INTRODUCTION AND BACKGROUND
MCL 400.117a(4)(c) began providing an additional 25% reimbursement to the County for In Home
Care programs. This additional 25% reimbursement can only be used to create and implement
community-based services and comply with new Juvenile Justice reforms as mandated by
MCL400.117a(4)(c) and MCL 400.a(13) – (15). Oakland County Corporation Counsel advises the
County to create a segregated line item within the Juvenile Court budget where the additional 25%
of Child Care Fund monies can be placed.
The Circuit Court has reviewed its operations and determined areas where new programs are
needed to support Juvenile Justice Reform. It has been determined that two new Juvenile programs
can be created to increase opportunities for In Home Care as opposed to residential or detention
placement, one program for Domestic Violence/Status Offenders and one program for Juvenile
Intake/Pre-Adjudication. As In Home Care programs, these will be reimbursed by the Department of
Health and Human Services at 75% through the Child Care Fund. The Circuit Court has obtained
special approval to begin these programs mid-year from the department of Health and Human
Services. To staff these programs, five (5) new positions will be required in the Juvenile Court
Services area, four (4) FTE Youth and Family Caseworker II positions and one (1) FTE Technical
Office Specialist are needed. Creation of the new Juvenile Intake/Pre-Adjudication program will
allow for an existing FTE Youth and Family Caseworker II position (P00002674) (not previously
eligible for Child Care Fund reimbursement) to qualify for 75% Child Care Fund reimbursement
under the new program. The Circuit Court would like to move position 00009712, Youth & Family
Casework Supervisor, currently funded by 50% Child Care Fund In Home Care programs and 50%
Adult Treatment Court, back to entirely to Juvenile to supervise the new positions. Position
P00009712, Youth & Family Casework Supervisor will be eligible for 75% reimbursement from the
Child Care Fund. The Circuit Court would like to move position P00010677, Technical Office
Specialist, currently filled as Business Analyst, funded 50% Child Care Fund in home care programs
and 50% Adult Treatment Court, back entirely to Juvenile to assist in data capture and new Juvenile
Casework system report development. Position P00010677, Technical Office Specialist, currently
filled as a Business Analyst, will be eligible for 75% reimbursement from the Child Care Fund for
50% of salary and fringe benefits in FY 2024. Position 00010677 should be eligible for 75%
reimbursement for 100% of the salary and fringe benefits in FY25 under MCL400.117a(14). The
programs are intended to support Juvenile Justice Reform Legislation and provide more in-home
care opportunities to keep youth within the community. The additional funding from the Child Care
Fund under MCL400.117(13)-(15) will support this resolution and provide funding.
POLICY ANALYSIS
The Sixth Judicial Circuit Court, in cooperation with the Department of Health and Human Services,
is seeking to implement two new In Home Care programs under the Child Care Fund. These
programs have a goal of increasing the number of kids eligible for community placement and avoid
residential out of home placements. To that goal the Court brings two resolutions, one to amend the
Child Care Fund and create positions and one to restore an Adult Treatment Court position to be
funded by the Adult Treatment Court grant.
