INTRODUCTION AND BACKGROUND
State of Michigan Public Act 152 of 2011, the "Publicly Funded Health Insurance Contribution Act,"
was enacted by the State of Michigan and given immediate effect on September 27, 2011.The Act
sets forth various options that public employers may follow when providing healthcare benefits to
their employees.
Public Act 152 of 2011 requires public employers to observe a state-mandated "hard cap" on the
cost of employee medical and prescription benefits, or limit the employer cost share to 80%, with an
opt-out provision for public employers. Oakland County has exercised this opt-out right every year
since PA 152 went into effect in 2012. The Human Resources Department is again proposing that
the Oakland County Board of Commissioners continue the opt-out for 2024.
POLICY ANALYSIS
Approval of this exemption preserves flexibility with compensation packages to meet county needs
and objectives. Additionally, it provides cost-savings for county employees in their health benefits by
allowing the county to offer plans with lower employee contributions.
Legislation: PA 152 of 2011 (MCL 15.568 Sec 8) allows an exemption to this act with a 2/3 vote of
the governing body each year.

Attached for your consideration is a resolution to opt out of Public Act 152 (PA 152) for calendar year
2024 along with supporting detail and documentation .
PA 152 requires public employers to observe a state-mandated “hard cap” on the cost of employee
medical & prescription benefits or limit the employer cost share to 80%. PA 152 also provides an opt-
out provision for public employers.
Oakland County has exercised its legal right to exempt itself from th is act each year since the act went
into effect January 1, 2012.
The 2024 PA 152 hard-cap amounts increased by 4.1% over 2023 hard cap levels. The table below
shows how Oakland County contributions compare to the hard -caps.

$64,614,357, which is 18.9% above the hard cap of $54,383,872. In 2023 Oakland County was 19.8%
above the hard-cap. Employer cost share ranges from 84.9% to 97.5%, above the PA 152 limit of 80%.
