I am committed to their importance to our region and ensuring that they continue to not only exist but thrive for decades to come. Since I was first appointed to the HCMA Board I have helped guide the organization through tough economic conditions, challenging climate factors and the COVID pandemic. I am pleased to say the parks are thriving but there is more progress to be made and I hope to be reappointed to continue towards that progress. The HCMA Board is charged with overseeing the regional park system of Wayne, Macomb, Oakland, Livingston and Washtenaw counties, consisting of 13 beautiful parks covering 25,000 acres, ten public golf courses and two marinas. In 2019, Jaye was appointed by the Oakland County Executive to serve on the Board of the Great Lakes Water Authority (GLWA). GLWA was formed in 2014 as an outgrowth of the Detroit bankruptcy matter (in which Jaye represented Oakland County). GLWA provides nearly 40% of Michigan s population with quality water as well as effective wastewater services to nearly 30% of the state. Representative Cases Trustee of Pacific Steel v. UHY et al – Represented UHY in an action brought in federal court in the Northern District of California alleging that UHY, together with the owners of Pacific Steel Casting Company, breached their fiduciary duty to the company, making a claim for damages of more than $40 million. Following two years of discovery and motion practice, UHY successfully excluded the Trustee’s experts and then won a full dismissal of the claim against it following multiple dispositive motions. Versata v. Ford Motor Company – Represented Versata Software, Inc. in a trade secret infringement case against Ford Motor Company. The case was complex and involved highly technical evidence regarding computer software. After three weeks of trial, the jury in Detroit found that Ford had breached its contract with Versata and misappropriated the trade secrets in Versata’s proprietary configuration software, awarding Versata $105 million. United States of America v. City of Detroit, et al - Represented the Oakland County Water Resources Commissioner in the Clean Water Act matter regarding the operation of the Detroit Water and Sewer Department. Worked closely with all parties to ensure compliance with the Clean Water Act and efficient operations of the regional water and sewer services. Advanced Aerofoil Technologies v. Todaro, et al – Represented defendant multi-national individuals and jet engine supplier in fraud and trade secret actions brought in the Northern District of Illinois, Southern District of New York and in arbitration. Achieved complete dismissal in federal courts in both Illinois and New York and first-chaired a complete victory in arbitration including the award of over $300,000 in legal fees. Youmans v. Charter Twp of Bloomfield – Represented Bloomfield Township in an appeal following a bench trial where a judge ruled in favor of the plaintiffs in a class action challenging the Township’s utility and ratemaking practices. In a published opinion, the Michigan Court of Appeals reversed the trial court’s judgment in full. NorthPointe Holdings, LLC v Nationwide Emerging Managers, LLC - Represented a Michigan-based investment boutique in a five-year legal battle with Nationwide Mutual Insurance Company. After a two-week trial in Delaware, the Court determined that NorthPointe was entitled to $15,186,381 in damages after finding that Nationwide breached its contract and the covenant of good faith and fair dealing in its sale transaction. — 3 — In re: City of Detroit, Michigan - Represented Oakland County in the historic City of Detroit bankruptcy case, the largest Chapter 9 bankruptcy in history. Achieved a global settlement involving the Detroit Water and Sewerage Department and the Counties of Oakland, Wayne and Macomb following months of discovery and days after presenting Oakland’s opening statement. Biber v. Webber – Represented individual and founder of construction and real estate company in a breach of contract, breach of fiduciary multi-year litigation in state court in Michigan. The jury returned a verdict awarding $0 in damages. Arthrex, Inc. v. Smith & Nephew, Inc.– Represented the global leader in arthroscopic surgery technology Arthrex, Inc., a Florida based orthopedic product developer. After a fast -tracked 18 months of intense discovery, the jury in the Eastern District of Texas found the patents at issue valid and the defendants to have willfully infringed every claim of the patents at issue.
