cold War era," said Yauk, adding that the federal government put three missile silos on the property in the late,1940s as part of the De- troit def nse strategy and re- moved them in the early 1970s. "Now it's largely used ille- gally by people who don't pay fees," he said, "They go there to play paintball games and drive their off -the -road vehicles that type of thing." Yauk noted state conserva- tion officers are often diverted from the _adjacent 3,78o-acre Proud Lake Recreation area nearby to chase and ticket scof- flaws. "The property isn't fenced, and we don't collect fees there," said Yauk. "There is no 'formal parking. It's not even signed. It's our job to maintain it, but there really isn't much to main- tain because we haven't put anything up on the property." Yauk said the state is looking for some kind of a partner, "Do we want to sell it off? No, but a state review of our properties made it clear we wanted to separate it from Proud Lake (recreation area)," he said. Yauk said the Walled Lake School system has shown an in- terest in about 155 acres. "We are reviewing that and aren't completely comfortable with it," said Yauk. "We would Like to see it modified. We would like this to be discussed with the locals and have some of their concerns addressed. But we think, coming from a school system, that the request has merit." Walled Lake Schools Super intendent Robert Geisler said the property is seen as an insur- ance policy for the future in that the growing school district t could find itself in a position where it would have to seize property through the courts to build more schools. "Today, you have to figure in much more space for parking and other needs." Geisler said the schools were only interested in 30 to 40 acres, which would not be de- veloped for several years, if at all: "The way the township is growing it appears it's only a matter of time before we need o build another school, per- haps a middle school or grade school," he said. "But that might not ever happen." A copy of the schools' land ransaction application to the tate, signed by Geisler, indi- cates the school is interested in wo parcels of the 70o-acre property: One is about So acres south of Wise Road and was a former missile site and is near what is now used for a Cross- roads for Youth program; and a second So -acre parcel on the north side of Wise abuts De- partment of Natural Resources property and has been left in its natural state, Some officials think the land could be converted into'a park or a historic site, .but Com- merce Township Supervisor Thomas Zoner said the town- ship lacks the "pocket money" to purchase the land. "Some acres around the township are selling for S50,000," said Zoner. "That would cost upwards of $35 mil- lion. We don't have any money like that lying around:' The township has an open spaces proposal on the Nov z ballot to set up a fund to buy property and maintain its cur- rent parks. Zoner said regard- less of how that particular vote goes, residents have to be real- istic about their expectations on development and change in even the most rural areas. "People who buy land adja- cent to a piece of wooded or forested property and expect it to remain virgin forever are looking through a different type of window," said Zoner. "You don't have control over pieces of property you don't own. This is the United States of America, and people have the right to de- velop property within the law" Zoner hopes eventually there will be some middle ground for sides to meet on the Wise Road issue. "We have master plans to govern land use," said Zoner. "I think it's great for people to stand up and say 'we like the way things are and don't want it to change: "But a school may, only take up a small piece .of land and leave the rest for good recre- ational use — that could be a plus as well," he said. .........................................................
