AYES: Kostin, Lewis, Long, McCulloch, Palmer, Scott, Skarritt (7) NAYS: (0) Motion carried on a voice vote UPPER BUSHMAN CASH DONATION AND EISELE PARCEL DONATION: Moved by Mr. McCulloch, supported by Mr. Skarritt to approve the resolution supporting the Funding Agreement between Oakland County and Ducks Unlimited to facilitate the County's acquisition of the Upper Bushman Tract and the Eisele Parcel; and the resolution supporting the Declaration of Charitable Gift for said properties from Wetlands America Trust, Inc.: PR10-013 DUCKS UNLIMITED ACQUISITION FUNDING AGREEMENT UPPER BUSHMAN LAKE-EISELE PROPERTY DONATION WHEREAS, Ducks Unlimited (DU) and the County of Oakland willingly choose to enter into this Agreement to facilitate the County's acquisition of properties located in Oakland County, Michigan known as the Upper Bushman Tract and the Eisele Parcel (hereinafter "Sites") as specifically described in Exhibit A and hereby made a part of this Agreement; and (Commission Meeting, September 1, 2010) WHEREAS, the acquisition of the Sites has also been undertaken to substantially increase the size of Independence Oaks County Park; and WHEREAS, Wetlands America Trust, Inc. ("WAT") owns the Eisele Parcel located in Independence Township, Oakland County, Michigan and this property is adjacent to the Independence Oaks County Park; and WHEREAS, the acquisition of the Eisele Parcel by the County from WAT will be accomplished via a separate "Declaration of Charitable Gift" agreement; and WHEREAS, the parties desire to work together to further the goals and purposes of the project as well as the mission and purpose of each respective organization. NOW THEREFORE BE IT RESOLVED that the Oakland County Parks and Recreation Commission hereby recommends the Oakland County Board of Commissioners approve and accept the terms and conditions of the attached Funding Agreement between the County of Oakland and Ducks Unlimited. BE IT FURTHER RESOLVED that the Oakland County Parks and Recreation Commission hereby recommends the Oakland County Board of Commissioners direct its Chairperson or his designee to execute the attached Funding Agreement between the County of Oakland and Ducks Unlimited. PR10-014 WETLANDS AMERICA TRUST, INC. DECLARATION OF CHARITABLE GIFT UPPER BUSHMAN LAKE-EISELE PROPERTY DONATION WHEREAS, Wetlands America Trust, Inc. ("WAT") and the County of Oakland ("County") willingly choose to enter into this declaration to facilitate the County's acceptance of WAT's donation of property located in Oakland County, Michigan known as the Eisele Parcel (hereinafter "Property') as specifically described in Exhibit A of the Declaration of Charitable Gift and hereby made a part of this Agreement; and WHEREAS, WAT is a supporting organization of Ducks Unlimited, Inc. which holds most real estate interests on behalf of Ducks Unlimited, Inc.; and WHEREAS, WAT owns the Property located in Independence Township, Oakland County, Michigan and this Property is adjacent to the Independence Oaks County Park; and WHEREAS, the County's acquisition of the Property will increase the size of Independence Oaks County Park; and WHEREAS, the acquisition of the Property will provide for access to wetland habitat at Independence Oaks County Park allowing for stewardship and maintenance opportunities. NOW THEREFORE BE IT RESOLVED that the Oakland County Parks and Recreation Commission hereby recommends the Oakland County Board of Commissioners approve and accept the attached Declaration of Charitable Gift between the County of Oakland and Wetlands America Trust, Inc. BE IT FURTHER RESOLVED that the Oakland County Parks and Recreation Commission hereby recommends the Oakland County Board of Commissioners direct its 4-5 (Commission Meeting, September 1, 2010) Chairperson or his designee to execute the attached Declaration of Charitable Gift between the County of Oakland and Wetlands America Trust, Inc. AYES: Burns, Kostin, Lewis, Long, McCulloch, Palmer, Scott, Skarritt (8) NAYS: (0) Motion carried on a voice vote PROPOSED EROSION CONTROL GRANT PROJECT RESOLUTION — WATERFORD OAKS: Moved by Mr. Kostin, supported by Mrs. Long to approve the following resolution supporting the application to the Michigan Department of Natural Resources and Environment's Section 319 Non -Point Source Program to fund an erosion control and associated wetland fill project at Waterford Oaks County Park: IN SUPPORT OF THE APPLICATION FOR A MICHIGAN DEPARTMENT OF NATURAL RESOURCES AND ENVIRONMENT SECTION 319 NON -POINT SOURCE GRANT FOR THE OAKLAND COUNTY PARKS AND RECREATION COMMISSION WHEREAS, the Oakland County Parks and Recreation Commission has been notified by the Department of Natural Resources and Environment that application for Section 319 Non -Point Source grants may be submitted by October 20, 2010 for the 2011 funding cycle; and WHEREAS, the Oakland County Parks and Recreation Commission has identified and established priorities for the stewardship and maintenance of park natural resources within the adopted Recreation Master Plan; and WHEREAS, the Oakland County Parks and Recreation Commission recommends the filing of the following application to the Department of Natural Resources and Environment for a $56,850 grant (58% of total project costs) with a local match of $41,950 (42%): WATERFORD OAKS EROSION CONTROL PROJECT NOW THEREFORE BE IT RESOLVED that the Oakland County Parks and Recreation Commission hereby requests the Oakland County Board of Commissioners authorize and approve the grant application for Section 319 Non -Point Source Grant for the Waterford Oaks Erosion Control Project to Michigan Department of Natural Resources and Environment. BE IT FURTHER RESOLVED that the Oakland County Parks and Recreation Commission hereby requests the Board of Commissioners direct its Chairperson or designee to execute said application on behalf of the County of Oakland. AYES: Burns, Kostin, Lewis, Long, McCulloch, Palmer, Scott, Skarritt (8) NAYS: (0) Motion carried on a voice vote RESIDENTIAL LEASE -INDEPENDENCE OAKS: Moved by Mr. Palmer, supported by Mrs. Long to approve the following resolution supporting the residential lease agreement with Kristy Ottman Leahy: (Commission Meeting, September 1, 2010) PR10-011 RESOLUTION RESIDENTIAL LEASE -INDEPENDENCE OAKS WHEREAS, the County of Oakland is the owner of Independence Oaks County Park; and WHEREAS, a one-story one -bedroom house, identified as 5511 Oakhill Road, is located on the grounds of Independence Oaks County Park; and WHEREAS, it is the desire of the Oakland County Parks and Recreation Commission to lease said house located at 5511 Oakhill Road to Kristy Ottman Leahy for a period of one year commencing September 15, 2010; and WHEREAS, under the terms and conditions of the attached Lease Agreement Kristy Ottman Leahy will pay rent as follows: September 15, 2010 — September 14, 2011 $700.00 each month and pay all utility costs; and WHEREAS, the Departments of Facilities Management and Corporation Counsel have reviewed and/or prepared all necessary documents related to the attached lease agreement; and WHEREAS, it is the recommendation of the Oakland County Parks and Recreation Commission and the Department of Facilities Management that the Oakland County Board of Commissioners accept and approve the terms and conditions of the attached Lease Agreement. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby approves and authorizes the attached Lease Agreement between the County of Oakland and Kristy Ottman Leahy. BE IT FURTHER RESOLVED that the rent amount received be deposited in the Oakland County Parks and Recreation Rental House Revenue fund line item. BE IT FURTHER RESOLVED that the County of Oakland Board of Commissioners hereby directs its Chairperson or his designee to execute the attached Lease Agreement and all other related documents between the County of Oakland and Kristy Ottman Leahy, which may be required. AYES: Burns, Kostin, Lewis, Long, McCulloch, Palmer, Scott, Skarritt, VanderVeen (9) NAYS: (0) 4-7 (Commission Meeting, September 1, 2010) Motion carried on a voice vote ACTIVITY REPORT: The July Activity Report was received and filed. 2010 MILLAGE RESULTS REPORT: Official millage renewal results, as certified by the Board of Canvassers on August 17, 2010, were provided which verified the 76.46% approval of the parks millage. Additionally, more than 50% of the CVT communities approved the millage at 75% or greater. INFORMATION TECHNOLOGY QUARTERLY UPDATE: Phil Castonia, Business Development Representative, and Dawn Siegel, IT Supervisor, provided an update on the Information Technology Road Map. Mr. Castonia also announced Oakland County Parks and Recreation was awarded the Digital Government Achievement Award (DGAA) which recognizes outstanding agency and department web sites and projects at the application and infrastructure level. EXECUTIVE OFFICER'S REPORT: In addition to the Executive Officer's Report, the following was also noted: --A work session has been scheduled for Wednesday, October 20 from 9 am — Noon. This is the first of several work sessions to be held during the fall and winter. Meeting site to be determined. OLD BUSINESS: None. NEW BUSINESS: A residential gas line was cut at Independence Oaks last week. As a result, staff will attend safety training on Miss Dig and incorporate a process for staff to follow before equipment goes out to a park construction site. Meeting adjourned at 10 a.m. J. (168,805.29) $2,795,718.79 (Page 3 of 3) 713-3 Item VC Waterford Oaks Entrance Drive & Playground Parking Lot Repairs Construction Modification With the assistance of Oakland County Facilities Management/Engineering Department, staff completed the Waterford Oaks Entrance Drive and Playground Parking Lot Repairs approved at the March 3, 2010 Commission Meeting. During the project, staff made several field modifications mainly due to deteriorating/unstable concrete curb conditions of the entrance drive. Additional modifications required the complete reconstruction of existing storm structures along the existing road. These modifications, based on contract unit prices, resulted in an expenditure of $11,522.79 more than the previously approved project contingency of $7,577.00. Therefore, staff requests approval to increase the previously approved contingency of $7,577.00 (5%) to include the overage of $11,522.79, resulting in a total contingency amount of $19,099.79 (12.6%). Funds are available in the Waterford Oaks FY2010 Operating Budget — Grounds Maintenance line item for this expense. 7C-1 Item NA Staff Introduction Effective October 11, 2010 John Chasteen, former Groundskeeper II assigned to Springfield Oaks Golf Course, will be promoted to Park Supervisor at Lyon Oaks. John is a graduate of the Michigan State University Turfgrass Management Program. He is replacing 35-year employee Bill Stokes who is retiring. Bill served as the grow -in supervisor for Lyon Oaks Golf Course and Park. Congratulations are extended to Bill for his years of service and dedication to the Oakland County Parks. The approach is based on both the Strategic Master Plan and the Sponsorship Policy adopted by the Commission in 2009. A copy of the policy is included for reference. The presentation will include a summary of sponsorship solicitation and acquisition activities to date and outline a strategic approach moving forward. Date Adopted: Dated Revised: C: 09-006 05-06-09 1 05-06-09 Page 1 of 6 Sponsorship Policy BACKGROUND: Oakland County Parks and Recreation Commission staff has continually pursued sponsorship and partnerships to generate revenue to offset operational and capital costs over the last 43 years. In an effort to coordinate sponsorships within the Commission with the corporate community, business partners, and not -for -profit partners to enhance parks and recreational services and facilities in the county, staff desires a detailed sponsorship policy and procedures to guide their efforts. This policy is intended to guide staff in sponsorship management and development. All gifts, sponsorships, and collective partnerships must meet county legal considerations and policies and reinforce the county's mission, values and priorities. II. PURPOSE: The purposes of the Sponsorship Policy are the following: A. To provide guidelines for developing and managing sponsorships which ensure that all marketing of sponsorships support Oakland County Parks and Recreation Commission's goals of service to the community and remain responsive to the public's needs and values. B. To recognize that corporate and business sponsorships provide an effective means of generating new revenues and alternative resources to support Oakland County Parks and Recreation Commission's facilities, programs and services. C. To establish and guide relationships with existing and potential partners who share the county's commitment to provide the highest quality parks and recreation environment throughout Oakland County. D. To generate revenue to fund existing and additional facilities, projects, programs and events provided to residents in order to maintain valuable and important parks and recreation services and facilities within specific boundaries and with built-in safeguards against misuse of this revenue opportunity tool. E. To minimize the competition between facilities and programs within Oakland County Parks and Recreation Commission seeking business support while limiting the perception of "excessive corporatization" in the number of sponsors and maximizing the cumulative revenue from these partners. III. SPONSORSHIP CATEGORIES: A. Co -Sponsorships Co -sponsorships are when the Oakland County Parks and Recreation Commission supports, either in -kind or financially, an outside organization's event or program. ICAKLAND 5 .S Date Adopted: ( Dated Revised: ( C: 09-006 05-06-09 05-06-09 Page 2 of 6 Sponsorship Policy The support must be mutually beneficial and a collaborative venture that furthers Oakland County Parks and Recreation Commission's mission, goals and priorities, as well as demonstrates community pride and involvement. It must not have a religious or political purpose. Example: County and Hospital develop a fitness walk/run for kids and parents to promote the benefit of a healthy body. This benefits the Oakland County Parks and Recreation Commission based on its value to promoting healthy lifestyles and the hospital on promoting preventative care for youth and adults. B. Partnership A partnership is an organized and agreed to relationship between Oakland County Parks and Recreation Commission with another public agency, not -for -profit, or business where complementary resources are combined to establish a mutual direction or complete a mutually beneficial project. The level of investment by each partner is on an equity level and are agreed on in advance to develop a project, program, facility or event. All partners must receive a return on their investment in a partnership. Partnerships can take the form of- 1 . Cash gifts and donor programs 2. Improved access to alternative funding 3. Property investments 4. Charitable trust funds 5. Labor 6. Materials 7. Equipment 8. Sponsorships 9. Technical skills and/or management skills, and other forms of value. The effective use of volunteers also can figure significantly into developing partnerships. Some partnerships involve active decision malting, while in others, certain partners take a more passive role. Example: Youth soccer club develops half the cost of development of a soccer park within Oakland County Parks and Recreation Commission in exchange for priority use of the facility for their specific purpose, as well as half the cost of maintenance of the park. Partnerships are subject to Oakland County Parks and Recreation Commission's Partnership Policy and are considered separately from sponsorships. C. Site Specific Sponsorships Site Specific Program Sponsorships are when a neighborhood, business, local merchant, or local branch of a corporation sponsors a time -limited event or program 8D-3 ()AI(LAND Date Adopted: I Dated Revised: I C: 09-006 05-06-09 05-06-09 Page 3 of 6 Sponsorship Policy at an individual Oakland County Parks and Recreation Commission facility. Sponsorships usually are incorporated as a title sponsor, presenting sponsor, associated sponsor and product sponsors. Example: An outdoor adventure retail store or sporting goods company will sponsor a adventure sport special event at the Oakland County Parks and Recreation Commission park to promote skills and competition for the cost to produce the event. D. County -wide Program Sponsorships County -wide Program Sponsorships are when a local corporation sponsors a time -limited program held at Oakland County Parks and Recreation Commission facilities or has a county -wide presence. Example: A local utility sponsors the Christmas lighting program in a park for the County that includes the purchase of the lights and the installation, as well as providing the utility cost for the display. E. Temporary Logo or Recognition Display Sponsorships Temporary Logo or Recognition Display Sponsorships include a display of recognition on Oakland County Parks and Recreation Commission property for more than seven days and less than one year. Example: An ice cream store provides signs at national events to attract kids and parents in exchange for the cost (usually minimal) of trophies for the tournament. F. Long-term Sponsorships Lorig-wiiii Sponsorsnips include the naming of a facility or portion of a facility for a corporate sponsor for more than one year. Example: Sponsor provides the cost of maintenance of a mile of trail for $15,000 a year in exchange for trail markings at the start of each mile and at the trail heads along with recognition on trail maps. IV. GENERAL PRINCIPLES AND GUIDELINES A. Oakland County Parks and Recreation Commission accepts the principle that third persons may become sponsors of Oakland County Parks and Recreation Commission -approved programs, projects, events, facilities or activities where such partnerships are mutually beneficial to both parties and in a manner consistent with all applicable policies and ordinances set by OCPRC. Under the conditions of this policy, staff may solicit such sponsorships. B. At all times, recognition for sponsorships must be evaluated to ensure the Oakland County Parks and Recreation Commission is not faced with undue commercialism and is consistent with the scale of each sponsor's contribution. C. Restrictions on Sponsorships and Partnerships: In general, the following industries and products are not eligible for marketing partnerships: 1. Companies whose business is substantially derived from the sale or manufacture of tobacco products 3. Alcoholic beverages when the targeted beneficiaries of the sponsorship/partnership are youth under the legal drinking age 4. Parties involved in a lawsuit with the County of Oakland 5. Parties involved in any stage of negotiations for a Oakland County Parks and Recreation Commission contract unless contract is directly linked to a sponsorship or partnership opportunity 6. Oakland County Parks and Recreation Commission may elect to enter into a sponsorship or partnership with restricted parties when it is deemed appropriate and tasteful for the project 7. Anytime Oakland County Parks and Recreation Commission determines the credibility of affiliation with a specific sponsor would damage its image. D. Exclusions to Sponsorship Policy 1. Gifts or unsolicited donations to Oakland County Parks and Recreation Commission where no business relationship exists 2. Sponsorship proposals forwarded to Oakland County Parks and Recreation Commission may not be subject to the Sponsorship or Partnership Policy if the proposed sponsorship is determined through a good faith effort to be unique and without interested competitors. E. Additional guidelines for the development of sponsorships for Oakland County Parks and Recreation Commission will include the following: 1. The corporation's or business involvement in community and OCPRC projects 2. The desirability of association — The "image" of the corporation or business is in good standing in the community and would not damage the image of OCPRC 3. The timeliness or "readiness of the corporation to enter into an agreement 4. The level of resident and visitor visual impression points, the number of users involved, level of media exposure, and costs associated with the park, recreation facility, activity or event 5. The actual value in cash or in -kind goods or services of the sponsorship in relation to the benefits received by the corporation or business and the investment by Oakland County Parks and Recreation Commission 8D-5 6. Community support for or against the sponsor 7. The operating and maintenance costs associated with the sponsorship 8. The corporation's effort of responsible environmental or community stewardship V. PROCEDURES: A. All proposals for sponsorship must be submitted in writing using the Sponsorship Proposal form to the Business Development Representative for Organizational Management. The Business Development Representative will review and submit to the Sponsorship and Partnership Team comprised of staff from various departments within OCPRC to review and provide comments, as well as make recommendations to the Executive Officer. B. The Executive Officer or his/her designee will review the proposal and make a decision if the sponsorship is less than $10,000 (cash and/or in -kind). If the request is for more than $10,000 the Oakland County Parks and Recreation Commission will act on the proposal. C. If the Executive Officer approves the sponsorship proposal in principle, the Business Development Representative will work with the staff involved in the sponsorship to draft a Sponsorship Agreement for signature. This agreement will include the contract relationship; the term and renewal opportunities; description of programs, the project, and activities to be provided; description of fees, commissions, and/or in -kind services provided to Oakland County Parks and Recreation Commission; the marketing rights and benefits provided to the sponsor; termination provisions, and performance measures expected on behalf of the partner. VI. CRITERIA: The Executive Officer and Sponsorship and Partnership Team may use, but are not limited to, the following criteria when evaluating a corporate sponsorship proposal: A. The compatibility of the corporation's products, customers and promotional goals with Oakland County Parks and Recreation Commission's Mission B. The corporation's or partner's past record of involvement in community and Oakland County Parks and Recreation Commission projects C. The desirability of association — the image of the corporation or business is in good standing in the community and would not damage the image of Oakland County Parks and Recreation Commission D. The timeliness or readiness of the corporation, business, partner to enter into an :w el agreement E. The actual value in cash, or in -kind goods or services, of the proposal in relation to the benefit to the corporation and Oakland County Parks and Recreation Commission F. Community support for, or opposition to, the proposal G. The operating and maintenance costs associated with the proposal on behalf of Oakland County Parks and Recreation Commission H. The corporation's effort of responsible environmental or community stewardship 8D-7 Item #8E Urban Recreation Initiative (URI) Preliminary Draft Staff will make a presentation on the Urban Recreation Initiative (URI) to provide information on the development of the URI Proposal. An informational packet has been distributed with the agenda. Staff will discuss the role the URI could play in the continued implementation of the 2008 Strategic Master Plan and the development of the 2012 Recreation Master Plan. Staff will also address the process that would be required to implement the URI and obtain Commission input. E: M Item #8F Executive Officer's Report 1. The contract with Ferris State University has been cancelled due to staff changes at the university. Staff is looking at options to complete the work specified on the contract. 2. The Oakland County Print shop will close April 1, 2011. Staff will be contracting with Oakland Schools for print services. 3. Please plan to attend the first Commission Work Session scheduled for Wednesday, October 20 from 9 a.m. to Noon at the Executive Office Building in the Pontiac Training Room. Topics for discussion and Commission input are: 1. Strategic Marketing Review and 2. Capital Improvement and Major Maintenance 15-year Priority Projection. Currently Staff is working on the following three CIP projects for the newly acquired Upper Bushman Lake Property at Independence Oaks as required by the MNRTF Grant Agreement: • Boundary Fence (Budget $100,000) 0 5 bids were received on September 2, 2010; a contract was issued to the lowest qualified bidder, Metamora Fence Company, in the amount of $46,505.30. o MDNRE Wetland Permit has been received. • Gravel Parking Lot (Budget $40,000) o Final engineering drawings will be completed at the end of November. o Due to RCOC permit requirements, staff will be releasing the project for bid in January and may have to obtain Commission approval in March if bids are over budget. ■ Current engineer estimate is $70,000 - $80,000. ■ After meeting with the Permits Division of the RCOC, some , savings may be realized with our agreed revisions. o Staff originally anticipated this parking lot to be constructed this fall utilizing existing blanket contract vendors; however, we now anticipate opening public access April 1, 2011. • Boardwalks & Trails (Budget $216,000) o Bids for lumber, hardware, and floatation systems will be released in October. 8F-1 o Park Staff, trustys and potential volunteers will be constructing the boardwalks and trails this winter and spring. o MDNRE Wetland Permit has been received. 8. Staff is in receipt of information detailing the State of Michigan's Recreation Passport Program. Information is included in the commissioners' folder for your review. We want to thank you for this fabulous trip, which was the highlight of our year! As frequent users of the Orion Oaks Dog Park, we have walked acres for more years than we wish to admit, and this summer we heard about this wonderful opportunity through fellow dog walkers at Orion Oaks Dog Park. Mileage we may not know, but time spent at this outstanding park facility has and will continue to keep us walking, while our dogs are out there running. We cannot thank you enough for being a part of this extraordinary program (Walk Michigan!). As first place winners of Walk Michigan! we enjoyed a first class trip with phenomenal folks who guided us through the entire weekend, and provided for us such an excellent opportunity to enjoy our glorious state. First class accommodations, transportation, and front row starting on the bridge walk could not be improved. The ferry crossing with Governor Granholm being so gracious and encouraging just added extra enjoyment to the whole experience. As a retired public school teacher myself, I know how public service may not always get its due rewards or acknowledgements, but Oakland County being a participant in the Walk Michigan! program cannot be underestimated.
