INTRODUCTION AND BACKGROUND
The Circuit Court would like to extend the interlocal agreement with OCHN to provide Peer
Recovery Coach services to the Adult Treatment Court participants. This would be an extension of
previous years' contract with a not to exceed amount the same as last year at $21,000. The
Optional Unified Form of Government Act provision MCL 45.556(p) gives the County Board of
Commissioners the statutory authority to “Enter into agreements with other governmental or quasi-
governmental entities for the performance of services jointly”.
The Sixth Judicial Circuit Courts Adult Treatment Court has been increasingly receiving referrals for
individuals having substance abuse problems. Individuals in this special high-risk population have
significant rates of recidivism and are likely to be incarcerated if left untreated. The Adult Treatment
Court (ATC) was developed as an alternative to incarceration for individuals who suffer from mental
illness and substance abuse. A partnership with Oakland Community Health Network (OCHN) and
the Sixth Judicial Circuit Court has been established to collaborate in providing Peer Recovery
Support Services (PRSS). The role of a PRSS provider is to support individuals working on recovery
both in the treatment center and in their natural environment. Pursuant to the Urban Cooperation
Act, MCL 124.501 et seq., the County and the OCHN would like to extend an agreement for the
purpose of continuing peer recovery support services through a Peer Recovery Coach. The funding
for these services was included in the FY 2024 Michigan Drug Court Grant Program (Adult
Treatment Court) agreement. OCHN will be reimbursed a not-to-exceed amount of $21,100 for FY
2024. Once awarded, funding for the peer recovery support services will be included in the FY 2024
Michigan Drug Court Grant Program (Adult Treatment Court) agreement, administered by the State
Court Administrative Office (SCAO), (approved via separate resolutions).
The agreement amendment has been presented to the OCHN for their approval.
POLICY ANALYSIS
A budget amendment is not required at this time as funding for these services in FY 2024 will be
included in the Michigan Drug Court Grant Program (Adult Treatment Court) agreements via
separate resolutions. The acceptance of this agreement does not obligate the County to any future
commitment and continuation of this program is contingent upon continued future levels of grant
funding.

AMENDMENT #5
The Parties, COUNTY OF OAKLAND (“County”), and OAKLAND COUNTY
COMMUNITY HEALTH NETWORK (“OCHN”), agree and acknowledge that the purpose of
this Amendment is to modify as provided herein and otherwise continue the present Agreement
relationship between the Parties as described in their current Adult Treatment Court Program
Agreement dated April 14, 2018, as amended (“Agreement”).
This Amendment 5 shall take effect on October 1, 2023, and shall continue through September 30,
2024, unless otherwise terminated by any of the Parties pursuant to section 12 of the Agreement.
In consideration of the mutual promises, representations, assurances, agreements and provisions
in the Agreement and this Amendment, the adequacy of which is hereby acknowledged by the
Parties, the Parties agree to amend the Agreement as follows:
1. The Agreement heading shall be amended to begin with “FY2024”.
2. Section 3.5 of the Agreement shall be amended in part to include the following:
For fiscal year 2024, the County agrees to pay a not to exceed amount of $21,000
to OCHN for providing, through the designated Service Provider, the services of a
Peer Recovery Coach during fiscal year 2024, which runs from October 1, 2023,
through September 30, 2024 (FY2024).
3. Section 3.6 of the Agreement shall be amended to the following:
To ensure timely payment, OCHN will invoice the County quarterly for the services
provided by the Peer Recovery Coach. OCHN will calculate this amount based on
the employment costs of the Peer Recovery Coach not to exceed amount of $21,000
for FY2024.

4. Sec. 3.12 shall be added to state the following:
If any part of this Agreement is supported or paid for with any State, federal, or
other third-party funds granted to the County, then OCHN and its contractual
Service Providers shall comply with all applicable grant requirements. The County
will provide OCHN with a copy of any applicable grant requirements.
5. Sec. 12 shall be amended to the following:
Except as otherwise provided herein, either Party may terminate and/or cancel this
Agreement upon thirty (30) days written notice to the other Party. The effective
date of termination and/or cancellation shall be clearly stated in the written notice.
Termination of this Agreement does not release any Party from any obligations that
Party has pursuant to any law.
6. Exhibit I: Financial and Reporting Obligations: For fiscal year 2024 (FY2024), the not to
exceed amount is $21,000.
For and in consideration of the mutual assurances, promises, acknowledgments, warrants,
representations and agreements set forth in the Agreement and this Amendment, and for other
good and valuable consideration, the receipt and adequacy of which is hereby acknowledge, the
undersigned hereby execute this Amendment 4 on behalf of the Parties, and by doing so legally
obligate and bind the parties to the terms and conditions of this Amendment 4.
Except as expressly amended by this Amendment, all of the terms of the Agreement shall remain
in full force and effect.
