and Recreation Commission's administration office.

ACTIVITY REPORT:
The Activity Report for October, 2004 was accepted as filed.
PROPOSED WHITETAIL DEER FIREARMS MANAGEMENT HUNT:
Moved by Mr. Skarritt, supported by Mr. Palmer to approve closing Independence Oaks
on December 13 and 15, 2004 for the purpose of conducting a muzzleloader deer
management hunt, and to implement additional management hunts should the Michigan
Department of Natural Resources extend any firearms or archery seasons for the balance
of 2004 or at any time in 2005.

ELLIS BARN RELOCATION:
Chief of Design and Development Joe Figa presented a budget review of the projected costs for the
proposed Ellis Barn relocation. The information included two scenarios on projected costs, which range
from $818,155 to $952,955.
There are currently three bids on the project: the foundation, the disassembly/relocation/re-assembly, and
architectural services.
The foundation received only one bid in the amount of $243,000; staff is working with the bidder on ways
to reduce that cost. Currently the foundation is designed as a total engineered foundation. Staff will have
the barnwright or possibly another engineer review the plans for consideration of a pier foundation, plus
review the portion under the stables.
The low bid for the disassembly/relocation/re-assembly of the barn was $522,155. The grand will be 80%
of that, which is $417,724. There is also a section in the bid that provides for the replacement of certain
portions of the building that might be deteriorated. The bid provides for 15 to 20% replacement and includes
unit prices of the replacement materials. Since the bid was less than the grant amount, the replacement
costs can be included up to the awarded grant amount of $600,000.
Project funds currently include the $417,724 from the MDOT grant, plus donations from RBI 33, Mrs.
Dorothy Ellis, Springfield Township, and Friends of the Ellis Barn totaling $118,000. The Oakland County
Parks and Recreation Commission previously committed $50,000, which leaves unfunded costs ranging
between $232,431 and $367,231.
Mr. Birtsas, co-owner of the barn, addressed the Commission on fund-raising plans through the Friends of
the Ellis Barn to cover the remaining unfunded costs. Tentative plans include soliciting commitments for in -
kind services for some of the work, such as the excavating for the foundation, the masonry, and painting.
Ideas for sponsorships are also being explored.

A maintenance fund for the barn has already been established, plus 4-H has made a ten-year commitment
to the maintenance of the barn with options to extend that further.
Springfield Township Supervisor Collin Walls urged the Commission to move forward on the relocation,
pledging his — and the local community's — support on this project.
Staff requested Commission's commitment to move forward on the Ellis Barn Relocation Project, adopting
the attached resolution in support of the Road Commission for Oakland County's acceptance of the low
bidder for the disassembly/relocation/re-assembly.
Moved by Mr. Palmer, supported by Mr. Crawford to adopt the following resolution
recommending the Road Commission for Oakland County award the contract for the
relocation of the Ellis Barn, with the proviso that the written materials presented at the
meeting be attached to these minutes:
WHEREAS, the Oakland County Parks and Recreation Commission on September
8, 2004 approved the Donation Agreement with RBI 33, LLC for the Ellis Barn; and
WHEREAS, the Oakland County Parks and Recreation Commission has
supported the relocation of the historic barn to the 4-H Fairground at Springfield Oaks
County Park; and
WHEREAS, the Oakland County Parks and Recreation Commission has, on behalf
of the Road Commission for Oakland County, successfully secured funding through the
Michigan Department of Transportation's Transportation Enhancement Program in the
amount of $600,000; and
WHEREAS, the bids for the relocation of the Ellis Barn were received in
accordance with the grant regulations on November 23, 2004; and
WHEREAS, the apparent low bidder was CLR, Inc. in the amount of $522,155.00.
NOW THEREFORE BE IT RESOLVED that the Oakland County Parks and
Recreation Commission recommends the Road Commission for Oakland County award
the contract for the relocation of the Ellis Barn to the apparent low bidder, CLR, Inc., in the
amount of $522,155.

ELLIS BARN ACCESSORY BUILDINGS REVISED DONATION AGREEMENT AND OAKLAND COUNTY
4-H FAIR ASSOCIATION PSC AMENDMENT #1 REVISION — SPRINGFIELD ACTIVITY CENTER:
Moved by Mr. McCulloch, supported by Palmer to approve the revised agreement for the
donation of two accessory buildings from RBI 33, LLC to Springfield Oaks Activity Center,
plus approval of the revised professional services contract amendment with the Oakland
County 4-H Fair Association for the Springfield Oaks Activity Center.

MAPLE GRANGE PROPERTIES POLE BARNS DONATION AGREEMENT AND 4-H FAIR ASSOCAITON
PSC AMENDMENT #2 — SPRINGFIELD OAKS ACTIVITY CENTER:
Moved by Mr. Skarritt, supported by Mr. McCulloch to approve the Donation Agreement with Maple Grange
Properties, LLC for the donation of two pole barns, plus approve the Amendment #2 to the professional
services contract with the 4-H Fair Association to facilitate the location of the two pole barns to the
Springfield Oaks Activity Center.

low bidder, Ekocite Architecture, in an amount not to exceed $27,000.

ROOFING PROJECT —SPRINGFIELD OAKS:

shingle the roof of the horse barn at the Springfield Oaks Activity Center and the clubhouse
roof at the Springfield Oaks Golf Course to C. Davis Roofing in the amount of $28,044.75.
Funds will be transferred from the Operating Budget Contingency as follows: $19,388.75
to the Activities Center Horse Barn Building Maintenance, and $8,656.00 to the Golf
Course Clubhouse Building Maintenance.

VOLUNTEER PROGRAM:
Recreation Supervisory Sandy Dorey provided information on the volunteer program for 2004 and noted
the hours of volunteers have doubled within the parks since 2000. These hours do not reflect either the
community service or WAM hours, which are also provided on a weekly basis.

Executive Officer Richard noted that statistics used in the report were provided by the Bureau of Labor
Statistics. Value of volunteer time to the Oakland County Parks totaled $463,028 for 2004.
Report was accepted as filed.
2005 MASTER CALENDAR:
The proposed master calendar for 2005 was distributed for review and possible changes.
Commission concurred to continue with plans for the legislators/commissioners outing planned for May 13,
as there are a significant number of newly elected county commissioners. A suggestion was made to
change the location of the legislators/commissioners outing on May 13 to the Red Oaks Golf Course.

DONATIONS BENEFIT OAKLAND COUNTY TRAILS
OAKLAND COUNTY — Donations of $1,000 from Wal-Mart and Pontiac Osteopathic Hospital are hoped to be
the "first step" in future contributions for trails in Oakland County.
Wal-Mart and POH recently presented $1,000 checks to Marge Gatliff, Oakland County Parks Trails
Coordinator. Gatliff oversees the 18-member Oakland Trails Advisory Council.
"On behalf of our partners, we're happy to use these donations to promote fitness and improve trails in Oakland
County," Gatliff said. "These gifts will be the first steps in making people aware of the trails available to them
and the healthy benefits of walking."
"Wal-Mart likes organizations that give a sense of community, especially those related to children, parks and the
outdoors," Faye Berry, community involvement coordinator for Wal-Mart Foundation, said. Berry is based at the
White Lake Wal-Mart store.
Deciding how to use the donations is now up to the OTAC partners. These include: Clinton River Trail;
Headwaters Trail, Inc; Huron -Clinton Metropolitan Authority; Huron Valley Trail; League of Michigan Bicyclists;
Lakes Community Trail; Paint Creek Trail; Polly Ann Trail; Michigan Department of Natural Resources; Michigan
Department of Transportation; Michigan Mountain Bike Association; Oakland County Equestrian Coalition; Rails
to Trails; and West Bloomfield Trails.
Participating Oakland County departments include the Drain Commission, Parks and Recreation, Planning and
Economic Development, and Road Commission.

COMMUNITY ASSISTANCE PROGRAM PROPOSAL
The Community Assistance Program was developed to provide recreational services to the
population in Oakland County based on socioeconomic needs. The program has provided an
opportunity for recreation to all areas of Oakland County. The Oakland County Parks and
Recreation Commission has responded to the needs of Oakland County residents for the past
23 years, by appropriating funds. In 2005 we would like to request the Commission to approve
$25,000.
2005 Program Proposal
The recreation section staff recommends continuation of the Community Assistance Program
(C.A.P.) in 2005. Staff has revised the C.A.P. program and will be offering it to all sixty-one
communities in Oakland County. In addition to the mobile units and bus transportation will be
offering discounts for groups to come to both Red Oaks Waterpark and Waterford Oaks
Waterpark. We would like to request that the Commission grant to the Recreation and Parks
department $25,000. This would be distributed to municipalities and governmental agencies
demonstrating a need or inability to pay a reduction or total price of the units:
The request of funds for the 2005 Community Assistance Program will be $25,000. We
will allocate $20,000.00 for mobile recreation visits and buses for transportation to the
Waterford Oaks and Red Oaks Waterpark and trips to the Lewis E. Wint Nature Center.
The remaining $5,000.00 will be used to fund discounts for trips to the waterpark, youth
group camping, the refrigerated toboggan run and nature center trips.
This program will provide the opportunity for over 30,000 citizens to enjoy quality
recreation activities. With the addition of wavepool and nature center trips, we will
provide this excitement to 2,520 citizens. One per community.
2. Communities will be notified that this program has been established by the Oakland
County Parks and Recreation Commission and is not affiliated with a federal or state
funded program.
Description of Services Available Under This Program
Waterparks:
New for 2005 the C.A.P. program will include $2 discount tickets for groups of 45 or less. This
will be available Monday and Tuesday only. This can be used in conjunction with the C.A.P.
buses or utilizing community transportation.
Transportation:
The C.A.P. buses may be used for transportation to and from Waterford Oaks and Red Oaks
Waterparks, Lewis E. Wint Nature Center, Lyon Oaks Nature Center, or any day -use park
(Independence Oaks, Addison Oaks, Groveland Oaks). Park entry fee will be waived. The
buses will be available Monday through Thursday from 10:30 a.m. - 1:30 p.m. One per
community.

Mobile Recreation:
The NEW Treasure Island, Sport Mobile, In -line Skate Mobile, Climbing Wall, Puppet Mobile and
buses would be available for this program. The units will only be available for this program
Monday through Friday with the option to use one visit on a .weekend. One per community.

Priority for the distribution of the C.A.P. visits would be based on the following:

RECOMMENDED WATERPARK FEES
Staff has been reviewing the attendance at the Red Oaks and Waterford Oaks
Waterparks over the last three years and has noted a decline in the groups. After talking
with several communities who have traditionally scheduled several visits to the
waterparks, the reasons given for not scheduling include:
• Budget cutbacks
• Expense for offsite visits
• Expense for transportation
These communities include Huntington Woods, Madison Heights, Royal Oak,
Pontiac, Clawson, Clinton Township, and Berkley.
Waterpark groups attend despite poor weather, due to their commitment to
transportation. Groups who attend are more likely to return to the waterparks with a
family member, due to a positive experience.
In 2003, groups accounted for 13% of our total revenues; in 2004, they
accounted for 14%. These percentages translate to approximately 13,000 swimmers at
each facility.
It is staff's goal to be sensitive to these issues while remaining fiscally
responsive. Therefore, it is staff's recommendation that we lower the group fees for the
2005 season as follows:

MARKETING REPORT

Total Oakland County Parks and Recreation system attendance for FY 2004 reached a
record 1,545,233.
This was achieved in spite of another cool, wet summer. May was one of the wettest
months in history. June through August temperatures remained in the 70s and mid-80s. Only
two days in early June reached 90 degrees. "Summer" arrived in September contributing to
strong attendance numbers that month.
Visits on the Oakland County Parks web site during July 2004 totaled 35,000 -- an
average of 1,126 visits per day. Pages receiving the most views reflected the previous year:
pick a park or golf course, the home page, fees and charges, Red Oaks Waterpark, activities and
Waterford Oaks Waterpark.
Nearly 380 e-mail requests/comments were responded to through mid -October, 2004.
Most were inquiries about camping (84), mobile recreation (50), and banquets/groups (40).
Coupon Redemption
Less discount coupon use was prevalent this year — 9,190 compared to 16,600 last year.
Again, this is likely to be attributable to poor weather for the waterparks, which receive the most
coupons.

Waterparks
As in the 2003 season, weather made a significant impact in 2004 attendance at both
waterparks. Red Oaks 2004 attendance was 64,049 compared to 71,626 last season. At
Waterford Oaks, numbers reached 68,384, down from 92,539 in 2003.
For the first time in history, Waterford Oaks Wateipark was open to the public on
Saturday, Sept. 11 (due to an open date prior to a reserved large group event the next day.)
Attendance on this late summer day attracted 1,700 swimmers.
In spite of less than desirable weather conditions, visitors redeemed nearly 3,400
coupons for $1 off admission from the parks and recreation web site. In addition, a promotion
with Coca-Cola and Jet's Pizza resulted in redemption of nearly 1,200 buy -one, get -one free
vouchers.
Individuals who were interviewed in -person during July indicated that they had waited all
summer for dry, warm weather when they could bring their families to the waterparks. Survey
respondents also said that cleanliness, the variety of attractions, good staff, and safety were
reasons they visit the waterparks.
Group Sales
Groups at both waterparks remained fairly comparable to the previous summer's
numbers. Shelter rentals more than doubled to 69 at Addison Oaks and increased by 30
percent to 91 rentals at Waterford Oaks.
Sales of waterpark consignment tickets through Leisure Pursuits more than doubled to
revenues of $68,075 compared to $32,817 in 2003. An additional $30,000 in ticket revenue

came from sales to MGM Casino, Waterford Parks and Recreation, a hotel, credit union and
bank.
Annual vehicle permit sales at off -site locations were up slightly from 2003. A total of
1,626 Oakland County Parks permits were sold off -site in 2004 (compared to 1,577 in 2003.)
During 2004 (the first year dual passes were sold off -site), 159 OCP/Metroparks dual
permits were sold. (Note: during 2004, a total of 1,099 dual permits were sold by Oakland
County Parks and Metroparks, compared to 568 in 2003.)
Orion Township Offices sold the most permits: 808 Oakland County Parks and 125
OCP/Metroparks permits. Sales at Bass Pro Shops Outdoor World in Auburn Hills continue to
be strong with 646 permits purchased. Oakland County Credit Union will begin participating in
permit and waterpark ticket sales in 2005.
An initial 50 Commemorative bricks have been sold to start the projects at Orion Oaks
and Lyon Oaks. In addition, eight memorial benches were sold as well as seven commemorative
trees.
Camping
With the new sites open, Addison Oaks accommodated 68,556 campers in 2004, up
from 62,424 last year. Groveland Oaks also experienced an increase with 109,207 campers
during the 2004 season, compared to 106,446 in 2003.
A direct mail piece to current Oakland County Parks campers and those from select zip
codes returned 285 responses for a $10 off discount at Addison Oaks through the regular
camping season. However, a similar $5 offer mid -season on the web site, drew 322 returns.

This larger web return leads to the conclusion that campers are seeking more information
via the web site. A promotion in 2005 will focus on using the web to provide discount offers.
A search of camping -related web sites revealed at least 20 sites that provided
information about Groveland Oaks and Addison Oaks.
Camp Wilderness, the new youth group area at Independence Oaks, enjoyed a
successful opening season with 24 organizations reserving the site for a minimum of two nights
each. Schools, scout troops and churches were the primary campers.
Golf Courses
Totals for the golf courses reached 214,452 (including 26,940 rounds at Red Oaks) in
2004 compared to 177,716 in 2003.
At Lyon Oaks, 66 offers for a free bucket of balls at the driving range were redeemed
throughout the summer. While considerably lower than anticipated, it is likely that response was
directly affected by the very wet, cool weather occurring during the time the mail offer was
received. In spite of these issues, 18-hole rounds at Lyon Oaks tallied upward to 21,931 in
2004
On the same direct mail postcard, golfers also received an offer for $5 off a round at
Springfield Oaks. Only 66 were redeemed. Despite the low redemption, Springfield Oaks
golfers responded significantly to the on -location, 2 for 1 promotion offered on weekends after 4
p.m. Rounds at Springfield Oaks were basically at par with last year's numbers.

THIS EASEMENT IN GROSS is granted this day of
2005 by the
County of Oakland, a Michigan Constitutional Corporation, whose address is 1200 N. Telegraph Road,
Pontiac, Michigan 48341, (hereinafter referred to as "Grantor") to the Detroit Edison Company, a
Michigan Corporation, whose address is 2000 Second Avenue Detroit, Michigan 48226 (hereinafter
referred to as "Grantee").
FOR AND IN CONSIDERATION of One Dollar ($1.00) and other good and valuable
consideration receipt of which is hereby acknowledged, and pursuant to the conditions set forth herein,
Grantor does hereby grant to the Grantee, and the Grantee does hereby accept, the right to construct,
operate, maintain, repair and/or replace underground utility line facilities and related appurtenances, and
to provide the Grantee with access to the property described herein for the limited purpose of maintaining
said underground utility line facilities and related appurtenances:

2. Grantor's Land is in the Township of Addison, Oakland County, Michigan described as:
The Southeast %4 of Section 33, TSN, R11 E, also known as part of Addison Oaks County Park.
3. Purpose: The purpose of this grant is to provide the Grantee with a non -perpetual, non -
assignable, non-exclusive easement in gross to permit construction, installation, operation,
maintenance, replacement and removal of underground utility line facilities and related
appurtenances, consisting of poles, guys, anchors, wires, cables, transformers and accessories
and to provide the Grantee with access to the burdened property described herein for the limited
purpose of constructing, installing, operating, maintaining, replacing or removal of the said
underground utility line facilities and related appurtenances. Under no circumstances can the
easement be used for any other purpose than underground utility line facilities. The Grantee shall
provide the Oakland County Parks and Recreation Commission reasonable notice of its intent to
enter the property for the purposes stated above so as not to interfere with grantor's scheduled
recreational activities on the property except in an emergency situation.
4. Grant of Easement in Gross: Grantor hereby grants and conveys to Grantee a 12-ft, wide non -
perpetual, non -assignable, non-exclusive easement in gross for the construction, operation,
maintenance, replacement and removal of said underground utility line facilities and related
appurtenances, as shown on the attached Exhibit A.

4a. Trees, bushes, branches, roots, structures and fences: Grantee may trim, cut down,
remove or otherwise control any trees, bushes, branches and roots in the easement
area (or that could grow into the easement area) and remove structures and fences in
the easement area that Grantee believes could interfere with the safe and reliable
construction, operation and maintenance of Grantee's facilities. No trees, plant life, structures and
fences can be planted, grown or installed within 8-feet of the front door and within 2-feet of the
other sides of transformers and switching cabinet enclosures. Grantee will not be responsible to
Grantor for damages to or removal of trees, plant life, structures and fences placed in front of
transformer doors.
5. Interest in Realty: This Grant and Conveyance of an easement in gross shall be binding upon
and inure to the benefit of the Grantor and Grantee, their, representatives, successors and
assigns, and the covenants and grants contained herein shall not run with any parcel of land, and
shall only extend to the use of said easement in gross for underground utility line facilities. In the
event that Grantee, its heirs, representatives, successors and assigns (hereinafter Grantee) shall
no longer require the use of said easement in gross for the purposes described herein, said
easement shall be considered abandoned, and the easement in gross shall terminate and be
extinguished and, the land shall revert back to Grantor, its heirs, representatives, successors or
assigns (hereinafter Grantor), with no interest remaining in Grantee. Upon the request of
Grantor, the Grantee shall provide a Release of Easement in Gross to Grantor. If no Release of
Easement in Gross is provided to the Grantor within a reasonable period of time, the Grantor may
file with the Oakland County Register of Deeds an Abandonment of Easement in Gross which
shall act in place of the Release of Easement in Gross, required of the Grantee. If the easement
in gross is abandoned, terminated or extinguished, then upon the request of Grantor, the Grantee
shall remove any structures in the easement in gross as requested by Grantor, and restore the
easement in gross to the condition it was in prior to the removal. Any damage or claim of damage
(including but not limited to environmental damage), to persons or property, including property of
the Grantor, resulting from the use of the easement in gross or the construction, installation,
operation, maintenance, replacement or removal of the underground utility line facility, shall be
the sole responsibility of the Grantee.
6. Restoration of Property: Any portion of Grantor's property, which is damaged by Grantee's
exercise of the easement in gross granted herein, shall be restored to its original condition by
Grantee.
7. Indemnification: To the extent permitted by law, Grantee hereby agrees to indemnify and hold
harmless the County of Oakland, its elected officials, officers, employees and/or agents from and
against any and all claims which are imposed upon, incurred by, or asserted against the County
and/or any County elected official, officer, employee, and/or agent, which are based upon, results
from, or arises from, or are in any way related to an alleged error, mistake, negligence, or
intentional actions or omissions by the Grantee or any of the Grantees elected officials, officers,
employees or agents, relating to the construction, installation, operation, maintenance,
replacement or removal of the underground utility line facilities and related appurtenances as
described herein. -

Bids were requested for the purchase of ski rental equipment for Independence Oaks
County Park.
The ski rental equipment order is as follows: 31 pr. ski boots (various sizes), 31 pr.
cross-country skis (various sizes), 31 pr. bindings, and 15 pr. ski poles (various sizes).
Bids were sent to 22 companies, with only one company submitting a bid by the due
date. One bid was received after the due date. Purchasing indicated that some of the
companies misplaced or overlooked the bid packets. Two companies submitted a "no bid"
response. No other vendors responded.

Golf Car for the following reasons:
• Club Car has the only aluminum frame, which creates less wear and is

• Our existing fleet of 340 cars is all Club Car.
Staff recommends awarding the bid to Club Car for a total of $222,100.

Staff requests an additional 10% contingency, $12,598, to address necessary

RECREATION SECTION BUILDING RENOVATION
WATERFORD OAKS
Proposals were received on December 9, 2004 for the renovation of the Recreation
Section staff office building. This structure is one of the oldest buildings in Waterford Oaks. It
initially housed technical support, which moved to a larger addition in 1991.
The Recreation Section includes mobile recreation, therapeutic recreation, senior
recreation, the fridge and wave pool staff, as well as Waterford Oaks staff. In the summer, it
also is the main headquarters for all of the summer mobile recreation employees as well as the
main area for customer services, such as annual permits registration, class reservations, etc. To
accommodate this staff, some minor renovations were completed over the years. The current
space consists of approximately 4,500 sq. ft. of which 1,400 sq. ft. is a garage for setting up
mobile units.
The proposal consists of (Phase1) a cursory structural review, a needs assessment,
(Phase 2) a preliminary and final design, plans and specifications and (Phase 3) project
administration.

Foundation Construction
The construction of the Ellis Barn foundation is currently being advertised,

Bid packages were delivered to interested parties on December 21, with a
public bid opening scheduled for January 4. A short bid period was necessary to
accommodate the re -design of the foundation and the January 5 Commission
meeting date. As advertised, construction on the foundation is to begin within ten
days of contract signing.
Staff will present a bid tabulation and recommendation to the Commission
at the January 5 meeting.

I would like to thank the Michigan Natural Resources Trust Fund Board for approving
the grant to the Oakland County Parks and Recreation Commission for the Organized Youth
Camping Connector Trail at Independence Oaks County Park. This will help give residents
access to the Clinton River and the surrounding wetlands.
Regarding our application for Project #002, the Addison Oaks Land Acquisition, the
Natural Resources Trust Fund staff recommended to fund the $1,712,000 for the acquisition
of 346 acres at Addison Oaks County Park. This was arbitrarily removed from the staff -
recommended list with no explanation.
This was our third attempt for a grant for this acquisition, with a very agreeable seller
willing to wait throughout the grant process. After having made the points requirements, what
else might we have done to receive approval for grant funding?
Since a point system has been adopted by your commission to keep politics out of this
process, what allows other projects to be favored over existing pointed and recommended
projects?
We agree that the demand is greater than the resource to help fund every project
submitted to the Trust Fund, but I feel the point system should be final.

There was approximately 1200 lbs. of meet donated to the food banks in conjunction with the hunters
against hunger program.
Staff is recommending two shotgun dates for 2005 similar to the muzzleloader program
We have several habitat enclosures to monitor habitat damage at both Independence Oaks and
Addison Oaks due to deer populations. Staff will be installing additional enclosures at other park
locations to monitor habitat damage.
